HomeMy WebLinkAboutSP-98-0000 - Decision - 1200 Airport DriveFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Burlington International Airport to amend a previously approved plan to construct a 13,240 square foot addition to an existing 72,625 square foot airport terminal building, 2) construct a multi -level parking structure for 1143 vehicles, and 3) construct new employee and long term surface parking areas. The amendment consists of modifying the approved landscape plan by reducing the amount of new landscaping, 1200 Airport Drive. On the "'i'day of November, 1998, the South Burlington Planning Commission approved the request of Burlington International Airport for site plan review under Section 26. 10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of amending a plan approved on 2/11/97 to construct a 13,240 square foot addition to an existing 72,625 square foot airport terminal building, 2) construct a multi -level parking structure for 1143 vehicles, and 3) construct new employee and long term surface parking areas. The amendment consists of modifying the approved landscape plan by reducing the amount of new landscaping. 2. Landscqping: The minimum landscaping requirement for this project was $129,050. This requirement includes the shortfall on four (4) previously approved projects. The landscaping plan approved on 2/11/97 met this minimum requirement Staff inspected the landscaping prior to issuance of a Certificate of Occupancy and discovered that the landscaping planted was different and included less plant material than that shown on the approved plan. A temporary C.O. was issued pending the outcome of this request. 3. The planted landscaping may meet the minimum dollar requirement, however, it is substantially less than what was proposed on the approved plan. The applicant submitted a summary of their landscaping expenditures. This statement indicates that they spent $208,682 which includes credits for stone walls, sidewalks and moving and saving existing trees. They are seeking credits for $30,077 worth of trees saved or transplanted. 4. The landscaping bond for this landscaping expired some time ago and staff has been unable to obtain another one. The approval required that the bond remain in effect for three (3) years. The applicant is in violation of this requirement. 5. Staff recommended approval of the revised plan. A condition should be attached that requires posting of a landscaping bond prior to issuance of a permanent C.O. permit. DECISION & CONDITIONS Based on the above Findings of Fact, The South Burlington Planning Commission approves the site plan application ofBurlington International Airport to amend a previously approved plan to construct a 13, 240 square foot addition to an existing 72,625 square foot airport terminal building, 2) construct a multi -level parking structure for 1143 vehicles, and 3) construct new employee and long term surface parking areas. The amendment consists of modifying the approved landscape plan by reducing the amount of new landscaping, 1200 Airport Drive, as depicted on a three (3) page set of plans, page one (1) entitled, "Burlington International Airport South Burlington Vermont As Built Tree and Shrub Planting Plan", prepared by Dunn Associates, dated 10/16/97, last revised 9/2/98, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The applicant shall post a $129,050 landscape bond within 30 days of this approval or prior to obtaining the permanent Certificate ofOccupancy/Compliance, whichever occurs first. The bond shall remain in effect for three (3) years to assur hat the landscaping takes root and has a good chance of surviving. 7 Chairmith or Clerk South Burlington Planning Commission Date 2
