HomeMy WebLinkAboutSD-89-0001 - Decision - 0000 Queensbury RoadPLANNING COMMISSION 9 MAY 1989 The South Burlington Planning Commission held a regular meeting on Tuesday, 9 May 1989, at 7:30 pm, in the Conference Room, City Hall, 575 Dorset Street. Members Present Peter Jacob, Chairman; William Burgess, William Craig, Catherine Peacock, John Belter, Ann Pugh Also Present Joe Weith, City Planner; Charles Hafter, City Manager; Steve Stitzel, City Attorney, Sid Poger, The Other Paper; Chris D'Elia, Dan O'Brien, Douglas Fitzpatrick, Chip Burr, Gordon Champine, Theresa Champine, Larry Hayes, Susan Hayes, Sharon Smith, John Romanoski, Geri Millette, Edward Millette, Richard Lucia, Lee Bissonette, Donna Bramley, Bob Bramley, Paul Menard, William Bissonette, Steve Crowley, Roger Dick- enson, George Brady Other Business a) Mr. Weith said he met with a Burlington Planner and they decided to set up a joint meeting in late summer b) Maureen O'Brien Bouchard has asked to be on the City Center Committee. Mr. Burgess will have a charge ready for the next meeting. 1) P Preliminary Plat applicatio of O'Brien for 1) subdivision of a 10. parcel into 18 lots, and 2) construction of a 4-unit residential building on one of the newly created lots (2.8 acre lot), southeast corner of Kirby & Patchen Rds. Mr. D'Elia said there will be one road through the sub- division. City water and sewer will be used. There will be a 20 ft. right-of-way to the multi -family lot. Mr. Weith said there is a provision that would allow the Commission to approve lots with no frontage, and the City Attorney recommends that it be made clear there will beno--curb cut authorized on Kirby Road. The drive to the multi -family units will be considered a private driveway. Mr. Burgess asked about the utility easements. Mr. D'Elia said they will go through the green space on lot 16. Ms. Pugh asked if the Natural Resources Committee had re- viewed the plan. Mr. Weith said they were concerned with the 4-building lot and potential for ersion to the brook. They felt there should be proper erosion control. There will be no work done in the CO Zone. PLANNING COMMISSION 9 MAY 1989 PAGE 2 Mr. D'Elia said the "dog -leg" on the multi -family lot will be made part of lot 9. Members felt they preferred a recreation fee in lieu of 150 of the land. A resident felt the developer should consider a bridge of some sort over the ravine which would save children 1/2 mile walking to Chamberlin School. Residents also noted the beaver are back damming up the stream so the pond is getting much deeper. A detail should be added to the plan showing 2 trees per lot with a list of possible varieties. Members discussed the question of a sidewalk on Patchen Rd. Neighbors noted children walk to school there, and in winter they have to walk in the heavily traveled road. Members agreed to collect a sidewalk fee to be used when the city puts in the sidewalk. Mr. Burr, representing Munson Earth Moving said they were concerned with drainage that might affect their property. Mr. D'Elia said that will come under Act 250 review. A street lighting plan is needed, and the City Engineer wants a main line valve at Station 8. Ms. Peacock moved the Planning Commission _approve the prelim- inary plat application of O'Brien Brothers Agency, Inc, for subdivision of a 10.84 acre parcel into 18 lots and con- struction of a 4-unit residential building on one of the newly created lots (lot 17) as depicted on a 6 page set of plans titled "Kirby/Patchen Road, Site & Utilities Plan," prepared bv Fitzpatrick -Llewellyn, Inc, and dated April, 1989 last revised 5/5/89, with the following stipulations: 1. The landscape plan shall show 2'trees per lot to be planted. A typical detail of the lot trees shall be shown on the final plat. A 3-year landscape bond for street trees and lot trees shall be posted prior to permit. The amount shall be determined by the City Planner prior to Final Plat. 2. The applicant shall pay a $200 per unit recreation fee prior to permit. 3. The applicant shall contribute $11,745 to the City's side- walk fund based on 783 feet of frontage on Patchen Road at $15 per linear foot. 4. The Final Plat shall show the footprint of the single- PLANNING COMMISSION 9 MAY 1989 PAGE 3 family residence south of the multi -family lot. S. The Final Plat shall properly show the adjoining property owners. 6. The Final Plat shall show additional inlets at station 12+25 at the center of the horizontal curve unless the City Engineer determines these not to be necessary. 7. The Final Plat shall show the name of the new street. 8. Offers of dedication and deeds for streets shall be sub- mitted to the City Attorney for approval prior to permit. 9. Power and telephone lines shall be in easements outside the street r.o.w. This shall be shown on the Final Plat. 10. A street lighting plan shall be submitted for review prior to Final Plat. Street lights shall be installed at the same time as the power lines are installed 11. A sewer allocation of 9,000 gpd is granted. The $2.50 per gallon fee shall be paid prior to permit. 12. Bonds for streets, sidewalks, water and sewer shall be posted prior to permit in an amount to be determined by the City Engineer. 13. The Planning Commission approves lot 16 with a 50 foot frontage on Kirby Road with the condition that access to this lot shall be only from the new road via a 20-foot wide right- of-way over lot 15. There shall be no curb cut allowed in this 50 foot right-of-way. 14. The Final Plat shall be submitted within 12 months or this approval is null and void. Mr. Burgess seconded. Motion passed 5-0, Mr. Craig abstain- ing. 2. Site Plan application of William and Lee Bissonette for an 11 space expansion of the parking lot at Al's French Fries, 1251 Williston Road Mr. Bissonette said they want to add parking at the rear of the property. They would continue the sidewalk and curbing on the Midas Road through the Williston Rd. and will land- scape a berm at the front to try to hide some of the parking.
