N.. 0341 [1 ; .?0UT MEMORANDUM TO: South Burlington Development Review Board(3 , FROM: Cathyann La Rose, AICP, Associate Planner DATE: September 16, 2010 RE: Agenda #3, Design Review Application #DR-10-05 COPY TO: Annette Southern, for applicant Design Review Application Master Signage Permit DR-10-05 60 San Remo Drive Atlas Signs, hereafter referred to as the applicant, is seeking to obtain a new master signage permit for a property in the Dorset Street/City Center Design District. The master signage permit would establish the design scheme for the freestanding and wall signs on the property, 60 San Remo Drive. Pursuant to Section 6 of the City of South Burlington Sign Ordinance, the erection, alteration, or relocation of any sign within this district shall require design review by the South Burlington Design Review Committee (DRC) and Development Review Board (DRB). Section 8 of the Sign Ordinance requires all property owners within the DS/CC Sign District to obtain a Master Signage Permit. The Design Review Committee discussed this application via email. Only two members of the Committee issued responses; their thoughts are as follows: Design Review Application DR-10-05 Page 2of4 'Seems to me that they are within requirements for this permit... this is simplifying the signage that is currently there. I am a little unimpressed with the renderings of what it will look like. Seems as though there are more pictures of what is currently there versus renderings of what the new sign will look like. I'm personally not a fan of the large black sign; however, see no strong need to push back due to my thoughts on the overall design of the sign. If others are a bit unimpressed with the large black sign on the yellow building I suppose we can further discuss, but if not I am fine with an approval. *I'm good with doing this simple review via email... this one looks straightforward enough, although I don't particularly like the new sign, if it meets the requirements I see no reason to turn it down. 1. A Master Signage Permit shall be issued to the applicant by the DRB, prior to the issuance of any individual sign permit for the property. DESIGN REVIEW CRITERIA In reviewing an application for signage, the DRC and DRB shall consider the following: (a) Consistent Design The design of a sign must be compatible and harmonious with the design of buildings on the subject property and nearby. The design of all signs on a property shall promote consistency in terms of color, graphic style, lighting, location, material and proportions. Staff finds that the design of the proposed signs are harmonious with the design of the buildings on the subject property and nearby. The proposed sign package achieves consistency in color, graphic style, lighting, material and proportions. The sign posts are to remain the same, with only a change in the colors permitted. (b) Promotion of City Center Goals Signs within the DS/CC Sign District should be of high aesthetic quality and pedestrian oriented. Staff finds that this criterion is being met. The colors, lettering, and design come together to present a simple and legible sign. The applicant has also stated that no more than two fonts, `Helvetica' and or `Microgamma', shall be used. (c) Color & Texture A maximum of 3 colors is encouraged. The applicant is proposing that signs be limited to Red, Black, and White. 2. The colors of the signs shall be limited to red, white, and black. Fonts shall be limited to Helvetica and or Microgamma, or a combination of both. Design Review Application DR-10-05 Page 3 of 4 3. No more than two different shades of any one color shall be used in any combination of signs on the property at the same time. The applicant has submitted a color photo showing the existing and proposed signs. No freestanding signs are requested at this time. At such time as the property would like a freestanding sign, they shall amend the master sign permit to include provisions for post materials and colors. 4. No freestanding signs are requested or approved at this time. At such time as the property owner would like a freestanding sign, they shall amend the master sign permit to include provisions for post materials and colors. (d) Materials Used Pursuant to Section 20 of the Sign Ordinance, all signs shall be of substantial and sturdy construction, kept in good repair, and painted or cleaned as necessary to maintain a clean, safe, and orderly appearance. The applicant is proposing to use aluminum cabinets with an acrylic material for the signs. 5. All signs shall be kept in good repair, landscaping surrounding signs shall be kept trimmed and neat and shall not obscure the text of the signs. (e) Wall Mounted Signs Section 10 of the Sign Ordinance governs the size and location of wall -mounted signs. Her name is Char Bassett. Ifr. Ward said that the tax records showed the lot as 85' deep and if it was only 40' deep the diocrepancy should be cleared up. Mr. Belcher said that Mrs. Fernandez had not held title to the land the last time she came before the board, but she had not known that at the time. Mr. Graves asked what the annual tax bill for the lot was and was told it was S66 per year. It was also noted that if the building were to be 20' x 281, it would not meet the minimum size standards for a dwelling unit. P°.r. Ward said the appeal would have to be totally rewarned. Xr. Belcher asked about reasonable use and the selling of the lot. Yr. Kartineau said the board had to make a judgement on reasonable use. Mr. Dinklage felt that the appeal was far from what he would consider to be reasonable use and he did not think he could support the request. Mr. '-:artineau agreed. 'Kr. Campbell stated that he felt selling a lot was reasonable use of the land and he said that he felt the proposal would have to be dramatically chanced from the one of a year ago in order for him to approve it. Hr. Graves felt this appeal was substantially the same as the one denied a year ago and he felt this was no better use of the land than at that time. Mr.. Belcher withdrew the application on behalf of his client. Ap:-eal of Gordon and Hester Paterson (tabled October 8) Mr. Paterson has shortened the structure to be 17'3" long, which means he will meet the front yard requirement. The side yard is now the only issue and there the present 8 112' yard will be maintained. The addition will now be 17'3" a 121. Mr. Paterson felt he could tie in adequately to the chimney. Yr. Graves was not present at the last meeting but said he felt comfortable voting on the appeal. The appeal was granted unanimously. No. 3 Appeal of South Burlington Realty Corporation Appeal of South Burlington Realty seeking approval under Section 8.10, Conditional use and Section 11.00, Dimensional requirements of the South Burlington Zoning Regulations. Request is for permission to construct a 50' a 100' building to within thirty seven (37) feet of the required front yard and fifteen (15) feet of the northerly side yard, to be occupied as a wholesale business, also requiring a variance from Section 13.40, off street parking, request to set off twelve (12) parking spaces, located at 60 San Remo Drive. yr. Ward said the area was zoned BPD and that the minimum required setback was 75' where 37,is proposed. Minimum side yard is 30' and 15' is proposed on the north. The proposed use is a wholesale business, which is a conditional use. The lot is 100' = 180' and 80,000 sq. ft. is required. This lot, however, was set off prior to the 1974 regulations so it is grandfathered. 50 parkins spaces are required and 12 are proposed. Yr. Ward said the application had been before the board about 1 year ago for use as a dance studio, but that had never come about. The plan was ap7roved by the Co :=ission at that time, and the only changes from one year ago are the date of tte application and the use proposed. Yr- Doug Sch-veer represented South Burlington Realty. He said that all the otaer Iota in the San Remo area had 35;,' lot coverage and this one had 277. Schneer said they had three possible tenants - two wanted the building for a wholesale use and the other wanted it for a permitted use in the area. He said that they could not construct 50 parking spaces on the lot and still use the property. The warehouse uses will be for a glass distributor or another type of distribution. The glass business would bring in large sheets of glass and sell it to retail outlets. The other business is a small package distributor similar to UPS but much smaller. Mr. Graves felt there was not much space on the lot and he wondered where snow would be piled. He mentioned the vacant land adjacent to this property and was told that that lot would be developed at a later date. Mr. Graves questioned whether the City wanted asphalt from lot line to lot line here. Kr. Schneer said this was a pre-existing subdivision and e1r. Graves suggested that perhaps the lot was not large enough for the proposal. He said he would feel better if the Planning Commission looked at the plan and Xr. Ward added that they had to have site -plan approval anyway and that this board could express its concerns to the Commission. Mr. Dinklage moved to table the arzeal until November 12, 1979. -Mr. Campbell seconded the motion and all were in favor. The meeting was adjourned at 7:30 pm. 11 Clerk 5. ZONING BOARD OF ADJUSTMENT NO�K 12 1979 + At the hearing and in the view of the traffic consultant, such a machine spreads the traffic out at a bank and eliminates congestion. Nr. Cauchon said the enclosure was for the shelter of the customers. It is on the front of the building for security purposes. It cannot be set farther back because some space is needed to service it and as it is placed now it intrudes into teller space behind it. The foyer existing in the bank is too narrow to use. The cost of the enclosure is about 43300. It was noted that the enclosure only protruded about 2' beyond the existing porch of the building. The ATN cannot be placed outside on the islands. The appeal was granted unanimously. South Burlington Realty, tabled October 22 Mr. Ward said that at the last meeting Mr. Graves had asked about the proposed circular traffic pattern around the building. The Planner checked in the minutes and submitted a memo stating that the Planning Commission was concerned with the volume of traffic the former use would create. This use would create very different traffic and perhaps the circular pattern is not best (copy of memo on file with Zoning Administrator). The proposed side yard is 15' and front yard is 37'. Mr. Martineau asked if the applicants objected to Messrs. Guyette and Chepulis hearing the appeal if they were brought up to date on it and Mr. Schner replied that they had no objections to that. Mr. Schner noted that the subdivision on San Remo Drive was created by Pizzagalli and that the lot in question is a pre-existing small lot (100'xl8O'). They are asking for a variance so they can keep the front of the building in line with the others on the street and not set it back the required 50'. Another issue is parking. The Regulations require 50 spaces for this 5,000 sq. ft. building and it is not possible to put in that many and still build the building. There is a fence in the rear of the lot to screen the building from the residential area. There will be 27'� lot coverage on this site, as compared to an average of 35& on other lots in the subdivision. Yr. Schner'said the building on the lot next to this could be constructed in a mirror image of this one with common parking in the center. The number of parking spaces has been increased from 12 to 14. The loading dock is not recessed and Mr. Chepulis pointed out that if a truck with a small 36' box backed up to the dock to be loaded, the cab would be in the street, Yr. Schner said that was correct, but noted that traffic was very low on San Remo Drive. He felt this proposal was the only way to use the lot for this size building, which is the economical size for rental. He added that the drive for the building across the street was not directly across from this proposed drive, and he felt any future curb cut would be south of the drive for this building. 2•r. Chepulis noted that with a 40' box the truck would be in the street and if one added 15' for the tractor on top of that, one lane would be blocked in a two lane road. Mr. Schner felt this was the best place for the loading dock. The board asked why the building could not be set farther back on the lot. If trucks did not go around the building, there would be no need for 43' in the back. Mr. Schner saw no reason the building could not be moved back on the lot by 13'. Kr. Guyette asked if one 10,000 sq. ft. building could be built or. both lots and Yr. Reed suggested perhaps this building was too large for the lot. The lot has Leen owned since 1968 or 69. Schner suggested that the applicants build the building now for a permitted use and come back to the -board later if they want a use which is conditional. The building will be set 13' back, so it will meet the front requirement of 501. Mr. Dinklage moved to vote on the appeal with the following stipulations; 1. That the applicant withdraws his request for a conditional use permit. 2. That the board vote on the dimensional requirement and the parking requirement. 3. That it is implied that the ap_roval will be for a permitted use in the area. 4. That the front yard setback will be 50' instead of 37'. Mr. Peed seconded the motion and all were in favor. The appeal was granted unanimously per stipulations above. Appeal of Edward Austin and Mary Coneelman (tabled October 22) Mr. Martineau told the new board members that there arpeared to be useable land behind the structure the applicant wishes to improve, but it was noted that if the home were moved back, the applicant would lose his view of the lake because of nearby structures. The issue of the right of way has been resolved. Mr. Austin said the home had been there since the 1920's and that they want to winterize it now. He also said that if it had to be moved back, it might be better to just build a new home and he did not want to do that. Mr. Dinklage said one of the neighbors had a concern about the dormers Fir. Austin is proposing. She does not want her view from her kitchen blocked. Mr. Austin said the front dormer would be the same size, but would extend the full width of the house. There would be no change in its elevation. A dormer would also be added to the back of the house the same size as the f ront one. Mr. Dinklage moved to consider the application with the stipulation that the dormers front and back not be higher in elevation that the present dormer on the house. Mr. Reed seconded the motion and all were in favor. The appeal passed unanimously with the above stipulation.
