HomeMy WebLinkAboutDR-05-10 - Decision - 0072 San Remo DriveCITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING MONTPELIER BROADCASTING, INC & PIZZAGALLI CONSTRUCTION COMPANY — 72 SAN REMO DRIVE DESIGN REVIEW APPLICATION #DR-05-10 FINDINGS OF FACT AND DECISION Montpelier Broadcasting, Inc. and Pizzagalli Construction Company, hereinafter referred to as the applicants, are seeking Design Review approval for the installation of two (2) communications antennas on the roof of the existing Pizzagalli Construction building, 72 San Remo Drive. The Development Review Board held a public meeting on December 20, 2005. The Design Review Committee held a meeting on December 19, 2005 and discussed this project as part of their agenda and recommended approval. Based on information provided at the above mentioned public meeting and the plans and supporting materials contained in the document file for this application, the Development Review Board, finds, concludes, and decides the following: FINDINGS OF FACT The applicants are seeking Design Review approval for the installation of two (2) communications antennas on the roof of the existing Pizzagalli Construction building, 72 San Remo Drive. 2. The applicants have submitted a site plan of the Pizzagalli building , photos of the existing structure (including the 20' tall single antenna existing on the building), and photo simulations of how the property will appear from two points on San Remo Drive after installation of the proposed communications antennas. 3. The Design Review Committee held a meeting on December 19, 2005 and discussed this project as part of their agenda and recommended approval. 4. The subject property is located in the Central District 4 (CD4) Zoning District. 5. The owner of record of the subject property is Pizzagalli Construction Company. 6. Communications antennas are protected under zoning, meaning that mitigating conditions may not interfere with the installation, operation and use of these devises. The criterion for review of these structures within the City Center zoning district is Section 11.01(F)(1)(h) of the Land Development Regulations which states: (h) Conceal rooftop devices. Rooftop mechanical equipment and appurtenances to be used in the operation or maintenance of a structure shall be arranged so as to minimize visibility from any point at or below the roof - 1 - level of the subject structure. Such features, in excess of one foot in height, shall be either enclosed by outer building walls or parapets, or grouped and screened in a suitable manner, or designed in themselves so that they are balanced and integrated with respect to the design and materials of the building. 7. Montpelier Broadcasting has come to an arrangement that puts the communications antennas on an existing building that already has such a structure, and that is farther away from the right-of-way on Dorset Street and San Remo Drive than their building at the corner of Dorset and San Remo. This is visual mitigation in and of oneself. 8. The antennas are located in such a manner that they are both grouped with another antenna on an existing roofline, which reduces the amount of change to the existing visual profile, and which makes them largely invisible from Dorset Street since the existing antenna blocks a direct view.
