Master Signage Permit DR-06-05
36 San Remo Drive
David Simendinger, hereafter referred to as the applicant, is seeking design review approval for a
master sign permit for the property located at 36 San Remo Drive in the Dorset Street/ City Center
Sign District. The master signage permit would also establish the design scheme for future tenants.
Pursuant to Section 6 of the City of South Burlington Sign Ordinance, the erection, alteration, or
relocation of any sign within this district shall require design review by the South Burlington Design
Review Committee (DRC) and Development Review Board (DRB). Section 8 of the Sign Ordinance
requires all property owners within the DS/CC Sign District to obtain a Master Signage Permit.
1. A Master Signage Permit shall be issued to the applicant by the DRB, prior to the
issuance of any individual sign permit for the property. Individual sign permits shall be in
compliance with the Master Signage Permit.
DESIGN REVIEW CRITERIA
In reviewing an application for signage, the DRC and DRB shall consider the following:
(a) Consistent Design
The design of a sign must be compatible and harmonious with the design of buildings on the
subject property and nearby. The design of all signs on a property shall promote
consistency in terms of color, graphic style, lighting, location, material and proportions.
Staff feels the proposed sign is compatible with the existing building and the surrounding buildings.
The proposed wall signs shall be white with black lettering and a red border. Letter shall be foam

cutout. Graphics shall be black or red and shall be consistent with the name or operation of the
business.
The applicant is proposing two gooseneck exterior light fixtures to be placed symmetrically above the
sign. The light fixtures shall have black arms and black housing. Staff finds that this achieves
consistent design.
(b) Promotion of City Center Goals
Signs within the DS/CC Sign District should be of high aesthetic quality and pedestrian
oriented.
The proposed signage is in compliance with this requirement. The sign appears to be legible and
aesthetically functional.
(c) Color & Texture
The standard in Section 6(b)(3) states that, "The use of a maximum of three (3) predominant colors
is encouraged to provide consistent foreground, text, and background color schemes." The
applicant is proposing a blue background with white lettering and a black border. This proposal
satisfies this criterion.
2. The colors of all wall signs shall be limited to a white background with black lettering, red
borders, and black or red graphics.
(d) Materials Used
Pursuant to Section 20 of the Sign Ordinance, all signs shall be of substantial and sturdy
construction, kept in good repair, and painted or cleaned as necessary to maintain a clean,
safe, and orderly appearance.
Staff feels the proposed signs are compatible with the existing building and the surrounding
buildings. The applicant has proposed wood signs.
3. All signs shall be kept in good repair.
(e) Wall Mounted Signs
Section 10 of the Sign Ordinance governs the size and location of wall -mounted signs.
Pursuant to Table 10-1 of the Sign Ordinance, the total area for all wall signs for a single -
tenant building with no freestanding sign shall not exceed 10% of the principal public faigade.
The applicant has stated that they will adhere to this criterion.
Pursuant to Table 10-1 of the Sign Ordinance, the maximum area of an individual wall sign on
the subject property shall not exceed 15% of the facade to which it is attached or 100 SF,

whichever is smaller.
The applicant has stated that they will adhere to this criterion.
4. The applicant shall adhere to the size limitations of all wall -mounted signs as stated in the
South Burlington Sign Ordinance.
Section 10(c) states that a wall -mounted sign shall not project above the roof or parapet of
the building nor below the top of any first floor doorway unless permitted through the design
review approval process.
The proposed sign locations will not project above the roof or parapet of the subject building. In
addition, the proposed signs will not extend below the top of any first floor doorways or windows.
Thus, the proposed signage is in compliance with this requirement.
Pursuant to Section 10(d), a wall -mounted sign shall not cover any opening or project
beyond the top or end of any wall to which it is attached.
The proposed signs are in compliance with this requirement.
Section 10(g) stipulates that a wall -mounted sign shall not project from the wall in excess of
9".
The proposed signs are in compliance with this requirement.
(t) Freestanding Signs
Section 9(h) states that free-standing signs along Dorset Street are to be located in a sign
corridor that begins adjacent to the road Right -of -Way and runs sixteen (16) feet from the
edge of the Right of Way toward the building face. In those instances where dimensions do
not provide for a two (2) foot setback from the Right -of -Way before a sign support post can
be located, it is permitted to erect a centered single pole mounted sign of which the road
side edge of the sign is directly outside the R.O.W. line.
The applicant is not proposing any freestanding signs.

Oil / Water Separator Connection into Municipal Sewer
Dear Joe,
Please find attached an existing site plan of Lily Transportation on San Remo
Drive in South Burlington. Lily Transportation is requesting permission from the City
of South Burlington to connect an oil/water separator that currently collects water from
the building floor drains to the City sanitary sewer system.
The existing building has a number of floor drains in the work area that
originally drained to an underground leach field located under the gravel parking lot to
the North of the building. A few years ago, as part of a company -wide program to
lessen the company's impact on the environment, an oil/water separator was installed to
treat the floor drain discharge prior to disposal in the leach field area. During a recent
environmental audit of the site, it was recommended that the outlet to the leach field at
the tank be plugged to prevent an accidental discharge from the floor drains from
reaching the leach field. The tank is now pumped on a weekly basis.
Since the floor drains are used sparingly, most of the water that accumulates in
the oil/water separator is assumed to be groundwater. As part of the proposed
connection to the City sewer, the existing tank will be excavated, resealed, and tested
for watertightness in accordance with ASTM standard C 1227-96 to minimize any
groundwater infiltration. The tank will continue to be checked on a weekly basis and
pumped when necessary to remove any accumulated grit and oil.

Re: Lily Transportation Corporation
This letter is to furnish the information requested at the
hearing on 10 August with reference to the above. The Board
specifically asked for a chronological report pertaining to the
handling of customers' products at the Lily facility on San Remo
Drive, prior to the enactment of the zoning law in 1994 and
continuing through the spring of 1998. The Board specifically
requested whether there were any "breaks" during that period of
time.
As was confirmed by Richard Ward at the hearing, the Lily site at
San Remo Drive has been in use for probably longer than there has
been zoning in South Burlington. At some point in time, that
site became a nonconforming use because of the adoption and/or
amendment to zoning regulations. The records that Lily was able
to locate go back to January 1988 although Lily has been
utilizing the site since 1980 and it has been used as a truck
terminal since sometime prior to 1980. It is uncontroverted that
the property in question has been categorized as a truck terminal
by the City of South Burlington, that said use has been in
continuous operation for at least 18 years, that the City of
South Burlington does not have a definition of truck terminal in
its regulations (nor is there one in the state planning and
development statute), that a platform exists on the premises for
the purpose of transferring inventory, product, and other goods
from, to, or between vehicles at the site, and that Lily
customers have and continue to transfer product and/or inventory
on a regular and periodic basis while their vehicles are located
on Lily premises.
Specifically, H.P. Hood was a customer of Lily some time prior to
February 1988 through the first half of 1994. Hood was not a
customer of Lily from 1994 until the beginning of 1998. However,
during that period of time, various customers continued to have
vehicles maintained which carried both nonperishable and

perishable inventory and product. Those companies include
Hallsmith-Sysco, Capital Candy, Bouyea-Fassetts, Country Kitchen,
MacKenzie's, and Drake's Bakeries. There has never been a six
month hiatus where this activity ceased. Quite frankly, Lily
does not agree that it would be precluded from resuming such an
activity in the future if there was a hiatus as such a narrow
interpretation is not consistent with the generally recognized
definition of truck terminal.
At the hearing on 1.0 August, there was some discussion as to
whether or not Lily was operating a truck terminal, a
distribution center, or both. In attempting to distinguish
between these two terms, an opinion was requested and obtained
through the managing editor of Traffic World, a trade publication
dealing with traffic/distribution. The editor, Clayton Boyce,
distinguished the two enterprises by defining a trucking terminal
as being operated by a company serving many customers while a
distribution center is owned and operated by one shipper or
operated for one shipper by a trucking or logistics company. In
effect, a trucking terminal includes the use of handling and
distribution of customers' products or inventory. Although that
is not the principal operation of Lily, it is a practice which
has continued at that location for as long as Lily has been
operating the site.
Throughout the entire period of time, the level of product
transferred has been dependent upon the number of customers and
the size of the fleets of those customers. The only change which
took place in 1998 was the resumption of Hood as a customer at
the South Burlington location.
This leads us to the second issue raised by Mr. Ward's office,
i.e., the installation of posts for the maintenance of exterior
outlets. Contrary to what was represented to the Board at the
hearing, the definition which appears in Paragraph 28.156 of the
South Burlington Zoning Regulations defines structure as an
object which obviously has a use unto itself. While an outlet
would certainly not be included in the definition of a structure,
the post which holds the outlet is nothing more than an object
which supports the outlet which itself does not require a
municipal permit. Unfortunately, there was some confusion in the
letter sent by Mr. Ward's office as it pertains to the outlets.
It was assumed that the permit which was not obtained was a
municipal permit for an electrical connection. At the hearing,
we learned that it was a permit for the construction of a
structure. We respectfully disagree that the outlets are
structures which would require a permit under the municipal
regulations.
The outlets are placed on a post for support and safety. As was
indicated at the hearing, the sole purpose of the external power
outlets does two things. First, the outlets are to be used in

inclement weather as heaters so that the trucks may be started
without difficulty. For several years, Lily has been running
extension cords outside of the building and this is obviously not
the safest way to provide this service. Second, the outlets are
used to operate refrigeration compressors on vehicles that are
left on the Lily property. It is a method of staying abreast of
the latest technology of operating compressors with an electrical
backup motor rather than running them with the main diesel
engine. This is more economical, substantially quieter, and less
of a burden on the environment. As was indicated at the hearing,
Lily expects to continue obtaining the new style compressors with
the hope that they will transfer the entire fleet of refrigerated
vehicles over time to the electrical backup system. Should the
City of South Burlington take the position that a permit is
required, Lily would temporarily revert to the older style diesel
compressors until this matter is finally resolved. It appears
clear, however, that the principal objection and dispute of any
neighbor of Lily is not the activity on Lily property but the
need for noise abatement, especially by the use of the
independent compressors of vehicles which are left on the Lily
site until they are removed by the customers. obviously, a
refrigerated vehicle must stay refrigerated if it is going to be
used so the running of compressors will continue. The issue
seems to be whether the allowing of external outlets is anything
more than upgrading the existing technology of what is otherwise
an authorized use.

Please be advised that based on information available to the City, you have commenced land
development on your property at the above address without obtaining a permit from the City as
required by Section 27.10 of its Zoning Bylaws and 24 GSA §4443(a)(1). Specifically, you have
initiated the following activities on the above -described property:
Expanded a nonconforming use by using the propertyfor the distribution of bread and milk
products and the installation of posts with electrical outlets for use by the milk distribution
trucks.
You have seven (7) days from the date of this letter to discontinue this violation and take
appropriate remedial action. Specifically, you must accomplish the following:
Remove the posts with the electrical outlets and cease the use of the propertyfor the distribution
of bread and milk products.
If you dig not accomplish the actions directed in this letter within seven (7) days of the date of
this letter, the City may pursue this matter in court. In such court proceeding, the City will be
entitled to seek appropriate it junctive relief and fines of up to fifty ($50.00) dollars per day for
each day your violation continues beyond the seven (7) day period provided in this letter.
If the violation described in this letter occurs again within twelve (12) months of the date of this
letter, you will not be entitled to receive a further Notice of Violation from the City before the
City pursues further enforcement proceedings.
You may appeal this Notice of Violation to the Board of Adjustment by filing a written notice of
appeal (see enclosed) and fifty ($50) dollars within fifteen (15) days of the date of this letter with
the Clerk of the Board of Adjustment at the following address: 575 Dorset Street, South
Burlington, Vermont 05403.

On June 19, 1998, Lily Transportation Corporation was given notice by Ray Belair, Assistant
Zoning Administrative Officer, that they are in violation (enclosed letter dated 6/29/98).
Lily Transportation expanded the use by using the property for the distribution of bread and milk

Thank you for meeting with me on July 8, 1998 regarding our appeal of the
Administrative Decision concerning our property at 36 San Remo Drive. I would like to
confirm the following actions we discussed:
• We have applied for the appeal and understand that the meeting is tentatively
scheduled for August 10, 1998.
• our customer, HP Hood has agreed to find another parking facility and relocate by
September 1, 1998. They are actively working with their prospective landlord to
finalize an agreement. As we discussed, this intent on their part will preclude any
fines or penalties .from being assessed against HP Hood or Lily, regardless of the
outcome of the appeal.
Please acknowledge receipt of this letter and confirm in writing that the above is
acceptable to the City of South Burlington. Thank you for your assistance.
