SITE PLAN APPLICATION #SP-17-75
FINDINGS OF FACT AND DECISION
Tri-D III Associates, FLP, hereinafter referred to as the applicant is seeking after -the -fact
approval to amend a previously approved plan for a mixed use 12,000 sq. ft. building.
The amendment consists of: 1) designating an outdoor storage area, 2) relocating bike
rack, and 3) designating a screened dumpster storage area, 27 Berard Drive.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking after -the -fact approval to amend a previously approved plan
for a mixed use 12,000 sq. ft. building. The amendment consists of: 1) designating an
outdoor storage area, 2) relocating bike rack, and 3) designating a screened dumpster
storage area, 27 Berard Drive.
2. The owner of record of the subject property is Tri-D I I I Associates, FLP.
3. The subject property is located in the I-C Zoning District.
4. The application was received on October 27, 2017.
5. The plan submitted is titled, "27 Berard Drive Berard Drive South Burlington,
Vermont", prepared by Krebs & Lansing Consulting Engineers, Inc., and dated May 23,
2017, and last revised on 10/27/17.
DIMENSIONAL REQUIREMENTS
6. Building coverage is 30% (maximum allowed is 40%), overall coverage is 70%
(maximum allowed is 70%), and front yard coverage is 28% (maximum allowed is 30%).
7. Setback requirements are being met.
SITE PLAN REVIEW STANDARDS
Only the standards below are affected by this application. All other standards will
-continue to be met.
Bicycle Parking
8. The plan complies with Section 13.14 of the LDRs to include the new type and
location for bicycle racks, to accommodate the minimum requirement of two (2)
short-term bicycle parking spaces (100% of requirement).

Outdoor Storage
9. A 1,000 sq. ft. outdoor storage area is proposed for the rear of the building which had
been used for this purpose without approval.
Dumpster
10. The previously unscreened dumpsters will now be screened as required.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP-1 7-75 of Tri-D 111, FLP, subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval will
remain in effect.
2. This project must be completed as shown on the plan and shall be on file in the South
Burlington Department of Planning and Zoning.
3. The applicant must obtain a zoning permit within six (6) months pursuant to Section
17.04 of the Land Development Regulations or this approval is null and void.
4. The applicant must obtain a Certificate of Occupancy from the Administrative Officer
prior to use of the site modifications.
5. Any change to the site plan will require approval by the South Burlington Development
Review Board or the Administrative Officer.

Board. This Notice of Appeal must be accompanied with a $233 filing fee and be filed
within 15 days of the date of this decision.
