The new addition will not encroach on the setback any more than
the original structure. That structure was approved for 40 units
of which only 36 were built.
Ms. Byrnes said there isn't more than 6-10 ft. of existing
grassed area and asked how they can leave 6 ft. Mr. Rabideau
said there is more than 6 ft. now. They will not reconfigure the
rear parking lot. Ms. Byrnes asked about alteration of the ex-
isting water and sewer lines. Mr. Rabideau showed the existing
lines. They will install a new structure and relocate a sanitary
sewer line. There will still be adequate slope to function.
This has nothing to do with drainage.
Ms. Byrnes said she has a perscriptive easement. She noted that
in previous construction, sewer/water lines were severed twice.
She wanted to know how the new addition will make the
neighborhood a better place. Mr. Burgess said that is not within
the Commission's consideration.
Mr. Rabideau noted that Pillsbury Manor is very popular. All the
units are full. He noted they had gotten rid of the old house
and its objectionable tenants. The property looks very nice now.
Mrs. Maher asked whether the dumpster is where it should be. Mr.
Weith said it is not but the applicant will ask for approval of
the present location as part of this application. It is now
closer to the retention pond. He said he had no problem with the
location. A poll of members showed the had no objections to this
location.
Mrs. Maher noted a tree has died and asked that it be replaced
before the bond is released.
5. Public Hearing: Revised final plat application of S. D. Mans-
field, Inc, to amend an approved 18-lot subdivision located at
Kirby & Patchen Roads. The amendment consists of 1) designating
lots 1-16 as a planned unit development and 2) adding 400 sq. ft.
of neighborhood community space to an approved duplex on lot #9:
Mr. Crow stepped down due to a potential conflict of interest.
Mr. Farrell said the project is now half done. There will be no
changes to landscaping or anything else as a result of this ap-
plication.
Mr. Champine asked what hours the meeting room will be open. Ms.
Wright said they expect to use it for small meetings to do the
business of the co-op. They will also interview new potential
residents there. The room will be closed by 11 pm. It will not
be used in the evening for parties, though there may be some

daytime children's birthday parties occasionally. Mr. Burgess
suggested putting an 11 pm closing into the motion. Ms. Wright
said they will also incorporate it into the leases.
Mr. Austin moved _the Plannin Commission approve the revised
final at_app_lication of S. D. Ma_nsfield,_ Inca to amend an 2p
proved-18 lot subdivision located at Kirby and Patchen Roads.

Llewellyn, Inc_, dated April_ 1989, with a last revision date of
2/28 91, with the followina stipulations:
1. All previous approvals and stipulations which are not su er-
seded by this approval shall remain in effect.
2. The P_lann� in3Commission approvesasewer allocation of 150 gpd
for the neighborhood community meetin space, The appli__cant
shall pay the_ per_ ga_ llon fee prior to the issuance of a zoning/
buildinq permit.
3. The use of the community meeting space shall_ only_ be for
resident co-op related functions.
4. The applicant shall submit for review and approval by the Cit
Attorne a "Notice of Condition" which clearly identifies and
legally ties to ether lots #1-16 as a PUD forplanninq, zoning
and subdivision purposes. The applicant shall also submit for
review and approval by the City Attornu a "Notice of Amendment"
of Subdivision Approval & Declaration of PUD Approval." These
legal documents shall be recorded in the South Burlin ton Land__
Records within 90 days gr this approval is null and void.
5. As expresses represented b� the_ applicant_ the community space
shall not be used any later than 11:00 P.M.
Mrs. Maher seconded. The motion passed unanimous._
Mr. Crow rejoined the Commission.
6. Site plan application of Perry Restaurant Group to amend a
previously approved site plan consisting of revising the parking
layout, coverage, and other site modifications on a lot contain-
ing a 303 seat restaurant, 1080 Shelburne Rd:
Mr. Melincoff said that in the approval of 2/93, they shifted the
parking to the east. Some of the required improvements were not
done. They felt mature trees would not have survived if those
