FINDINGS OF FACT AND DECISION
John Larkin, hereinafter referred to as the applicant, is seeking to amend a previously
approved plan for: 1) a 10,064 sq. ft. mixed use commercial building, 2) a 3100 sq. ft.
short-order restaurant, and 3) a 35 room extended hotel. The amendment consists of
site and building elevation modifications, 388-410 Shelburne Road.
The Development Review Board held a public hearing on Tuesday, March 18, 2008. Bill
Nedde represented the applicant.
Based on testimony provided at the above mentioned public hearing and the plans and
supporting materials contained in the document file for this application, the Development
Review Board finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking to amend a previously approved plan for: 1) a 10,064 sq. ft.
mixed use commercial building, 2) a 3100 sq. ft. short-order restaurant, and 3) a 35
room extended hotel. The amendment consists of site and building elevation
modifications, 388-410 Shelburne Road.
2. The owner of record of the subject property is John Larkin.
3. The subject property is located in the C1-R15 Zoning District.
4. The plans submitted consists of a six (6) page set of plans, page one (1) entitled, "Site
Plan 388 Shelburne Road U.S. Route 7 (Shelburne Road) South Burlington. Vermont,
prepared by Krebs & Lansing Consulting Engineers, LLC, dated April 12, 2005, last
revised on February 26, 2008.
The applicant is seeking approval for the following changes to the building:
A 12.5' x 7' transformer pad added near the southeast corner of the
building
■ Remove two (2) openings by the north east corner of the garage
■ Add thru wall a/c units louvers
■ Enlarge the tower window
■ Revise the tower roof
■ Add rain leader locations
■ Remove small roof over side door entrance on north side
■ Revise parking space layout in the garage

The applicant has since submitted renderings of the new elevations and a new
landscaping plan detailing additional landscaping around the proposed
transformer pad.

to approve Site Plan Application SP-08-14 of John Larkin, subject to the following
conditions:
1. All previous approvals and stipulations which are not superseded by this approval,
shall remain in effect.
2. This project shall be completed as shown on the plans submitted by the applicant and
on file in the South Burlington Department of Planning and Zoning.
3. The applicant shall obtain a zoning permit within six (6) months pursuant to Section
17.04 of the Land Development Regulations or this approval is null and void.
4. The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer prior to occupancy of the building.
5. Any change to the site plan shall require approval by the South Burlington
Development Review Board or the South Burlington Administrative Officer.
