HomeMy WebLinkAboutDR-02-17 - Decision - 0040 San Remo Drive# DR-02-17 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of fact, design review application #DR-02-17 of South Burlington Realty Co. seeking design review approval of exterior elevation and window alterations to the west, north, and south side of a structure, 40 San Remo Drive. On the 5 h of November 2002, the South Burlington Development Review Board approved the request of South Burlington Realty Co. seeking design review approval under Section 24 of the South Burlington Zoning Regulations based on the following findings: 1) This project consists of elevation alterations to the north, south, and west elevations on the existing metal skin building. The changes include: 1) addition of one window on the northern elevation, 2) addition of one window on the western elevations, 3) replacement of a window on the southern elevation, and 4) painting the structures southern and western elevations beige. 2) The owner of record is South Burlington Realty Co. 3) Non- complying structure: The applicant is requesting design review for a non- complying structure in the Central District 2. The applicant may propose alterations to the fagade and finishes, Section 26.002 (c) of the zoning regulations. 4) Consistent design: The applicant proposes minor alterations to a non -complying structure. These alterations include the addition of two windows, one on the west and one on the north side of the building, and replacing a window on the south side. The construction of all proposed windows is the same, but not the same as existing windows on the building. The applicant also proposes painting the visible public side elevations of the building classic ivory, to match 50 San Remo Drive. This creates a corridor of consistent buildings where currently there is no consistency between properties. 5) Windows and doors: The applicant proposed two (2) new windows, one on the west and one on the north side of the building. The premier elevation of the building does not have a rhythm of window openings. Staff suggested the finish on the proposed windows be white, because the current window finishes are white. 6) Materials: The applicant proposed no changes in siding materials. 7) Colors and textures: The applicant proposed to paint the south and west side of the building same color as 50 San Remo Drive. Staff recommended painting the northern side of the building as well. The proposed window trim is bronze. Staff suggested proposed additional windows' trim be painted white to match existing window trim. 8) Human scale design: Nothing proposed. 9) Screening: The dumpsters should be screened and so noted on the plan. 10) Lighting: The exterior non-downcasting and non -shielded fixture on the southern elevation shall be removed or replaced with downcasting and shielded fixtures approved by the Director of Planning and Zoning prior to installation. 11) Other: On the property there is an existing pad mounted air conditioning unit. This should be shown on the site plan. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves of the design review application #DR-02-17 of South Burlington Realty seeking design review approval for elevation alterations to the north, south, and west elevations. The changes include: 1) addition of one window on the northern elevation, 2) addition of one window on the western elevation, 3) replacement of a window on the southern elevation, and 4) painting the structures southern and western elevations classic ivory, 40 San Remo Drive, as depicted on a one (1) page plan and elevations, the plan entitled "Site Plan (Existing) 40 San Remo Drive", prepared by J. Jaeger, dated 10/21/02, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) The site plan and elevations shall be revised to show the changes listed below. Three copies of the approved revised plans shall be submitted prior to issuance of a zoning permit. a) The site plan shall be revised to note the dumpster area as a "screened dumpster storage area". b) The window trim shall be white or the same as the existing window trim. c) The elevations shall note that the northern, western and southern elevations shall be painted classic ivory as proposed. d) The site plan shall note the location of the pad mounted air-conditioning unit. e) All doors are to be painted white or same as existing. f) The dumpster storage area shall be screened with stockade fence or similar material. 2 I 3) All exterior non-downcasting and non -shielded fixtures shall be removed or replaced with downcasting and shielded fixtures approved by the Director of Planning and Zoning prior to installation. 4) This approval of the proposed renovation is based on the application's compliance with the design review criteria contained in Section 24 of the South Burlington Zoning Ordinance. The determination of whether or not this application complies with all other requirements contained in the zoning ordinance shall be made by the Administrative Officer. 5) Any change to the site plan or elevations shall require approval by the South Burlington Development Review Board. 6) A Certificate of Occupancy/Compliance shall be obtained prior to use of the structure. -4 1 �) -:)"I An L i / -O S- o.Z CWaiyg.r Clerk 01,Date Sout Burlington Development Review Board Please Note: You have the right to appeal this decision to the Vermont Environmental Court, pursuant to 24 V S.A. § 4471 and V.
