All drivers participate in monthly training programs designed to meet the requirements of 49 CFR 172, 29 CFR 1910.120 and the HazMat regulations. The training programs are designed by our in-house expert and delivered with a combination of hands-on and classroom instruction. Outside trainers are routinely involved in the training to offer additional program variety. Drivers are instructed in equipment use, emergency procedures, manifesting, DOT and EPA requirements and driving safety, among other cs. C. Transportation Operations Emergency Procedures Guidance This Emergency Procedures Guidance has been prepared in accordance with 29 CFR 1910.120 to provide guidance to TMC Services, Inc. (TMC) in the event of a discharge of hazardous waste during transportation activities. A copy of this guide shall be carried on all of TMC's vehicles transporting hazardous wastes at all times. A. Initial Response Actions In the event of a release of hazardous waste, TMC personnel will perform the following initial response actions: 1. The driver of the vehicle will remain with his or her vehicle unless conditions are unsafe to do so. 2. The driver will keep all unauthorized personnel away from the incident scene and warn persons of the potential hazards associated with the release. All persons in the area will stay clear of all spills, vapors, fumes, and smoke. ALWAYS CONSIDER THE SAFETY OF PERSONS IN THE IMMEDIATE AREA, INCLUDING YOUR OWN. 3. The driver will assess the hazards presented by the spill to reduce immediate risks and to obtain as much information regarding the release as is safely possible. The driver will consider the following: • Is there a spill, leak, or fire? • What material, and what quantity, has been spilled? • What is the terrain like? • What are the weather conditions? • Who/what is at risk: people, property, and/or the environment? • What actions should be taken: Is evacuation necessary? Is diking/containment necessary? • What resources (personnel and equipment) are needed and are readily available? • What can be done immediately and safely? • Is anyone in a life -threatening situation? 4. If any person is in a life -threatening situation, all necessary actions which are safely possible will be conducted to remove them from such a situation. If possible, the person will be removed to an uncontaminated area where appropriate first aid can be administered. 5. The driver will contact TMC's office (if during business hours) or Matthew Clark, President, or Thomas Clark, Vice President and Secretary of TMC (if during non -business hours). After obtaining all pertinent information pertaining to the release including an evaluation of potential risks as ER Guide Page 1 of 5 detailed above, TMC will contact the appropriate parties and agencies including the local fire and police departments, the generator of the hazardous waste, the Rhode Island Department of Environmental Management (RI DEM), the Massachusetts Department of Environmental Protection (MA DEP) and, if applicable, the National Response Center (NRC) and Director of the Office of Hazardous Materials Regulations, Materials Transportation Bureau, U.S. Department of Transportation (U. S. DOT). Information to be conveyed to these parties will include, at a minimum, the following: a. Name of the person reporting the incident; b. Name, address, and U.S. Environmental Protection Agency (U.S. EPA) Identification Number for the transporter; c. Telephone number where the person reporting the incident can be reached; d. Date, time, and location of the incident; e. Mode of transportation and the type of transport vehicle; f. A brief description of the incident and the reason why the material was released; g. For each type of hazardous waste involved in the release: 1. The name and U.S. EPA hazardous waste generator number of the generator(s) of the waste; 2. Shipping name, hazard class, and 4-digit ID number of the waste (as referenced in the "North American Emergency Response Guidebook" (ERG2000); 3. Estimated quantity of the material spilled; and 4. The estimated extent of soil, water, and/or air contamination. h. The shipping name, hazard class, and the 4-digit ID number of any other material carried (not released); i. Local conditions (weather, terrain, proximity to schools, hospitals, residences, etc.); j. Injuries and exposures; and k. Other emergency response services or agencies which have been notified. These activities will follow the steps detailed in ERG2000 and may include the following: 1. Evacuation: The necessity for an evacuation of surrounding populations should be considered in the event of a spill of highly dangerous materials (highlighted chemical entries in ERG2000) or a major spill. If an evacuation is necessary, the guidelines provided in the "Table of Initial Isolation and Protective Action Distances" (the green section of ERG2000) will be followed. 2. Containment Activities: If safely possible, containment activities will be performed to prevent the migration of any spilled liquid or solid into the ground or into a storm drain or sanitary sewer. Containment activities shall be performed based on information on spills and leaks presented in the orange section of ERG2000. In most cases, a physical barrier will be erected to attempt to prevent the migration of spilled materials. The barrier will be constructed using absorbent materials which will be carried on the vehicle or, if necessary and available, sand or soil in the I 1 ER Guide Page 3 of 5 vicinity of the spill area. If necessary, holes or trenches can be excavated to prevent further migration; however, the use of absorbent materials is preferred. Containment of solids will be dependant on wind and weather conditions; however, use of plastic (or other material) tarpaulins can be used to cover the spilled material to prevent migration due to high winds. Spills to surface water bodies will be contained using absorbent booms. In concurrence with the containment activity, the source of the spill or leak should be identified and controlled, if safe to do so. The spill or leak may be controlled through the use of plugs stored in the vehicle or simply uprighting overturned containers such as drums. 3. Cleanup: When the source of the spill or leak has been completely contained and controlled, and any immediate hazards associated with the release have been controlled, cleanup can begin. If the spill is contained on an impervious paved surface, the material should be absorbed onto a compatible material (e.g., speedi-dry, sand, etc.). The absorbent material must compatible with the waste so that a violent reaction does not occur. In addition, wash solutions compatible with the spilled material can be used remove residual contamination on an impervious surface or to neutralize corrosive materials. If the released material has reached exposed earth, contaminated soil will be excavated and stored in drums or secured stockpiles for proper disposal. Spills to surface water bodies will be contained and cleaned -up using absorbent booms and pads. A confirmatory sampling program or other method of confirming the effectiveness of the cleanup will be implemented. When applicable, a Rhode Island Licensed Site Professional (LSP) will be contracted to oversee the cleanup to insure that it is completed in accordance with the requirements of the Rhode Island Contingency Plan (RICP). Damaged 55-gallon drums will be placed in oversized "recovery drums" for safe transport and disposal off -site. Similarly, all absorbent materials and contaminated personal protective equipment (PPE) will be transported off -site for proper disposal. 4. First Aid: Consult the orange section of ERG2000 for guidance on performing first aid on any persons requiring such attention. C. The existing MSP allowed one wall sign, and the applicant is now asking to amend that approval to allow one free-standing sign and two window graphics The applicant appeared before the DRC on December 19, 2005 and was asked to return to show landscaping or planters at the base of the sign. That information is now included. In addition, design plans for properties within Design District 2 shall comply with the following site design criteria, as outlined in Section 11.02 of the Land Development Regulations Landscape and plantings. Significant trees and vegetation should be preserved in its natural state insofar as practicable. Any grade changes should be in keeping with the general appearance of neighboring developed areas. Landscape plantings and amenities shall be well designed with appropriate variations and shall be included as an integral enhancement of the site and, where needed, for screening purposes. The plans now show landscaping at the base of the new sign. The Design Review Committee should discuss this and determine consistency with the design guidelines for the City Center District. South Burlington City Center Design Review Committee Meeting Monday, December 19th, 2005 6:30 PM Item #3 is #DR-05-11, an amendment to a previously issued Master Signage Permit (DS-02-20) for Randall Munson, 40 San Remo Drive. The existing MSP allowed one wall sign, and the applicant is now asking to amend that approval to allow one free-standing sign and two window graphics, illustrated in the attached application. The applicant has submitted the following pursuant to Section 8(c) of the Sign Ordinance: (a) Plot plan showing sign location and landscaping (b) Proposed sign dimensions (c) Design parameters including fonts, colors and materials (d) Lighting — the applicant states that there are "no plans to provide illumination" for any signage. Evaluation: (a) Size: the proposed wall sign is 21 square feet in size and 7' tall, which is well within the square footage and height limits for the district (32 SF and 12', respectively). Pursuant to Section 18(h) of the Sign Ordinance, window signs may not exceed 25% of the area of the window area to which a sign is attached. There is a note on the application to this effect. (b) Setback: As this property fronts on San Remo Drive, the sign must be set back five feet from the right of way. This standard is met. (c) Landscaping. The plans do not show landscaping of the sign base. Landscaping or planters should be provided when the sign is installed. Staff recommends the DRC condition this approval on submittal of a revised site plan showing landscaping or planters at the base of the sign, with the Administrative Officer to approve prior to issuance of a sign permit. The other landscaping on the property was reviewed and approved by the DRB and exceeds the City's minimum standards. (d) Lighting. The applicant has stated that no illumination is proposed. The applicant needs to be aware that the DRC will need to amend the MSP if illumination is desired in the future. (e) City Center standards. Section 6 of the Sign Ordinance has four criteria for signs in this district: consistent design; promote city center goals; color and texture; and materials used. i. Consistent design. The graphics on the proposed freestanding and window signs are consistent, cleanly designed, and easy to read. They are consistent with the primary structure on site as well. Staff recommends the DRC approve the proposed signs and MSP, with the condition that any subsequent signs other than the freestanding and window signs approved herein require DRC review prior to approval, and that the materials, fonts, colors, and treatments used on the free-standing sign be utilized for any and all other signs on the property. Consistent design. This sign design uses specific treatments that reference the Beacon Hill townhouse buildings, such as using the same paint colors as the trim and siding on the townhouses. I Promote city center goals of pedestrian orientation and high quality. The use of copper and wood accents and quality lighting design, and the scale of this sign (smaller and lower than allowed) both promote a high -quality, pedestrian oriented look for the property. iii. Color and texture. The red and copper accents are compatible with the brick, tan and white colors of the townhouses and form a harmonious overall scheme. iv. Materials used. Again, copper and wood are good choices of materials for the City Center and promote a quality appearance. (f) Other issues. The applicant has not stated whether other signs are desired. Staff recommends the DRC stipulate that any subsequent signs require DRC review prior to approval, and that the materials, fonts, colors, and treatments used on the free-standing sign be utilized for any and all other signs on the property. Application #2 — DR-o�s-10 — Design Plan approval The second application is from Montpelier Broadcasting, Inc. and Pizzagalli Construction for installation of two communications antennas on the roof of the existing Pizzagalli Construction building at 72 San Remo Drive. The applicants have submitted a site plan of the Pizzagalli building, photos of the existing structure (including the 20' tall single antenna existing on the building), and photo simulations of how the property will appear from two points on San Remo Drive after installation of the proposed communications antennas. Communications antennas are a protected use under zoning, meaning that mitigating conditions may not interfere with the installation, operation and use of these devices. The criterion for review of these structures within the City Center zoning district is Section 11.oi(F)(i)(h) of the Land Development Regulations, which states: (h) Conceal rooftop devices. Rooftop mechanical equipment and appurtenances to be used in the operation or maintenance of a structure shall be arranged so as to minimize visibility from any point at or below the roof level of the subject structure. Such features, in excess of one foot in height, shall be either enclosed by outer building walls or parapets, or grouped and screened in a suitable manner, or designed in themselves so that they are balanced and integrated with respect to the design and materials of the building. Staff believes that this application meets the standards in (h) above for several reasons. First, Montpelier Broadcasting has come to an arrangement that puts these communications antennas on an existing building that already has such a structure, and that is farther away from the right-of-way on Dorset Street and San Remo Drive than their building at the corner of Dorset and San Remo. This is visual mitigation in and of itself. Second, the antennas are located in such a manner that they are both grouped with another antenna on an existing roofline, which reduces the amount of change to the existing visual profile, and which makes them largely invisible from Dorset Street since the existing antenna blocks a direct view. Staff thus recommends approval of this design plan. Agenda Item # 3 — DR-os-11 — MSPAmendment and sign approval South Burlington City Center Design Review Committee Meeting Monday, December 19tn, 2005 6:30 PM Item #3 is #DR-o5-11, an amendment to a previously issued Master Signage Permit (DS-02-20) for Randall Munson, 40 San Remo Drive. The existing MSP allowed one wall sign, and the applicant is now asking to amend that approval to allow one free-standing sign and two window graphics, illustrated in the attached application. The applicant has submitted the following pursuant to Section 8(c) of the Sign Ordinance: (a) Plot plan showing sign location and landscaping (b) Proposed sign dimensions (c) Design parameters including fonts, colors and materials (d) Lighting — the applicant states that there are "no plans to provide illumination" for any signage. Evaluation: (a) Size: the proposed wall sign is 21 square feet in size and 7' tall, which is well within the square footage and height limits for the district (32 SF and 12', respectively). Pursuant to Section 18(h) of the Sign Ordinance, window signs may not exceed 25% of the area of the window area to which a sign is attached. There is a note on the application to this effect. (b) Setback: As this property fronts on San Remo Drive, the sign must be set back five feet from the right of way. This standard is met. (c) Landscaping. The plans do not show landscaping of the sign base. Landscaping or planters should be provided when the sign is installed. Staff recommends the DRC condition this approval on submittal of a revised site plan showing landscaping or planters at the base of the sign, with the Administrative Officer to approve prior to issuance of a sign permit. The other landscaping on the property was reviewed and approved by the DRB and exceeds the City's minimum standards. (d) Lighting. The applicant has stated that no illumination is proposed. The applicant needs to be aware that the DRC will need to amend the MSP if illumination is desired in the future. (e) City Center standards. The subject property falls within Design District 2 of the City Center Design Review Overlay District. Pursuant to Section 11.01(D)(1)(b) of the South Burlington Land Development Regulations, the addition or alteration of an exterior wall of a building or structure shall be subject to design review by the Design Review Committee (DRC) and the Development Review Board (DRB). Design plans for properties within Design District 1 shall comply with the following design criteria, as outlined in Section 11.01(F) of the Land Development Regulations: (a) Consistent design. Building design shall promote a consistent organization of major elements; and decorative parts must relate to the character of the design. All sides of a building shall be designed so that they are compatible in terms of material, window treatments, architectural accents, cornice/parapet design, etc. The design of a building should consider the design features of other structures in the area so as not to be harshly discordant with other nearby buildings. The proposed modifications are in compliance with this criterion. (b) Materials used. A wide variety of both natural and high quality man-made materials are allowed. Examples of acceptable materials include red brick, indigenous stone (i.e., granite, limestone, and marble), architectural concrete, synthetic stucco, wood clapboard (synthetic materials such as vinyl siding may be used in place of wood provided it is of high quality and closely resembles wood clapboard/shingles), and glass or glass block. Other materials may be used as an architectural accent provided they are harmonious with the building and site. Examples of unacceptable materials include metal skin and laminated wood (e.g., T-111). Design Review Application DR-04-08 40 San Remo Drive Page 2 of 5 The applicant is proposing to replace the existing overhead doorways with metal siding to match the existing metal siding. The applicant is proposing to replace a very small portion of the total surface, so staff feels that the additional of metal siding is appropriate. However, staff notes that if and when the applicant proposes any major renovations to the exterior of the subject building, metal siding will not be an acceptable material. (c) Colors and textures used. The color and texture of the building shall be harmonious with the building itself and with other buildings on the site and nearby. Colors naturally occurring from building materials and other traditional, subdued colors are encouraged. More than three (3) predominant colors are discouraged. The applicant is proposing to match the color of the proposed metal siding with the existing color of the subject building. 1. The color of the proposed metal siding shall match the existing color of the subject building. (d) Windows and doors. Window and door treatment shall be a careful response to the buildings interior organization as well as the features of the building site. The treatment of windows and doors shall be in a manner that creates a rhythm that gives necessary order and unity to the facade, yet avoids monotony. For sides of buildings that face or front public streets, the majority of the first floor's facade area shall consist of see -through glass in order to promote pedestrian activity, however, the windows and doors should be of human scale, so as to welcome pedestrians. The applicant is proposing to replace the existing door and window on the south side of the building. The proposed door and window are in compliance with this criterion. The applicant submitted details of the proposed door and window (attached). (e) Roofs as a design element. Roofs shall be part of, or define, the style of a building. They shall be used creatively to break up long facades and potentially long roof lines. For one-story structures, the minimum and maximum slope of a pitched roof shall be 8 on 12 and 12 on 12, respectively. For structures of two (2) or more stories, the minimum and maximum slope of a pitched roof shall be 5 on 12 and 12 on 12, respectively. Only a small portion of roof area may be flat provided it is not visible from the public street, existing or planned, or does not detract from the overall design and harmony of the building. Where portions of a roof are flat, architectural elements such as cornices and parapets shall be included to improve the appearance and provide interest. Large, low -slope (i.e., less than 5 on 12) gable forms are discouraged. This criterion is being met through the proposed project. (t) Orient buildings to the public street. Buildings shall be designed in a manner that relates the building to the public street in order to protect the integrity of city blocks, present an inviting street front and promote traditional street patterns. New buildings shall be built to the street property line. For existing buildings undergoing renovation, improvements shall be done to relate the building better to the public street. Such improvements could include installation of doors and windows facing the public street. Design Review Application DR-04-08 40 San Remo Drive Page 3 of 5 The orientation of the subject building is not being altered through the proposed project (g) Conceal rooftop devices. Rooftop mechanical equipment and appurtenances to be used in the operation or maintenance of a structure shall be arranged so as to minimize visibility from any point at or below the roof level of the subject structure. This criterion is not applicable to the subject application. (h) Promote energy efficiency. Where feasible, the design of a building should consider solar energy and the use of natural daylight by capturing the sun's energy during the winter and providing shade during the summer. This criterion is not applicable to the subject application (i) Pedestrian promenade along Market Street. In Design District 1, the provision of a covered pedestrian promenade along Market Street is required in order to protect pedestrians from inclement weather and promote walking. Any pedestrian canopy, or portion thereof, that is proposed to be located within or encroach into the public R. O. W. shall meet the specifications identified in the City Center Streetscape Guidelines. An applicant may elect to incorporate a covered pedestrian promenade as a component of the building and completely on the applicant's property, provided the promenade is at least 10 feet high and 8 feet deep. The Development Review Board may waive the requirement for a covered pedestrian promenade or canopy on a building or portion thereof if the Development Review Board finds that the block on which the building is located is adequately covered by other existing promenades/canopies. This criterion is not applicable to the subject application. In addition design plans for properties within Design District 1 shall comply with the following site design criteria as outlined in Section 11.02 of the Land Development Regulations: (a) Landscape and plantings. Significant trees and vegetation should be preserved in its natural state insofar as practicable. Any grade changes should be in keeping with the general appearance of neighboring developed areas. Landscape plantings and amenities shall be well designed with appropriate variations and shall be included as an integral enhancement of the site and, where needed, for screening purposes. In particular, parking areas shall be well screened by berms, plantings, or other screening methods to minimize their visual impact. Planting islands shall be used to break up larger expanses of paved parking areas. This criterion is not applicable to the subject application. (b) Integrate special features with the design. (c) Walls, fences or other screening features: Such elements, if used, shall be employed in a skillful manner and in harmony with the architectural context of the development. Such features should be used to enhance building appearance and to strengthen visual linkages between a building and its surroundings. This criterion is not applicable to the subject application. (d) Accessible open space. When providing open space on a site, it shall be designed to be visually and physically accessible from the public street. Open space should add to the visual amenities of the vicinity by maximizing its visibility for persons passing by or overlooking the site from neighboring properties. If open space is intended for active use, it should include such elements as benches, shade trees, and refuse containers and be so designed to maximize its accessibility for all individuals, including the disabled, and encourage social interaction. The siting of open space on a lot shall also consider the potential impact of buildings, both existing and potential, on shadow casting and solar access. This criterion is not applicable to the subject application (e) Provide efficient and effective circulation. With respect to vehicular and pedestrian circulation, special attention shall be given to the location and number of access points to public streets and sidewalks, to the separation of vehicles and pedestrians, to the arrangement of parking areas and to service and loading areas, and to the location of accessible routes and ramps for the disabled. Staff feels that either lighting option is acceptable, but care needs to be taken to ensure that the direct light source or bulbs in a gooseneck feature are sufficiently shielded so as not to have bulbs directly visible to pedestrians or those driving. (e) City Center standards. Section 6 of the Sign Ordinance has four criteria for signs in this district: consistent design; promote city center goals; color and texture; and materials used. i. Consistent design. This sign design uses specific treatments that reference the Beacon Hill townhouse buildings, such as using the same paint colors as the trim and siding on the townhouses. I Promote city center goals of pedestrian orientation and high quality. The use of copper and wood accents and quality lighting design, and the scale of this sign (smaller and lower than allowed) both promote a high -quality, pedestrian oriented look for the property. iii. Color and texture. The red and copper accents are compatible with the brick, tan and white colors of the townhouses and form a harmonious overall scheme. iv. Materials used. Again, copper and wood are good choices of materials for the City Center and promote a quality appearance. (f) Other issues. The applicant has not stated whether other signs are desired. Staff recommends the DRC stipulate that any subsequent signs require DRC review prior to approval, and that the materials, fonts, colors, and treatments used on the free-standing sign be utilized for any and all other signs on the property. Application #2 — DR-os-lo — Design Plan approval The second application is from Montpelier Broadcasting, Inc. and Pizzagalli Construction for installation of two communications antennas on the roof of the existing Pizzagalli Construction building at 72 San Remo Drive. The applicants have submitted a site plan of the Pizzagalli building, photos of the existing structure (including the 20' tall single antenna existing on the building), and photo simulations of how the property will appear from two points on San Remo Drive after installation of the proposed communications antennas. Communications antennas are a protected use under zoning, meaning that mitigating conditions may not interfere with the installation, operation and use of these devices. The criterion for review of these structures within the City Center zoning district is Section 11.oi(F)(1)(h) of the Land Development Regulations, which states: (h) Conceal rooftop devices. Rooftop mechanical equipment and appurtenances to be used in the operation or maintenance of a structure shall be arranged so as to minimize visibility from any point at or below the roof level of the subject structure. Such features, in excess of one foot in height, shall be either enclosed by outer building walls or parapets, or grouped and screened in a suitable manner, or designed in themselves so that they are balanced and integrated with respect to the design and materials of the building. Staff believes that this application meets the standards in (h) above for several reasons. First, Montpelier Broadcasting has come to an arrangement that puts these communications antennas on an existing building that already has such a structure, and that is farther away from the right-of-way on Dorset Street and San Remo Drive than their building at the corner of Dorset and San Remo. This is visual mitigation in and of itself. Second, the antennas are located in such a manner that they are both grouped with another antenna on an existing roofline, which reduces the amount of change to the existing visual profile, and which makes them largely invisible from Dorset Street since the existing antenna blocks a direct view. Staff thus recommends approval of this design plan. Agenda Item #-3 — DR-os-lr — MSP Amendment and sign approval l South Burlington City Center Design Review Committee Meeting Monday, December igth, 2005 6:�o PM Item #3 is #DR-oS-ii, an amendment to a previously issued Master Signage Permit (DS-02-20) for Randall Munson, 40 San Remo Drive. The existing MSP allowed one wall sign, and the applicant is now asking to amend that approval to allow one free-standing sign and two window graphics, illustrated in the attached application. The applicant has submitted the following pursuant to Section 8(c) of the Sign Ordinance: (a) Plot plan showing sign location and landscaping (b) Proposed sign dimensions (c) Design parameters including fonts, colors and materials (d) Lighting — the applicant states that there are "no plans to provide illumination" for any signage. Evaluation: (a) Size: the proposed wall sign is 21 square feet in size and 7' tall, which is well within the square footage and height limits for the district (32 SF and 12', respectively). Pursuant to Section 18(h) of the Sign Ordinance, window signs may not exceed 25% of the area of the window area to which a sign is attached. There is a note on the application to this effect. (b) Setback: As this property fronts on San Remo Drive, the sign must be set back five feet from the right of way. This standard is met. (c) Landscaping. The plans do not show landscaping of the sign base. Landscaping or planters should be provided when the sign is installed. Staff recommends the DRC condition this approval on submittal of a revised site plan showing landscaping or planters at the base of the sign, with the Administrative Officer to approve prior to issuance of a sign permit. The other landscaping on the property was reviewed and approved by the DRB and exceeds the City's minimum standards. (d) Lighting. The applicant has stated that no illumination is proposed. The applicant needs to be aware that the DRC will need to amend the MSP if illumination is desired in the future. (e) City Center standards. The subject property falls within Design District 2 of the City Center Design Review Overlay District. Pursuant to Section 11.01(D)(1)(b) of the South Burlington Land Development Regulations, the addition or alteration of an exterior wall of a building or structure shall be subject to design review by the Design Review Committee (DRC) and the Development Review Board (DRB). Design plans for properties within Design District 1 shall comply with the following design criteria, as outlined in Section 11.01(F) of the Land Development Regulations: (a) Consistent design. Building design shall promote a consistent organization of major elements; and decorative parts must relate to the character of the design. All sides of a building shall be designed so that they are compatible in terms of material, window treatments, architectural accents, cornice/parapet design, etc. The design of a building should consider the design features of other structures in the area so as not to be harshly discordant with other nearby buildings. The proposed modifications are in compliance with this criterion. (b) Materials used. A wide variety of both natural and high quality man-made materials are allowed. Examples of acceptable materials include red brick, indigenous stone (i.e., granite, limestone, and marble), architectural concrete, synthetic stucco, wood clapboard (synthetic materials such as vinyl siding may be used in place of wood provided it is of high quality and closely resembles wood clapboard/shingles), and glass or glass block. Other materials may be used as an architectural accent provided they are harmonious with the building and site. Examples of unacceptable materials include metal skin and laminated wood (e.g., T-111). Design Review Application DR-04-08 40 San Remo Drive Page 2 of 5 The applicant is proposing to replace the existing overhead doorways with metal siding to match the existing metal siding. The applicant is proposing to replace a very small portion of the total surface, so staff feels that the additional of metal siding is appropriate. However, staff notes that if and when the applicant proposes any major renovations to the exterior of the subject building, metal siding will not be an acceptable material. (c) Colors and textures used. The color and texture of the building shall be harmonious with the building itself and with other buildings on the site and nearby. Colors naturally occurring from building materials and other traditional, subdued colors are encouraged. More than three (3) predominant colors are discouraged. The applicant is proposing to match the color of the proposed metal siding with the existing color of the subject building. 1. The color of the proposed metal siding shall match the existing color of the subject building. (d) Windows and doors. Window and door treatment shall be a careful response to the buildings interior organization as well as the features of the building site. The treatment of windows and doors shall be in a manner that creates a rhythm that gives necessary order and unity to the facade, yet avoids monotony. For sides of buildings that face or front public streets, the majority of the first floor's facade area shall consist of see -through glass in order to promote pedestrian activity, however, the windows and doors should be of human scale, so as to welcome pedestrians. The applicant is proposing to replace the existing door and window on the south side of the building. The proposed door and window are in compliance with this criterion. The applicant submitted details of the proposed door and window (attached). (e) Roofs as a design element. Roofs shall be part of, or define, the style of a building. They shall be used creatively to break up long facades and potentially long roof lines. For one-story structures, the minimum and maximum slope of a pitched roof shall be 8 on 12 and 12 on 12, respectively. For structures of two (2) or more stories, the minimum and maximum slope of a pitched roof shall be 5 on 12 and 12 on 12, respectively. Only a small portion of roof area may be flat provided it is not visible from the public street, existing or planned, or does not detract from the overall design and harmony of the building. Where portions of a roof are flat, architectural elements such as cornices and parapets shall be included to improve the appearance and provide interest. Large, low -slope (i.e., less than 5 on 12) gable forms are discouraged. This criterion is being met through the proposed project. (t) Orient buildings to the public street. Buildings shall be designed in a manner that relates the building to the public street in order to protect the integrity of city blocks, present an inviting street front and promote traditional street patterns. New buildings shall be built to the street property line. For existing buildings undergoing renovation, improvements shall be done to relate the building better to the public street. Such improvements could include installation of doors and windows facing the public street. Rooftop mechanical equipment and appurtenances to be used in the operation or maintenance of a structure shall be arranged so as to minimize visibility from any point at or below the roof level of the subject structure. This criterion is not applicable to the subject application. (h) Promote energy efficiency. Where feasible, the design of a building should consider solar energy and the use of natural daylight by capturing the sun's energy during the winter and providing shade during the summer. This criterion is not applicable to the subject application (i) Pedestrian promenade along Market Street. In Design District 1, the provision of a covered pedestrian promenade along Market Street is required in order to protect pedestrians from inclement weather and promote walking. Any pedestrian canopy, or portion thereof, that is proposed to be located within or encroach into the public R.O. W. shall meet the specifications identified in the City Center Streetscape Guidelines. An applicant may elect to incorporate a covered pedestrian promenade as a component of the building and completely on the applicant's property, provided the promenade is at least 10 feet high and 8 feet deep. The Development Review Board may waive the requirement for a covered pedestrian promenade or canopy on a building or portion thereof if the Development Review Board finds that the block on which the building is located is adequately covered by other existing promenades/canopies. This criterion is not applicable to the subject application. In addition, design plans for properties within Design District 1 shall comply with the following site design criteria, as outlined in Section 11.02 of the Land Development Regulations: (a) Landscape and plantings. Significant trees and vegetation should be preserved in its natural state insofar as practicable. Any grade changes should be in keeping with the general appearance of neighboring developed areas. Landscape plantings and amenities shall be well designed with appropriate variations and shall be included as an integral enhancement of the site and, where needed, for screening purposes. In particular, parking areas shall be well screened by berms, plantings, or other screening methods to minimize their visual impact. Planting islands shall be used to break up larger expanses of paved parking areas. This criterion is not applicable to the subject application. (b) Integrate special features with the design. Storage areas, machinery and equipment installation, service areas, truck loading areas, garbage and refuse collection areas, utility connections, meters and structures, mailboxes, and similar accessory structures shall be positioned in such a way to minimize visibility from the public street, Design Review Application DR-04-08 40 San Remo Drive Page 4 of 5 existing or planned. Such features shall be incorporated within or designed as part of the building on the site, not added as an afterthought. HVAC equipment should not be pad mounted at grade. (c) Walls, fences or other screening features: Such elements, if used, shall be employed in a skillful manner and in harmony with the architectural context of the development. (d) Accessible open space. When providing open space on a site, it shall be designed to be visually and physically accessible from the public street. Open space should add to the visual amenities of the vicinity by maximizing its visibility for persons passing by or overlooking the site from neighboring properties. If open space is intended for active use, it should include such elements as benches, shade trees, and refuse containers and be so designed to maximize its accessibility for all individuals, including the disabled, and encourage social interaction. The subject property is identified as tax parcel ID#1490 00040 C and is located at 40 San Remo Drive within the Dorset Street/City Center Sign District (DS/CC Sign District). Pursuant to Section 6 of the City of South Burlington Sign Ordinance, the erection, alteration, or relocation of any sign within this district shall require design review by the South Burlington DRC and DRB. Section 8 of the Sign Ordinance requires all property owners within the DS/CC Sign District to obtain a Master Signage Permit prior to the issuance of any individual sign permit for the subject property. Therefore, Staff feels the sign is in keeping with DS/CC Sign District goals. Color & Texture A maximum of three colors is encouraged. The proposed sign includes black text and a blue and teal logo on white background. The sign texture is smooth, which is in keeping with the siding of the structure. Staff feels that the sign is compatible and harmonious with buildings in the vicinity. Materials Used The sign will be constructed of luster board with vinyl lettering. Staff contacted the applicant's sign contractor, Kershner Signs, for more information on the materials. Kershner Signs uses luster board almost exclusively. Luster board has a plywood core with a very thin aluminum facing. Staff believes that luster board qualifies as a high quality material and is complementary to the building's siding. WALL MOUNTED SIGNS Section 10 of the Sign Ordinance governs the size and location of wall mounted signs. Pursuant to Section 10(b)(1) a wall mounted sign shall not exceed 5% of the area of the principal public facade or 100 sq. ft., whichever is smaller. The applicant has indicated that the western facade facing San Remo Drive is approximately 14' x 41 1/2', or 581 sq. ft. The proposed sign is 68" x 48", or 22.7 sq. ft. This is less than 5% of the San Remo Drive facade and therefore complies with Section 10(b)(1). Section 10(b)(2) states that a wall mounted sign cannot exceed 15% of the area of the facade to which it is attached. The proposed sign is to be attached to the principle public facade on the San Remo Drive side of the building. As already noted, the sign is less than 5% of the area of this facade. Pursuant to Section 10(d), a wall mounted sign shall not cover any opening or project beyond the top or end of any wall to which it is attached. Based on the simulation photo submitted by the applicant, it appears that the sign will not project over any opening or beyond the top or end of the front facade. Section 10(g) stipulates that a wall mounted sign shall not project from the wall in excess of 9". Based on the cross sectional drawing submitted by the applicant, the sign will not project from the facade more than 2". Table 10-1 limits to two (2) the number of wall mounted signs for a single tenant building with no free standing or landscape feature signs. Again, only one wall mounted sign is proposed. 2. Pursuant to Section 20, all signs shall be of substantial and sturdy construction, kept in good repair, and painted or cleaned as necessary to maintain a clean, safe, and orderly appearance. Access: Access is proposed via a city street from Hinesburg Road, intersecting opposite Van Sicklen Road. A city street is proposed to connect with Butler Farms utilizing a reserved r.o.w. called Link Street on the plans. The applicant is also proposing to reserve a r.o.w. to connect to the Old Cross Road r.o.w. extension. The Municipality will promptly submit to the Developer a copy of such statement as it files with the Bank. The consent of the developer to such payment by the Bank to the Municipality shall not be required. The Bank shall incur no liability to the Developer on account of making such payment to the Municipality, nor shall the Bank be required to inquire into the propriety of any claim by the Municipality of default on the part of the Developer or into the use of such funds by the Municipality in completing such improvements. 7. If monies are released by the Bank to the Municipality pursuant to paragraph five (5) and it shall later develop that a portion of the released monies are surplus to the Municipality's needs, any such surplus shall be refunded by the Municipality to the Bank to be held and distributed by the Bank pursuant to the terms of this Agreement. 10. The Bank will not refuse or delay to make such payments to the Municipality when requested by the Municipality by the appropriate statement, and Developer will not interfere with or hinder such payments by the Bank to the Municipality. They propose to change to a specialty retail store which will bring the use into conformance. There will be no exterior changes to the building. There will also be no outside storage. The proposed tenant is Fasten -All. Lighting will be changed from floods to downshielded wall lights. They have planted a 2-1/2" caliper red maple tree in the front to meet the landscaping budget. Mr. Burgess suggested grassing in the extra parking space. Mr. Jaeger said they would offer to grass in 1/2 of the front area. Members wanted two parking spaces grassed in. Mr. Burgess asked about screening for the dumpster. Mr. Jaeger said it is screened on 3-1/2 sides and is not visible from the street. Members were OK with this. The amendment consists of resubdividing eight lots (lots #80-87) by shifting seven of them 60 feet to the south, Golf Course Rd: Mr. Marshall said there was originally a 20 ft. r.o.w. for access to the golf course. With reconfiguration, this access is not required. They will instead create a 60 ft. r.o.w. access to the remaining undeveloped area. As part of the design of the golf course, they changed the location of tees. Several landed on property lines. They want to alter (reduce) some lots because of this. Mr. Dinklage asked about the bike path which appears to come out to the street. Mr. Marshall said that is an error. He showed the route of the bike path. Mr. O'Rourke said he wanted the applicant to understand that allowing the r.o.w. change does not indicate an OK for any further building on the property. The ZBA on 11/9/98 granted the applicant a conditional use permit for the retail use. Approval from the City Council is needed since a public hearing has b/een warned for a zoning change to create the design review overlay district in this area. The City Council reviewed this application on 11/16/98 and decided that the applicant does not need to comply with the proposed design review criteria. This property located at 40 San Remo Drive lies within the CD4 District. It is bounded on the north by a trucking terminal, on the south by a printing use, on the east by a residence, and on the west by San Remo Drive. Access/circulation: Access is provided by 32 foot curb cut on San Remo Drive. No change proposed. Circulation on the site is adequate. Since the warning, the City received a site plan application to change the use of a property located at 40 San Remo Drive from automotive repair to general retail. The 40 San Remo Drive property is affected by the proposed design review overlay district. The proposed zoning requires a "change of use" to also obtain a design review approval. You had mentioned to me that under state statute, an application that is affected by a warned zoning amendment must obtain approval from the City Council. It appears that the 40 San Remo Drive application falls into this special review category. I am requesting that you prepare a written opinion that explains the proper procedure for going through this process and also the City Council's role in this process.
