Re: °Findings of Fact, application of O'Brien Brothers Agency,
Inc. for subdivision of a 10.84 acre parcel into 18 lots and
construction of a 4-unit residential building on one of the newly
created lots (lot 17), 8 single-family dwellings and 9 two-family
,dwellings and 9P two-family dwellings, Kirby & Patchen Roads.
On the 5th of February 1991, the South Burlington Planning Com-
mission approved the request of O'Brien Brothers Agency, Inc. for
a Revised Final Plat under Section 204 of the South Burlington
Subdivision Regulations based on the following findings:
1. This project, for which a revision is being requested,
consists of an 18 lot subdivision and the construction of a 4-
unit residential building on one of the newly created lots (lot
17). Final Plat approval was granted by the Planning Commission
0 on August 29, 1989. The revision is to substitute duplexes for
single-family dwellings on nine (9) of the lots. The lots in-
volved include lots #1, 2, 3, 9, 10, 11, 12, 14, and 15.
2. The property is bounded on the north by Kirby Road and 13
single-family dwellings which front Kirby Road, on the west by
Patchen Road and a single-family dwelling, and on the south and
east primarily by a stream and wooded open space owned by the
City of South Burlington. A single-family home abuts the multi-
family lot to the south.

° 3. The neighborhood is single-family residential in character.
A pond is located on the southern end of the property (multi-
family lot 17).
4. Access: A new 30 foot wide paved road is proposed to pass
through the middle of the subdivision connecting Patchen and
Kirby Roads. This new road will serve 7 single-family lots and 9
two-family lots.
S. Sewer: 9,000 gpd was granted on August 29, 1989 and this
revision would require an additional 4050 gpd. The state has
asked that an additional 286 gpd be allocated for infiltration
making the total allocation needed at 13,336 gpd.
6. Lot Size: All proposed duplex lots will meet the minimum lot
size requirement of 12,000 square feet and minimum frontage re-
quirement of 85 feet.
7. Recreation Fee: The developer will be required to pay the
$200 per unit fee.
DECISION & CONDITIONS
Based upon the above Findings of Fact, the South Burlington
Planning Commission approves the Revised Final Plat application
of O'Brien Brothers Agency, Inc. for subdivision of a 10.84 acre
parcel into 18 lots and construction of a 4-unit residential
building on one of the newly created lots (lot 17), 8 single-
family dwellings and 9 two-family dwellings as depicted on a 2
page set of plans titled "Kirby/Patchen Road Site & Utilities
Plan", prepared by Fitzpatrick -Llewellyn, Inc. and dated April
1989, last revised 8/1/90, with the following stipulations:
1. All stipulations contained in the August 29, 1989 approval
shall remain in effect unless superseded by this approval.
2. The recorded plat and construction drawings shall have a note
indicating that this approval is for 8 single-family lots, 9
two-family lots and one 4 unit multi -family lot and that any
change in these numbers would require approval from the Planning
Commission.
3. A sewer allocation of 13,336 gpd is granted. The $2.50 per
gallon fee shall be paid prior to permit.
4. The final plat shall be recorded within 90 days or this
approval is null and void.
