HomeMy WebLinkAboutSP-17-38 - Decision - 0027 Berard Drive*SP-17-38 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING TRI-D III ASSOCIATES, FLP - 27 BERARD DRIVE SITE PLAN APPLICATION #SP-1 7-38 FINDINGS OF FACT AND DECISION Tri-D III Associates, FLP, hereinafter referred to as the applicant is seeking after -the -fact approval to amend a previously approved plan for a mixed use 12,000 sq. ft. building. The amendment consists of converting 4,456 sq. ft. of warehouse use to equipment, service & repair use resulting in 7,521 sq. ft. of warehouse use and 2,432 sq. ft. of pet day care use, 27 Berard Drive. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking after -the -fact approval to amend a previously approved plan for a mixed use 12,000 sq. ft. building. The amendment consists of converting 4,456 sq. ft. of warehouse use to equipment, service & repair use resulting in 7,521 sq. ft. of warehouse use and 2,432 sq. ft. of pet day care use, 27 Berard Drive. 2. The owner of record of the subject property is Tri-D III Associates, FLP. 3. The subject property is located in the I-C Zoning District. 4. The application was received on May 23, 2017. 5. The plan submitted is titled, "27 Berard Drive Berard Drive South Burlington, Vermont", prepared by Krebs & Lansing Consulting Engineers, Inc., and dated May 23, 2017. DIMENSIONAL REQUIREMENTS 6. Building coverage is 30% (maximum allowed is 40%), overall coverage is 70% (maximum allowed is 70%), and front yard coverage is 28% (maximum allowed is 30%). 7. Setback requirements are being met. SITE PLAN REVIEW STANDARDS Only the standards below are affected by this application. All other standards will continue to be met. Parking - 1 - #SP-17-38 8. The new mix of uses will require a minimum of 18 spaces and there are 18 parking spaces available, including one (1) handicapped space. A bike rack is also being provided. Traffic 9. The applicant estimates that the change in use will result in 2.8 additional vehicle trip ends being generated during the p.m. peak hour for a total of 19.7 vte's for the property. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP-1 7-38 of Tri-D III, FLP, subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval will remain in effect. 2. This project must be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Administrative Officer estimates that the change in use will generate 2.8 additional vehicle trip ends during the P.M. peak hour. 4. The applicant must obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 5. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to use of the newly converted space. 6. Any change to the site plan will require approval by the South Burlington Development Review Board or the Administrative Officer. Signed on this day of 2017 by Rafmon'd J. This Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
