Dear Ray,
We have entered into a preliminary lease agreement with Craig Leland, MSC Corp. dba
ServiceMaster AAA to lease suite 2702, 2,000 sf (footprint) located at 27 Berard Drive.
They are a fire restoration and carpet cleaning sub contractor.
I will be applying for 130 gallons per day of extra sewer capacity to increase my
allocation from 370 GPD to 500 GPD, see enclosed copy of the land use permit.
I will contact Ernie Christianson to change to the allocation on the permit as well.
George Dow has indicated that he has no problem with the dirty water from the carpet
cleaning truck in the sanitary sewer system, see attached MSDS.

Dear Cedric,
I wanted to Send you this fax accompanied by 2 MSDS sheds for the chemicals that we use for carpet
cleaning. These chemkais not considered hazardous by the DOT, and are diluted to about one ounce
per gallon when used. They are then prespayed and on the carpet and then further diluted by the
steam cleaning of the carpets- For the most part we will only be damping clean ester down the drain.
This water will be coming from pistomer's homes that have suffered a water damage. We do not
egad any sewerage, or any hazardous liquids such as heating oil, or any other type of volatile
chemical or liquid that may be found in a home or business.
As I told you in our conversation yesterday. the absolute maximwn that we would be dumping per day
would be 100 gallons. That is all our steam truck can carry. For the most part they would be dumping
the clean water back down the drains at the customers homes, because in most instances we have
several jobs to handle in one day, and we need to anfve at a customers home with an empty tank
ready to remove water, and also the weight of the water In the vehicle greMly at%ds it's fuel economy -

Mr. Ward said that this area is zoned R-4 and the dimensional requirements

minimum rear yard 30' - existing 10'
minimum side yard 10' - existing 4' north and 0' south.
Mr. Lowy said that the proposed addition fits the criteria. The lot is
irregular and the house and lot are non -complying but this was the way he
purchased it. All lots in Queen City Park are the same. Mr. Lowy discussed
this with his neighbors and all of them were supportive and it will not change
the character of the neighborhood.
Mr. Guyette said that that area is generally non -complying but has been
upgraded in the last 5 - 10 years.

already been before the Planning Commission for site plan approval. The
proposed building is 100' x 120' and the lot is 40,000 square feet.
Mr. Dinklage asked if this would be handled by staff referring to a memo
from the City Manager. Mr. Ward said that this would be handled staff wise and
they will be working with the Knights of Columbus to continue from their lot
into the road and tap into the pumping station.
Mr. Walter Adams said that Mr. Demeritt currently has a similar building
in Winooski. Mr. Adams said he thought that this building was for an
appropriate use in that area and will not change the neighborhood in any way.

Mrs. Lafleur explained that the building is not "existing" but
has been approved.
Walt Adams presented the plan. This is the last lot before the
cul de sac on Berard Drive. They are asking to divide the
building into 4 pieces. Mr. Demeritt owns a building in Winooski
which is divided into 3 pieces; he is familiar with the market
and feels this kind of building will work here. The site is
essentially level, and they are proposing parking in the front
area. All accesses are across the front, and landscaping will
be concentrated in the front as well. Mrs. Lafleur noted extra
parking will be required from the original plan. She also
noticed that landscaping was reduced from the original plan,
and this will be made up by requiring larger Austrian pines.
Since the curb cut is very wide, the City Engineer has requested
closing a portion of it. Mr. Adams said they had no objection.

Dave Raphael presented the plan. He noted this will be a facility

adjacent property (G.E.) when the present leases expire in 1993.
The Shelburne Rd. access will be an entrance only. Exit and an
additional entrance will be on Bartlett Bay Rd. He felt they
exceed landscaping requirements for the lot as they propose to
add unpaved islands of grass which will also aid in drainage.

into two lots. The property is zoned Commercial -One.
Access: Under Section 19.20, the Mareks propose to provide
access through a 20 foot right-of-way to lot #2.
Lot Size: Lot #2 shows approximately 29,600 square feet of the 1
acre lot that is usable. The balance is on the slope.
Landscaping: The large trees around the property perimeter shall
not be removed.

Walt Adams, on behalf of Cedric Demeritt proposes to convert the
"prove4 existing 12,000 square foot building to multiple uses and in-
crease the parking area to accommodate these industrial uses.
The Zoning Board granted approval with the condition that all
tenants be reviewed by the Board.
Parking: The previously approved site plan showed 11 spaces in
the front parking lot; this plan shows 18 spaces to meet the
parking requirement.
Access and Circulation: Access will remain from the existing
curb cut and driveway. Circulation is adequate.
Landscaping: No new landscaping is proposed. However, the plant
schedule shows a reduction from those previously approved. Orig-
inally $5220 was required. The new plan should meet the original
amount. I have recommended larger trees in order to compensate
for the loss in number.
Sewer: The applicant is working with the Knights of Columbus for
joint use of the pump since the new parking lot was the proposed
septic area.
Lot Coverage: The plans show total coverage at 52%. The front
yard coverage (within the 40 foot setback) is adequate although
most of the actual front yard is paved. The rear of the lot
drops off steeply.

1. A drop inlet should be placed in the existing drain line and
site graded toward this inlet.
2. An easement to maintain the drain line should be given to the
City.
3. The Planning Commission should look into the regulations to
see if this type of development can be discouraged. In similar
developments adjacent residents complain about users driving at
excessive speeds, lack of maintenance, dust, and overflow parking
blocking entrance for emergency vehicles.
4) MAREK SUBDIVISION (M & M PARTNERSHIP) SWIFT STREET
1. Development of lot #1 will require draining across lot #2.
That may require swales and or pipes. That right shall be given
to lot #1 especially if lot #2 develops first.
5) CEDRIC DEMERITT, BERARD DRIVE
1. There is a long depressed curb of approximately 50 feet
which will only in part be used for the proposed driveway. The
unused portion shall be removed and a barrier curb installed. As
long as this has to be done, it would improve the access if the
drive were constructed at a right angle to the street.
6) NORDIC CAR RENTAL (FORMERLY MILLBROOK STORE) SHELBURNE ROAD
1. The first curb cut on Bartletts Bay Road should be
eliminated.
2. Plan shall include storm water runoff control and a complete
site drainage plan.

had been granted and Mr. Poger said he did not understand how a residential
use could be allowed on this property.
Ms. Bechtel noted that lot coverage would be 97%. The lot is mostly gravel.
Mr. Cota said an existing building would be removed and the new one erected
in,the same spot. $e expected the apartments to be for elderly people, noting
that they would be 204 x 30' large. He said the business proposed for the first
floor might use one of the apartment areas. Mr. Poger felt this was not the
beat place for apartments.' The building to be removed is 20' x 28' and the new
one will be 30' x 401.
Ms. Bechtel noted that the ordinance allowed,:70% coverage. She noted that
the lot contained 3 openings ( not really curb cuts) and she mentioned closing
some of this area and adding landscaping. Mr. Cota said that the school busses
occasionally used the midd�e opening to turn around, and that Ireland's trucks
used the most northerly on to turn around. He noted also that Harrington's,
across the street, used the most southerly opening to pull his trucks into. He
added that when large trucks pulled into Harrington's to unload, they parked
partially in the road, and cars going by needed to pull around the trucks.
The Commission felt the landscaping would be better used in front of the
lot than in the back in front of the proposed new building. Mr. Poger felt the
center curb cut should be closed and he said the landscaped area should be curbed.
Mr. Dooley moved that the South Burlington Planning Commission approve

Mr. Jacob seconded the motion.
Mr. Dooley was concerned about giving an extension to an approval that had
expired. He felt that approval was lost after the expiration date. Ms. Bechtel
said the outcome would not be any different, probably, if he went through the
entire process again, but Mr. Dooley felt that in the future, approval should
be given again.
The motion carried unanimously.
Consider revision to approval motion for Calkins Court Industrial subdivision
for 7 foot rather than 12 foot dedication of land for future road widening
Ms. Bechtel said the City Manager only needed 7'. They do not intend to
straighten the curve in that area.
Mr. Dooley moved that the South Burlington Planning Commission amend item
#2 of final plat approval for the "Calkins Subdivision" granted on April 9, 19f
deeded to the City. Legal documents shall be filed 'within 90 days." Mr. Burgess
seconded the motion and all voted aye.
Other business
Since the Chairman's last meeting is May 14, the Commission decided to
take him and his wife out to dinner that night.

prepared by Adams Construction Company, dated August 11, 1984, and
revised 9/11/85, with the following stipulations:
1) All stipulations from the September 11, 1984 approval are
still in effect.

4) FRANK COTA, PATCHEN ROAD
The applicant proposes to construct a third building on this 1.15
acre lot that will be used for a photography mail order facility on
the first floor and two apattments on the second. The two existing
buildings -are used for Twin State Neon and a number of small
businesses, one which will move to the new building. The Zoning
Board granted approval for the additional building use on this
lot. The area is zoned R4. It is directly across from the en-
trance to the City landfill and Harringtons.
Lot coverage: 97% of this lot is covered by buildings, parking
and outside storage. The ordinance allows a 70% maximum. The
area is presently gravelled. A small portion around the new
building will be paved.
Parking: The entire lot could presumably be used for parking.
However, 6 spaces are shown for the new building. The applicant
claims this is sufficient since no more than 2 cars are at the
photography shop at one time and the 2 apartments will have 4
spaces.
There are 3 curb cuts along the 253 foot long frontage. Our
regulations require a 15' landscaped strip along the entire front-
age. The two end curb cuts or the center driveway should be closed.
Mr. Cota is willing to close the middle driveway although,he says
it is used by school busses coming from the City landfill area.
He does not want to close the two end driveways since cars and
trucks often use them to bypass Harrington's trucks that stick
out into Patchen Road when unloading.
The proposed landscaping land consists of six spreading yews. A
$1200 landscaping plan is required.
5.) MODERN MAILING SERVICE, 25 BERARD DRIVE, WALT ADAMS, AGENT
This site plan application was approved on September 11, 1984 and
expired on March 11, 1984. This request is to extend that approval
for six additional months. There are no changes from the original.
Enclosed are the Findings and the original approval. The approval
motion should be amended to include a $5000 bond for landscaping.

Ms. Bechtel asked Mr. Berard if anything had been done on the
land yet. Mr. Berard said nothing above grade had been done.

Walter Adams explained that the company assembles catalogs,
brochures, etc. 85% of their business is generated from Offset
House which is about one-half mile down the Road. The lot is
160, x 150'. Parking will be in front of the lot. There are
2 loading docks, one to bring materials into the building and
one for loading into a Post Office Box. Drainage is on two
sides. There is also a swale which heads to the edge and into
the River. Plantings will include evergreens along the front
of the building, with additional trees and hedges. Mr. Adams
noted that the Fire Chief had been concerned that they couldn't
get two pieces of aparatus in, so the lot had been made bigger
to meet this requirement. Another concern was the the Fire
Dept. couldn't properly ventillate the building, so there will
be a couple of manua]Ly operated vents (operated from outisde
the building) on the roof to allow venting. The Fire Chief is
now satisfied. The driveway at the street is 25 ft. wide, and
there is an existing depressed curb.
Mr. Doolev moved that the South Burlington Planning Commission
approve the site plan application of Adams Construction Company,

Mr. Peter Collins explained that Champlain College would like
to buy the existing Lakeside Tennis Facility to use for intramurals,
varsity basketball, and graduation in inclement weather. They
intend to upgrade the facility and put in 150 parking spaces.
They also plan to run a shuttle bus from the campus. The sole
access would be on Farrell St.- Mr. McConaughy, representing
Mr. Farrell, noted that the College is buying a piece of land
which is less than what Farrell presently owns. They will not
be creating any new lots. Sixty and Seventy foot strips along
the south and west sides will be merged with present Farrell
property. Apparently, when the original subdivision was planned,
this was to be the arrangement; however, when Lakeside actually
constructed, the additional strips were added. Mr. Dooley asked
that the City Planner research and see if it could be determined
why the original lot grew. Mr. McConaughy advised that the
Farrells will at some point come in to the Commission to try to
get a sensible land use plan for the entire area. That is why
they wanted more frontage on Farrell Street and more space to
be used for landscaping or parking, etc.

Ms. Bechtel advised that she and the City Attorney and Zoning
Administrator Wa.rk:ect on language with the intent of preserving
the character of neighborhoods but also allowing for the need for
smaller living space. She noted two possible alternatives: to
increase the minimum lot size required for a duplex, so that at
least 90% of the homes in the city would not have enough space,
thus making accessory apartments the easier option; or to say that
a 2-family structure could be built only on a vacant lot. She
said she preferred the first alternative, and the concensus of
the Commission was for this alternative.
Regulatory points would include: minimum and maxiymim a rtmPnt

might be difficult to enforce. Mr.Krassner noted an instance

like language in the ordinance that an accessory apartment is
not allowed as a use if the owner is not resident in the building.

The applicant proposes to construct a one-story, 4000 square foot
structure that will be both residential (1200 square feet) and
a construction company facility (2800 square feet). The Zoning
Board will consider a request for a Multiple use permit on September
10. Assuming it is (granted, my comments are as follows:
Pedestrian and Vehicular Access: A twenty foot wide gravel driveway
will serve the lot.
Circulation and Parking: Circulation is adequate. Seven spaces are
proposed, although 14 are required. The applicant requests a waiver
of 7 spaces. With only 8 daily trips estimated, this waiver
appears justified.
Landscaping: $1500 in landscaping is required. The landscaping
plan does not meet this requirement and additional plantings will
be required.
Other: On -site septic is proposed. Chief Goddette has reviewed thls
and has no problems with the proposal. See Bill Szymanski's memo
on drainage and the septic system.
8) ADAMS CONSTRUCTION COMPANY IOR MODERN MAILING_ SERVICE, BERARD
DRIVE (CEDRIC-DEMERITT)
The applicant proposes to construct an 11,910 square foot building
for Modern Mailing Service, a mass mailing and envelope -stuffing
operation. It is located in the Industrial -Commercial District on
Berard Drive.
Circulation and Parking: Eleven parking spaces are proposed. Sp'lc
is avilable for loading and unloading two tractor- trailer sized
trucks.

9) DAVID FARRELL, 70 FARRELL STREET
The applicant is proposing to re -subdivide two lots so that two srips
of land measuring .62 acres and .64 acres, will be removed from the
Lakeside Tennis lot and added to the lot of Thomas A. Farrell. The
new, smaller lot will eventually be be sold to Champlain College, Inc.,
for a sports facility. The two strips of land will be reserved for
the College's use through an agreement between Farrell and the
College. This resubdivision is required so that the two strips can
be retained by Farrell and reserved for the College's use. (see
sketch below)
Assuming this minor subdivision is approved by the Commission, the
applicant will present a final plat and a site plan application at
the next Commission meeting. The site plan will require Zoning
Board approval for an addition to the Conditional Use.
