FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: Findings of Fact, site plan application #SP-00-64 and design review application #DR-00-32 of
Associates in Orthopedic Surgery to amend a previously approved site plan for a 7,478 square foot
building with two dwelling units and 5,478 square feet of medical office use. The amendment
consists of: 1) a 56.25 square foot addition for medical office use, 2) minor landscaping changes, 3)
minor elevation changes, and 4) minor circulation changes, 6 San Remo Drive.
On the 6th of February, 2001, the South Burlington Development Review Board approved the site
plan application of Associates in Orthopedic Surgery under Section 26.10 and Section 24.20 of the
South Burlington Zoning Regulations based on the following findings:
1. This project consists of a site plan application and a design review application to amend a
previously approved site plan for a 7,478 square foot building with two dwelling units and 5,478
square feet of medical office use. The amendment consists of: 1) a 56.25 square foot addition for
medical office use, 2) minor landscaping changes, 3) minor elevation changes, and 4) minor
circulation changes, 6 San Remo Drive.
2. The owner of record of this particular property is AOS Realty, LLC.
3. This property is located within Central District Two and Design District Two. It is bounded on
the north and east by undeveloped land, on the west be a medical office building, and on the south
by San Remo Drive.
4. Access/Circulation: The applicant proposed to move the access drive approximately five (5) feet to
the east to accommodate the proposed addition. Circulation on the site is adequate.
5. Coverage/Setbacks: The total coverage will increase from 55% to 60% (90% max). Building
coverage is 19% (40%). The plans should be revised to provide the proposed building coverage
information.
6. Traffic: The proposed addition will result in a minimal amount of additional traffic.
7. Parking: The proposed alterations will result in minor parking layout changes but will not alter the
number of parking spaces or handicapped spaces. A bike rack must be provided.
8. Landscaping The applicant proposed temporarily removing the existing landscaping from in front
of the building for regrading work. It was proposed that the less mature landscaping would be
replaced instead of replanted. The Design Review Committee recommended that the applicant
should perhaps comply with the planting requirements of the San Remo Drive Streetscape instead of
replacing the less mature landscaping. The Streetscape calls for relocating several of the existing
Honey Locust trees to the greenbelt of San Remo Drive.
9. Lighting The applicant has proposed increasing the wattage on the two pole mounted lights from
175 watts to 250 watts apiece. The applicant had originally applied for two additional pole mounted
lights but reached this compromise with the Design Review Committee.
10. Dum sp ter: The existing dumpsters on -site must be screened.
11. Design Review: The City Center Design Review Committee considered this application at their
January 22nd meeting.
The Design Review Committee recommended approval with the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval
shall remain in effect.
2. This recommendation for approval of the proposed addition is based on the
application's compliance with the design review criteria contained in Section 24
of the South Burlington Zoning Ordinance. The Administrative Officer shall
make the determination of whether or not this application complies with all other
requirements contained in the Zoning Ordinance.
3. The plans shall be revised to show the changes below and shall require approval
of the Director of Planning and Zoning. Three copies of the approved revised
plans shall be submitted to the Director of Planning & Zoning prior to obtaining a
zoning permit.
a) The plans shall be revised to illustrate the San Remo Drive Streetscape
plantings. The applicant shall implement the planting of Honey Locust Trees
along San Remo Drive instead of replacing some of the less mature plantings.
b) The plans shall be revised to note the correct existing wattage not to exceed
250 watts for the two existing light poles. Proposed poles on the north side shall
be deleted.
4. The applicant shall obtain a zoning permit within six (6) months pursuant to Section
27.302 of the zoning regulations or this approval is null and void.
5. The applicant shall obtain a Certificate of Occupancy/Compliance from the

Administrative Officer prior to use of the addition.
6. Any change to the plans shall require review by the South Burlington Design Review
Committee.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board approves site
plan application #SP-00-64 and design review application #DR-00-32 of Associates in Orthopedic
Surgery to amend a previously approved site plan for a 7,478 square foot building with two dwelling
units and 5,478 square feet of medical office use. The amendment consists of: 1) a 56.25 square
foot addition for medical office use, 2) minor landscaping changes, 3) minor elevation changes, and
4) minor circulation changes, 6 San Remo Drive, as depicted on a four (4) page set of plans, page one
(1) entitled "Assoc in Orthopedic Surgery Site Plan 6 San Remo Dr So Burlington, VT," prepared by
GVV Architects, dated 11/29/00, with the following stipulations:
1. All previous approvals and stipulations which are not superseded by this approval shall remain in
effect.
2. The plans shall be revised to show the changes below and shall require approval of the Director of
Planning and Zoning (hereinafter Director). Three (3) copies of the approved revised plans shall be
submitted to the Director prior to permit issuance.
a) The applicant shall revise the plans to provide screening for all dumpsters on site.
b) The plans shall be revised to illustrate the San Remo Drive Streetscape plantings.
The applicant shall implement the planting of Honey Locust trees along San Remo
Drive instead of replacing some of the less mature plantings. The plans shall be
revised to depict the tree belt and foundation plantings.
c) The plans shall be revised to note the correct existing wattage not to exceed 250
watts for the two existing light poles. Proposed poles on the north side shall be
deleted.
d) The plans shall be revised to provide a bike rack.
3. For the purpose for calculating road impact fees under the South Burlington Impact Fee Ordinance,
the Development Review Board estimates that the 56.25 square foot addition for medical office use
will generate zero (0) additional vehicle trip ends during the P.M. peak hour.
4. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the
Zoning Regulations or this approval is null and void.

5. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer
prior to occupancy of the addition.
6. Any change to the site plan shall require approval by the South Burlington Development Review
Board.
7. Prior to issuance of a zoning permit, the applicant shall post a landscape bond in an amount to be
determined by the Director. The bond shall remain in effect for three (3) years to assure that the
landscaping has taken root and has a good chance of surviving.

long. You will be bound by the decision, pursuant to 24 V.S.A. § 4472(d) (exclusivity of
remedy; finality).
