AMENDMENT APPLICATION AND HEARING

Amendment Application #4C0034-7 was filed by the Burlington International
Airport, c/o Walter Houghton, Director of Aviation, Burlington International
Airport, South Burlington, Vermont and the City of Burlington, Burlington City
Hall, Burlington, Vermont and 3060 Associates, c/o Paul Wamsganz, 66 Pearl
Street, Essex Junction, Vermont, on October 1, 1985 for the construction of
an 1,150 foot access road from Route 2 into the hangar area at the end of
Runway W33 in South Burlington, Vermont.
This project will be evaluated in accordance with the 10 environmental cri-
teria of 10 V.S.A., 6086(a). Statutory parties to this application are the mun
cipality, the municipal planning commission, the Chittenden County Regional
Planning Commission, and affected State agencies. Adjoining property owners
may participate to the extent the proposal will have a direct effect on their
property under the 10 criteria. Other persons may participate at the discretio
of the District Commission. If you wish to participate, please contact the
Coordinator for further information before the first hearing or date as speci-
fied below.
Copies of the application and plans for this project are available for in-
spection by members of the public during regular working hours at the South
Burlington Municipal Office, the Chittenden County Regional Planning Commission
Office and the District #4 Environmental Office.
A public hearing is scheduled �di 6:445 gym., Thursday, October 24 1985 at
the Chittenden County Regional P1 in ission office at 66 Pearl Street,

Please enter the appearance of the Agency of Environmental Conservation,
State of Vermont, in the above captioned matter.
The Agency of Environmental Conservation would request the District
Cammission to require Applicant to submit a master plan for all proposed
development and expansion at the Burlington International Airport. The master
plan should include prospective runway expansion, terminal expansion, parking lot
expansion, and all site related improvements. Additionally, the master plan
should include an overall comprehensive system for managing non -sanitary wastes
at the airport. These non -sanitary wastes most corramnly consist of spilled oils,
gasoline, hydraulic fluid and other fuels. It is necessary to have some sort of
plan to deal with these types of substances so that the soils in and around the
airport area will not be adversely affected. An overall master plan for the
project will also serve the ends of the Act 250 process by allowing the
Commission to see and evaluate a comprehensive plan for development rather than a
piece -meal type of development. The basic purpose of Act 250 is to allow an
impartial Commission to take a look at the true impacts of a project. The
Commission can accomplish this goal effectively in this case only if it has a
master plan to which it can refer.
There may be some wetlands on or within this project area and, therefore,
Applicant should contact Carl Pagel, Aquatic Biologist, Department of water
Resources and Environmental Engineering, 81 River'Street, Montpelier, Vermont
05602, 828-2761, to determine if the wetlands will be adversely affected.
Finally, the Agency of Transportation will require an access permit for
access onto U.S. Route 2. Applicant should contact the Agency of Transportation
at its earliest possible convenience. Additionally, the Agency would request the
Cammission to look at any adverse impact this project may have on traffic on U.S.
Route 2.

and brook. The building will be 80' x 401, mainly for
warehouse and storage with a 20' x 40' office in front.
There are 3 parking spaces in front and 3 in the rear. The
company has 2 employees now and may have 3 in the future.
Access will be off Ethan Allen Drive. The building is set
back starting from the 5-1/4' dedicated strip. The City
Manager has approved the location of the septic tank and
recommends that water service come from Ethan Allen Drive.
Mr. Fitzpatrick noted that water service is already installed
on Limerock Rd. to the property line which the City Manager
may not be aware of.
The applicant may wish to have some outside storage and Mrs.
Lafleur said there should be some screening for that. Mr.
Fitzpatrick said they would be willing to revise the plan to
indicate that. Mr. Samson of NETC stressed they want the
site to be a good landscaping example since they supply land-
scapers.
4) Mr. Dooley moved that the Planning Commission _approve the
site plan application of Rene Berard for construction of a
3200 sg ft building on lot #2 of the Belter Industrial sub-
division as depicted on a plan entitled "N.E.T.C. Livestock
Fence Company, lot 2, Ethan Allen Farm _ Site Plan" stamp
dated October 17, 1985 prepared �?y Fitzpatrick -Llewellyn,
Inc, with the following stipulations:
1. A $1800 landscaping bond shall be posted prior to permit.
The applicant shall submit a revised landscaping plan to
screen any outside storage to be approved �2y the City Planner
prior to permit.
2. The plan shall be amended as approved 12y the City Planner
prior to permit to show an area in which outside storage is
permissible up to 600 sA ft. No other area shall be used for
outside storage
3. Septic connections shall be located for future connection
to a sewer line.
4. The new inlet on Ethan Allen Drive shall be City standard.
5. The building permit shall be obtained within 6 months.
Mr. Burgess seconded, and the motion passed unanimously.
5) Review proposed Burlington International Airport access road
from Williston Rd. to the southern end of the Airport.
Mrs. Lafleur expressed concern with the proposed -road as it

could result in increased traffic on Williston Rd. and also
does not leave adequate room without disrupting the Tate
plan. Mrs. Maher asked why the airport is 5 E.AJ%ng a paved
city street when it is"not needed for just a few cars. She
said that even though the Airport has said they will have a
fence at the end of the road, fences can be removed, and the
Commission is concerned that the road will become another
major access to the Airport. Mr. Dooley said the plan showed
the road directly opposite Shunpike Road, but it was his
under standing that the road is not directly across. Mrs.
Lafleur stressed that the City Manager had never approved a
major road for this site, just an access for Brockway. In
addition, Tate never said a road would be put in, and it is
not part of their approval. Mr. Dooley expressed concern
that a person with site plan approval is suddenly putting a
road through the middle of the plan.
The concensus of the Commission was that they wanted Tate to
come back to the Commission to discuss what is happening.
Mrs. Lafleur noted that an Environmental hearing has been
scheduled and wanted to know the Commission's wishes as to
what to convey to that Board. Mrs. Hurd said she would like
to see an engineering study. Mr. Dooley felt that nothing
should be done until the question of the violation of Tate's
subdivision is settled. He felt the Environmental Board
should be asked to continue the hearing until that time.
Mrs. Maher said they better have recommendations in case the
hearing goes forward. She felt a 20-foot gravel road would
leave the city with the assurance that the airport is not
planning for this to become a major access. She added she is
very suspicious when a full standard road is proposed.
Mr. Burgess said if it is the intention to discourage use of
this road, the Commission should do everything in its power
to do so. Mr. Dooley agreed. He said there is nothing to
say what the airport will be like 10 years from now, and this
road could become a major artery. If that's not good
planning, it should be prevented.
Mrs. Lafleur will check with the City Attorney as to the
City's rights as far as Mr. Tate is concerned.
6) Consider revised site plan application of RIVCO for 15
additional parking spaces on Lot #_ , Gregory Drive.
Mr. Dugan said the 15 spaces will be: 4 on the southwest
corner of the building and 11 down below. They would still
be OK on coverage. He said the spaces are needed for sales-
men coming to the building.

Re: Airport Access Road Update and other business
Date: October 25, 1985
Attorney Richard Spokes believes we have a legal right to require
Ira Tate to revise his site plan. The access road agreement
with the Airport has changed the use of a portion of Tate's
property and it affects one or more of the site plan criteria,
namely access, parking and perhaps landscaping.
Ira Tate has agreed to revise his plan if the Planning Commission
requires it. I will be meeting with him and his architect today.
Tate's deal with the airport was for the airport to pave the
driveway/parking area in exchange for the use of his land for
access. His understanding was that it is limited access for the
Brockway office and hangar traffic and for the people who use the
private hangar condos. He belives it will be a limited use road.
I expressed the concerns of the Planning Commission to the District
Environmental Commission at the Act 250 meeting on October 24.
The Commission has restricted this to a "limited access" private
road that is open only to the Brockway hangar and the private
condo'hangars. The expected traffic is 20 vehicles per day.
Any additional uses will require a new or amended application.
Of course, this is usually a question of good faith on the part
of the Airport, or enforcement on the part of the District
Commission, or a watchdog neighbor.
The District Commission wants to be notified if the South Burlington
Commission requires the road be moved to the west six feet to better
align with Shunpike Road. This will not affect their approval.
I still believe this may some day become a more heavily used access
road to the Airport -Industrial area. Given this, we should re-
quire Tate's site plan be changed to remove any parking -access
road conflicts and improve the alignment with Shunpike Road.
This will be on the November 12, 1985 agenda.
Ernie Pomerleau is ready to submit a sketch plan for a large
commercial development on Shelburne Road behind Burger King. He
has a traffic study to justify it. Given the serious traffic
problems in this area, he has agreed to wait until we can hire
our own traffic consultant to conduct a detailed, independent study
of the area. I am talking with consultants now and will schedule
a meeting with one to develop the scope of work. This study will
begin with an assessment of existing conditions and required
improvements and an analysis of what level of development could be
permitted, if any, given certain improvements. This includes
but not limited to signals, intersection improvements and the
Southern Connector.
I am enclosing a copy of my letter to Pomerleau outlining some
concerns.

7) BURLINGTON INTERNATIONAL AIRPORT, ACCESS ROAD TO ALERT AREA
The City has been asked by the District #4 Environmental Commission
to comment on the proposed 1250 foot access road fromthe alert area
to Williston Road. The project will be evaluated by the District
Commission in accordance with the 10 environmental criteria on
October 24, 1985. The City and the Planning Commission are
statutory parties. This is not a site plan or subdivision
application. Our only authority to view this is as a statutory
party to Act 250.
Comments: The project consists of a 1250 foot (approximate) by
24 foot wide road from the southern end of Airport to Williston
Road. (see sketch) It appears to be 20 to 30 feet from the
center line of Shunpike Road.
The plan shows a 24 foot road and a six foot right-of-way to the
west towards Calkins Court. This 24 foot strip is part of the
parking and access driveway to Ira Tates pet warehouse at 3060
Williston Road. Vehicles parkingin Tate's lot will necessarily
back into the proposed airport access road. Perhaps the
Planning Commission should recommend to the District Commission
that Tate's parking spaces be relocated to the rear of his
building as part of the access road project.
The six foot right-of-way to the west was approved by the Planning
Commission for a row of 29 White pines. I understand that these
White pines will be planted as per Tate's approval. I re-
commend that a more salt tolerant tree be planted given the expected
use of this road.
The Planning Commission recently approved the revised site plan
for Brockway offices on lot #1 of Calkins Court. This included
an opening to allow vehicles from Brockway to use this access road
rather than entering on Williston Road. Enclosed is a letter
from Bill Szymanski dated 4/29/85 approving the access between
3060 Williston Road (Tate's building), when Brockway was consider-
ing it. He approved it as a private drive between Tates and the
Brockway hangar.
My two concerns are the increase in traffic on Williston Road
after the hangar area is more developed, and that there is not
adequate room for a 24 foot road without disrupting the approved
Tate plan. It appears the parking should be relocated at the very
least. A far better location would be on the 20 foot utility
easement.

1. I would recommend the water service come from the Ethan Allen
Drive water main. This would make the service line direct and
shorter.
2. The new inlet on Ethan Allen Drive must be City standard.
6) RIVCO, GREGORY DRIVE
1. The drainage swale along the easterly property line should be
cleaned and regraded.
7) AIRPORT ACCESS ROAD �(TO ALERT AREA) BURLINGTON MUNICIPAL AIRPORT
1. This access road at its intersection with Williston Road is
offset from the intersection of Shunpike Road. This creates a
difficult intersection for left turns and cross movements.
2. This is a very expensive road (+ $100,000) for what was suppose
to be a connecting drive for Brockway from their new office on
Williston Road to their maintenance building in the alert hangar
area.

The Planning Commission of the City of South Burlington has
reviewed the plans for construction of a frontage road from the
alert area to National Guard Road, parallel to Williston Road at -
the Burlington international Airport. (The Zoning Board also
reviewed this because it will be constructed within a
Conservation Open Space District). The Commission was also
requested t.o approve additional use of the new road west of 3060
Wi-piston Road that connects to the hangar area. A]though the
original stipulations on this use of the road were for the
existing hangars and Brockway Air, the Commission agreed to the
additional use by Valley Air as well as the Brockway employees
and aircraft owners in this area. This conforms to the South
Burlington Comprehensive Plan.

On June 18, 1986, The Burlington International Airport (B.I.A.) applied
for approval to construct a frontage road from the new "Alert" road to
National Guard road, on the Airport. A portion of the proposed roadway
included access from the alert road to Valley Air Service, a tenant on
the Airport.
The application for this roadway and drive to the Valley Air Hangar was
approved by the Zoning Board of Adjustment on July 8, 1986. At the
hearing, B.I.A. indicated that the access to connect National Guard
road to the Alert Road was not planned to be built this year, as the
entire project was not in our budget. However, B.I.A. did intend to
construct the driveway to the Valley Air Hangar. This driveway is required
to prevent congestion and traffic problems caused by the interaction of
automobiles and aircraft on the "alert ramp".
The Act 250 permit for th construction of the Alert Access Road, issued
2 December, 1985, stipulated that use of this roadway for access to the
alert area would be limited to five of the twelve owners of the
Condominium Hangars and to Brockway Airline employees.

After receiving the approval of the Zoning Board of Adjustment for the
Access Road and driveway, the B.I.A. applied to the District Environmental
Commission to amend the Act 250 permit to allow access to the alert area
from Williston Road via the Alert roadway, for the current 'users', which
would include the following:
1. Brockway employees
2. Valley Air Services Personnel and customers
3. Aircraft owners
At the Act 250 hearing for the amended application, the Environmental
Board requested that prior to approval of this application, that B.I.A.
request that the City of South Burlington respond to the Board that the
proposed change in useage will comply with the City Plan, and that the
City has no ojbection to the proposed amendment.

Dear Mr. Ward:
Enclosed is a notice of appeal application for the construction of a
frontage road from the National Guard Road to the Alert Area Access
Road at the Burlington International Airport. This road will allow
for access between the National Guard road and the Alert Area. Cur-
rently vehicle traffic on airport business must either cross the
Airport on the "air side" of the Airport or enter Williston Road.
This new access will decrease the turning movements off Williston Road
by keeping airport related traffic on the Airport.

Dear Ray:
I am including the following traffic information to supplement the
proposed land use permit amendment submitted on 3 July, 1986. The
present traffic on this roadway is estimated to be 30 trips per day.
Current useage is by Brockway Maintenance personnel and the owners
of the private aircraft at the Alert Hangar. Maintenance staff work
in two (2) shifts. The day time shift consists of 10 and the night
time shift consists of 8. We anticipate that the useage by Valley
Air Services would amount to 12 to 15 trips per day and other aircraft
owners would number five to six trips per day.
