The landowner shall record and index this permit in the South Burlington Land Records within thirty, (3o) days of issuance of this permit and prior to the conveyance of any lot subject to the jurisdiction of this permit. ;A Regional Offices — Barre/E-,; 3ex Jct./Rutland/Springfield/St. Johnsbury Wastewater System and Potable Water Supp( '?rmit W W -4-1042-9 Page 2of3 1.4 The landowner shall record and index all required installation certifications and. other documents that are required to be filed under these Rules or under a specific permit condition in the South Burlington Land Records and ensure that copies of all certifications are sent to the Secretary. 1.5 No permit issued by the Secretary shall be valid for a substantially completed potable water supply and wastewater system until the Secretary receives a signed and dated certification from a Vermont Licensed Designer (or where allowed, the installer) that states: `I hereby certify that, in the exercise of my reasonable professional judgment, the installation -related information submitted is true and correct and the potable water supply and wastewater system were installed in accordance with the permitted design and all the permit conditions, were inspected, were properly tested, and have successfully met those performance tests', or which otherwise satisfies the requirements of §1-308 and §1-911 of the referenced rules. 1.6 This project is approved for the construction of an aircraft sewage receiving station at the existing airport. The historic use of the airport is reported to be 690, 568 passengers departing per day during 2oo6, with the average daily enplanements during 2oo6 of 1,892 passengers. The average daily design flows would be calculated at 1, 892 passengers x 5 gpd per person = 9,'46o gallons per day. A permit will be required for any increase in use over the 2oo6 values. 1.7 All conditions set forth in Permit Number WW-4-1042 and amendments shall remain in effect except as amended or modified herein. 1.8 Construction of additional nonexempt buildings, including commercial and residential buildings, is not allowed without prior review and approval by the Drinking Water and Groundwater Protection Division and such approval will not be granted unless the proposal conforms to the applicable laws and regulations. No construction is allowed that will cause non-compliance with an existing permit. 1.9 Each purchaser of any portion of the project shall be shown a copy of the Wastewater System and Potable Water Supply Permit and the stamped plan(s), if applicable, prior to conveyance of any portion of the project to that purchaser. 1.10 By acceptance of this permit, the landowner agrees to allow representatives of the State of Vermont access to the property covered by the permit, at reasonable times, for the purpose of ascertaining compliance with the Vermont environmental and health statutes and regulations, and permit conditions. 1.11 Any person aggrieved by this permit may appeal to the Environmental Court within 3o days of the date of issuance of this permit in accordance with 10 V.S.A. Chapter 22o and the Vermont Rules of Environmental Court Proceedings. 2.WATER SUPPLY 2.1 The components of the potable water supply herein approved shall be routinely and reliably inspected during construction by a Vermont Licensed Designer (or where allowed, the installer) who shall, upon completion and prior to occupancy of the associated building, report in writing to the Drinking Water and Groundwater Protection Division that the installation was accomplished in accordance with the referenced plans and permit conditions, as specifically directed in Condition #1.5 herein. 2.2 This project is approved for connection to the water supply system owned by the City of South Burlington for a maximum of 30 gallons of water per day. 2.3 The landowner shall install and maintain backflow prevention devices that conform to Vermont Department of Public Safety standards and NFPA 13 for any connection of a sprinkler fire suppression system to a public drinking water system. 2.4 This permit is .based, in part, on a municipal approval for connection to their water distribution system. If the municipal approval expires, this permit shell be invalid unless the municipality renews its approval. If the municipality approval expires, a new permit must be issued for the project. An updated application form and an application fee will be required for the project. A new municipal approval letter shall be required. The rules in effect at the time of the filing of the application for a new permit will be applied to the project. .WASTEWATER DISPOSAL 3.1 The components of the sanitary wastewater system herein approved shall be routinely and reliably inspected during construction by a Vermont Licensed Designer (or where allowed, the installer) who shall, upon completion and prior to occupancy of the associated building, report in writing to the Drinking Water and Groundwater Protection Wastewater System and Potable Water SupP( ?rmit W W-4-1042-9 Page 3 of 3 Division that the installation was accomplished in accordance with the referenced plans and permit conditions, as specifically directed in Condition #1.5 herein. 3.2 This project is approved for connection to the City of South Burlington wastewater treatment facility as depicted on the plan(s) stamped by the Drinking Water and Groundwater Protection Division. The project is approved for a maximum of 1120 gallons of wastewater per day. 3.3 The design flows for this project are based on the proposal from the Licensed Designer and existing practices. A magnetic flow meter shall be installed on the discharge side of the rotary pump in order to track the daily volume of wastewater discharged into the municipal wastewater collection system. The system shall record daily flow data. A Vermont Licensed Designer shall analyze the data and submit an annual report by July 1 that demonstrates the design flows are within approved gallons per day. If the maximum daily flow rates exceed the approved allocation of 1120 gallons per day, an amendment to the permit will be required. 3.4 A Vermont Licensed Designer shall include certification that the oil/water separator was installed as shown on the approved plans. 3.5 This permit is based, in part, on a municipal approval for connection to their wastewater treatment facility. If the municipal approval expires, this permit shall be invalid unless the municipality renews its approval. If the municipality approval expires, a new permit must be issued for the project. One reason I am so interested in the space you have for lease is that I have been a pilot for 25 years and in the early 90's kept my Cherokee six at Valet Air. 1 know that the surrounding atmosphere will make an ideal home base for my company. Omni Meas- urement Systems, Inc. is an engineering research and development company. We work primarily in areas where the design of new technology and equipment is required for industry to meet the new or upcoming government regulations. One of the main products we will be testing and assembling in this facility is a proprietary design, owned by me, for a new Smart Sensor Technology used to meet the US Weights and Measures' requirements for NTEP certified on -board weighing systems. This technology has applications ranging from Commercial Trucking to Aircraft. Omni is currently delivering over $50,000.00 per month worth of product. Once this facility is up, we will be ramping production to $200,000.00 per month over the next 12 months. I anticipate requiring additional space within the next 12 months. Omni intends to use this space as an engineering and light manufacturing facility. It will be assembling Load Cells and other smart sensor technology devices as required for business. This process includes the use of standard 208 three phase power for 2 — 30' kitchen sized ovens. A small amount of welding and drilling will be done as modifications to the test vehicle and test equipment are required. We will also be doing electronic assembly and testing of the digital indicators developed by Omni. This facility will be a white lab coat environment. A Clean, professional looking facility is essential for the image and qualtiy control that I expect for Omni. Mr. Burgess referred to his question at the previous meeting about whether this use was an approved use. Ms. Bechtel said she had reviewed the records and could find no approval for a multiple use on the lot. The City Attorney has said that since the use exists there now, a Zoning Board review is not appropriate, but Mr. Burgess was concerned about uses starting which were not approved by the city. If those uses later asked permission to expand, would they be grandfathered simply because they existed at the time permission was requested? Mr. Poger asked Ms. Bechtel to ask the City Attorney whether, in cases where a use has grown over time, the• administrative officer could declare that the use was no longer ancillary and must come in for a zoning 'variance. He also wanted to know if a use which had grown out of bounds could be terminated. Mrs. Maher did not feel the Commission had done that at the last meeting on this item. She felt the Commission had requested a clarification. Ms. Bechtel noted that the Board had met last night and had received a copy of the Attorney's letter. The Board felt that to add a stipulation which would limit the number of support staff allowed would change the motion, which they could not do. Individual members did make comments, though. They felt that the size of. the building would limit the size of the staff and the stipulations already placed would apply to any new owners of the building. Mr. Dooley asked whether the Zoning Board had asked the applicant if he would enter a stipulation as to the number of employees and was told that a-:xoluhtar.,,amendment had not come up.. Ms. Bechtel said changes had been made on the lot to address the Commission's concerns. It was a larger addition and involved changing curb cuts. This new plan does not involve the changing of curb cuts. The location of trees will have to be verified as they may be on city land. Mr. Dooley asked about the truck issue in the past. Mr. Kellogg said they had wanted a loading dock with a curb cut to service it, but the Commission had not approved it. He added that they haven'-t been able to locate water lines yet. The hydrant requested for the rear of the building will be a problem. He said the Northern Airways and Pratt & Whitney buildings will both be sprinklered and there will be a firewall between. Mrs. Lafleur said the Chief is trying to aid Air Guard fire fighting efforts when they come across the field. There will be two fire hydrants on the site, and Chief Goddette's concern about adequate water flow has been addressed by putting a fire wall between the existing building and the addition. Mr. Burgess referred to his question at the previous meeting about whether this use was an approved use. Ms. Bechtel said she had reviewed the records and could find no approval for a multiple use on the lot. The City Attorney has said that since the use exists there now, a 'Zoning Board review is not appropriate, but Mr. Burgess was concerned about uses starting which were not approved by the city. If those uses later asked permission to expand, would they be grandfathered simply because they existed at the time permission was requested? Mr. Pager asked Ms. Bechtel to ask the City Attorney whether, in cases where a use has grown over time, the administrative officer could declare that the use was no longer ancillary and must come in for a zoning; variance. He also wanted to know if a use which had grown out of bounds could be terminated. Maher did not feel the Commission had done that at the last meeting on this item. She felt the Commission had requested a clarification. Ms. Bechtel noted that the Board had met last night and had received a copy of the Attorney's letter. The Board felt that to add a stipulation which would limit the number of support staff allowed would change the motion, which they could not do. Individual members did make comments, though. They felt that the size of the building would limit the size of the staff and the stipulations already placed would apply to any new owners of the building. Mr. Dooley asked whether the Zoning Board had asked the applicant if he would enter a stipulation as to the number of employees and was told that a voluntary amendment had not come up. Ms. Bechtel said changes had been made on the lot to address the Commissiun's concerns. The driveway has been widened to allow cars to back up on the lot, not out into Williston Road, if there is a conflict. Mr. Michael Dugan said he had discussed drainage with the City Manager Engineer and it will go to the storm drains on Williston Road. The possible connection to the Yierriam-Graves lot was discussed with thew and they will not agree to it. Dr. Guerra said there was an area for snow storage, but if there is excess, they will truck it out. Mr. Dooley felt the question about the Zoning Board stipulation had not really been answered and it was suggested that future such questions be in the form of a motion. Mr. Dooley felt that the Commission had wanted a clarification, with the consent of the applicant, not a reconsideration. He indicated that since there is no new use on the site, -and this is continuing a use that has been on -going it is probably inappropriate to require zoning Board review. If it was a totally new use, their approval may be appropriate. The maintenance and repair shop, and warehousing and trucking are all permitted uses in the Air- port -Industrial District. All of the major concerns from the July meeting have been resolved. These include: 1. One 3V wide driveway located at the center of the building rather than two as originally proposed. The existing drive will be closed off. Parking spaces have been moved so traffic can circulate more easily around the corner of the building; to s , 2. The aisle at the southern wall of the building has been widened accommodate parking cars and emergency vehicles; 3. Two fire hydrants will be placed on site; 4. Parking is provided for trucks loading and unloading. 5. Chief Goddette and the Air Guard Chief are satisfied that the fire wall between the existing building and new addition will remove any concerns they had about insufficient water to the building. That discussion will be re- layed to you at the Commission meeting. Also the City Attorney has noted that it is not appropriate to request the Zoning Board to reconsider their decision (see enclosed Spokes letter of July 31, 1984). The Zoning Board's stipulations for one physician, a limited number of parking spaces and no significant external changes to the structure, seem to place maximum control over the use of the land as was within their jurisdiction. Several items have been improved on the site to meet your concerns. A wider area is provided in the front yard to allow vehicles to back into, in the event two vehicles meet in the driveway. This prevents any backing onto Williston Road, which was Bill Szymanski's concern. The applicant has also discussed 2. Consider site plan application of Northern Airways, 1150 Airport Drive for T 100' x 50' addition to bu' ing and renovation of parking area Mr. Hal Findlay said they wanted to expand the parking lot from 78 spaces which are dirt and unmarked, to 82 paved spaces. They would also like a second curb cut to allow transport and delivery trucks a more direct access to the new addition. The addition is for engine overhaul and shipping. Pratt & Whitney does Northern Airways' engine repair and has a shipping and receiving dock on the west end of the building. Mr. Poger said the Commission did not like adding curb cuts, especially in areas with a lot of traffic. He asked about closing the existing cut. It was noted that sometimes they had two trucks on ttie lot at one time, and with only one cut, traffic might be blocked. Ms. Bechtel suggested a waiting area for trucks. Mr. Findlay was asked about the use of the building and he said this facility was the base for the U.S. Pratt & Whitney engines are shipped through here because they are manufactured in Canada. From here they go to one of 7 service centers. They usually have 2-3 trucks per day delivering engines and there are 5 - 12 engines per truck. They are not all serviced here, many are shipped through. Mr. Burgess asked if that was part of the originally approved use, since it sounded like warehousing. He asked Ms. Bechtel to check on that. Mr. Findlay said they also did inspections and repairs on engines in this building. Mr. Dooley asked about the size of the delivery trucks and was told some were 22' long and some were 40' and that there were 5-12 trucks in and out per day. Ms. Bechtel said the trouble with closing the existing curb cut was that it would make fire protection hard. The Chief would prefer that the existing cut be chained. Mr. Roger said a chain might work better for a commercial use than for residential. PLANNING COMMIS;;ION JULY 10, 1984 Ms. Bechtel noted that the widest a single curb cut could be was 36'. Mr. Findlay said they had pilots coming in and out on their shifts and that they ran a day and night shift, so there were always cars coming and going. The Commission cannot waive the curb cut width. The Zoning Board would have to give approval. Mrs. Maher felt the Planner and Engineer should look at the plan again, especially the width of the drive. Ms. Becthel said she and the Engineer had looked at the lot and that he had felt the existing curb cut should be closed. Mr. Poger noted that the Fire Chief had said there was not enough water for fire protection. He wanted to know the flow rate in the area for the next meeting. Mr. Poger mentioned eliminating some parking spaces for easier traffic flow around the corner of the building if the existing curb cut were closed. Mr. Burgess wanted more information from the Fire Chief on the adequacy of the water supply in the area, and Mr. Poger noted that if there were not enough water to protect the building, he would not recommend that approval be granted. Mrs. Maher suggested that some pine trees be added for landscaping. Mrs. Maher moved to continue the site plan application of Northern Airways until July 24, 1984, 7:30 pm at City Hall. Mr. Belter seconded the motion and all voted aye. Consider request by Green Mountain Masonic Center(formerly Ancient Accepted Scottish Rite Temple for extension of site plan approval granted 6 19 84 from 6 months to 15 months . Mr. Hugh Marvin told the Commission that they were in the process of arranging a financial campaign in the membership and that they would not have funding until the end of December. They do not expect to begin construction until next summer. He asked that the approval be good for 15 months so they could get organized. Mr. Poger noted that a synagogue at the corner of Dorset Street had recently made the same request and been granted an extension. Ms. Bechtel warned Mr. Marvin that although the plan had sewer capacity from the city, the State did not have to honor that and when this plan went before the State, it was possible they would say there was not enough capacity. Mr. Dooley moved that the site -plan approval for the Green Mountain Masonic Center be extended from 6 months as originally granted, to 15 months, and that all the stipulations on the original approval still exist. Mrs. Maher seconded the motion and all voted for it. Other business Mr. Poger noted that plans had been submitted for the conversion of the Mobile station at the corner of Kennedy Drive and Hinesburg Road, but there was a slip-up on the agenda. Since the application had not been warned, no action could be taken tonight, but the applicant wanted to make a presentation tonight. The item will be on the next agenda also. Mr. Schmucker represented Mobile and Mr. Lareau, who operates the station. He said that the present building would be removed and replaced with a new one, in an altered location. The new building will have 2 bays instead of 3. The existing two curb cuts on Hinesburg Road will be made into one more central one. Both Kennedy Drive cuts will remain, but will be moved slightly. There will be only one pumping facility, with a canopy, but it will allow 6 vehicles to be gassed at one time. Green space on the site will be increased. Mr. Schmucker said he had met with representatives of the condominium association adjacent to this lot, and they had requested more plantings between the two uses. Those will be added. The area is zoned R-4. Pedestrian and Vehicular Access: A ten foot wide existing circular driveway provides access to the building and parking area. Circulation and Parking: Circulation is adequate and parking space for 5 vehicles are provided. Seven parking spaces are required to meet the requirement of 1 space for each 200 square feet of building area, however, I agree with the Zoning Board that 5 are adequate for this specific use. I recommend the Planning Commission waive the other two required spaces. Landscaping: Existing landscaping is adequate. Proposed interior improvements total $2000, calling for a landscaping value of $60. Credit should be allowed for existing vegetation worth well above this figure. Other: Chief Goddette has reviewed this plan and finds it satisfactory. 10) Benchmark Construction The applicant proposes to convert the structure into 2 offices for Benchmark Construction and Lawson Office Products. Bechtel, City Planner Re: July 10 Agenda Items Date: 7/6/84 3) MARINE COLLECTION, LTD, 2073 WILLISTON ROAD The applicant has received Zoning Board of Adjustment approval to construct a 30'x80' storage building with boat wash racks as a multiple -use on the property. This is the third building on the lot; the existing two structures are for automotive sales and service and marine sales and service. The new boat wash facility is to service the existing boat sales operation and will not create new traffic. The land is zoned mixed Industrial and Commercial. Pedestrian and Vehicular Access: The existing access points are no major items of concern. Circulation and Parking: No new parking is required. However, some existing parking spaces do not meet the 20' aisle requirement and emergency vehicle access is limited. (see Chief Goddette's letter) Landscaping: The proposed landscaping plan meets the 3% require- ment. Other: The lot coverage is less than the 70% maximum limit. See Bill Szymanski's memo regarding water disposal and drainage. 4) NORTHERN AIRWAYS, 1150 AIRPORT DRIVE Northern Airways and Air North propose to build a 100'x50' add- ition to the existing building and to renovate the parking area. The new building will be located at the north end of the present hangar and will be used as an engine repair and over facility, and as office space. The revised parking plan is proposed to remedy serious parking problems. Pedestrian and Vehicular Access: There is one existing 47 foot driveway. The applicant is proposing two curb cuts; the proposed 40' driveway will be as an exclusive delivery truck entrance and exit, leading directly to the loading dock. While it may be reasonable to limit truck traffic to this one access point and to limit conflicts with car traffic, in practice, both driveways will probably be used by autos and since parking is proposed on either side of the truck access drive. A better alternative may be to close the existing driveway and to use the new driveway for two- way traffic serving both parking vehicles as well as delivery trucks. In either case, the maximum width of a single driveway is 36 feet and 30 feet for a dual driveway. Chief Goddette does not recommend one access drive unless the second is paved and chained for emergency vehicle access only. Circulation: The aisle/ between the two parking lanes located between the south wall of the building and the fence ark narrow; the applicant should move the fence a few additional feet south, to better accommodate parking vehicles. The aisle should be 24'. Parking: Ninety seven spaces are proposed. Two handicapped spaces are required measuring 131x20'. Loading and unloading space should be shown to accommodate the maximum number present at any one time. leiAt ,rul- Landscaping and Screening: I have not yet received landscaping plan although it is expected by the time of the Commission meet- ing. Other: A 15' landscaped strip is proposed in the front yard, as required. Since Airport Drive is scheduled to be widened from 66' to 80', the applicant has been asked to dedicate seven feet of frontage to the City. No progress has been reported on this date. Maximum lot coverage restrictions do not apply to this application since it is part of the entire airport complex and not an individual lot. See Bill Szymanski's memo regarding drainage. 5) GREEN MOUNTAIN MASONIC TEMPLE (formerly Ancient Accepted Scottish Rite Temple) On June 19, 1984, the Planning Commission considered and approved the Site plan application for the above mentioned applicant. A 6 month expiration date was set. The applicant has requested an extension of that period to a 15 month period from approval date. They indicate that construction can not begin within 6 months. The Zoning Regulations allow the Commission to grant a longer approval period if a project reason- able requires a longer period prior to construction. (section 20.302) I recommend approval of this extension request. The applicant should be aware however, that although sewer capacity was available at the time of approval, capacity can not be guaranteed at a later date. The engineer's report shall include but not be limited to the numerical results of all leakage tests performed on the water line and review of the pipe in trench before covering, and the disinfection of all water pipes. The work shall be done in accordance with the Environmental Protection Rules, Effective September 10, 1982. (7) A professional engineer, registered in the State of Vermont, is to generally supervise the construction of the sanitary sewer line extensions, and, upon completion of construction, the supervising engineer is to submit to the Protection Division a written certification stating all construction has been completed in accordance with the stamped approved plans. The engineer's certification is to be submitted to the Division prior to the occupancy of any unit and the certification shall include, but not limited to, the numerical results of all leakage testing performed on each section of the sanitary sewer extension as described in Appendix A, of the Environmental Protection Rules. (8) The engineer's certification mentioned in Condition 7 above shall also include an inspection of the connection to the existing water and sewer lines where they enter the 1980 building addition in order to confirm suitable pipe materials in accordance with the Rules and the National Plumbing Code. Any deficiencies found shall be reported immediately in writing to the Division of Protection and a plan shall be submitted outlining how and when the deficiencies shall be corrected. PLUMBING (9) The Division of Protection is to be notified prior to the closing or covering of any waste plumbing so that we may inspect the workmanship. (10) The Master Plumber responsible for the interior plumbing shall provide the owner of the project a written certifica- tion stating that the work has been done in accordance with the approved plans and the Environmental Protection Rules, Effective September 10, 1982. (11) The applicant is reminded that all plumbing material and workmanship must meet the standards of the Environmental Protection Rules, Chapter 9, Plumbing; the National Plumbing Code; and the requirements of the Vermont Fire Prevention Section of the Department of Labor and Industry. ACCESS AND CIRCULATION: Access shall be from the existing entrance at the southern corner of the building. Circulation is around three sides of the building. PARKING: The plan proposes 94 existing parking spaces. LANDSCAPING: The $100,000 addition requires a $3000 landscaping plan and bond. The plan shows approximately $2500 worth of landscaping. Five new norway maples are shown in the front lawn. This may be on City owned property and should be checked. If there is adequate space, these could be increased in size or number to make up the deficiency in cost. A revised plan should be submitted prior to permit. HICKOK AND BOARDMAN, ORDINANCE INTERPRETATION Bill Rowell has asked for an interpretation of section 16.202 of the Zoning Regulations that permits light manufacturing in the Industrial -Agricultural district. The Lane Press is considering the former Mitel building on Hinesburg Road and requests that they be considered a permitted use under this section. Dick Ward and I were reluctant to agree with this interpretation since other sections of the ordinance clearly distinguish between light -manufacturing and printing.
