HomeMy WebLinkAboutSD-13-11 SD-13-18 - Decision - 1150 Airport Drive#SD-13-11 and #SD-13-18 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING CITY OF BURLINGTON/ BURLINGTON INTERNATIONAL AIRPORT 1150 AIRPORT DRIVE PRELIMINARY PLAT APPLICATION #SD-13-11 FINAL PLAT APPLICATION #SD-13-18 FINDINGS OF FACT AND DECISION City of Burlington, Burlington International Airport hereafter referred to as the applicant, is seeking Preliminary and Final Plat approval for a planned unit development to construct a 711 sq. ft. sewage receiving facility, 1150 Airport Drive. The Development Review Board held a public hearing on August 20, 2013. Jon Leinwohl represented the applicant. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The City of Burlington, Burlington International Airport hereafter referred to as the applicant, is seeking Preliminary and Final Plat approval for a planned unit development to construct a 711 sq. ft. sewage receiving facility, 1150 Airport Drive. 2. The owner of record of the subject property is the City of Burlington. 3. The application was received on March 29, 2013. 4. The subject property is located in the Airport Zoning District. 5. This is a reopened hearing to consider new evidence regarding the hours of operation. 6. The plans submitted consist of a fourteen (14) page set of plans, page one (1) entitled "Burlington International Airport South Burlington, Vermont Aircraft Sewage Receiving Station FAA AIP Project No. 3-05-0005-095-2013 Contract #2" Submittal Revised , prepared by Stantec Consulting Services Inc., dated June 7, 2013. DIMENSIONAL REQUIREMENTS 7. Building coverage, overall coverage, and front yard coverage requirements are being met. 8. Setback requirements are being met. CADocuments and Settings\ray\Local Settings\Temporary Internet Files\0LK45\SD_13_11_and_SD_13_18_1150AirportDrive_final_revised_ffd doc #SD-13-11 and #SD-13-18 SUBDIVISION CRITERIA Pursuant to Section 15.18 of the South Burlington Land Development Regulations, subdivisions shall comply with the following standards and conditions: Sufficient water supply and wastewater disposal capacity is available to meet the needs of the project. According to Section 15.13 of the South Burlington Land Development Regulations, the existing public water system shall be extended so as to provide the necessary quantity of water, at an acceptable pressure. According to Section 15.13 of the South Burlington Land Development Regulations, the subdivider or developer shall connect to the public sewer system or provide a community wastewater system approved by the City and the State in any subdivision where off -lot wastewater is proposed. 9. The project will tap into existing sewer lines near the location of proposed sewage receiving facility. The City Engineer has reviewed the plans and stated that he has no comments. The Board finds that this criterion is being met. Sufficient grading and erosion controls will be utilized during and after construction to prevent soil erosion and runoff from creating unhealthy or dangerous conditions on the subject property and adjacent properties. The proposed project shall adhere to standards for erosion control as set forth in Section 16.03 of the South Burlington Land Development Regulations. In addition, the grading plan shall meet the standards set forth in Section 16.04 of the South Burlington Land Development Regulations. 10. The Board finds that this criterion is being met. The project incorporates access, circulation, and traffic management strategies sufficient to prevent unreasonable congestion of adjacent roads. 11. The proposed project will have no impact on traffic. The Board finds that this criterion is being met. The projeces design respects and will provide suitable protection to wetlands, streams, wildlife habitat as identified in the Open Space Strategy, and any unique natural features on the site. 12. There are no wetlands, streams, or wildlife habitat on the site. The subject property is an operating airport and is not identified in the Open Space Strategy. The Board finds that this criterion is being met. The project is designed to be visually compatible with the planned development patterns in the area, as specified in the Comprehensive Plan and the purpose of the zoning district(s) in which it is located. The Board previously recommended that the building be designed to complement the architecture of the parking garage and/or terminal building, as this structure will be among the first seen from Airport users approaching from Kennedy Drive. The building will be visible through the cemetery to the south. As recommended at the sketch plan review, the applicant has proposed planting fifteen (15) Thuja occidentalis 'Nigra'trees at the southwest corner of the property to screen the view from Airport Drive and to abut a line of existing cedar hedges on the west edge of the property. 13. The Board finds that the building's design is complementary with the parking garage and/or terminal building. Open space areas on the site have been located in such a way as to maximize opportunities for creating contiguous open spaces between adjoining parcels and/or stream buffer areas. 14. There are no open space areas on the site. This criterion has been met. The layout of a subdivision or PUD has been reviewed by the Fire Chief or (designee) to ensure that adequate fire protection can be provided. 15. The Fire Chief had no concerns or comments with respect to this project's compliance with City regulations. This criterion has been met. Roads, recreation paths, stormwater facilities, sidewalks, landscaping, utility lines and lighting have been designed in a manner that is compatible with the extension of such services and infrastructure to adjacent landowners. 16. Utility lines for this project are buried. The applicant has submitted details on proposed lighting. The Board finds that this criterion is being met. Landscaping Pursuant to Section 13.06(A) of the Land Development Regulations, landscaping and screening shall be required for all uses subject to site plan and PUD review. Landscaping budget requirements are to be determined pursuant to Section 13.06(G) (2) of the SBLDR. The landscape plan and landscape budget shall be prepared by a landscape architect or professional landscape designer. 17. The applicant has submitted a detailed landscaping plan and budget proposing $4,500 in landscaping costs and $150,000 in building construction costs. 18. The Board finds that this criterion is being met. Roads, utilities, sidewalks, recreation paths, and lighting are designed in a manner that is consistent with City utility and roadway plans and maintenance standards. 19. The proposed project has no impact on roads, sidewalks or recreation paths. The project is linking with existing City utilities. The proposed use of downcast and shielded light fixtures is consistent with City standards. This criterion is being met. 3 CADocuments and Settings\ray\Local Settings\Temporary Internet Files\OLK45\SD_13_11 _and_SD_13_18_1150AirportDrive_final_revised_ffd.doc #SD-13-11 and #SD-13-18 Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. The project is consistent with the goals and objectives of the Comprehensive Plan for the affected district(s). 20. The Board finds that the proposed project is in conformance with the South Burlington Comprehensive Plan. In addition to the above general review standards, site plan applications shall meet the following specific standards set forth in Section 14.07 of the Land Development Regulations: (a) The reservation of land may be required on any lot for provision of access to abutting properties whenever such access is deemed necessary to reduce curb cuts onto an arterial or collector street, to provide additional access for emergency or other purposes, or to improve general access and circulation in the area. 21. The reservation of land is not necessary. This criterion will continue to be met. (b) Electric, telephone, and other wire -served utility lines and service connections shall be underground. Any utility installations remaining above ground shall be located so as to have a harmonious relation to neighboring properties and to the site. 22. This criterion will continue to be met. (c) All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure, and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). A roll -off trash compaction unit and conventional recycle dumpster are proposed for the easterly side of the new building. These will be screened from the view from Airport Drive by the new building and by chain link fence with slats on the north and south sides. 23. To mitigate against noise during construction and from operation of the trash compaction unit, the applicant has indicated they will construct a poured concrete wall and not conduct construction activities nor operate the trash compaction unit between the hours of 7 PM to 7 AM. (d) Landscaping and screening requirements 24. This criterion is being met. OTHER STANDARDS: Section 13.06((8) Snow Storage. Pursuant to Section 13.06(8), snow storage areas must be specified and located in an area that will minimize the potential for run-off. 11 CADocuments and Settings\ray\Local Settings\Temporary Internet Files\OLK45\SD_13_11_and_SD_13_18_1150AirportDrive_final_revised_ffd doc #SD-13-11 and #SD-13-18 Section 13.07(A) Lighting. Pursuant to Section 13.07(A), all exterior lighting shall be shielded and downcasting to prevent light from spilling onto adjacent properties and rights -of -way. 25. Snow storage areas are shown on the plan. Downcast and shielded lighting is proposed. This criterion will be met. DECISION Motion by Bill Miller, seconded by Michael Sirotkin, to approve the Preliminary Plat Application #SD-13- 11 and the Final Plat Application #SD-13-18 of the City of Burlington / Burlington International Airport, subject to the following conditions: 1. All previous approvals and stipulations shall remain in full effect except as amended herein. 2. This project shall be completed as shown on the plat submitted by the applicant and on file in the South Burlington Department of Planning and Zoning. 3. Prior to permit issuance, the applicant shall post a $4,500 landscaping bond. This bond shall remain in full effect for three (3) years to assure that the landscaping has taken root and has a good chance of survival. 4. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 5. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to use or occupancy of the building. 6. The applicant shall not conduct construction activities nor operate the trash compaction unit between the hours of 7 PM to 7 AM. 7. Any changes to the final plat plan shall require approval of the South Burlington Development Review Board. 8. The mylar shall be recorded prior to the issuance of a zoning permit. 9. The final plat plan (site plan) shall be recorded in the land records within 180 days or this approval is null and void. The plan shall be signed by the Board Chair or Clerk prior to recording.
