FINDINGS OF FACT AND DECISION

Re: Site plan application #SP-01-83 of Ray Michaud to amend a previously approved site
plan for a 4,000 sq. ft. building used for a private club. The amendment consists of
making landscape modification to a previously approved site plan, 2 Berard Avenue.
On the 18t' of December, 2001, the South Burlington Development Review Board
approved the request of Ray Michaud seeking site plan use approval under Section 26.10
of the South Burlington Zoning Regulations based on the following findings:
1) This project consists of amending condition #2 of the 2/20/01 approval to change the
landscaping requirement.
2) The owner of record is St. John Vianney home Association, Inc.
3) The project is at 2 Berard Drive within the Mixed Industrial and Commercial District.
The property is bounded on the north by a gym, on the west by Berard Drive, on the
south by a vacant lot, and on the east by a vacant lot.
4) The only issue affecting this application is landscaping.
5) Landscape/Screening: The previous approval called for the planting of 400 seedlings,
5 feet on center on a steep western slope. Craig Lambert noted that the slope was
regenerating nicely and suggested that an alternative remediation measure could be
the installation of two (2) 2.5"-3" saplings, either Imperial Honeylocust, Amur
maackia, Hedge Maple, or Autumn Blaze Freeman Maple. The applicant is
proposing to install two (2) 2"-2.5" Honey Locust saplings as this caliper tree is
available.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board
approves site plan application #SP-01-83 of Ray Michaud to amend a previously
approved site plan for a 4,000 sq. ft. building used for a private club. The amendment
consists of altering condition #2 of the 2/20/01 approval changing the landscaping
requirement at 2 Berard Drive, as depicted on a plan entitled "St. John Vianney Home
Assoc. Inc" prepared by Travis Putnam with a revised date of 10/31/01, with the
following stipulations:
1) All previous approvals and stipulations which are not superseded by this approval
shall remain in effect.
2) Prior to issuance of a zoning permit, the applicant shall post a $900 landscape bond.
The bond shall remain in effect for three (3) years to assure the landscaping takes root
and has a good chance of surviving.
3) The applicant shall obtain a zoning permit within six (6) months pursuant to Section
27.302 of the zoning regulations of this approval is null and void.
4) The applicant shall obtain a certificate of Occupancy/Compliance from the
Administrative Officer after planting the landscaping.
5) Any change to the site plan shall require approval by the South Burlington Development
Review Board.
