The South Burlington Development Review Board held a regular meeting on
Tuesday, 20 December 2005, at 7:30 p.m., in the Conference Room, City Hall, 575
Dorset St.
Members Present: J. Dinklage, Chair; L. Kupferman, C. Bolton, G. Quimby, M. Behr,

1. Other Business:
Mr. Belair reported on administrative decisions he had rendered including the relocation
of a pavilion at Technology Park.
2. Minutes of 15 November and 6 December 2005:
Mr. Bolton moved to approve the minutes of 15 November as written. Mr. Birmingham
seconded. Motion passed 6-0 with Ms. Quimby abstaining.
Ms. Quimby moved to approve the Minutes of 6 December as written. Mr. Birmingham
seconded. Motion passed unanimously.
3. Consent Agenda:
a. Design Review Application #DR-05-09 of Dorset Holdings, Inc., for a
single sign permit, Beacon Row Townhouses, Dorset St.
b. Design Review Application #DR-05-11 of South Burlington Realty
Company for an amendment to the master signage permit, 74 San
Remo Drive
c. Design Review Application #DR-05-10 of Montpelier Broadcasting,
Inc., for the installation of communication towers, 72 San Remo
Drive.
No issues were raised.
Ms. Quimby moved to approve the Consent Agenda subject to the stipulations in the draft
decisions. Mr. Bolton seconded. Motion passed unanimously.
OPublic Hearing: Conditional Use #CU-05-16 of Montpelier Broadcasting, Inc
for conditional use approval under Section 14.10, Conditional Use Review, of
the South Burlington Land Development Regulations. Request is for

permission to install telecommunication antennas on the roof, 72 San Remo
Drive: and
Site plan application #SP-05-59 of Montpelier Broadcasting, Inc., to amend a
plan for a 19,800 sq. ft. warehouse building with related exterior equipment
storage. The amendment consists of installing two five-foot high antenna
masts on the building, 72 San Remo Drive:
Mr. Flanagan said he had no issue with staff comments.
Mr. Belair noted that the applicant has asked to be exempt from the bike rack regulations;
however, the regulations say "shall," so the Board does not appear to have the right to
grant the exemption. Mr. Dinklage said this should be taken up with the Planning
Commission.
Mr. Belair also noted the 33-foot height includes the antenna and is within the height
limit.
Ms. Quimby moved to approve Conditional Use #CU-05-16 and Site Plan application
#SP-05-59 of Montpelier Broadcasting, Inc., subject to the stipulations in the draft
motion. Mr. Farley seconded. Motion passed unanimously.
6. Continued Public Hearing: Final Plat Application #SP-05-85 of Pizzagalli
Properties, LLC, to amend a previously approved 28,000 sq. ft. building with
18,400 sq. ft. of medical office use, 9400 sq. ft. of general office use, and 200
sq. ft. of retail food establishment use. The amendment consists of adding
utility cabinets with landscaping, 118 Tilley Drive:
Mr. Belair noted he had just received the landscaping plan this afternoon. On the second
page, they show that the utility cabinets are not screened on 3 sides. He suggested a
stipulation that all utility cabinets be screened on 3 sides. Mr. Bouchard said he had no
problem with this.
Condition #5 was added to the motion as follows: The final plat plan shall be revised to
show additional plantings to screen the utility cabinets on three sides and 3 copies of the
revised plan shall be submitted prior to recording.
Ms. Quimby moved to approve Final Plat Application #SD-05-85 of Pizzagalli
Properties, LLC, subject to the stipulations in the draft motion as amended above. Mr.
Farley seconded. Motion passed unanimously.
7. Public Hearing: Final Plat application #SD-05-85 of Dorset Street Associates
for a two -lot subdivision, 1650 Hinesburg Road:
Mr. Belair said staff has no issues.

PROJECT DESCRIPTION
Montpelier Broadcasting, Inc., hereafter referred to as the applicant, is seeking
conditional use and site plan approval under Article 14, Site Plan and Conditional Use
Review, of the South Burlington Land Development Regulations. Request is for
permission to install two (2) five foot antenna masts on roof, 72 San Remo Drive.
The Design Review Committee held a meeting on December 19, 2005 and reviewed this
project. They recommended approval. The draft decision reflects the recommendations
(you will receive the draft at the meeting).
COMMENTS
Planning & Zoning Assistant Betsy McDonough and Administrative Officer Ray Belair,
referred to herein as Staff, have reviewed the plans submitted on December 2, 2005 and
have the following comments.
Zoning District and Dimensional Requirements
There are no dimensional or setback changes associated with this application.
CONDITIONAL USE CRITERIA
Pursuant to Section 14.10(E) of the Land Development Regulations the proposed
conditional use shall meet the following standards:
1. The proposed use, in its location and operation, shall be consistent with the
planned character of the area as defined by the City of South Burlington
Comprehensive Plan.
The proposed project is consistent with the planned character of the area, as defined by
the Comprehensive Plan.
2. The proposed use shall conform to the stated purpose of the district in which
the proposed use is located.
The proposed is consistent with the stated purpose of the CD 4 Zoning District.
3. The Development Review Board must find that the proposed uses will not
adversely affect the following:
(a) The capacity of existing or planned municipal or educational facilities.
The proposed project will not adversely affect municipal services.

(b) The essential character of the neighborhood or district in which the
property is located, nor ability to develop adjacent property for appropriate
uses.
Staff does not feel that the proposed project will have an adverse affect on the character
of the neighborhood or zoning district that this property falls within.
(c) Traffic on roads and highways in the vicinity.
The proposed antennas will not have an adverse affect on the traffic patterns in the
vicinity.
(d) Bylaws in effect.
The proposed project is in keeping with applicable regulations.
(e) Utilization of renewable energy resources.
The proposed project will not affect renewable energy resources.
(0 General public health and welfare.
The proposed project will not have an adverse affect on general public welfare.
Montpelier Broadcasting is obligated by Federal law to comply with the radio frequency
emissions levels established by the Federal Communications Commission.
Pursuant to Section 3.13(F) of the Land Development Regulations, the proposed
conditional use shall meet the following standards:
The Development Review Board, in granting conditional use approval, may impose
conditions of the following:
1. Size and construction of structures, quantities of materials, storage locations,
handling of materials, and hours of operations.
Staff does not feel it is necessary to impose any of these conditions to the proposed
project.
2. Warning systems, fire controls, and other safeguards.
Staff does not feel it is necessary to impose any of these conditions to the proposed
project.
3. Provision for continuous monitoring and reporting.
Staff does not feel it is necessary to impose any of these conditions to the proposed
project.

4. Other restrictions as may be necessary to protect public health and safety.
The proposed antennas are located on the roof of the 72 San Remo Drive. Staff does
not feel it is necessary to impose any additional conditions to the proposed project.
SITE PLAN REVIEW STANDARDS
Pursuant to Sections 14.06 and 14.07 of the Land Development Regulations the
proposed conditional use shall meet the following standards:
(a) The site shall be planned to accomplish a desirable transition from structure
to site, from structure to structure, and to provide for adequate planting, safe
pedestrian movement, and adequate parking areas.
The proposed project has been planned to accomplish a desirable transition from structure
to site, from structure to structure, and to provide for adequate planting and safe pedestrian
movement.
Parking will not be affected by this proposal.
Pursuant to Section 13.01(G)(5) of the Land Development Regulations, a bicycle rack shall
be installed on the property to "serve persons employed or residing on the premises as well
as the visiting public". A bicycle rack is not shown on the plan.
1. The plans shall be revised to show the location of a bicycle rack, prior to permit issuance.
(b) Parking shall be located to the rear or sides of buildings to the greatest extent
practicable.
The parking spaces on the subject property are currently in existence.
(c) Without restricting the permissible limits of the applicable zoning district, the
height and scale of each building shall be compatible with its site and
existing or adjoining buildings.
The proposed antennas will be located on the roof of 72 San Remo Drive. The existing
building is 28 feet high. The proposed antennas are 5 feet high. Therefore, the antennas
will be a total of 33 feet high. Pursuant to Section 3.07(G) of the Land Development
Regulations, the Development Review Board may approve the height of communication
antennas and farm silos to exceed the limitations set forth in Section 3.07(B) of the Land
Development Regulations subject to conditional use approval.
(d) Newly installed utility services and service modifications necessitated by
exterior alterations or building expansions shall, to the extent feasible, be
underground.
2. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility
lines, services, and service modifications shall be underground.

(e) The DRB shall encourage the use of a combination of common materials and
architectural characteristics, landscaping, buffers, screens and visual
interruptions to create attractive transitions between buildings of different
architectural styles.
Staff feels that the proposed landscaping is adequate to satisfy this requirement.
(t) Proposed structures shall be related harmoniously to themselves, the terrain,
and to existing buildings and roads in the vicinity that have a visual
relationship to the proposed structures.
Staff feels that the proposed structure will relate harmoniously to existing buildings in the
area.
(g) The reservation of land may be required on any lot for provision of access to
abutting properties whenever such access is deemed necessary to reduce
curb cuts onto an arterial of collector street, to provide additional access for
emergency or other purposes, or to improve general access and circulation
in the area.
Staff does not feel it is necessary to require any additional access easements as part of the
proposed project.
(h) Electric, telephone and other wire -served utility lines and service connections
shall be underground. Any utility installations remaining above ground shall
be located so as to have a harmonious relation to neighboring properties and
to the site.
As already noted, pursuant to Section 15.13(E) of the Land Development Regulations,
any new utility lines, services, and service modifications shall be underground.
(i) All dumpsters and other facilities to handle solid waste, including compliance
with any recycling or other requirements, shall be accessible, secure and
properly screened with opaque fencing to ensure that trash and debris do not
escape the enclosure(s).
The plans do not show any dumpster locations. The plans should be revised to show the
location of screened dumpster(s).
3. The plans shall be revised to depict the dumpster location(s) adequately screened, prior
to permit issuance..
Q) Landscaping and Screening Requirements
There is no minimum landscaping requirement, based on building costs, for this project.
The site is adequately landscaped and no additional landscaping is recommended.
Pursuant to Section 13.06(B) of the Land Development Regulations, snow storage area
must be specified and located in an area that will minimize the potential for run-off. The
plans do not depict any snow storage areas.

4. The plans shall be revised to show the location of the snow storage area(s), prior to
permit issuance.
RECOMMENDATION
Staff recommends that the Development Review Board approve Conditional Use
application #CU-05-16 and Site Plan Application #SP-05-59.

PROJECT DESCRIPTION
Montpelier Broadcasting Inc., proposes to place point to point antenna on the roof of the
Pizzagalli Building located at 72 San Remo Drive. The Building is of metal construction
including the siding and roof and is used as a maintanance shop for the Pizzagalli
Construction Company. The Building stands 28 feet tall to the top ridge of the roof and
presently has a 18 foot antenna on the roof that is used by the Construction Company,
and pipe vents which stand approx 3 feet tall.
Montpelier Broadcasting , Inc. proposal calls for the installation on the roof of two
antennae mounts which will be 5 feet tall secured to the top of the building. Each of the
mounts will accommodate an open grid Scala antennae (see attached cut sheet) and
backhaul antenna which measure 6 inches by 12 inches.

supported by two steel posts set in concrete, as depicted on a photo exhibit and three page
set of plans entitled "Pizzagalli Construction Company" re -submitted on 3/22/00, with
the following stipulations:
This recommendation for approval of the proposed sign design is based solely on the
application's compliance with the design review criteria contained in Section 4 of the
South Burlington Sign Ordinance. The determination of whether or not this application
complies with all other requirements_ contained in the sign ordinance shall be made by the
Code Officer.

I move the City Center Design Review Committee recommend approval of the design review
application of Pizzagalli Construction Company for the erection of a free standing, aluminum,
non -illuminated sign with white lettering on a black background supported by two steel posts set
in concrete, as depicted on a photo exhibit and three page set of plans entitled "Pizzagalli
Construction Company" re -submitted on 3/22/00, with the following stipulations:
1. This recommendation for approval of the proposed sign design is based solely on the
application's compliance with the design review criteria contained in Section 4 of the South
Burlington Sign Ordinance. The determination of whether or not this application complies

windows will conform to the existing structure. The proposed signs are of a
channeled plastic construction similar to most other wall signs within the shopping
plaza.. The menu holder's color and texture are not compatible with existing design
elements.
Additional Sign Ordinance Criteria:
Master Signage Plan: Section 23 of the Sign Ordinance requires that a master
signage plan be submitted for any lot within the Dorset Street/City Center Sign
District. The applicant has submitted a master signage plan that includes most but not
all of the required information. The applicant should note removal of the Softhome
signs and the addition of the Outback Steak House signs in the master signage plan.
Sign Location: The signs do not project above the roof.
Number of Signs: The two wall signs proposed are permissible. The menu holder
will count as a third sign and is not permissible.
Dimensions: The proposed signs appear to comply with the maximum allowed 5% of
the signable wall area. The applicant has not submitted information on the signable
wall area. The applicant will need to submit this information prior to Development
Review Board approval.
6. Pizzaealli Construction Company— 72 San Remo Drive— Sign Design Review
Application
This sign review application is for a free standing, non -illuminated sign supported by
two steel posts set in concrete. The aluminum sign will be 33 inches high by 68
inches wide with white lettering on a black background.
Design Review Criteria:
Consistent Design: The sign is similar to other recently approved free standing signs
in the area, such as Hawthorne Suites which employs white lettering on a dark green
background.
Compatibility with City Center Goals: The sign, according to the photo exhibits
submitted, will be at a human scale. The height of the proposed sign is unknown but
is expected to be less than 12 feet. Additional information on the height of the sign
should be submitted. Plans should be revised to indicate height.
Color and Texture: The sign will be hand -painted and will employ white lettering on
a black background as required within City Center Districts.
Materials: The sign will employ metal and concrete as allowed within Central
District Three.
Additional Sign Ordinance Criteria:
Sign Location: The sign will not be located within the right of way.
Dumber of Signs: The one freestanding sign is permissible.
Dimensions: The proposed signs comply with the 32 square foot maximum and the
12 foot maximum height requirement.

This project involves the erection of a free standing, aluminum, non -illuminated sign with
white lettering on a black background supported by two steel posts set in concrete. The
aluminum sign will be 33 inches high by 68 inches wide with white lettering on a black
background rising to an overall height of 48 inches.
The City Center Design Review Committee reviewed this proposal at their 3/27/00
meeting.
The Design Review Committee recommends that the Board approve the application with
the following stipulations:
1. This approval is for compliance with only the design review criteria
contained in the South Burlington Sign Ordinance (i.e., section 4(a) - (d)).
The decision of whether or not this application complies with all other
provisions of the Sign Ordinance shall be made by the Code officer.
2. The applicant shall obtain a sign permit from the Code Officer within six
(6) months of this approval or this approval is null and void.
3. Any change to the sign design shall require approval of the Development
Review Board.
