The Commission has stipulated that a two year main- tenance bond in the amount of lj% of total construction cost be posted. The question concerns the possible exemption of the City of Burlington from the zoning ordinance as a municipal corporation performing a governmental function. It is the type of question that could only be answered with certainty by the courts. However, we believe that persuasive arguments exist in favor of the applicabi- lity of the South Burlington ordinance, and we would re- commend that position by the Planning Commission and Zoning Board. It is also my opinion that the airport is in the Planned District under the ordinance, as shown on the zoning map, except for the properties purchased recently by the City of Burlington easterly of Airport Drive, some of which may be in residence District B. Burlington, VT 05403 RE: Burlington International Airport - North Hangar Oil/Water Separator connection to Municipal Sewer D-H Project #6380009 Dear Bill: Thank you for meeting with me on Thursday the 8h, concerning the above referenced project. Enclosed is a site plan with details and notes which propose the elimination of an underground drywell fed by a floor drain and oil -water separator. The oil/water separator will be connected to the existing sewer on Airport Drive. We propose a 6" SDR 28 PVC sewer line at constant slope with clean -outs at bends of 45 degrees or more, and approximately every 100 ft. As discussed, I think the sewer as-builts are a reliable indication that the unused stub exists at station 59+17 on Airport Drive, and based on the elevation given for the stub to the north (shown as 7.3 ft. deep), should be at a similar depth. The contractor is required to verify this first thing (see notes on plan), and the exact slope of the pipe will be determined at that time. It should be greater than I%, and considering the low flow and lack of solids, should be sufficient for this purpose. I will verify their findings myself in the field during the exploratory excavation. As the airport is on a very tight schedule relating to the necessity of completing this work we would appreciate your review as soon as your schedule allows. The sewage pumping station should have piping for an auxiliary pump in the event of an extended power failure or pump failure and a fill station. This piping is preferred in a separate vault just outside the station. 2. The station control panel should be at a location so that the pumps can be manually operated and at the same time the operator can observe their operation. 3. Manual and parts list must be in English and replacement parts obtainable in the United States or Canada. 4. The audio alarm should be placed inside of the adjacent building. Dear Mr. McEwing, An application for the above named project was received on January 6, 1995. After reviewing the application, visiting the site and reviewing previous land use permits for the airport properties, I have determined that the project does not represent a "material change," thus does not require a permit amendment. A material change is defined by Environmental Board Rule 2(P) As: .Any,alteration to a project which has a significant im,pact on any finding, conclusion, term or condition of the project's permit and which affects one or more values sought to be protected by the Act. As long as construction and maintenance of the proposed sewer system conforms with the findings and conditions of Land Use Permit #4CO034 and amendments no permit amendment is necessary - We ask that you submit to this office, the Water Supply and Wastewater Disposal Permit for this project when it is issued by the Wastewater Management Division of the Agency of.Natural Resources. This Permit does not constitute Act 250 approval under Case Number 4CO331. GENERAL 1. This permit does not relieve the permittee from obtaining all other approvals and permits as may be required from the Act 250 District Environmental Commission, the Department of Labor and Industry (phone 828-2106 or 658-2199), the Vermont Department of Health (phone 863'-7,220), and local officials PRIOR to proceeding with this project. 2. No alterations to the building other than those indicated on the approved plan or Water Supply and Wastewater Disposal a Water Supply and Wastewater Disposal Permit WW-4-0809 Page 2 Permit, which would change or affect the exterior water supply or wastewater disposal or the approved use of the building shall be allowed without prior review, and approval from the Agency of Natural Resources. 4. The Wastewater Management Division now reviews the sewage and water systems for public buildings under 10 V.S.A., Chapter 61 - Water Supply and Wastewater Disposal Permit. WASTEWATER DISPOSAL 5. The project is approved for connection to the South Burlinton Airport Parkway wastewater treatment facility for a -maximum of 600 gallons of sewage per day. 6. A professional engineer, registered in the Stat - e of Vermont, is to generally supervise the construction of the pump station, force main and new manhole and, upon completion of construction, the supervising engineer is to submit to the Wastewater Management Division a written certification stating all construction has been completed in accordance with the stamped approved plans. The engineer's certification is to be submitted to the Division prior to utilizing the pump station and the certification shall include, but not be limited to, the numerical results of all leakage testing performed on the manhole, pump station and force main as described in Appendix A, of the Environmental Protection Rules.
