The amendment consists of altering condition #2 of the 2/20/01 approval changing the landscaping requirement at 2 Berard Drive, as depicted on a plan entitled "St. John Vianney Home Assoc. Inc" prepared by Travis Putnam with a revised date of 10/31/01, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) Prior to issuance of a zoning permit, the applicant shall post a $900 landscape bond. The bond shall remain in effect for three (3) years to assure the landscaping takes root and has a good chance of surviving. 3) The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations of this approval is null and void. 4) The applicant shall obtain a certificate of Occupancy/Compliance from the Administrative Officer after planting the landscaping. 5) Any change to the site plan shall require approval by the South Burlington Development Review Board. DEVELOPMENT REVIEW BOARD 18 DECEMBER 2001 PAGE 4 7. Public Hearing: Application #CU-01-48 of Steve and Betty Rambur seeking conditional use approval from Section 26.05, Conditional Uses, and Section 26.75, Accessory Residential Units, of the South Burlington Zoning Regulations. Request is for permission to construct a 512 sq. ft. addition to a single family dwelling for use as an accessory residential unit, 981 Dorset Street: Mr. Rambur said he understood the restrictions on the unit. Mr. Dinklage also noted that use of the unit is not transferred with the sale of the building. Mr. Belair said staff has no issues. Mr. Boucher moved to approve Application #CU-01-48 of Steve and Betty Rambur subject to the stipulations in the draft motion of 18 December 2001. Mr. Farley seconded. Motion passed unanimously. 8. Site plan application #SP-01-83 of Ray Michaud to amend a previously approved site plan for a 4,000 sq. ft. building used for a private club. The amendment consists of altering condition #2 of the 2.20/01 approval changing the landscaping requirement at 2 Berard Drive: Mr. Belair noted there was a violation and a lot of trees were cut. The applicant was required to replant the trees but didn't. In the meantime, a lot of vegetation grew up, and the arborist now suggests that instead of replanting that area the applicant put in larger trees up by the street. Mr. Dinklage asked if the slope is being secured with vegetation. Mr. Michaud said there has been no erosion. The bushes that have grown there are 6-8 feet high. The applicant agreed to plant the trees as specified. Mr. Farley moved to approve Site Plan Application #SP-01-83 of Ray Michaud subject to the stipulations in the draft motion of 18 December 2001. Mr. Boucher seconded. Motion passed unanimously. 9. Sketch Plan Application #SD-01-67 of Barone Construction to subdivide a 1.53 acre lot into two lots, a one acre lot and a .5 acre lot, 1759 Spear Street: Mr. Dinklage questioned the width of the right-of-way. Public Hearing: Application #CU-01-02 of Technology Park Partners seeking conditional use approval from Section 26.05, Conditional Uses of the South Burlington Zoning Regulations. Request is for permission to utilize 220 parking spaces of a 1057 space parking area as a private parking facility for Fletcher Allen Health Care employees, 30 Community Drive: Mr. Illick said Fletcher -Allen needs off -site parking and Technology Park has the space, so they have agreed to rent these sTl ces.. Mr. Belair asked how the employees of Fletcher -Allen will know where to park. Mr. Illick showed the area that will be for Fletcher -Allen. There will be no signage. Only 220 parking tags will be issued by Fletcher -Allen, so that will be the maximum number of cars. Employees will be picked up by a bus. They will remain in their cars until the bus drives by and stops for them. This is a safety precaution so people are not milling around in the parking lot. Ms. Quimby moved that the Development Review Board approve Site Plan application #SP-01-05 and application #CU-01-02 of Technology Park Partners subject to the stipulations in the draft motion of approval. Mr. Farley seconded. Motion passed unanimously. 8. Continued Public Hearing: Appeal #AO-00-10 of Judge Development Corporation, Tekram Partners & Century Partners of a decision by the Administrative Officer to issue Notices of Violation #NV-00-27, NV-00-28 and NV-00-29 dated 9/26/00 for property at 1-00 and 102 Dorset Street and 4 Market St: Mr. Belair noted the applicant has again asked for a continuance. He recommended continuing until 20 March and notifying the appellant that the Board will make a decision at that time. Members agreed. Ms. Quimby moved to continue the Public Hearing on Appeal #AO-00-10 until 20 March. Mr. Boucher seconded. Motion passed unanimously. 9. Site plan application #SP-01-04 of the Knights of Columbus to amend site plan for a 4,000 sq. ft. building used for a private club. The amendment consists of amending the landscaping by the removal of a large area of natural vegetation,17 Berard Drive: Mr. Stevens said their intent had been to trim the trees, but when he went out of town, the person who was covering for him and the tree trimmer decided to cut the trees down. He showed the area where the trees were cut. DEVELOPMENT REVIEW BOARD 20 FEBRUARY 2001 Mr. Belair noted that the arborist does not want the trees replaced with the same kind of trees. The recommendation is for 70-100 trees or 400 seedlings with 5 ft. centers. Mr. Stevens said this would be more than they cut down and he was concerned that when the seedlings grew they would again cut off their light. Mr. Belair said this is the arborist's recommendation. The trees would not grow as high as the ones that were cut down. Mr. Belair noted that the area that was cut was 50 ft. by 200 ft. Mr. Stevens said they would choose to do the seedlings but he felt it was "overkill." M JUDGE DEVELOPMENT CORPORATION, TEKRAM PARTNERS, & CENTURY PARTNERS- APPEAL OF ADMINISTRATIVE OFFICER'S DECISION, 100 & 102 DORSET STREET & 4 MARKET STREET This hearing was continued from the January 16, 2001 meeting which was continued from the December 5, 2000 meeting (minutes enclosed). This hearing was continued to provide the appellant and the city an opportunity to sign a "settlement agreement" on those issues that could be resolved. The appellant has not contacted the City or the City attorney regarding this agreement. Staff recommends that the Board proceed with the hearing and render a decision (see enclosed draft). This appeal is from a decision made by the Administrative Officer that the property at 100 & 102 Dorset Street and 4 Market Street is in violation of the zoning regulations (see enclosed Notices of Violation). Enclosed is staff 11/7/00 memo regarding this appeal. 9) KNIGHTS OF COLUMBUS — LANDSCAPING ALTERATIONS - SITE PLAN & CONDITIONAL USE APPLICATIONS,17 BERARD DRIVE This project consists of amending site plan for a 4,000 square foot building used for a private club. The amendment consists of amending the landscaping by the removal of a large area of natural vegetation, 17 Berard Drive. Staff discovered that the applicant cut a large area of trees along a bank to the rear of the property and notified them that they must obtain approval from the Development Review Board for this change. This property is located within the Mixed Industrial and Commercial District. It is bounded on the north by a gym, on the west by Berard Drive, on the south by a vacant lot, and on the east by a vacant lot. Landscaping_ The applicant has noted the size and location of the trees that were destroyed: ■ Two 8" diameter trees on the lower bank ■ Twenty 2-3" diameter trees on the lower bank ■ One 12" diameter tree on the upper bank ■ Three 8" diameter trees on the upper bank The City Arborist has recommended that the trees not be replaced in -kind as placing large trees on the steep bank would be difficult and may result in injuring the trees to be planted. It is the Arborist's recommendation that the 50 foot by 200 foot cut area on the lower bank be replanted with a mixture of White Pine, Red Maple, and Paper Birch. It is not of much value for industrial or commercial uses because it drops off steeply in the rear and there is little useable area. For the K of C it is ideal - they can construct a building and have a parking lot. The lot is 2 acres in size and they expect to build a 1 112 story building 40' x 100'. The parking lot will hold 16 cars, which is enough room for a membership of 80. Current membership is 40. There is a second level area which can be used for parking in the future if needed. It was noted that the K of C had permission from the business across the street to park cars in that lot if it became necessary. The curb cut will be 25' and the building will be partially on a 75' airport right of way, but they have permission from the airport for that. Mr. Woolery felt that should be put in writing so the city would have a record of it. Mr. Audette said the building would cost about 540,000 because much of the labor will be supplied by the members, and they plan for S12-1400 of landscaping. A safety fence will be installed behind the parking lot. The building cannot be expanded, Nor. Audette said, and the kitchen facilities will be small. For any large meal, caterers will have to be used. Xr. It seems that the landscaping is planted to the amount required and that it is in good shape. The problem seems to be with the site, not with what the developers have done. Mr. Foger suggested asking for more landscaping because the development is near a major corner in the city with no visual buffer. Ir. Spitz said there were a lot of small trees which could not be seen from Kennedy Drive. Mr. Palin said the reason for the new name of Southridge and a new condominium association had to do with financing for the project. He said phase 1 was complete and that they now wanted to construct phase 4 (24 units). There has been some building relocation done in response to requirezents of other agencies. The configuration has also been changed a little. I•:r. Mona did not want Grandview Drive to become Twin Oaks Terrace in the middle of the street and placing the street sign at the corner was suggested. Ifr. Levesque arrived at this time. Ir. Palin hoped to perhaps start additional units in phase 2 later this year if financing became available. They will not start more than 40 units in 1980, though. The phasing which has been discussed is 40 units in 1980, 50 in 1981 and 18 in 1982. Vir. Woolery said that if any buildings were started, he would like to know where they were and to have them completed. Kr. Spitz suggested that if a building permit were issued and a unit started, that would count as a unit in the phasing schedule. Mr. Palin had no problem with that. The question was asked of when the road to Dorset Street would be completed. The Commission has said that as a policy they do not want more than 50 units on a street with one access point. The Commission wanted to outline exactly when the road would be expected to be finished. It was decided that the road would have to be built either at the 83rd unit or at the start of construction of the second parking lot in phase 2, whichever was sooner. Mr. Woolery raised the question of the developer selling the project (and with it, the obligation to construct the street). He wondered if the City Attorney could give the Co=ission any thoughts on this and he mentioned getting the bond from the original developer. Mr. Curtis said his firm had an escrow account for the roads which guaranteed that the work would be done. The developers want to raise the ceiling price of the units from $39 - 43,000. It has been 15 months since the last units were approved, and the increase is E;�, or, annualized, 10-11!j�. The Commission felt this was reasonable. Mr. awing asked how many of these units were owner -occupied and was told that landlords owned 15 out of 42. Mr. Ewing felt this defeated the principals of low cost housing, which the Commission had favored. Xr. Curtis felt they were working within the intent of the Co=ission. Request is for permission to construct a 40' x 100' building on a lot containing approximately 2 acres, and occupy same as a business office and meeting hall for the Knights of Columbus, on lot #18 on Berard Drive. Mr. Ward noted that the area was zoned Industrial and that private clubs were permitted in the C-1 district, but prohibited in this district. The lot contains 2 acres and the building conforms to dimensional requirements. 1 parking space is provided for each five active members, and that conforms to the regulation. Mr. Ward noted that he was on the building committee and would remove himself from further discussion. Mr. Berard noted that much of this lot was not usable land. He felt that parking would be adequate and noted that they would have written permission from 7-UP to use its parking lot across the street. Mr. Robert Audette noted that the lot was irregular and he did not think it could be developed for an industrial use because there was not enough land. He noted that the K of C had not created the hardship and that the lot was pre-existing. Most functions will take place on nights or weekends, so it will not affect the other people in the area. He did not feel traffic would be substantial - 10-20 cars on a dead-end street. They do feel this is the minimum variance they can request. They have 35-6 members and 14 parking spaces. Mr. Thomas Schmidt said he was the airport manager and that he had no objections to the use, feeling it was a good use for the area and caused no problems with air space. The appeal was granted unanimously. Appeal of Edward Barnes (tabled May 26) Mr. Ward said a letter from the City Attorney's office indicated that the issue of the 1961 zone change was not valid and Mr. Barnes will have to start from a multiple use situation. He noted that the land was zoned,Airport Industrial and that the existing residential uses are non -conforming. Mr. Barnes wants to use 112 acre for a commercial parking lot and maintain the residential uses. Mr. Barnes said he wanted the parking lot to supplement income from Social Security. Mr. Berard foresaw no outside storage but said that if the business ever did get a large shipment of materials, they could store them on the north and cover them with a tarp or something. There is no smoke, noise or odor associated with the business. Mr. Poger said that if they planned to store materials outside regularly, they could put up a couple of fences to hide the materials. Mr. Fargnoli said most of his suppliers were local and he had a van and a truck to make deliveries. The landscaping is in front of the building and meets the requirements. Trucks will deliver and turn around on the west of the building. Application by Rodney Mayo for site plan approval of a new and used car dealership at 370 Dorset Street The Commission had Zoning Board minutes from 11/21/77 and 1/26/81 relating to this property and the adjacent one. Mr. Spitz said the Board had given conditional use approval to this use and looked at the property in relation to the adjacent lot. The Board had previously approved a use on the adjacent site and one plan showed a shared access, but the adjacent lot has no legal right to use part of this applicant's lot. Each lot has separate access now. The front is all open now and that will be closed off and landscaped. A fence will be extended along the property line between the two properties and access to the lot will be from San Remo Drive. There are 6 bays facing San Remo Drive and that will be reduced to 4. Mr. ;spitz did not feel the curb opening on San Remo Drive should be made smaller because of the building location and the short distance. He said the road and the right of way might be used for some movements. There will be one-way circulation on the lot and cars will be displayed in front. The fence between the properties is needed for security. Mr. Poger noted that approving this site plan would impact the lot next door. Mr. Spitz noted that when the "Zoning Board had given approval for 2 or 3 uses on the other lot, a shared drive had been shown, but the applicant at that time had no authorization to use that. What it means now is that the site next door will be crowded. Mr. Mayo said he had offered to let the owners of the building next door buy this lot from him, but they had not exercised their option. Mr. Poger stated that what the Commission was doing here was creating new conditions on the lot next door, and while he realized that they could not force the adjacent owners to come back in, he wondered if the zoning ordinance should have some provision added to deal with situations like this. Mr. Nona mentioned informing the Zoning Board in writing of the action the Commission would take tonight. Mr. Mayo said the owners next door had told him that one of the uses in the building would be moving out and they would try to work out something for the other uses. Mr. Mayo said there would not be a curb in front; it would just be closed off with the landscaping. There will be a small sign and the cars sold will be very expensive. Mr. Mona wondered about what would happen if Mr. Mayo were not sucessful and had to sell. Someone else could come in with the same use and sell junk. The issues being that a private sewer line will be installed along Airport Parkway. The on -site sewer system will be abandoned. The sewer allocation is 600 g.p.d. An existing curb cut off Berard Drive will be used, providing two openings. Second opening will provide for trailer truck movements. --Being a double lot I see no reason for not permitting two openings. Removing heavy traffic move- ments to Berard Drive is an ideal situation. Average daily traffic, 100 trips has caused no problems to the area, no additional traffic is excepted. The proposed parking and landscaping is adequate. The City will supply a street light to the new pole being installed near the intersection. 4) PJ's Auto, 2073 Williston Road As the result of a stipulation, Mr. Choiniere was prohibited from displaying or parking vehicles on the grassed area in the front or to the side of his lot. Mr. Choiniere is proposing to purchase a strip of land to the east of his property from Dr. Brown to provide additional grassed and landscape area in order to be allowed to display new truck and cars. Public hearing on Preliminary plat application of Gerald Milot for construction of two 20,000 square foot office buildings on Kennedy Drive, directly west of Treetop Condominiums Mr. Milot said that he had been before the City Council with this proposal because of Interim Zoning. The plan is to build two office ce buildings nd so on Kennedy Drive each of two stories, but to use the topography rom Kennedy Drive the buildings will look like they contain one story. As one drives around in back, the second level will show. The buildings will be served by municipal water and sewer. A lift station will be necessary for the sewer. The buildings will contain professional offices and be made of brick. Lighting will be town and country type. It will be low level on the front and the sidewalks, and the rear parking lot will be flooded. The lights will be directed away from the residential area next door. Mr. Gagne said that storm runoff from the parking lot would go into a retention pond and that drainage presently coming from across Kennedy Drive would be piped but not treated. It would not go into the pond. The pipe will be only under the new road and will not disturb the area. Mr. Gagne said the slope of the new road would be 6 112% maximum. 193 parking spaces are shown, as per ordinance. Mr. Page said he had looked at similar office buildings in the area and that if the same ratio of parking spaces to square footage was used here for how many spaces those buildings seemed actually to use, this building would only need about 140 spaces. He said the building area on this land was comparable to what land would be covered if the developers had built the maximum number of dwelling units. Mr. Poger said that at final plat the Commission could waive the spaces to 140 if it wished, in order to preserve green area, but could have some area cleared so that if more spaces were needed they could be paved later. Mr. Mona asked about the water line and was told that the adjacent property owner (Treetop) had a condition for receiving building permits that a bond be posted to extend that water line within a certain time period. Ms. Sandy Kleppinger asked what uses were planned for the building and was told they would include the medical profession, accountants, lawyers, etc. Mr. Poger asked about traffic and was told that the developers had had a traffic study done for the Interim Zoning review and that the evening peak would generate 1 trip per 1,000 sq. f t. of space, roughly. The consultant projected 48 trips during the 4-5 pm peak hour, of which he felt that 29 of those exiting the area would turn left and go to the Kennedy Drive - Williston Road intersection. Mr. Page said the volume to capacity ratios on that intersection and the intersection of Kennedy and Hinesburg Road were at good levels and could handle the load. Mr. Page also noted that the Council's approval had required office hours in the building to be staggered, which would help the traffic flow. Mr. Krassner asked about the location of the parking lots and was told the developers had moved them to where they are now at the request of the Council. Mr. Ronald Schmucker said that he represented the residensof Treetop, who had turned out in force to oppose the plan, and that a petition ould be submitted (see attached copy). He also felt that the determination of the Council N on traffic impact was not binding on the Commission and he hoped the Commission would review it anew.
