HomeMy WebLinkAboutZB-97-0000 - Decision - 1200 Airport DriveSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON q7 —06 Oe') DECISION AND FINDING OF FACT On the 10th day of March, 1997, the South Burlington Zoning Board of Adjustment heard testimony regarding a variance application of the Burlington International Airport, J.J. Hamilton agent, 1200 Airport Drive. Attending this meeting representing the applicant was Jonathan Miller and Jon Lienwohl, Webster -Martin, Inc. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findings of Fact 1) The area in question zoned AIR District. 2) Section 25.113 Height of structures requires increasing the setbacks by one (1) foot for each additional foot of height above the maximum height of 35 feet. 3) The proposed height of an elevator tower is 36.9 feet, therefore, the required front yard setback would be 51.9 feet. 4) The appellant is requesting a 50 foot setback for a portion of the proposed parking structure. 5) The rear yard setbacks are in compliance. Conclusion 1) The Board finds that reposition of the building creates a problem due to limited space between the parking garage and the terminal. 2) Traffic movements as well as parking in front of the terminal restricts the placement of the parking garage. 3) A minor portion south-west corner of the structure is affected by the proposed fifty (50) foot setback. 4) The entire front yard will provide green space as a buffer to the Airport Drive right-of-way. 1 5) The appellant has made every effort to minimize the variance. This is a minimum variance of less than two feet. 6) Hardship is partly due to A.D.A. requirements, only the elevator tower exceeds the maximum height requirements. 7) The actual height of the parking garage is 33 feet 6 inches. Based upon the findings and conclusion setforth above, the Zoning Board of Adjustment hereby grants the applicant request to construct a parking garage at a height of thirty six feet nine inches (36.9) with a front yard setback of fifty (50) feet located at the Burlington Inter 1 Airport, 1200 Airport Drive.
