orfce on the outlet structure are 486,64 s The average elevation of the

the invert of the inlet pipes in the northeast area of the basin are 487.01 _.
The outlet structure's rim/grata elevation is 489.751.
12. The Ridgewood Pond was originally built during the construction of the
Ridgewood Estales The 2010 modification to the outlet structure included
the addition of a 3-inch orifice at elevation 509, 10 The horizontal opening
of the existing 36-inch RCP outlet pipe Is at elevation 510.55. A 42-inch
metal hood and grate were placed over the 36 inch RCP and secured in
place over the RCP with metal rods approximately 0 4 feet above the
horizontal opening at the top of the existing 36-inch RCP. The elevations
of the orifice, horizontal opening and top of hood were obtained in the
2010 survey and adjusted to match the 2006 assumed datum from
Benchmark Ni.
13. St.-Irr mno0 heatment facilities shall be accessed by private 12-foot
wide gravel access roadways located within 20-foot access easements to
the City of South Burlington.
14, Rim and invert elevations for catch basins from 2010 survey adjusted to
the 2006 assumed datum. Elevations listed for CB through CBS were
calculated using the elevation data for the existing sanitary pump station
hatch cover. Elevations recorded for CB7 and CB8 were adjusted to the
2006 assumetl datum using the elevation data for Bench Mark #2.

13. Stormwater runoff treatment facilities shall be accessed by private 12-foot
wide gravel access roadways located within 20-foot access easements to
the City of South Burlington.
14. Rim and invert elevations for catch basins from 2010 survey adjusted to
the 2006 assumed datum. Elevations listed for CB1 through CBS were
calculated using the elevation data for the existing sanitary pump station
hatch cover. Elevations recorded for CB7 and CBS were adjusted to the
2006 assumed datum using the elevation data for Bench Mark #2.

NOW COMES Daniel S. Connelly (the "Appellant"), for himself, pursuant to 10 V.S.A. §8504(a) and
V.R.E.C.P. 5(b)(1), and hereby appeals to the Environmental Court a March 16, 2010 decision of the
Vermont Agency of Natural Resources (NOI #6285-9030) approving Ridgewood Estates and Indian
Creek Homeowners Associations' joint application for stormwater permit coverage for two properties,
separately listed by Agency for residual designation as point source discharges regulated under
federal Clean Water Act NPDES program, located at NW corner of Dorset and Swift Streets, South
Burlington, Vermont,
The Appellant claims standing and party status as an aggrieved person under 27 VSA §1304 as
owner of apartment number 15 of condominium property named Indian Creek Condominiums, with
obligations for common expenses including permit enforcement penalties and corrective actions. The
terms of this permit may adversely affect the Appellant's financial interests in this property due to
stormwater discharges from Ridgewood Estates being cause for permit enforcement against Indian
Creek; and, also, due to loss of protections for Indian Creek as a unitary designated discharger and as
offset provider for impaired waters under 10 VSA §1264(f)(4,5), under 10 VSA §1264a(c)(1,2),(d)
(1,2,3),(e)(1,2,3,4) and under federal Clean Water Act as held in 426 US 200 (1976), in 2006 VT 91
and in Vtec Judgment Order (Doc #14-1-07, 2008).
Interested parties may enter an appearance in writing within 20 days at the Vermont Environmental
Court, 2418 Airport Road, Suite 1, Barre, Vermont 05641.

lot subdivision. The amendment consists of a boundary line adjustment

Mr. Llewellyn recalled that last year the Shea property was subdivided into 4 lots. They
are now asking for a boundary line adjustment between lot #4 and the lot with the Shea
house. The adjustment would extend the boundary line of lot #4 by .33 acres to 1.05
acres and would decrease the Shea lot by .33 acres to 6.67 acres.
Mr. Belair said staff has no issues with the request.

5. Miscellaneous Application #MS-06-06 of Ridgewood and Indian Creek
Homeowners Associations to alter the existing grades by constructing
three stormwater ponds and the rehabilitation of an existing pond,
Ridgewood Drive and 911 Dorset Street:
Mr. Conway told the Board that the engineers have said that this is what they need to do
to get their stormwater permits renewed. He then showed pictures of the proposed ponds.
Mr. Dinklage asked if there is any erosion today from the existing ponds. Mr. Conway
said there is not. He added that they have met with the Stormwater Superintendent and
there do not seem to be any issues. Ms. LaRose said Mr. DiPietro will look at the plans,
but he didn't anticipate any problems.
Ms. Quimby moved to approve Miscellaneous Application #MS-06-06 of Ridgewood
and Indian_ Creek Homeowners Associations subject to the stipulations in the draft
motion. Mr. Farley seconded. Motion passed unanimously.

The applicant, Ridgewood and Indian Creek Homeowners Association, is seeking
miscellaneous approval to alter the existing grades by constructing three (3) stormwater ponds
and the rehabilitation of an existing pond, Ridgewood Drive and 911 Dorset Street.
This application shall be reviewed under Section 3.12 of the Land Development Regulations.
The removal from land or the placing on land of fill, gravel, sand, loam, topsoil, or other
similar material in an amount equal to or greater than twenty (20) cubic yards, except when
incidental to or in connection with the construction of a structure on the same lot, shall
require the approval of the Development Review Board. The Development Review Board
may grant such approval where such modification is requested in connection with the
approval of a site plan, planned unit development or subdivision plat. This section does not
apply to the removal of earth products in connection with a resource extraction operation.
Standards and Conditions for Approval:
(1) The Development Review Board shall review a request under this Section for
compliance with the standards contained in this sub -Section 3.12(B). An application under
Section 3.12(A) above shall include the submittal of a site plan, planned unit development
or subdivision plat application showing the area to be filled or removed, and the existing
grade and proposed grade created by removal or addition of material.
Agenda # 5
The applicant submitted a plan, containing one (1) sheet showing the removal of the fill and
subsequent regarding on the subject property. This plan is sufficient to satisfy this
requirement.
(2) The Development Review Board, in granting approval may impose any conditions it
deems necessary, including, but not limited to, the following:
(a) Duration or phasing of the permit for any length of time.
Staff does not feel this requirement is applicable to the subject application.
(b) Submission of an acceptable plan for the rehabilitation of the site at the conclusion
of the operations, including grading, seeding and planting fencing drainage, and
other appropriate measures.
The applicant is proposing to install three (3) stormwater management ponds. The
South Burlington Stormwater Superintendent has been working with the applicant to
review the plans and will continue to do so. Staff finds it sufficient to grant approval
of this application conditional upon the satisfaction of the Stormwater Superintendent.
(c) Provision of a suitable bond or other security adequate to assure compliance with
the provisions of this Section.
Staff does not feel this requirement will be necessary for the subject application.
(d) Determination of what shall constitute pre -construction grade under Section 3.07,
Height of Structures.
The pre -construction height for future development will be the existing grade.
Other:
The South Burlington Stormwater Superintendent has been working with the applicant to
review the plans and will continue to do so.
1. The applicant must comply with all requests of the South Burlington Stormwater
Superintendent and shall meet with his approval prior to the issuance of a zoning permit.
Staff recommends that the DRB approve miscellaneous application #MS-06-06 subject to the
applicant addressing the numbered items above.

In order to move into compliance with stormwater regulations. the residents of Ridgewood
Estates and Indian Creek Condominiums have elected to construct stormwater structures in
conformance with the South Burlington Stormwater Utility's standards. The enclosed site
plans show the three stormwater structures to be constructed: one wet pond and two dry
basins. In addition to these, the existing pond to the west of Lexington Green (Ridgewood)
will be modified to order to meet the new stormwater criteria. Other, more minor
improvements will be made to the areas as well. These improvements include the cleaning
of Ridgewood's catch basins, the repair/re-grading of Indian Greek's swales, and repair of
Indian Creek's culverts
The new ponds will be constructed in Class 3 wetlands (delineated by Cathy O'Brien), and
we are working with the US Army Corps of Engineers to answer the questions they have
regarding the wetland impacts of this project.
Since the project is moving more than 20 cubic yards of material, the project requires a
Miscellaneous DRB permit. Enclosed with this letter are six sets of site plans (including one
reduced set), an application for the DRB, and an $85 application fee. We are eager to
complete this project as soon as possible. Plcase schedule us for the first available hearing.

Vegetation Plan
Vegetation is recognized as the best erosion control device, and existing
vegetative cover will be conserved wherever possible. All disturbed areas that
will be mulched and seeded as soon as practicable. A mix of Tall Fescue
(applied at 20 lbs./sae), Creeping Red Fescue (20 lbs./acre) and Birdsfoot
Trefoil (8 lbs./acre) will be used to establish a permanent vegetative cover in
drainage swoles. In the stormwuter ponds and basins, a seed mix of wetland
plants (New England Wetmix by New England Wetland Plants, Inc. ((413)
548-8000) er approved equal) shall be used
Either compost or fertilizer must be used. Compost may be applied at o rate
of two (2) tons per acre. If the contractor selects fertilizer, soil samples
must be taken In order to determine the correct formulation (nitrogen,
phosphorus, and potassium content) for the site. Soil samples will be taken
of a frequency o1 I sample per 5 acres, and submitted to the UVM extension
office for analysis. With this information, a suitable blend of fertilizer can then
be chosen.
Mulching will consist of erosion control matting, such as North American Green
SC150BN (or approved equal) to ensure soil stability in these high -flow areas.

If soil disturbance activities ore not expected to occur in on area for one
week, cover (i.e.. erosion control blankets) shall be provided. If soil
