Very truly, Richard Nard, zoning Administrative officer Rw/mcg N October 25, 1983 page 3 Mark Roy and Ron Weber -Jones of Country Club Estates spoke strongly in favor of changing the zoning to R-3. They noted that most of the homes in the area are on half or 1/3 acre lots and they would like any future development to be commensurate with the rest of the community. Since Mr. Belter is owner of the undeveloped land, he stepped down from the Commission during the ensuing discussion. Mr. Poger explained that zoning is not determined by present use. The development of Country Club Estates occurred while the zoning was at R-4, and he doubted that in 10 aWk there could be little development that would change the way of life of Country Club Estates. Mr. Jones questioned whether the Planning Commission was serving the interests of tax payers in the area. He said he was not ready to believe that there wouldn't be R-4 development of the remaining land and said they are asking for protection of their property. Mrs. Maher said she really didn't know where the 10 acres were and would be willing to go out and see how the area could be laid out. She recommended that no action be taken at this time but that a date be set up for Com- mission members to walk the land in question. Mr. Mona said he did not feel that would tell them anything at all. He noted that there are areas in the City where duplexes exist in single family residence,areas and have done no harm to the neighborhood. Mr. Poger said he would like a petition from the residents of Country Club Estates stating what they want. It was determined that interested members of the Commission would meet on Saturday, 10/29/83, at 10:30 am at the tennis courts at Country Club Estates to view the land in question. Regarding Mr. Farrar's suggestions about duplexes, Mr. Spitz explained that the old standard for duplexes was 18,000 sq. ft. for a lot in an R-4 zone. It was suggested that this be lowered_ to 12,000 sq. ft. because that was the size a duplex needed. HE said it was never the intention to increase the overall density, but it has become apparent that in older areas if one has a 12,000 sq. ft. lot, one could convert a house to a duplex and thus change the density. He said there are two possible choices, first to make a duplex a conditional use or to re- institute the 18,000 sq.-ft. lot requirement. He recommended the latter. They are currently evaluating plans to expand usable space in the terminal, but there is no way to meet the immediate needs through the winter. The proposed plan was devised to give People's Express some additional area. Mr. Poger requested that in the future, it would be better to come in with both short and long-range plans for the terminal. Mr. Houghton said the proposed units would be 661x12', bolted together. - Mr. Mona asked whether there was to be a time limit on the use of these facilities and said he would be uneasy about passing a motion that did not have such a limitation. Mrs. Maher agreed. Mr. Houghton said the contract calls for 2 years. Mrs. Maher seconded and the motion passed unanimously. Mr. Houghton noted that the new parking,lot is coming along well ahead of schedule and added that it would be something the neigh- borhood could be proud of. Site plan application for an addition to Merchant's Bank, 50 White Street Mr. Moore noted that the proposed addition fills in the square in the rear of the building. They will roof over the new ad- dition and the vault with a new set of trusses. The addition is 550 sq. ft. There will be new landscaping in the back and on the left side of the building. A bush near the air conditioning pad will be removed, but 4 new ones will be added. Tlere will be no change in parking or traffic patterns. He said the addition is needed because in the current arrangement of offices the security is not the best. With the new addition, the Assistant Manager will have a good view of the lobby. Mr. Jacob recommended that the accesses to the Post Office in front and in back be kept open during the winter for safety. Mr. Jacob then moved that the South Burlington Planning Commission grant site plan approval for the application of the Merchants Bank MEMORANDUM To: South Burlington Planning Commission From: Richard Ward, Zoning Administrative Officer Re: Next week's agenda items Date: 10/21/83 2) Myers, Dorset and Swift Streets Existing lot (Myers homestead) contains 8.8 acres. Proposed lot contains 4.0 acres with 473 feet frontage on Dorset Street and 376 feet on Swift Street. Myers lot contains 4.8 acres with 744 feet frontage on Dorset Street. Proposed lot willbe used for a church. Myers lot to remain as is, single family dwell- ing. Proposed lot served by City water and sewer. Sewer to be extended along Swift Street and tap into line by Norman Church. No problems with this pro- posal. 4a) People's Express, Airport Complex Addition 36'x66' (modular unit) located to the south end of the main terminal. Because of overcrowding conditions a hold room and check -in counter is requested. The only issue is landscaping, parking and circulation will remain the same. Landscaping required would be in the area of $500 dollars, the landscaping as proposed are foundation plantings and are acceptable. Bond for $690 will be necessary. As a suggestion, the Airport Manager should have a work session with the Commission to discuss near and long range plans for the Airport Complex. 4b) Merchants Bank, 50 White Street Zoning Board of Adjustment granted a waiver, banks are non -conforming use with- in C-1 District. Addition located to the rear of building, does not affect the site. No improvements are required. Landscaping is only issue, an addition $750 in plantings are required. 5) Farrell, Sherwin Williams Post office will be a tenant. See City Attorney's comments. Traffic in- formation is expected from the applicant at the meeting. 6) Trevithick, 1751 Spear Street The area is zoned Residential 1 District. The minimum frontage requirement be- ing 170 feet. The existing lot contains five acres with 334 feet frontage. Zoning Board of Adjustment granted a waiver, the four acre lot will contain 164 feet frontage. I see no problems with this subdivision. City water is available, on site sewer is required. Design by an engineer is necessary prior to construction of a dwelling. This structure will be installed on the south side of the terminal adjacent to the ramp. It will be used as a temporary check -in counter and hold room with a pre -board security check point. I have enclosed the specifications and copy of a brochure. The structure will not require any restrooms or other utilities as it will be an intergral part of the main terminal. I have also enclosed a copy of the Master Plan. The Chairman of the Planning Commission also has one. Due to the limited number printed he will pass his to the other members of the Commission. Members Present Sidney Poger, Chairman; Robert Walsh, Kirk Woolery, John Belter, Mary -Barbara Maher, George Nona, Peter Jacob Others Present David Spitz, Planner; Tom Schmidt, Frank Tiparelli, Doug Schner, Steve Page, Mery Brown, Roger Dickerson, Joe Oppenlander, Albert Audette, Robert Deckelbaum, Peter Sidel, John Osgood, Robert Martineau, Duncan Case, Ed Smith, Lee Liggett, and several other Ridgewood residents. Minutes of November 9. 1982 On page 3, the first sentence of the 3rd paragraph under V.L. Properties should begin "Mr. Poger noted that he agreed with one of the former Commission members who had not liked ..." Mr. Jacob moved to approve the November 9 minutes as amended and the motion was seconded by Mrs. Maher. The motion carried unanimously. Site Plan application by Burlington Airport for a temporary office fof Peon IS Mr. Spitz suggested that parking lot discussion be saved until after site plan review of the building. Mr. Schmidt, Airport Manager, presented an aerial photo showing the location of the mobile office for People's Express. It will be immediately adjacent to the U.S. Air Freight building and is the same color. Every square foot inside the Airport Terminal is taken, so a temporary operations office of the building is the only other alternative until the expansion of the terminal building takes place. Mr. Poger asked when that might happen. Mr. Schmidt answered that it depended on how much traffic People's Express would generate. Mr. Poger asked if more temporary office spaces would be built. Mr. Schmidt replied that the board of Airport Commissioners were dead set against that type of idea. He added that there would be no public traffic associated with the mobile building. It is only for People's Express employees. Mr. Poger suggested that the parking problem now be discussed. Mr. Spitz said that the People's Express office might be there for awhile; however, the parking lot should only be allowed as a temporary situation. The applicants plan to come in to ask for more permanent approval in mid February, but something must be done now before the winter. Mr. Schmidt explained that the temporary parking area would be immediately north of the Barnes homestead which the Airport recently purchased. The tempnrary parking area would be for a combination of employee and public parking. The ground is solid and drains well. It is too late in the season to pave now. The entrance will be from the airport's exit roadway and there will be no direct excess to Airport Drive. Mr. Schmidt said that he hoped to open the lot tomorrow with the Planning Commission's approval. Burlington International Airport will be'allowed to:.temporarily utilize the Barnes property with the understanding that they will present a formal plan by mid February 1983 and that no parking will be allowed after August 1, 1983 without further approval by the Planninq Commission. Mr. Woolery arrived at this point. There was some discussion about the proper length of time for the approval of the People's Express office. Mr. Walsh seconded the motion and all voted in favor with Mr. Woolery abstaining. Final plat application by Vermont Sav for Indian Creek Development and the and Loan Association for subdivision Estates Mr. Poger pointed out that a memo from the City Planner, a letter from the Fire Chief, a letter from the City Attorney, and a petition from several Ridgewood residents had been submitted. Mr. Spitz said that two issues were involved: subdivision of Indian Creek itself and the status of the connecting road between the two developments. Concerning the subdivision, no change in layout of units is proposed. This is only the creation of a boundary line between the two developments. He further noted that most condiminium developments contain an umbrella association. However, when a subdivision takes place there has to be some agreement among the parties involved as to who will maintain the private roads. The City should ask for legal documents explaining how the road will be used and maintained. The first issue, though, is to consider the Ridgwood residents' request to change the existing requirement that the connecting road be kept open. Mr. Poger asked whether a stipulation for screening of the storage area has been carried out yet. Mr. Spitz replied that that still must be done. Mr. Martineau asked if the subdivision would allow construction of additional units on either property. He was told that no additional dwellings could be built under existing densities regardless of the amount of acreage on either parcel after the boundary line was drawn. Mr. Woolery asked how separate homeowner's associations would maintain the private road. Mr. Spitz replied that a maintenance agreement should be submitted to the City for review prior to recording of the final plat. It would also be a good idea to get easements in favor of each development over the common portion of the road. Mr. Sidel representing Vermont Federal Savings and Loan, said they have no particular preference as to whether the connecting road remains open. However, in fairness to the Ridgewood residents he felt he should support their request to close the road. In response to Mr. Poger, Mr. Sidel apologized for not having brought the subdivision request in earlier. He said that the lack of application has been his oversight. Schmidt, AAE Director of Aviation I I M E M O R A N D U M To: South Burlington Planning Commission From: David H.Spitz , City Planner Re: Next week's agenda items Date: March 18, 1983 2) Community Care Center Other than satisfaction of certain drainage and landscaping requirements, this application is identical to the previously submitted "revised final plat." It is now going back to the preliminary plat stage only to satisfy procedural requirements, i.e. to formally grant a sewer allocation. Since the sewer capacity question has still not been resolved, I re- cor wnd that the preliminary plat application be approved but that the pending final application be withdrawn, continued, or denied. It appears likely that the chemical testing on the sewer Plant will produce positive results. However, the chemical engineer has not yet submitted his findings, and we still must get State approval to allow expanded capacity based on the chemical test results. 3) Airport The airport has a number of expansion plans for both buildings and parking. a) Buildings. The Planning Commission recently approved a temporary (until January 1985) mobile office for People Express. The airport now wants to make a similar provision for another airline. This addition will have minimal visual or other impact on the City; however, it is being presented as a site plan be- cause the City should have a handle on the extent of temporary buildings. The temporary building has already been set up but will, of course, have to be removed if site plan approval is not granted. Sketch plans for future expansion of the terminal building should be available at Tuesday's meeting. No application or expansion is currently taking place (other than a minor addition to the baggage handling area), but more de- tailed plans for at least some of the terminal expansion are expected within a year or so. b) Parking. At the People Express hearing, the Planning Commission required the Airport to bring in a parking plan by February. Although it is a month late, they are now ready to bring in preliminary drawings for your review. Burlington International Airport Mr. David Spitz City Planner City of South Burlington 575 Dorset Street South Burlington, Vermont 05401 Dear David: November 22, 1982 With the advent of service by People Express Airlines, the airport has been experiencing a very serious problem with parking availability. The public parking facilities are proving to be woefully inadequate. During peak times of the day, the lot has been full and drivers have been forced to park on the roadway as well as all along Airport Drive. This, of course, results in clogged roadways and unhappy people. Also, access to the building for emergency vehicles is jeopardized. The airport is requesting permission to utilize the adjoining so-called Barnes property as an overflow parking area. The grass -covered area, about 2/3 of an acre in size, would only be utilized when the main parking lot was full. At all other times, the access to the temporary lot would be blocked. In addition, signs would be posted limiting parking to two hours and prohibiting overnight parking. Access to and from the area would be from the airport's exit roadway. No traffic would be permitted to exit the area directly onto Airport Drive. We would propose to operate the temporary facility until late spring of 1983, when a permanent, paved facility will be built. Spitz, City Planner Re: Next week's agenda items Date: 11/19/82 2) People's Express' This is a very minor modification to the airport. However, due to recent discussions about site plan jurisdiction over airport operations, I have asked that it be brought in for site plan review. The passenger area for Peoples Express will be within the terminal building. However, they also need an operations office elsewhere. Until the airport proceeds with more permanent building plans (which may not be for a while), a "temporary" mobile office will be located next to a storage building near the main terminal. I doubt that anyone would notice the addition from the road un- less they were specifically looking for it. I have no stipulations to suggest for this application. 3) Indian Creek/Ridgewood Representatives of the Indian Creek development have now filed an application showing the boundary line between Indian Creek and Ridgewood Estates. After discussions with both sides it appears that the two developments are in agreement as to how road maintenance will be handled. After Tuesday's meeting, this agreement should be submitted in written form to the City for review. The through -road connection remains as the one substantive issue. The Ridge- wood Homeowners' Association and the apparent majority of Ridgewood residents still request that the road connection be barricaded (see attached letter from Fire Chief Goddette). Other residents prefer that the road remain open (see attached letters and petition). The latter group also has submitted copies of Ridgewood Homeowners' minutes showing that a number of discussions took place in 1981 between Ridgewood and "Indian Creek" concerning issues connected to the re -design of Ridgewood III. Indian Creek developers apparently do not care if the through -road stays open or not. I have researched previous hearings on the Ridgewood development. The through -road has been included in all plans to date. When the overall layout was presented by the original developers in the early 1970's, the City asked whether there might be trouble with traffic cutting through on the Ridgewood road. The developer's response was that the road design would keep traffic at a low speed and should cut down on through traffic. My recommendation is still to keep the road open for reasons of both general circulation and emergency services.
