Dear Ms. Lafleur:
On behalf of our Client, and pursuant to our telephone conversation today,
we are formally asking that the continuation of the 24 September hearing,
scheduled for 12 November 1985, be rescheduled for 10 December 1985.
The Project, consisting of the proposed relocation of "Cluster 1" from the
vicinity of Dorset Street to a more central area of the development, is
still undergoing layout revisions.
During the September hearing there were some concerns voiced with the
proposed layout and building elevations. These concepts are being worked
on, and our Client would like to feel confident all, if not most, of these
concerns are settled before submitting a revised layout for Cluster 1.
Also, there appears to be some confusion as to the actual "plateau" the
proposed revision has "reached" during this review process. Originally,
our Client was merely looking for an approval of the concept involved with
relocating Cluster 1, before investing large amounts of money in refined
site and construction drawings. Of course, the Commission's decision on
the concept of moving the Cluster had to be assisted by a preliminary
layout , which was submitted before the September hearing. However, it
seems that somehow the energies of the Commission were deflected on to the
more nitty-gritty details of the layout, such as fire access and
elevations of buildings, rather than focusing on the concept of whether or
not our Client should even pursue in detail the relocation of the
Cluster. We fully appreciate that it's nearly impossible to have a
conceptual review of relocating the Cluster without considering the
engineering plans, but possibly an approval our Client seeks at this point
could be couched in terms of "the idea is fine, but you must still show us
how the details will work before final approval can be granted". This
would at least provide the incentive for returning to the drawing boards
and fine-tuning the engineering plans.

The plan to be submitted for the 10 December meeting will not be a "final"
engineering plan, but will be a different preliminary layout, designed to
accommodate the concerns of the fire chief and others.
We and our Client hope that at the 10 December meeting the Commission will
be able to give us more direction on whether or not they will permit the
Cluster to be relocated to the area proposed, as well as commenting on the
specifics of the layout.
We'll make an effort, before the meeting, to make sure we've had a chance
to meet with the fire chief.
Should you have any questions on the foregoing, please don't hesitate to
call me or Mr. Wooster.

This serves to confirm that the minor revision to cluster one
has been approved administratively by this office. (Plans last
revised 5/86 stamp dated 5/30/86). This modification consists
of changing the 10 unit structure originally approved for the
site to one 4-unit and one 6-unit building plus detached garages.
The landscaping plan prepared by David Raphael has also been
approved.
These plans have also been reviewed and approved by Fire Chief
James Goddette and City Manager/Engineer William J. Szymanski.

The South Burlington Planning Commission held a Regular
Meeting on Tuesday, 17 December 1985, at 7:30 pm, in the
Conference Room, City Hall, 575 Dorset Street.

Continue sketch plan discussion of the relocation of Cluster
One of Indian Creek condominiums
Mr. Burgess and Mr. Dooley, who revisited the site, felt that
the aesthetics were slightly better with the new location but
were not impressed one way or the other. Mr. Rider again
stressed the verbal agreement made at the time Ridgewood gave
up its rights to develop the property in question. Mr.
Barovick added that in the original plan, single family res-
idences were planned for that location, not condos. He added
that most of the 5 or 6 residences in his row have finished
ground floors and would be looking into someone else's
windows. He said it would be equally bad for the buyers.
Another Ridgewood owner indicated she had bought her property
less than a year ago with the understanding that nothing
would be built in that area with the possible exception of a
road. She was strongly motivated to have a view to one side
since the other side of her house faces a parking lot. She
is also concerned for the wild life in the area. A polling of
members indicated that if Indian Creek were to present the
plan to the Commission, it might pass.
Discussion of development policies for the Southeast Quadrant
including a critique of present zoning regulations, the 1985
Comprehensive Plan recommendations and other planning tools,
specifically transfer of development rights
Mrs. Lafleur introduced Rick Carbin of the Ottaquechee Land
Trust. Mr. Carbin explained that the Trust is a private,
non-profit land conservation group involved in protection of
forest and agricultural lands. Their aim is to find fair
ways of protecting land. Since 1980, they have completed 70
individual projects resulting in the protection of 20,000
acres throughout the state. The are currently working on
over 200 projects. The unique quality they bring to the

regarding traffic. She noted that the proposed use exceeds
the overlay standards for Zone 1 which would allow 11.4 trips
during one peak hour. This use ranges between 12 and 91.
Mrs. Maher said she felt this stretch of road was highly
dangerous and she has noted traffic backed up as far as
Burger King. Mr. Simendinger noted that Cumberland Farms is
a price cutter which develops a high volume business. They
have asked for a one-year supply with Chevron on the basis
that they can buy oil from cheaper from the Arabs. He sug-
gested that if Cumberland Farms does take over the location,
traffic will be generated by the current approved service
station use. Mrs. Lafleur noted that if the Commission chose
to waive the traffic overlay, there are very strict criteria:
the planned development must cover 4 acres, they must change
or reduce the number of curb cuts or the level of service at
the intersection must be Level C. She said these did not
seem to apply in this case. Mrs. Maher then polled members
as to whether they would waive the traffic overlay. The
concenses was 4-2 against waiving.
Mr. Dooley then moved that the Planning Commission deny the
site plan application of Wesco for conversion of existing
service station to a mini -mart with gas pumps located at 1118
Williston Road. Mr. Burgess seconded, and the motion passed
unanimously.

Mr. Fitzpatrick explained that the original plan was too
strung out for the Fire Chief, so they have put the units to
be relocated in a circular pattern. He indicated the land
where the units were previously planned will be left as is
now. Mr. Dooley asked why that site was not appropriate for
the units being moved. Mr. Fitzpatrick said because of the
size and the steep drop off. It had originally been set up
as 1 large structure with 10 units. Parking was a little
awkward and the feeling was that it would be best to leave
that area open and not to see the project until you got down
the hill. Mr. Rider of Ridgewood said they have a lower
level which they use as living space and which would be lower
than the proposed units•. He felt the plan was not as
advertised when the original proposal came up. Dr. Barovick
said they bought their property in 1984, and the plat plan
was that this site was to be open land. They bought their
unit on that basis. Carl Lisman, representing the residents,
said that when a developer submits a plan, it has some
binding nature. The people at Ridgewood had an expectancy
when they bought their units that the land across the pond

would be as shown on the plans with that land open. With the
present plan, this would not be so. Mrs. Maher asked if Mr.
Lisman was saying there can be no revisions to plans. Mr.
Lisman said he wasn't, but the aesthetic question was
considered by the Commission in the original plans and there
were no problems. Mrs. Maher said she has walked the land
and feels the new location is vastly superior. Mr. Dooley
said he would like to revisit the site and look again. Mrs.
Hurd said she is bothered by the situation. She said she is
more opposed to the old plan than in favor of the new. Mr.
Jacob said he would leave it as is. Mr. Burgess said he saw
no reason to move the buildings. Mr. Belter said he felt it
would look better from Dorset St. to move,the units but was
bothered by the legal situation. Members agreed to
reconsider the request at the meeting of 17 December after Al
members have had a chance to revisit the site.
6-Consider sketch plan application of Lakewood Associates for
the construction of 38,400 sq. ft of office space in 5
buildings and coversion of existing building to a 300-seat
restaurant/conference facility located at 1233 Shelburne Road
(former East-O-Lake Inn)
Mr. Allen indicated that in response to conversations with
the City Planner, they have eliminated the conference center
and dropped the total sq. footage to 37,000. This would also
eliminate some parking. He felt their proposal was an
appropriate use of the property. The Inn would be the
central focus; it would be renovated keeping the exterior
facade. The 5 office buildings would blend in with the area.
The hope to attract new high -profile companies looking for a
pleasant work environment. All buildings would be designed
to reflect the architecture of the original property and
would be appealing from the road. Landscaping would be pre-
served and enhanced and they would keep as many tall trees as
possible. They have secured an alternate access to the
property onto Holmes Road which would cause far fewer traffic
problems than Shelburne Rd. They presented figures which
showed that they would fall within the allowable traffic
figures. They stressed that they felt the 2 used (office and
restaurant) were as compatible as the restaurant/hotel use
now. Mrs. Maher asked how cars would be encouraged to exit
onto Holmes Road. Mr. Allen said there would be signs. Mrs.
Lafleur recommended that be the only exit.
Mrs. Lafleur then indicated that it was her feeling that this
C is a pCD, hr-t a site plan and that the applicant would fall under
in the level of service criteria which is being computerized
now. Mr. Brush said he didn't see how adding another 24 cars

Traffic: The overlay zone allows 11.4 trips during the peak hour
for this small lot. The attached traffic study, prepared by North
County Planning estimates 60 to 100 trips during the peak hour.
The applicant requests a vote from the Commission on this feature
before he revises the plan to make other improvements.
Access: There are two existing 40 foot curb cuts. These exceed
our 36 foot standard. The property also provides another access
to the Windjammer, although this is not shown on the plan.
Circulation: Most of the lot is paved providing unlimited
circulation.
Parking: The use requires seven spaces. Twenty four are shown.
Given the excessive parking and lot coverage (85% plus) I would
suggest the lot be brought into conformance by landscaping at
least 30% of the lot.
Landscaping: In addition to removing pavement and increasing land-
scaped/grassed and seeded areas, at least $360 in new plantings
is required. A plan will be required. The front yard coverage
should be brought closer to conformance although it is difficult
with two curb cuts and the pump islands. At the very least,
the eastern and western corners near Williston Road should be
seeded after removing pavement. The rear of the property is
used for storage of old Texaco signs. This should be cleaned
up.

5)` INDIAN CREEK ''CLUSTER ONE RELOCATION
This sketch plan is for the relocation of Cluster One from the
left side of the entrance drive near Dorset Street to a location
within the development. The applicant is requesting conceptual
sketch plan approval only, before he invests in detailed
engineering drawings. The issues are as follows:
Parking: These ten units require 22 parking spaces. The plan
shows 23.
Landscaping: Landscaping details must be submitted prior to
final plat equal to 3% of the construction cost.
Roads: A private road maintenance waiver must be recorded with
the City Clerk prior to permit.

RV Area: The recreational vehicle area must be relocated.
Other: The neighbors in Ridgewood are concerned about this location
since it will be built in a vacant field. A site visit will prove
that while the buildings will be visible to Ridgewood, they should
not be any higher in elevation than the Ridgewood buildings. I
suggest all members of the Commission visit the site and make
your own judgement as to the appropriateness of the approved
location (just beyond the mailboxes) versus this proposed location
within the development. (see enclosed map)
6) LAKEWOOD ASSOCIATES, INC., 1233 SHELBURNE ROAD
The applicant is proposing a new plan for the East-O-Lake Inn
property. This will be classified as a Planned Commercial
Development consisting of 38,400 square feet of office space in
five buildings and a 300 seat restaurant/conference facility.
The purpose of this sketch plan review is to discuss the issues
that will be of concern to the Commission and give conceptual
approval/disapproval to the applicant.
Traffic: As a Planned Commercial Development the applicant is
required to meet the traffic standards stated in section 11.504.
This includes a level of service C at designated intersections.
I suggest the applicant prepare a study indicating the level of
service at Holmes Road and Imperial Drive. We should then have
Craig Leiner evaluate it.
The overlay zone (Zone 2) permits 100 trips during the peak
hour for this property. This use projects 151 to 181 trips using
ITE data or 130 to 145 trips if the conference facility is removed.
The previous hotel plan would have created 89 to 109 trips.
The applicant is proposing a connection to Holmes Road through
the back of the VW property. I question whether it will be used
unless it is marked as the sole exit. In addition, Holmes Road
does not presently meet the warrants for a traffic signal. An
increase in traffic may help it to meet the warrants and make
a Holmes Road connection more advantageous but it does not seem
to be very helpful now. A study could be done to see whether
the additional traffic would warrant a traffic signal.
Parking: The ordinance requires 240 spaces; 244 are shown.

1. There is a large undeveloped parcel (former Marsh property)
now Merrill) across Shelburne Road. I would recommend that
this property have a single road opening as close to the
northerly line as possible so that it would be opposite the
vacant parcel. If the volume of traffic justifies traffic
signals, the installation of these signals will be simplified
and serve both parcels.

Mr. Fitzpatrick said the original location is not compatible
with the condo project. Mr. Jacob said he received call from
people in Ridgewood who do not like the proposed change as
they had been told this area would remain open. Mrs. Hurd
said she agreed with this. Other members did not object on
that basis. Mr. Fitzpatrick said they wanted to get the
massive structure away from the entrance. Mrs. Lafleur said
she though the new location was better because it was part of
the character of Indian Creek that it couldn't be seen from
the road.
Mr. Rider of Ridgewood said that when Vermont Federal took
over, Ridgewood gave up the right to building lots with the
understanding that nothing would be built in this area. Mr.
Robenstein said he wouldn`t like to see houses on the high
spot but he thought the decision should be based on what was
best environmentally. He said that landscaping has not been
done well on the site at present nor has grading and he would
like to see some real teeth in a landscaping plan. There is
nothing around the storage areas. Drainage is also very
poor.
Members agreed they would like to view the area before making
a decision.
Mr. Dooley moved that the Hearing be continued. Mr. Burgess

1. Water service (lz') serving Meinoke expansion shall include

2. New curb cut shall be constructed by removing the barrier

3. I see no reason to relocate the catch basin at the new entrance
drive.
7) NORDIC FORD, SHELBURNE ROAD
1. Plan dated 9/20/85 shows no control of increased storm water
runoff except for the most easterly parcel. It is my understanding
that this will be revised in consultation with Heindel and Noyes.
2. Six street access drives, especially three off Shelburne Road
is excessive. I would like to see at least one of those three
eliminated.
3. New curb openings shall be constructed with a concrete depressed
curb. Existing curb openings, not to be used, shall be removed and
a barrier curb installed.

3. Public Hearing: for Final Plat application of Alexander Lewis
and the City of South Burlington for the 2-lot subdivision at
1301 Shelburne Road (frontage on Holmes Road)
Mrs. Maher reminded the Commission that one of the lots will
be the proposed site of the new fire substation. Chief
Goddette said they want equipment to exit onto Holmes Rd.
Mr. Lewis requested a 30-foot road if he wants to build in
the future. The station will be a 2-bay facility. They in-
tend to put a light at the Holmes Rd./Shelburne Rd. inter-
section to relieve driveways from exiting traffic.
Mr. McClary moved that The Planning Commission approve the
Final Plat application of Alexander Lewis and the City of
South Burlington for the two lot subdivision of 1301
Shelburne Rd, known as lot #4 behind Chittenden County
Volk$wagen with Holmes Road frontage as depicted on a plan

Dear Ms. Bechtel:
On behalf of our Client, the Vermont Federal Bank, we are herewith submitting
revised site plans addressing Cluster #1 of the above -referenced Project.
As discussed with you earlier, and as indicated informally during our discussions,
the Owner would like to consider "relocating" Cluster #1 (10 units) from its
originally -approved site to the westerly extreme of the Project, as shown on the
enclosed plans (4 copies each of Site Plan and Overall Site Plan).
We've completed our preliminary engineering on the re -located site,as shown, and
prefer to to continue with final engineering details only after the Commission's
indication that the proposed site is acceptable, and that the preliminary plans
are also acceptable to the Fire Chief and the City Engineer.
The total number of units will remain unchanged with the new site, and all Project
boundary lines will also remain unchanged.
The principal reasons for the proposed relocation are aesthetics and the use of
more, but smaller, structures to contain the same number of dwelling units.
Parenthetically, the new location would probably be viewed as less of an impact
on the existing dwellings in Ridgewood, due to proximity, as can be seen on the
Overall Site Plan enclosed (Drawing D-1432).
The Overall Site Plan shows the remaining open areas of the site, while the Site and
Utilities Plan more clearly shows the proposed site's proximity to the Project's
boundaries and the pond.
Also enclosed is a signed'Application form regarding the revised Site Plan/Final
Plat.

2) VERMONT FEDERAL BANK, INDIAN CREEK
The applicant requests that the discussion of the relocation of
Cluster One be postponed until December 10, 1985. Although this
had been warned as a Final Plat Public Hearing, the applicant
is not ready for the level of detail and instead will request
conceptual approval (sketch plan) on December 10, 1985. (see
enclosed letter from Douglas Fitzpatrick)
3) LEWIS AND THE CITY OF SOUTH BURLINGTON, 1301 SHELBURNE ROAD
The applicant requests approval of this two lot subdivision. It
is zoned C-2. The parcel is 2.6 acres and will be subdivided
into .5 acres and 2.1 acres. The non -conforming lot received a
well publicized variance from the Zoning Board. The lot is the
proposed site of a fire substation. The City will be constructing
a road into the back of the Lewis property as part of the purchase
agreement.
4) ADAMS, 1215 AIRPORT PARKWAY
The applicant proposes to construct a 3920 square foot addition
to the existing building at 1215 Airport Parkway. It will be
built to serve his present welding business and will not result
in new employees.
Access and Circulation: Access will remain from the 24 foot
driveway. Circulation is adequate if the parking lot is used
as shown on the plan.
Parking: Eleven spaces are required. The applicant proposes 15
in the gravelled parking lot. Parking should be restricted to
this area only.
Landscaping: A $1100 landscaping plan is shown as required. A
bond shall be posted prior to permit. A stockade fence along
the western side and -front of the property screens the parking/
storage area. A rail fence exists on the eastern side and front
of the property. The rear of the property drops off steeply.

4) FOXCROFT (CARDINAL WOODS EXTENSION), O'BRIEN
The applicant proposes to subdivide the approved 107 unit project
into 4 lots. Lot #1 consists of 24 multi -family units and 4
single-family and is 3.32 acres. Lot #2 consists of 6 multi-
family units and is 3.09 acres; lot #3 is 3.80 acres with 16
multi -family units and lot #4 is 14.75 acres with 57 single-family
units, for a total of 46 multi -family and 61 single-family dwell-
ings as originally approved.
Legal documents must be filed with private street maintenance
clauses. There shall be no increase in density on any of these
lots.
5) VERMONT FEDERAL BANK, INDIAN CREEK
The applicant proposes to relocate Cluster one from a location
on the southern side of the entrance road, 350 from.Dorset
Street to a rlew location south of the newly constructed
Cluster 3. Cluster One is ten units.
The recreational vehicle area must be relocated since a new
driveway crosses it. The new layout meets the same standards
for parking, setbacks, etc. as the original approval and preserves
the aesthetic appeal of the entrance to the development.
6) MARK HILL INVESTMENTS, 5 GREEN MOUNTAIN DRIVE
The applicant proposes to construct anll,250 square foot addition
to the 3600 square foot existing building (Mienke Muffler) and a
new 11,925 square foot building on the 90,000 square foot lot.
The proposed use is automotive parts, repair sales and service
or storage and distribution facilities. These received conditional
use approval from the ZBA. The property is zoned C-2 and is at
the southwest corner of"Green Mountain Drive next to Racine AMC/
Jeep.
Access and Circulation: Access to the expanded building is from
an existing 24 foot wide driveway and a new 24 foot wide driveway
