HomeMy WebLinkAboutSP-02-47 DR-02-09 - Decision - 0006 San Remo DriveI FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON # SP-02-47 #DR-02-09 Re: Findings of Fact, site plan and design review applications #SP-0247 and #DR-02-09 of Associates in Orthopedic Surgery to amend a previously approved site plan for 5,478 square feet of medical office space and two (2) dwelling units. The amendment consists of enlarging a screened dumpster storage area to accommodate two dumpsters, 6 San Remo Drive. On the I" of October 2002, the Director of Planning and Zoning approved the site plan and design review applications of Associates in Orthopedic Surgery under Section 26.10 (b), and design review approval under Section 24.00 of the South Burlington Zoning Regulations based on the following findings: 1) The amendment consists of enlarging a screened dumpster storage area to accommodate two dumpsters. 2) The owner of record is Associates in Orthopedic Surgery. 3) This property located at 6 San Remo Drive lies within the CD2 and Design Overlay District 2. It is bounded on the north by Fitzpatrick's GMC, on the east by The B Team Auto Repair, on the west by Center for Chiropractic Care, and on the south by Health South and San Remo Drive. Design Review Criteria 4) Walls, fences or other screening features: The applicant proposed to replace the existing screening feature with same material that currently exists; wood stockade fence, approximately 6 foot tall, and painted the same color as the structure on the same property. The only change is the dumpster area will be enlarged to accommodate two dumpsters. Site Plan Criteria The only issue effecting this application is the coverage. 5) Coverage: The building coverage from the previous approval remains unchanged at 19% (maximum allowed is 40%). Overall coverage increases from 55% to 56% (maximum allowed is 90%). DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Director of Planning and Zoning approves site plan and design review applications #SP-02-47 and #DR- 02-09 of Associates in Orthopedic Surgery to amend a previously approved site plan for 5,478 square feet of medical office space and two (2) dwelling units. The amendment consists of enlarging a screened dumpster storage area to accommodate two dumpsters, 6 San Remo Drive, as depicted on a site plan entitled "Assoc in Orthopedic Surgery Site Plan 6 San Remo Drive So. Burlington, VT', prepared by GVV Architects, dated 29 November 2000, with a revised date of 3 September 2002, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) All existing floodlights shall be removed and/or replaced with downcasting and shielded fixtures approved by the Director of Planning and zoning prior to installation. 3) The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 4) The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer. 5) Any change to the approved site plan shall require approval by the South Burlington Development Review Board. li Beth Hoover Director of Planning & Zoning /C) I /(11:2, Date Please Note: You have the right to appeal this decision to the Vermont Environmental Court, pursuant to 24 V.S.A. § 4471 and V.RC.P. 76, in writing, within 30 days of the date this decision is issued.
