The building is presently a nonconforming structure because of it's set back. The require set-U,ack_ i _7j5''__the existing set back is 141. Section 13.00 (2) allows for the alteration, however this alteration can't exceed�25%a of the fair market value."" The City has a fair market value of the buildinT of �'24,575• It is my understanding that the proposed alterations to the building will be an 8' x 20' addition to the east side which is for additional rest rooms and a new entrance also on the east side. The front entrance is going to be closed. Based on information from the developer this alteration will not exceed 25', of the Fair Yarket Value and is less than 8"6,000.00, therefore the proposal will be in onformance with Section 13.00.7v.Sia1 Parking: The existing parking lot to the east will be altered to allow for 13 spaces. I feel that the maneuvering area between the spaces is not ample. The print shows 23 feet, 40 feet is recommended. My recommendation is to eliminate the spaces numbered 10 thru 13. These are not required spaces. The required spaces would be 22. The area should be a buffer strip. Off -Street Parking: Section 13.40 allowed for parking spaces to be located on other property. This plan proposed to have parking on other property. In order to direct people to these spaces I would recommend that the spaces be striped and that a directional sign be erected in accordance with the provisions of the Sign Regulations. Plantings & Screening: The proposed new plantings as shown on the plan are 6-9 maple or crab-apple trees. Use 3% of $6,000.00 and this would require $180.00 in landscaping. Nine trees will be in that price range. The screening proposed is a stockade fence along the easterly property line. This fence along with the existing vegetation is adequate screening for the residential area to the east of this property. Page 2 A performance bond should be posted in the amount of $1,000.00 to cover the landscaping; as proposed. This includes the new sidewalk and grass area directly in front of the building along with the 6 to 9 trees and the stockade fence. Clark hinacidlo, Jr. East Charlotte, Vermont 05445 Re: Queen City Park Road Lear Clark: t In reference to the parcel of land which you purchased Zrom the city on Queen City Park Road, the street R.0.14. is approximately 1 foot south of the power pole and continues concentric with the paved street. Tae records uo not detail the radius of the curve so the radius of the existing street will have to be used if the entire R.O.W. is to be staked out. I do not believe this is critical because the land across the street is public land. The entrance to the parcel is satisfactory. Placing it further westerly decreases the sight distance to the west. The Commission established the following at its September 10, 19%4 meetins: P•Tr. Power moved. that the PlanninC Commission approves the site Man review for "Arthur's Inc. park- in- lot as limited by the memorandum to the Planning Commission from Fred Mitchell dated September 10, 19741 with the following changes: that the easterly drive- way be designated Entrance Only; that it be on the westerly side of the pole opposite parking space label- ed #18, and that it be 24 feet wide which may than` e the barrier on the map; that the westerly entrance be des- ignated Entrance and Exit, and the barrier to the east- erl-IT side of parking space �18 be extended to the en- trance to the public parking area; secondly, that in the parking area, the number of spaces for the capacity of the restaurant be figured at 28 delineated spaces in the upper lot, and 19 spaces in the lower lot, and an additional 5 spaces undelineated on the -raveled portion of the upper lot; third, that the proper a-reement between Mr. Hinsdale and Green Mountain Power Corp. concerning; the safe re- location of the Zuy wires for the telephone pole be filed with the City Planner; and fotrth, that a proper bond of intent for landscaping and parking area be posted, that five trees should be flowering crabs; and fifth, item B is to be eliminated from Mr. Mitchell's requirement; and sixth, that a fence be erected adjacent to the Queen City Park Road and the entrance to the upper parking lot. Motion seconded by Mr. Levesque. Voted unanimously for approval. In thanking the Planning Commission, .fir. Hinsdale commented it will be a better parking lot because of the thouCht put into it. Respectfully, Fred Mitchell_, City Planner To: Planning Commission From: Fred Mitchell re: Arthur's Parking Lot Date: September 10, 1974 In a review of this proposal the following observations were noted: 1) There now exists 28 marked parking spaces and approx- imately 10 unmarked spaces adjacent to the existing structure. 2) It is assumed that additional parking, when needed, is accomplished by utilizing the gravel portion below the structure and/or within the parking lot provided by the shopping center. 3) Within the zoning district the use of the structure presently is the most intense with respect to need- ed parking requirements. 4) The traffic generated from this use should cause no undue congestion, especially in view of the evening hours of operation and the potential for high inten- sity of use, especially on Friday and Saturday nights. 5) No restrictions have been noted on the liquor license. I would recommend the following for the parking lot con- struction: A) Developer to establish a barrier on the south side sufficient enough to retain any slippage of gravel from the existing slope and to delineate the extent of parking. B) Developer to establish a barrier on the north side for any parking spaces established. C) Developer to establish a fence, preferable open and wooden as shown on the accompying map. D) 0n the west side developer to establish a barrier only in the areas where he cuts into existing bank to establish parking area. Developer relates that remainder of this side will be utilized for storage of plowed snow during the winter and additional barrier could prove hazardeous to snow removal oper- ation. -2- E) Developer should landscape the buffer zone on the north side with five (5) trees suitable -to the plan- ning commission and will plant grass that will extend to his property line. Fence posts where used, should set back approximiately 3 feet from the edge of the grass. F) Parking lot layout should be established as shown on the accompying map. G) The marking of parking spaces could be established as follows: On the south side a strip of paint should be used to delineate each parking space; Cn the west.this same procedure should be used where a barrier is established, when no barrier is used, marking stakes centered on each parking space should be used; On the north if any spaces are established they should be marked with a stake also.
