Burlington City Council waives its statutory right to request a hearing and its statutory time limits to request such hearing as set forth in Section 6085 (a) & (b) of Title 10. This request is made in reference to Act 250 Land Use Permit #300033-1 amendment, and for the following reasons: 1. The Champlain Water District is coordinating design and construction efforts of,a treatment plant addition on a very short and close time schedule. 2. All appropriate State and Local agencies have given written approval of the Champlain Water District filtration plant addition. (Copies attached.) 3. Champlain Water District has received notice that, con- trary to previous information, an Act 250 hearing is neces- sary; and that no construction will be permitted until a written permit is issued following a hearing. 4. Champlain Water District has made sizeable financial commitments to insure that this project will be finished in time to meet another water supply commitment with the Village of Essex Junction. j 5. Time is of essence and, based on the Water!IDistrict's original information, construction has alreadyI !been started. The time delay which would be experienced fromlithe legally warned hearing and its findings, would bring clnsiderable financial hardship to the Champlain Water DistrIl ict. Based on the Division's review of the above referenced documents, conceptual approv�#1 is hereby granted authorizing the detailed preparation of final plansll.and specifi- cations in accordance with said documents. In addition, thO detailed foundation drawings including the grading/site plan; yard P.ping plan; underdrain piping plan; and buried piping plan is approved �s a basis for construction. The above approvals are pursuant to 10 V.S.A. Chapter 37 and are subject to the following conditions: (1) The conceptual approval is an authorization to proceed through final design in accordance with the reviewed documents and basis of design. The conceptual approval does not forfeit the authority of the Division to comment upon the detailed design drawings for the plant as said drawings are submitted for review and approval. (2) The design and construction of the proposed 2 MGD plant expansion is to follow a design/build construction concept as a means of minimizing the construction period and controlling total project cost. (3) Design changes to previously approved design documents shall, as always, require review and approval by the Environmental Engineering Division prior to construction of said changes. (4) The design of the sludge treatment/disposal system shall be completed by January 1, 1980 and shall be submitted to this office for review by that date. The construc;:ion of sludge treatment/disposal facilities, as necessary, shall be initiated in the spring of 1980 and shall be completed by August 1, 1980. This office recognizes the nature of the design/build project in terms of plan review turn -around times to help insure non -interruption duri,g construction of the 2 MGD direct filtration facility. Every effort will be made to prevent such interruptions. To accomplish the above, it is imperative that engineering design documents be submitted to this office with sufficient lead time to allow timely reviews to occur. Jacob Water Treatment Facility located at 403 Queen City Park Road in South Burlington, and electrical upgrades to enable an immediate upgrade of one "high service" pump, and future upgrades to the remaining four high service pumps in anticipation of increasing base load and peak summer demands. The work shall include building construction of an approximate 950 square foot masonry building addition for the purpose of housing an electrical room, with construction including excavation, foundation, building addition, roofing, electrical and mechanical systems, as well as backfilling, grading, seeding, and restoration of paving. Construction of the addition shall include the installation of a 2000 kVA electrical pad mounted transformer which is owner -furnished, contractor -installed, 4000 ampere, 480 volt switchgear and motor starter for a 400 HP high service pump. The purpose of the work is to: •:• Enable upgrade of one high service pump from 300 HP to 400HP, and provide the electrical service and electrical room to upgrade the remaining four pumps similarly, in the future. •:• Upgrade the main electrical feed to pumping units, that is presently near electrical capacity. ❖ Improve service pumping capability to address increasing demands. ❖ Replace, relocate, and upgrade motor control centers that are poorly located and vulnerable to flooding at a lower level of the plant. ❖ Improve pumping efficiency. ❖ Provide one phase of a multi -phased approach to improving equipment redundancy, reliability, and flexibility.
