HomeMy WebLinkAboutZB-92-0000 - Decision - 0000 Queensbury RoadFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of O'Brien Brothers Agency, Inc. to amend the landscaping plan for a four (4) unit residential building on lot 17 of the 18 lot Kirby/Patchen Road subdivision. On the 9th of June 1992 the South Burlington Planning Commission approved the request of O'Brien Brothers Agency, Inc. for a revised final plat under Section 204 of South Burlington Subdivision Regulations based on the following findings: 1. This application is to amend the landscaping plan only for the four ( 4 ) unit multi -family dwelling which was part of an 18 lot residential subdivision approved on 8/29/89. This subdivision was revised on 2/5/91 but the revisions did not affect this four (4) unit building. This building is currently under construction and nearing completion. 2. This property located on Patchen Road is within the R4 District. The lot on which this multi -family dwelling is located is bounded on the south by a single family dwelling, on the east by a city park, on the north by a CO District and on the west by Patchen Road. 3. Landscaping: This is the only issue which is affected by this application. The landscaping requirement for this building is $6,150 which was not met at the time of the original approval in 1989. The landscaping value currently proposed is now $2,664 or $3,486 less than previously approved. The reason for this reduction is that the applicant has been able to save many of the larger pine trees near the building which would have to be removed in order to comply with the original landscaping plan. The applicant is seeking a credit for the shortfall. The plantings will include Douglas or Blue Rug Juniper, European Cranberry, Cranberry Cotoneaster. Burning Bush will substitute for the Crabapples as requested by the Fire Chief. 4. The site is heavily wooded and there is very little area for additional landscaping. In addition, the building is well screened from adjoining properties and Patchen Road. DECISION & CONDITIONS Based on the above Findings of Fact, The South Burlington Planning Commission approves the revsied final plat application of O'Brien Brothers Agency, Inc. to amend the landscaping plan for a four (4) unit residential building on lot 17 of the 18 lot Kirby/Ptchen Road subdivision as depicted on a plan entitled "Kirby/Patchen Road, Detail Landscape Plan", prepared by CCD and dated 4/29/92.
