MANSFIELD, INC. and its successors and assigns have in, and to a certain piece or parcel of land located in the City of South Burlington in the County of Chittenden and State of Vermont, described as follows, viz: Being a strip of land for purposes of a public street, shown as "Queensbury Road" on a Plan entitled "Plat of Subdivision of Lands of Vincent and Marcina Morin For O'Brien Brothers Agency, Inc." dated November, 1989, revised February 27, 1991, prepared by FitzPatrick- Llewellyn, Incorporated and recorded in Plat Volume 275, Page 90 of the City of South Burlington Land Records. Being a portion of the lands and premises conveyed to S.D. Mansfield, Inc. by Warranty Deed of O'Brien Brothers Agency, Inc. dated July 8, 1994, and recorded in Volume 366, Pages 36-37 of the City of South Burlington Land Records. Included in this conveyance are all water lines, sewer lines, stormwater collection system and the respective valves, connections, pipes and appurtenances related to said water lines, sewer lines and stormwater system located under or within the above described strip of land (the "Improvements"), together with all existing curbing and sidewalks. This deed shall act as a Bill of Sale with respect to said Improvements, and the Grantor does hereby transfer and convey to Grantee all of its right, title and interest in and to the Improvements. Reference is hereby made to the aforementioned instruments, the records thereof and the references therein contained, all in further aid of this description. TO HAVE AND TO HOLD all right, title and interest in and to said quit -claimed premises, with the appurtenances thereof, to the said Grantee, CITY OF SOUTH BURLINGTON, and its successors and assigns forever. Mansfield, Inc., upon completion, we request approval to add a 400 SF Community Room to the duplex to be constructed on Lot 9. LCHDC has represented to us that the space will be used as follows: Business meeting of the cooperative. These meetings are typically 6-9 persons involved in various co-op committees (legal/finance committee, maintenence/on-call committee, membership committee) and will be held primarily in the late afternoon or evening hours. Meetings with potential new members of the cooperative and orientation to the coop when units become vacant. These meetings would be held as needed during the daytime or early evening. It will be used solely by the coop residents who will walk from their respective units. It is my understanding from talking to you, that the scope of review of this application will be narrowed only to Lot 9 even though, to be approved, the entire subdivision may have to be upgraded to a PRD, and that this application will not trigger a reopening of the review of the project as previously approved. However, I do understand that the Commission can attach conditions to the approval which it deems appropriate and that if such conditions are unacceptable to us we can elect to abandon the application and proceed with the project as originally permitted. Burgess and Sheahan rejoined the Commission. 4. Sketch Plan application of S.D. Mansfield, Inc., to: 1)desig- nate lots 1-16 of an approved 18-lot subdivision as a planned unit development and 2) add 400 sq. ft. of neighborhood community meeting space to an approved duplex on lot #9 as an accessory use to the residential planned unit development, Kirby Rd. and Patchen Rd: Mr. Crow stepped down due to conflicting interests. Mr. Farrell said there are 9 duplex lots and 7 single family lots. The duplex lots are organized as a co-op. The 400 sq. ft. of additional space will serve as community space. It will be on the first floor with a separate access. No parking will be required as the space will be for use of those living in the development. Meetings and small social events (kids birthday parties) will be held in the community space. Mr. Weith said he is comfortable with the plan. Mr. Sheahan asked if the space would be rented to outsiders. Mr. Farrell said it would not. Members had no problems with the project. Mr. Crow rejoined the Commission. 5. Sketch plan application of James Harvell to subdivide a 67,095 sq. ft. lot into three lots of 22,584 sq. ft., 25,093 sq. ft., and 19,418 sq. ft., 1907-9, 1915-17 and 1923-25 Airport Parkway: Mr. Harvell said the land is owned by Marion Dumont and Lori ,pachmen. It is shown as 3 lots on the tax map. When the owners wanted to sell lot #2, they found the land had not been subdivided. There will be individual driveways for the properties. MOTION OF APPROVAL S.D. MANSFIELD. INC. I move the South Burlington Planning Commission approve the revised final plat application of S.D. Mansfield, Inc, to amend an approved 18 lot subdivision located at Kirby and Patchen Roads. The amendment consists of: 1) designate lots #1-16 as a planned unit development and, 2) add 400 square feet of neighborhood community meeting space to an approved duplex on lot #9, as depicted on a plan entitled "Kirby/Patchen Road, South Burlington, Vermont, Site & Utilities Plan, Final Plat" prepared by Fitzpatrick -Llewellyn, Inc., dated April, 1989, with a last revision date of 2/28/91, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The Planning Commission approves a sewer allocation of 150 gpd for the neighborhood community meeting space. The applicant shall pay the per gallon fee prior to the issuance of a zoning/building permit. 3. The use of the community meeting space shall 'only be for resident/co-op related functions. 4. The applicant shall submit for review and approval by the City Attorney a "Notice of Condition" which clearly identifies and legally ties together lots #1-16 as a PUD for planning, zoning and subdivision purposes. The applicant shall also submit for review and approval by the City Attorney a "Notice of Amendment of Subdivision Approval & Declaration of PUD approval". The sketch plan was reviewed on 9/20/94 (minutes not available). This subdivision located at the corner of Patchen Road and Kirby Road behind the existing residences on both streets lies within the R4 District. The proposed meeting space will be used as follows: --- business meetings of the cooperative. Mrs. Maher expressed concern for the safety of the pond and recommended a playground instead. Mr. Milot said the interior roads would be 24 ft., private roads. They would prefer no curbs or sidewalks. Ms. Peacock said she was not sure she liked private roads for so many units. Mr. Craig also felt the number of units was a concern. Mr. Milot said they would consider looping the road and would not allow parking on the road. Mr. Craig felt that looping was a must. Mr. Weith agreed and didn't feel a private road was a concern. Ms. Pugh agreed with Ms. Peacock. Mrs. Maher would go for a private road if it were looped. Mr. Weith noted the possibility of a connector from Laurel Hill to the potential Southern Connector. David White of Pomerleau felt there should be right of way on the property line between the Milot and Pomerleau properties. Mr. Milot suggested putting it in the buffer parallel to the private road and that the buffer be deeded to the City. Mr. Jacob then asked about density. Mr. Weith said the regulations are not clear on density with mixed residential and commercial uses. The regs say 7 per acre for the residential, but the commercial is calculated by lot cov- erage. Mr. Milot asked if it would be OK to take the total site and apply the R-7 coverage and commercial coverage and don't exceed that. Mr. Craig noted that would be using the open space to calculate lot coverage for the commercial. Mrs. Maher asked Mr. Weith to find out how density on the Deslauriers Dorset St. property was calculated. Mr. Weith noted that he will also need to know exactly which property is involved. Mr. Milot will provide this information. Ms. Pugh asked that Natural Resources look at this plan as well. 3. Final Plat application of O'Brien Brothers Agency, Inc, for subdivision of a 10.84 acre parcel into 18 lots and con- struction ofa 4-unit residential building on one of the newl created lots (lots 17), Kirby Rd. and Patchen Rd. Mr. D'Elia said the plan now shows 2 trees per lot. The footprint of the single family house is shown on p.2. The additional inlets will be added and shown on the plan, and the street will be named. Mr. Szymanski has suggested a 20 ft. easement to connect to it in case the city ever wants to build a bridge to that area. Mr. Earley noted that the O'Brien surveyors moved the markers and changed his property line. He also wanted to see the area remain single family or duplex housing, not multi -units. Mr. Earley noted they have paid taxes for 20 years based on the old property line, and if the new marker is right, they have been overtaxed. Mr. Jacob noted the road is incorrectly marked as 22 ft. Mr. D'Elia said it should be 24 ft. and will be so changed. Mr. Szymanski has asked for a temporary construction easement on lot #17. Mr. D'Elia said this will be provided. A poll of meml—s showed that a majority wanted the Patchen Rd. sidewalk fee to -include Lot 18, even though the de- veloper is not retaining this lot. Ms. Peacock then moved the Planning Commission approve the Final Plat application of O'Brien Brothers Agency, Inc, for subdivision of a 10.84 acre parcelinto 18 lots and construction of a 4-unit residential building on one of the newly created lots (lot 17) as depicted on a 6 page set of plans titled "Kirby/Patchen Road, Site & Utilities Plan," prepared by Fitzpatrick -Llewellyn. Inc, and dated April, 1989, last revised 7/18/89, with the following stipulations: 1. The applicant shall post a $28,260, 3-year landscaping bond prior to permit. Of the total $28,260 bond, $14,190 is for street trees. $7,920 is for lot trees, and $6,150 is for the 4 unit building lot (lot 17) Street trees shall be Planted at least 4 feet from the edge of curb 2. The applicant shall pay a $200 per unit recreation fee prior to permit. 3. The length of time that this sewer allocation will remain in effect is tied to roadway consruction. The roadways in the development must be completed within 10 years. No changes proposed. Sidewalk: The applicant is required to contribute $26,738 to the Hinesburg Road sidewalk fund. No changes proposed. Landscaping: The applicant was previously required to post a landscaping bond for the street trees and berm landscaping. The elimination of Malcolm Lane has reduced the value of street trees to $29,050. The berm landscaping remains at $14,716 for a combined total of $43,766. Buffer strip: Section 16.303 of the zoning regulations establishes an open space buffer strip, 200 feet in width, along Hinesburg Road. This buffer strip must be kept free of buildings, structures, parking facilities and access drives. Approximately one half of lot #10 lies within this buffer strip. These meetings are typically 6-9 persons involved in various co-op committees (legal/finance committee, maintenance/on-call committee, membership committee) and will be held primarily in the late afternoon or evening hours. --- meetings with potential new members of the cooperative and orientation to the co-op when units become vacant. These meetings would be held in the late afternoon or evening hours. --- social events such as children's birthday parties, potluck suppers, scheduled through the co-op. These activities would be limited to a maximum of 20 persons, and held primarily on weekend days or evenings. All activities would end by 11:00 P.M. --- storage of community equipment and records. The use of this equipment would be on an as needed basis by the co-op Board of Directors or authorized members of the co-op. Parking: Applicant has indicated that no additional parking is needed because the room will be used solely by the residents who will walk from their homes. This lot is currently developed with three (3) duplex residential buildings. The purpose of the subdivision is to set-off a lot for each duplex. The Zoning Board of Adjustment on September 26, 1994 will consider a variance request from the applicant to allow the creation of lots which do not meet the minimum area and frontage requirements. This property located at 1907-1909, 1915-1917 and 1923-1925 Airport Parkway lies within the IC District. It is bounded on the south by a single family dwelling, on the east by Airport Parkway, on the north by a single family dwelling and on the west by undeveloped property. Access: Each duplex has its own driveway on Airport Parkway. These driveways should be shown on the final plat. Setbacks:; It does not appear that the building on lot #1 will meet the 15 foot side setback requirement from the proposed northerly boundary line. Applicant should either obtain a variance or certify that this setback requirement will be met. Lot size/frontage: The minimum lot size in this district is 40,000 square feet. This minimum lot size is not being met. The applicant is scheduled to appear before the Zoning Board of Adjustment on September 26, 1994 seeking a variance to allow lots smaller than the minimum requirement. The minimum frontage requirement of 200 feet is not being met. Relief from this requirement is also being requested from the Zoning Board of Adjustment. Topics to be discussed include a possible waiver of the stipulated $11,745 sidewalk construction fee: Ms. Wright explained the background of the request. Their problem is that funding sources have asked what South Burlington can do for the developers in the way of fee waivers. She noted that in exchange for this they are willing to give a bike path easement. Ms. Wright felt this might make the difference be- tween them getting the grant or not getting it. Mrs. Maher said she had no problem with the request. Other members felt the City Council should be consulted to see if they had any strong feelings as this is a matter of money. They agreed to ask that the item be put on the next Council agenda. The proposed development involves approximately 7.5 acres. Sketch plan application of O'Brien Brothers Agency, Inc, for 1) subdivision of a 10.84 acre parcel into 16 single family residential lots and 1 multi -family residential lot (17 lots total) and 2) construction of a 4-unit multi -family dwelling on the 123,000 sq. ft. multi -family lot, Kirby and Patchen Rds Mr. D'Elia noted the correct total should be 181ots. The 18th lots is on the corner and will be retained by Mr. Morin, prior owner of the whole acreage. The development will retain the single family look of the area. City sewer and water will be used. He reviewed the contours briefly. Multi -family units will have garages and an additional 5 parking spaces probided. Members noted that there can be only 3 units off a private drive, not 4. Question of the right-of-way arose as it is only 50 ft. in certain locations and should be 60 ft. Members were concerned with this as it will be substandard. Other problems noted included: Lots 5, 6, and 16 which do not meet the minimum frontage; omission of the CO Zone from the plan; concern with visibility on Patchen Rd. due to location of one house. Mr. Craig asked that Natural Resources look at the plan because of the pond. Mrs. Hayes noted the presence of toxic chemicals from airport runoff in the pond and the danger of continued exposure to the fumes. Mr. Belter felt the major problem was the easement going onto Kirby Rd. This rubs up against one house. There is also a re- quirement that utilities be outside the easement and this couldn't be done without going through a house. The easement is also only 50 ft. which is below the 60 ft. standard. Mr. Craig noted that this would also put the sidewalk right up against the house. Mr. Bramley, adjacent property owner, said the surveying is not right. He said he has a 70' frontage and the markers are at 67 feet. If they are placed correctly, there won't be even a 50 ft. right of way. Mrs. Maher felt the sidewalk was not mandatory, but residents and other members felt it was as this is a walking school area. Mr. Craig also noted the curve of the road near units 5 and 6 is also substandard. PLANNING COMMISSION 21 FEBRUARY 1989 page 3 Mr. Belter felt the development could be reconfigured with a cul de sac. The applicant felt the City Engineer preferred a through road, but Mr. Weith said this wasn't necessarily the case. Mr. Jacob suggested all utilities could come in on the easterly most ingress/egress. Members felt regulations did not give them the right to waive the 80 foot frontage requirement. Mr. Jacob asked for an interpre- tation of that. Mr. O'Brien said the problem is that variances had been granted to allow adjacent owners to build additions up to the property lines adjacent to this property without taking into account the right- of-way. Mr. Craig felt that Section 18.102 of the Zoning Reg- ulations should be amended to include the wording "..or a right- of-way that may become a street." Residents and Commission members liked the single family home approach. 4. Discussion with Joe Ingram regarding a proposed amendment to the South Burlington Zoning Regulations to move the Commercial-1 Zone boundary on the Lindenwood Motel poperty 65 feet eastward Mr. Ingram noted this is one property with the zone line going through it. Theywould like to make the zoning uniform on the property. No particular ' -use is -presently planned. If the land were commercial, it would require a 15 foot buffer and a 50 foot setback from the residential area adjacent to it. Members had no objection to warning a public hearing for a possible zone change. Ms. Pugh asked that the applicant come prepared to say what type of development could go on the land if it were all Commercial (building height, size, uses, etc.). 5. Review draft #1 of the proposed amendment to Article 17 of the South Burlington Zoning Regulations to establish a City Center Traffic Overlay Zone Mr. Weith noted Mr. Farrar has concerns with traffic in the City Center Zone and feels it should be controlled until it can be de- termined what is to be done there. There is also a concern with fairness as one or 2 developers could use up all the traffic capacity allowed and other landowners could then not build. Mr. Weith was asked to come up with a plan that would give everyone a fair shot. Prior to being placed in operation for domestic use, all new portions of the system shall be flushed, pressure tested, disinfected and flushed again. Following this procedure, at least two samples must be collected (in our sample bottles), from representative sample points, and sent to our laboratory at 195 Colchester Avenue, Burlington, VT 05401 for Bacteriological Examination of Public Water Supply and indicate on the form that it is for a new system awaiting approval. Discussion of Proposed Kirby Heights Affordable Housing Pro- ject; Consideration of Letter of Intent and Scheduling of Public Hearing: Mr. Flaherty said that no action would be taken at this meeting. There will be a warned public hearing at which time the Council would make the decision. The proposed letter of intent will only indicate that the city is considering the proposal. Mr. Sassorossi of the Lake Champlain Housing Development Corp. explained that they are a non-profit corporation with 15 employees. The previously did a 5-unit development in Shelburne and projects at Fort Ethan Allen. He said theytry to tailor their projects to the community. Amy Wright then noted that in the past they have been shut out of South Burlington by the cost of development. This summer, however, they were offered a development which already has all of its city approvals. The property is located between Kirby and Patchen Roads and is tentatively called Kirby Heights. The de- velopment would consist of 7 single family home lots and duplex units facing the beaver pond area. These would be 2-story, 1,000 sq. ft. units. The single family homes would be 1200 sq. ft., cape styie. Financing sources are mixed and include owner equity, Vermont Housing Finance Agency, the Howard Bank, Vermont Housing and Conservation Board (state funds). The project is also a first alternate for a $150,000 grant. Some restrictions would apply to the development. Some units must be affordable on a perpetual basis for families with incomes between $15,000 and $35,000. Ms. Wright stressed that they are concerned with the long range upkeep of the buildings. She said they need the city's support to help get additional funding sources. Ms. Torpy of the Land Trust said that South Burlington is a good community in which to raise families. She showed the proposed design of the single family homes which would be 3 bedroom, 1-1/2 baths with full basements. The homes would be energy efficient. She estimated the average annual income of residents at about $23,000. She also noted that one home would be completely handi- capped accessible. Mr. Flaherty explained that the city is being asked to apply for $350,000 in grant money which would be used in this project. Mr. Dinklage asked if residents would be taxed as other property owners are. Ms. Wright said they would. She added that proposed residents are interviewed for their potential as good neighbors. Any subletting of units would require that sublettors go through the same process. The development must abide by fair housing N CITY COUNCIL 15 November 1993 page 3 rules and standards. Mr. Dinklage asked what happens if a resident defaults or tears up a unit. Mr. Mahnke said they can be evicted if they don't pay or if they cause a disturbance. He said the coop can take care of minor damages and there are trusts for damages and vacancy reserves. Credit checks are done for all applicants. Mr. Dinklage asked the City Manager to research the city's liability under various circumstances. Mr. Chittenden asked how long the city would be involved. Mr. Griffin said the longest period is 2 years. Then the grant is closed out and an audit is performed. Mr. Flaherty then asked for comments from the public. Mr. Sharp asked why the O'Briens aren't building the project as originally planned. Mr. Hafter said Mr. Sharp would have to ask the O'Briens directly. Another resident asked if the city is being pressured to do this. Mr. Dinklage said it has long been part of the city plan to provide for affordable housing. Other residents expressed concern with reduced property values and with the style of the proposed homes. Ms. Torpy said they are open to consider other styles. Mr. Bergangy asked if there is a landscaping plan along property lines so the lots are individual. Ms. Wright said there is some fencing required and stressed they are concerned with the property looking good. They are hoping to save as many trees as possible and there is a line item for additional landscaping. Mr. Hafter added that 3% of the cost has to go into landscaping and this provision has not been waived. Mr. Flaherty suggested neighbors meet with developers to discuss matters such as these. Mr. Kemp then explained how the Flynn Avenue coop works and noted these are co-ops, not "projects." Mr. Mahnke noted that the turnover rate is much lower than in rental housing. Ms. Wright said a public hearing must be held before 12/8 because of the funding requirements. She said an architect and builder can be present at the hearing. Mr. O`Brien noted the entire piece of the Oak Creek land was part of the subdivision and they developed the whole piece of land. He said O-Briens have no interest or title to the corner piece of land and there is a pre-existing house that is being retained by the owner. Mrs. Maher felt that when the corner lot comes in for re- development, that developer should pay for the sidewalk. She said she understood the other side of the argument as well. Mr. Burgess said there is a need for a sidewalk to run the whole frontage because there will be 20 new homes. Mr. O'Brien said they are building a sidewalk through the de- velopment. Mr. Weith said there is no clear written policy on this. Mr. Burgess said he felt in principle that Mr. Weith was right and the Commission had to be consistent. He wanted the side- walk. On the issue of the pond, the City Engineer wants the pond for the City and so suggests 1.5 or 1.6 acres be dedicated with the balance made up for in recreation fees. Mr. Jacob said the REcreation Dept. people could see no need for that land in their plans. Before a vote was taken on either issue, the applicant asked to withdraw his application. 7. Discuss proposed amendment to Section 18.113 "Minimum size of Dwelling Units" of the South Burlington Zoning Regulations Mr. Weith noted the Commission had voted to go back to the original wording instead of the proposed revised wording. The Council has questions on this and doesn't like either wording. Mr. Burgess noted the language was to allow for the possibility of a "mother-in-law" apartment. Mr. Weith said a bad effect was to double the minimum size of apartment units. Mr. Burgess said this was intentional. The Planning Commission does not have the authority to approve subdivisions which do riot meet minimum zoning requirements. City Attorney, Steve Stitzel, concurs with this. Section 19.20 of the zoning regulations however allows approval of lots with no road frontage. I will check with Steve Stitzel to see if this can be applied to this case. The multi -family lot is an irregularly shaped lot with an unusable "dog leg" extending to the northeast. This "dog leg" should be dedicated to the City or made part of lot 9. Traffic: The proposed subdivision will generate 19 peak hour trips ends assuming single-family homes and one 4-unit building. Open Space/recreation: No recreation or common space is proposed to be dedicated to the City. The Planning Commission may require 15% of the land donated or a $200 per unit fee. Landscaping: The plan proposes 2 1/2 - 3" Littleleaf Linden for street trees along the new road. City policy requires 2 addi- tional trees per lot. A typical detail for these lot trees should be included (see Belter's White Rock Point). I would recommend a mixture of evergreen and deciduous. Sidewalk: The Planning Commission should decide whether or not to require payment to the sidewalk fund for frontage on Patchen Road. Other: Several of the adjoining property owners to the north are not properly shown. This single- family residence should be shown on the plan. Density: In my last memo, I indicated that the maximum density range for this parcel is 6 to 11 units. The lower end was calculated by subtracting out undevelopable areas (i.e., excessively steep slopes, wet areas, conservation zone, etc.) and then multiplying by 4. I have discovered that subtracting of undevelopable areas to calculate density is only under the Planned Unit Development Section of the ordinance. Since this is not a PUD (multi -family is a permitted use in R-4 District), density is figured by multiplying total acreage by maximum densi- ty of 4 units per acre. Therefore, maximum density for this parcel is 11 units. Access/Circulation: The project will be accessed by a 22 foot wide private driveway off Patchen Road. The driveway is approximately 120 feet long and leads to a parking area in front of the building. Parking: The project requires 9 parking spaces. The plan shows 5 uncovered spaces in front of the building and a 4 or 5 space garage. landscaping: The 4-unit building requires $6,150 in new landscaping based on a building construction cost of $205,000. The landscaping plan for this parcel shows Austrian Pine, White birch , crabapple, honey locust, juniper and cotoneaster which is valued at $5,500. The Natural Resources Committee is concerned with potential erosion caused by construction of the 4-unit building and access drive and subsequent runoff from the site. Sufficient erosion control should be administered during construction. This is a requirement of Act 250. 3) PARKING LOT EXPANSION. AL'S FRENCH FRIES William and Lee Bissonette propose to expand the parking lot at Al's French Fries by 11 space. The location of the proposed expansion is in the rear of the property. The property is bounded on the south by Midas Muffler, on the west by school property, on the north by Williston Road and on the east by a private road serving the Commerce Square develop- ment and Midas. Access: Access will remain from the 22 foot wide driveway on Williston Road and the 45 foot wide curb cut on the road to the east. Circulation: Circulation will remain on the east and south sides of the building through the parking lot. Circulation is ade- quate. Minimum aisle widths are not being met for the southernmost rows of parking. Minimum aisle widths are 22 feet for single rows of parking and 24 feet in width serving double rows of parking. The plan shows 20 foot wide aisle widths. Building: No changes are proposed for the building. Sidewalks/curbs: The applicant is proposing to install sidewalks and curbing along the road to the east of the property. Coverage: The proposed coverage on the property is 73% (maximum 70% allowed). The applicant applied for a coverage variance last fall and was denied. The applicant is proposing to lease land (file a land use agreement) from the property owner to the east (Midas) in order to meet his coverage requirements. Leasing the land between the road and A1's east property line would result in a coverage of 67%. However, it is City Attorney Steve Stitzel's opinion that this is not legal because this strip of land is already being used for the Midas sign. 4 Memorandum - Planning May 30, 1989 agenda items May 26, 1989 Page 4 5) SUNMKERWOODS, PATCHEN ROAD Chip Hart is requesting to amend the approval motion (stipulation #5) for Summerwoods to allow installation of the "Roadway" light fixture provided by Green Mountain Power Corporation. The last sentence in stipulation #5 reads, "A downcast luminere which costs no more to operate than the Town and Country light shall be installed". The City has since discovered that there is no such downcast light fixture available which costs the same to operate as the Town and Country. This whole lighting/cost issue arose out of the Act 250 hearings on the Butler Farms application. The first Act 250 permit issued stipulated that a "downcast" street light must be used. The City appealed this ruling because the downcast fixture recommended by Act 250 costs $33.33 per light per month to operate compared to $7.70 per light per month for the Town and Country. The City and Act 250 were able to settle on GMP's "Roadway" fixture which is a downcast light and costs $10.29 per light per month to operate. This is now the light that both the City and Act 250 will be recommending for street lighting. I informed the applicant that this is just a housekeeping matter and, therefore, it is not necessary for them to be present at Tuesday's meeting. 6) O'BRIEN BROTHERS, KIRBY AND PATCHEN ROAD O'Brien Brothers ent to the Pre- liminary Plat approval for the 18 lot subdivision on Kirby and Patchen Roads (See enclosed letter). The applicant requests the following: 1) that the pond area be dedicated to the City in lieu of paying the $200 per unit recreation fee, and 2) that lot 18 be omitted in the calculations for the sidewalk fee. These requests are discussed below: Land Dedication: This request would affect stipulation #2 which reads, "The applicant shall pay a $200 per unit recreaton fee prior to permit." The subdivision regulations require a dedication of 15% of the land in lieu of paying the recreation fee. 15% of the entire 10.84 acres is 1.6 acres. The area proposed to be dedicated encompasses approximately 1.4 acres. The remainder should be made up in fee or additional land dedicated to meet the 1.6 4 acres. The exact area to be dedicated has not been identified by the applicant. Another consideration will be to make sure the Memorandum - Planning May 30, 1989 agenda items May 26, 1989 Page 5 multi -family lot meets density requirements if this lot is re- duced in size due to the dedication. The details of this issue will be worked out once the applicant defines the exact area to be dedicated. At this point, however, the applicant wants to know if the Commission is receptive to this concept of dedicating land in lieu of the fee. I shall meet with Bruce O'Neill before the meeting to get his input. Sidewalk fee: As explained in the letter, the applicant feels that lot 18 (the existing home) should be omitted from the calcu- lations of the sidewalk fee. Omitting this lot from the frontage calculations on Patchen Road would decrease the sidewalk fee from $11,745 to $7,305 (by the way, the fee would decrease even fur- ther with the dedication of the pond area to the City). Since there is no clear policy on the City's sidewalk fund, I feel the Commission can decide either way on how much frontage to include in the fee calculation. However, based on past practice (Oak Creek Village is the only other subdivision assessed a sidewalk fee), the entire frontage along the roadway in question was used in calculating the fee. 7) IBIS CORPORATION. BOUNDARY ADJUSTMENT Attorney Robert Perry will be present at Tuesday's meeting to discuss the IBIS Corporation subdivision application. 8) PROPOSED AMENDMENT TO SECTION 18.113 Section 18.113 "Maximum Size of Dwelling Units" currently reads: "Minimum floor area, excluding unfinished basements and attics, porches, garage, and other space not customarily used for living space, shall be 425 square feet for a one bedroom unit and 864 square feet per unit for single, two family and multi -family units. Floor area shall be computed measuring the outside dimen- sions of the building." The main reason for the applicant appearing before the Planning Commission is that this development was represented as for single-family dwellings except for the 4-unit building on lot 17 and the recreation fee and sewer allocation were based on these representations. The property is bounded on the north by Kirby Road and 13 single-family dwellings which front Kirby Road, on the west by Patchen Road and a single-family dwelling, and on the south and east primarily by a stream and wooded open space owned by the City of South Burlington. A pond is located on the southern end of the property (multi -family lot 17). I feel duplexes would fit into the character of the neighborhood. Access: A new 30 foot wide paved road is proposed to pass through the middle of the subdivision connecting Patchen and Kirby Roads. This new road will serve 7 single-family lots and 9 two-family lots. Sewer: 9,000 gpd was granted on August 29, 1989 and this revi- sion would require an additional 4,500 gpd. The state has asked that an additional 286 gpd be allocated for infiltration making the total allocation needed at 13,786 gpd. Lot Size: All proposed duplex lots will meet the minimum lot size requirement of 12,000 square feet and minimum frontage requirement of 85 feet. Recreation Fee: The developer will be required to pay the $200 per unit fee. Other: A note should be placed on the revised final plat indi- cating that this approval is for 8 single-family lots, 9 two- family lots and one 4 unit multi -family lot only and that any change in this would require approval from the Planning Commis- sion. Note #5 on the Site & Utilities Plan should also be re- vised to reflect the change in the number of single-family and two-family units. 5) 100 DORSET STREET EXPANSION - REVISED SKETCH PLAN Judge Development Corporation has submitted a revised sketch plan which they feel addresses the concerns expressed by the Planning Commission at the December 18, 1990 meeting (minutes enclosed). The square footage of the buildings at 100 Dorset Street has been reduced by 6,175 square feet and the square footage of the build- ings on Corporate Way has been increased by 20,400 square feet. The total project with the proposed additions is now proposed to be 89,850 square feet as opposed to the December 18th proposal which had a total of 74,325 square feet or a 21% increase in total square footage. The existing 100 dorset Street project has a total of 46,850 square feet including the 2100 square foot Net Result building which will be razed. The expansion will result in a total of 89,850 square feet or a 91.8% increase in total square footage. 3 Memorandum - Planning June 9, 1992 agenda items June 5, 1992 Page 4 Lighting: Additional exterior lighting proposed consists of five (5) 400 watt metal halide lights on 16 foot poles, two (2) 175 watt metal halide lights attached to the north side of the motel building and four (4) ground lights in the flower garden area which is adjacent to the residential uses. The pole and attached lights will have cutoff luminaires. The ground lights will be 75 watt incandescent lights with hoods and louvers. Other: --- a screened dumpster is being proposed. --- the applicant has not submitted a drainage plan as requested by Bill Szymanski. --- the applicant should address the concerns expressed at the 8/6/91 meeting with trucks with refrigeration units using the motel and running the trucks all night. --- the one-way access drive connecting the restaurant parking with the motel parking does not provide a five (5) foot snow storage area for a distance of about 40 feet. The applicant should obtain a snow storage easement from the adjoining property owner to the north. 5) O'BRIEN BROTHERS - REVISED FINAL PLAT - PATCHEN ROAD This application is to amend the landscaping plan only for the four (4) unit multi -family dwelling which was part of an 18 lot residential subdivision approved on 8/29/89 (minutes enclosed). This subdivision was revised on 2/5/91 but the revisions did not affect this four (4) unit building. This building is currently under construction and nearing completion. This property located on Patchen Road is within the R4 District. The lot on which this multi -family dwelling is located is bounded on the south by a single family dwelling, on the east by a city park, on the north by a CO District and on the west by Patchen Road. Landscaping: This is the only issue which is affected by this application. The landscaping requirement for this building is $6,150 which was not met at the time of the original approval in 1989. The landscaping value currently proposed is now $2,664 or 4 Memorandum - Planning June 9, 1992 agenda items June 5, 1992 Page 5 $3,486 less than previously approved. The reason for this reduction is that the applicant has been able to save many of the larger pine trees near the building which would have to be removed in order to comply with the original landscaping plan. The applicant is seeking a credit for the shortfall. The plantings will include Douglas or Blue Rug Juniper, European Cranberry, Cranberry Cotoneaster. Burning Bush will substitute for the Crabapples as requested by the Fire Chief. Staff recommends approval of this request. The site is heavily wooded and there is very little area for additional landscaping. In addition, the building is well screened from adjoining properties and Patchen Road. 6) S.B. COLLINS - CONVENIENCE STORE AND GAS SALES - 1314 WILLISTON ROAD This project consists of the removal of existing gasoline sales facility including the sales building and three (3) pump islands h with 12 pump stations. A new facility would be constructed which includes a 936 square foot convenience store with attached canopies on either side. This new facility would have two (2) pump islands with eight (8) pump stations. The Zoning Board of Adjustment on April 27, 1992 granted the applicant a variance from the setback requirements and a variance to exceed the coverage requirements. This property located at 1314 Williston Road is within the Commercial 1 District. It is bounded on the west by a convenience store/deli/gas sales facility and the Bagel Factory, on the north by an office building, on the west by Patchen Road, and on the so:ah by Williston Road. Access/circulation: Access is currently provided by four (4) curb cuts, two (2) on each street. As you know, our comments are required so that a meaningful assessment can be made under 10 VSA Sections 6086 (a) (9) (F) and (J). On September 26, 1989 the company submitted a letter that it had the ability to serve. Now you have reconfigured your development to accommodate ten additional living units. You have accomplished this by putting duplexes on eight lots and two duplexes on lot 9. Now the company will be reviewing ten duplexes, six single family units and a condo consisting of four units. In our previous letter we made the assumption that electric heat would not be used and that the electrical panels would be single phase and 100 to 150 amps. As stated previously, this requirement can be supplied from Green Mountain Power's existing and planned generation sources. If this is not consistent with your load projections, Green Mountain Power Corporation should be made aware of the situation for planning purposes. We have evaluated the transmission and distribution system that will be used to serve your project's requirements and have determined that existing facilities are adequate for that purpose. We do not anticipate that your addition will require distribution or transmission improvements at this time or accelerate routine system improvements planned for the near future. In view of these facts, we conclude that the proposed development will not put an excessive or uneconomic demand on Green Mountain Power's facilities. The approval was for 16 single family lots and one multi -family lot with a total of 9,000 gallons worth of sewer capacity. With the down turn in the economy over the past year we have been forced into taking a new approach towards this project. We have decided to go with duplexs on some of the lots in the subdivision. Based on section 18:00 in the zoning regulations, two family units in an R-4 zone require a minimum lot size of 12,000 square feet and lot frontage of 85 feet. According to these specifications lots 1, 2, 3, 9, 10, 11, 12, 14, and 15 could have duplexs built on them. I have enclosed a copy of a site plan for the subdivision indicating the lots, square footage and frontage. The reason we are going with additional units is to make the homes more affordable by spreading out the land costs and impact fees over a greater number of units. We are requesting That the planning commission grant approval for ten (10) additional units with a sewer allocation of 4,500 gallons. I would also like you to send me a letter concerning the sewer allocation and the availability of 4,500 gallons of capacity for the project. Mr. O'Brien said the cost is now $11,745 and without that lot included it would be $7,305. Mr. Weith said the Commission did the same thing at Oak Creek Village which was part of the Hinesburg Rd. sidewalk plan. To be consistent, the whole frontage should be included. Mr. O-Brien noted the entire piece of the Oak Creek land was part of the subdivision and they developed the whole piece of land. He said O-Briens have no interest or title to the corner piece of land and there is a pre-existing house that is being retained by the owner. Mrs. Maher felt that when the corner lot comes in for re- development, that developer should pay for the sidewalk. She said she understood the other side of the argument as well. Mr. Burgess said there is a need for a sidewalk to run the whole frontage because there will be 20 new homes. Mr. O'Brien said they are building a sidewalk through the de- velopment. Mr. Weith said there is no clear written policy on this. Mr. Burgess said he felt in principle that Mr. Weith was right and the Commission had to be consistent. He wanted the side- walk. On the issue of the pond, the City Engineer wants the pond for the City and so suggests 1.5 or 1.6 acres be dedicated with the balance made up for in recreation fees. Mr. Jacob said the REcreation Dept. people could see no need for that land in their plans. Before a vote was taken on either issue, the applicant asked to withdraw his application. 7. Discuss proposed amendment to Section 18.113 "Minimum size of Dwelling Units" of the South Burlington Zoning Regulations Mr. Weith noted the Commission had voted to go back to the original wording instead of the proposed revised wording. The Council has questions on this and doesn't like either wording. Mr. Burgess noted the language was to allow for the possibility of a "mother-in-law" apartment. Mr. Weith said a bad effect was to double the minimum size of apartment units. Mr. Burgess said this was intentional. They did want to double the size but also allow for the "mother-in'law" apartment. Mr. Jacob noted a joint meeting with the Zoning Board on 6/6 at which time this issue should be discussed. It is the City's policy to accept the street after the final course has been put down and the infrastructure (i.e., pavement, curbs, sewers, sidewalks) have been inspected. This is typically a 2 year time frame. The City recommends that the first course be laid in the first year. After a year of settling and routine maintenance, the final course should be put down. This should be moved out of the conservation zone as well as any planned fill, or approval will be necessary from the Zoning Board. Open Space: The residential portion is designed in two main clusters, a north and a south. Both are situated around large common open areas which I feel is a good concept. It creates 'a large usable open area usually lost in a typical subdivision or multi -family project. Traffic: A traffic impact study is required which should be submitted prior to Preliminary Plat review. Again, I feel it is important that the study address future development, including development of the Pomerleau parcel. Other: I like the overall concept of the plan. I feel the residential portion works well with the commercial portion. The project needs to be clarified as far as exactly what is being proposed at this time and what lands are to be involved. This is important in terms of calculating density and properly warning the application. A potential conflict area may be where residential is proposed adjacent to commercial. A loading dock area should not be pro- posed in these areas, or deed restrictions should be included which permit loading activities only during day time hours. 4) O'BRIEN BROTHERS, Ik LOT SUBDIVISION AND 4 UNIT BUILDING O'Brien Brothers Agency, Inc., proposes to: 1) subdivide a 10.84 acre parcel into 18 lots, and 2) construct a 4-unit residential building on one of the newly created lots (lot 17). The property is located south and east of the Patchen/Kirby Roads intersec- tion. Minutes from Sketch Plan review (2/21/89) and Preliminary Plat review (5/9/89) are enclosed. The property is bounded on the north by Kirby Road and 13 single-family dwellings which front Kirby Road, on the west by Patchen Road and a single-family dwelling, and on the south and east primarily by a stream and wooded open space owned by the City of South Burlington. A single-family home abuts the multi- family lot to the south. The neighborhood is single-family residential in character. A pond is located on the southern end of the property (multi -family lot, lot 17). 3 Memorandum August 29, August 25, Page 4 - Planning 1989 agenda items 1989 18-Lot Subdivision Access: A new 30 foot wide paved road is proposed to pass through the middle of the subdivision connecting Patchen and Kirby Roads. This new road will serve 15 single-family lots. The lot proposed at the corner of Patchen and Kirby Roads contains an existing dwelling which will retain its current access on Patchen Road. The multi -family lot will be accessed from Patchen Road. Lot 16 will be accessed via a 20 foot r.o.w. over lot 15 from the new street. The approval motion will pro- hibit access to lot 16 from Kirby Road. A portion of the new road will be within a 50' right-of-way. This substandard r.o.w. width is needed in order for the lots to meet standard setback and minimum lot size requirements. The remainder of the road is proposed to be within a 60' r.o.w. Minimum lot size/frontage: All of the lots meet the minimum lot size requirement of 9500 square feet. The smallest lot is 10,054 square feet (lot 7) and the largest is 95,592 square feet (lot 17). All lots meet minimum frontage. By prohibiting access to lot 16 from Kirby Road, lot 16 is considered a lot with no front- age. This is allowed in the Zoning Regulations. Traffic: The proposed subdivision will generate 19 peak hour trips ends assuming single-family homes and one 4-unit building. Open Space/recreation: No recreation or common space is proposed to be dedicated to the City. The Applicant proposed dedication of the pond area, however, the proposal was withdrawn (see 5/30/89 minutes). The Planning Commission should require the $200 per unit fee. Landscaping: The plan proposes 2 1/2 - 3" Littleleaf Linden for street trees. The plan also shows 2 trees per lot (Honey Lo- custs, Austrian Pine, White Birch or Crab apple). Street trees should be planted no less than 4 feet from edge of curb because of snow storage. Sidewalk: An $11,745 sidewalk fee is required based on 783 feet of frontage on Patchen Road at $15 per linear foot. Street Lighting: The street lighting detail proposes the G.E. M-2502 cutoff luminaire. The City has been requiring the G.E. M-250 A2 for street lights. Is this the same light? A separate covered parking area is proposed. The lot is 95,592 square feet. Almost half of the lot is covered by steep slopes and a pond. Density: Maximum density for this parcel is 9 units. Access/Circulation: The project will be accessed by a 22 foot wide private driveway off Patchen Road. The driveway is approximately 120 feet long and leads to a parking area in front of the building. Parking: The project requires 9 parking spaces. The plan shows 5 uncovered spaces in front of the building and a 4 or 5 space garage. Landscaping: The 4-unit building requires $6,150 in new land- scaping based on a building construction cost of $205,000. The landscaping plan for this parcel shows Austrian Pine, White birch, crab apple, honey locust, juniper and cotoneaster which is valued at $5,500. The $650 shortfall is easily made up by the significant amount of existing vegetation to remain untouched. Sheet 1: A mainline valve must be installed at or near station 8+00. In the event that the mainline has to be shut down for maintenance or repairs this valve would allow domestic and fire service to be maintained to at least one half of the development. 3. Sheet 2: The size of the water service line to units 17 through 20 is not indicated. It would appear that it is a service line to the units with one meter and the association being responsible for the water bill. If this is the intent then we would require that a curb stop be placed on the line at the point that it leaves the Patchen Road right-of-way. However, if each unit is to be individually metered then we would require not only the curb stop at the edge of the right-of-way, but a curb stop for each unit. If a fire hydrant is required at this location then an 8" main would be required to the hydrant and then the line could be reduced to serve the residential units. 4. We have addressed a number of issues that were part of the February 21st meeting. The utilities for the subdivision will b� brought through the right of way on lot 16. The question about road frontage for Mr. Bramley has been resolved' It was determined that when the pins were moved for road work there replacement was incorrect. Mr. Bramley has 70' of road frontage and the right of way is 50'. As for Mr' Belter's comments regarding the 50' easement onto Kirby road, that is already existing and was created back when the city regulations called for 50'. We are only proposing to use what is there, it is unfortunate that the Zoning Board allowed those structures to be built right on the property line' We resolved the placement of the utilities and after a meeting with 8iII Symanski came up with a solution for the sidewalk. The Environmental Commission retained the right to require Mr. Belter to install improvements at this intersection (stop sign or signal) until the last lot is sold. The maximum amount of trips in the 13 lot subdivision was limited to 81S weekday vehicle trips and 163 p.m. peak hour vehicle trips. CAL u(y).caa A,,--t QS4) Given the projected volume and the condition of Ethan Allen Road, I think it is essential that the City upgrade this road and straighten the intersection promptly. 4) LARKIN HOTEL, 1710 SHELBURNE ROAD This final plat application was reopened due to the failure to record the plat within 90 days. The Commission approved the plat on July 23, 1985. A recap of the issues follows: Project description: The project includes an addition to the 197 seat restaurant and the construction of 200 motel units in four buildings, 209 additional parking spaces and related site improvements. It is located on lots #10 and #11 of the previ- ously approved Bartlett property. This hotel/restaurant was reviewed using site plan criteria since it is different from a planned commercial development that has a number of different uses. For example L+eew od Associates, with a restaurant and office facility far"'ot commonly combined, was a legitimate PCD. As note? by the City Attorney, a restaurant and hotel are commonly together. However, this project did require a subdivi- sion of lots; lot #10 was subdivided and therefore the public hearing and three step review process was followed. In sum, the subdivision process was followed and site plan criteria was used. The Commission used the Traffic Overlay criteria, not P.C.D. level of service criteria.
