Dear Mr. Duppstadt:
Be advised that the South Burlington "mooning Hoard of Aejustment
has granted your request for a zoning variance. The Board stipulated
the followings
a. the variance is approved for three units upon.parcel #2
provided that the aggregate total of dwelling units upon the two
lots does not exceed four.
b. conditioned upon the applicant executing a convenant
limiting the use of parcel 41 to a single dwelling only.
The Hoard will issue formal findings at a later date. If you have

Mr. James Lamphere represented Avis and said that about 3 years ago he
hnd rFr:resc•nted Avie ar.d Hertz in a similar apr)eal on the other side of
Colez-J.n Parker and it had been approved but never was built. He said they
wanted -,:roperty adjacent to the airport and that there would be no sales
out of this location - only servicing of the rental cars. The lot is narrow
toward the back and that precludes a lot of uses. It has been filled to a
certain point in the back. The land has been on the market for 7 years. Xr.
Lasphcre pointed out that the lot was filled and that precluded a lot of uses
going on it which were allowed by the ordinance since the ground would not
be solid enough to bear heavy loads.
Mr. Lamphere did not feel that granting the variance would change the
charncter of the area because there were many car facilities nearby.
It was pointed out that looking at the Industrial uses and the shape of
the lot, the board did not have much choice on�wkether to approve this. Mr.
I1nec noted that it would have been hard to deny the recent subdivision
aprlication since the criteria for drainage, access, lot size, etc. were
met.
It was noted that there would be one access for this lot and the one next
to it.
Ma. O'Malley was asked if Avis had looked for Airport Industrial space
for the building and she replied that they had but that the only good piece
wan too far away. Right now they rent a bay on Williston Roid"and do the
servicing, there but they have done that for several yenrs now and it is
alwnys a temporary arranvement. They would like a permanent home. -ne felt
thin building would give them that and pointed out that the traffic t,.e
building would generate was already on Williston Road and would just be moved
to this location. She said the operating hours would be from 7:30 am to
6:30 pm right now and that later those might expand to 6:30 am to 9:30 pm
but ace did not think they would grow much beyond that because the airport
itself is not open really late at night.
The appeal was approved unanimously.
No. 1 An7)eal of the Allen Building Corporation. Nile Duppstadt
Ap-eal of Allen building Corporation, Nile Duppatadt seeking a variance
from uection 6.00, Permitted uses (subsection 6.002) and Section 11.00,
,density requirements of the South Burlington Zoning Regulations. Request
is for permission to construct a three unit dwelling on a lot containing
apijroximately 27,000 sq. ft., located on Quarry sill Road, bounded by
properties of Horizon Heights Apartments and University of Vermont.
Mr. Ward noted that the area was zoned R4 and that a two family dwelling
was the maximum density allowed. One and two family dwellings were permitted
ir. the zone and the lot size required for each was 10,OCO sq. ft' for one
family and 16,000 sq. ft. for two family. In the R7 district 6,500 sq. ft.
im required for each dwelling. The total lot size is 1.19 acres divided into
two lots in October 1978. Lot #l, which would have a single family home,
would ae .1-81 acres or 25.380 sq. ft, and lot #2, which would have a triplex,
wuuli I.P .615 acres or 26,7b9 sq. ft. Mr. Ward said the density would provide
for two lots with duplexes on them and the plan is to retain that density but
put three of the units on one lot so the other can contain a single family
home. He said this was the last of the R4 land that could be developed in
the area - the Quarry Hill property is R7. The land to the north is R4 and

to the south is the University farm. The 60' right of way used by Horizon
Heights will be used by these two lots also.
Mr. Duppstadt said that when he subdivided it was with the intention
of building two duplexes but that he has been asked to have a 3-plex on one
lot so the other lot can have a single family home. He said that economics
dictated the 4 total units. He felt this proposal was more in keeping with
the character of the area since there are single family homes along ::pear St.
to this ;point and the triplex will serve as a transition to the R7 land
behind it at horizon Heights. He said he bought the land last November, and
did not intend to live on it himself. He also said that because of the
slope of the land and the state of the sewer lines, more earthwork would be
reg4ired on lot 1 if a duplex were constructed.
Fr. Duppstadt was asked why two duplexes were not the solution to the
problem and he replied that they could be but that this was a better one
evince it would allow him to have a single family home on one lot. as he has
been asked to do, and also allow him to build a triplex for less than a
duplex costs, thereby allowing him to rent it for less. The home on lot 1
would have to be set back 75' from Spear Street. There will be one curb
cut for both parcels.

Mr. Myette noted that the board always took the most liberal interpretation'
of the ordinances when a situation like this came up.
The appeal was granted on a 4-1 vote with the stipulation that the
variance is granted for 3 units on parcel 2 provided that the aggregate total.
of dwelling units on the two lots does not exceed 4. The variance is
granted conditioned upon the applicant executing a covenant limiting the
use of parcel 1 to a single family dwelling only.
South Burlington Realty Corporation (tabled February 26, 1979)
This item was tabled at the last meeting in order to give one member
time to read the minutes. He was not present at this meeting tonight.
Mr. Ferkett moved to table action on the South Burlington Realty
Corporation appeal until the next regularly scheduled meeting. Mr. Graves
seconded the motion and ,all were in favor.
;Other business
Mr. Martineau noted that when the Planning Commission had concerns about
an apl.eal it might be better if a member attended the Zoning Board meeting
rather than having a memo sent to them. Mr. Page suggested a joint meeting
to discuss this.
