Mr. Jenkins noted this is an "after -the -fact" application that goes back to 1999. At that
time, the revised play was never submitted.
Ms. LaRose asked about an easement. Mr. Jenkins said there is a pedestrian easement on
the property. Ms. LaRose said that will have to be shown and identified on the plans.
No other issues were raised.
5. Continued Public Hearing: Final Plat Application #SD-06-62 of Allen Road
Land Co. to amend a previously approved planned unit development. The
amendment consists of. 1) enlarging the PUD by 5.5 acres, and 2)
constructing two 31-unit multi -family dwellings on 5.5 acres, 150 Allen Road:
Mr. Dinklage noted that the Fire Chief has asked that there be no use of gas grills on the
balconies. Mr. Larkin said that will be included in the By -Laws.
The remaining issue was receipt of the hydrology report which members had been given.
No issues were raised on this.
Ms. Quimby moved to approve Final Plat Application #SD-06-62 of Allen Road Land
Co. subject to the stipulations in the draft motion. Mr. Behr seconded. Motion passed 5-
0 with Messrs. Plumeau and Knudson abstaining.
6. Public Hearing: Final Plat Application #SD-06-75 of Timberlane Dental
Group to amend a previously approved planned unit development for an
8,304 sq. ft. medical office building. The amendment consists of constructing
a 1701 sq. ft. addition, 60 Timber Lane:
Ms. LaRose noted that "No Parking" signs have been put up along the entrance drive.
The City has also put signs on Hayes Avenue so that people will not park near the
corners. These appear to be working.
No other issues were raised.
Ms. Quimby moved to approve Final Plat Application #SD-06-75 of Timberlane Dental
Group subject to the stipulations in the draft motion. Mr. Birmingham seconded. Motion
passed unanimously.
7. Public Hearing: Variance Application #VR-06-01 of George & Ruth Wells to
allow an 8'x8' addition to an existing detached accessory structure to project
three feet into the required five foot setback, 4 Prouty Parkway:

Mr. Wells referred to pictures of the existing structure. He noted that the structure was
put in when it was allowed to be put on the property line; the regulations have now
changed so there is a required 5-foot setback.
Mr. Dinklage asked why the addition can't be built to meet the setbacks. Mr. Wells said
it would create an irregular roof line which could cause a water leakage problem. He said
he wasn't aware of the new regulations when he built the addition. Mr. Dinklage noted
that building anything in the city requires a permit. He asked if the existing structure
could be moved 3 feet to be within the setback. Mr. Wells said he wasn't sure it would
be able to be moved because of its age.
Ms. Lovett, a neighbor, said she opposes granting the variance. She noted that the fence
is not straight and there is no way he can maintain it without trespassing on her property.
She also said the addition to the building is unpainted and is unpleasant to look at from
her home. Mr. Wells said he didn't paint it because he was told of the violation the day
he completed the work on the building.
Mr. Dinklage explained the nature of a variance and the necessity of meeting all of the 5
criteria. He said it is very hard to get approval for a variance. Mr. Dinklage also
reminded the public that any time there is a significant change to a property, people
should consult the Administrative Officer to see if a permit is needed.
Ms. Quimby moved to approve Variance Application #VR-06-01 of George & Ruth
Wells subject to the stipulations in the draft motion. Mr. Farley seconded. The vote on
the motion was 0-7, and the motion was deemed to have been denied.
8. Sketch Plan Application #SD-06-71 of East Mountain View, LLC, for a
planned unit development to construct a 2-story 21,600 sq. ft. building
consisting of 13,000 sq. ft. of medical office use and 8,600 sq. ft. of general
office use, 1100 Hinesburg Road:
Mr. Dinklage noted a request from staff for a shared access with the property to the south.
Mr. Ribosky noted that property extends all the way to Meadowlands and already has an
access.
Mr. Larson said the business that would be using this building is now located in Williston
in a very difficult traffic situation. They have many patients who are elderly and have
vision problems. They are trying to bring the business to South Burlington. Mr.
Larson felt the shared access would have an impact on patients turning in with cars
coming at them. He did not want to see all that traffic furreled through this property.
Mr. Dinklage said that multiple curb cuts could be far more confusing to challenged
drivers. He noted that if there is a lot of traffic at that intersection, there could be a traffic
light. He noted that the Board is only asking for the dedication of an easement; if the
other development and this applicant feels it may be, they might have a different traffic
pattern altogether. He also reminded the applicants that a full interchange is in the plans

PROJECT DESCRIPTION
George Wells, hereinafter referred to as the applicant, is seeking a variance from Section 13.04(A)(4)
of the South Burlington Land Development Regulations. The request is to allow an 8'x8' addition to
an existing detached accessory structure to project three (3) feet into the required five (5) foot setback,
4 Prouty Parkway.
The proposed shed has already been built; thus the property is in violation of the South Burlington
Land Development Regulations.
Associate Planner Cathyann LaRose and Administrative Officer Raymond Belair, referred to herein as
Staff, have reviewed the plans and have the following comments:
VARIANCE REVIEW STANDARDS
Title 24, Section 4468 of the Vermont Municipal and Regional Planning and Development Act establishes
the following review standards for all variance requests:
On an appeal under section 4464 or section 4471 of this title wherein a variance from the provisions of
a zoning regulation is requested for a structure that is not primarily a renewable energy resource
structure, the board of adjustment or the development review board, or the environmental court created
under 4 V.S.A. chapter 27 shall grant variances, and render a decision in favor of the appellant, if all
the following facts are found and the finding is specified in its decision.
(1) That there are unique physical circumstances or conditions, including irregularity,
narrowness, or shallowness of lot size or shape, or exceptional topographical or other physical
conditions peculiar to the particular property, and that unnecessary hardship is due to such
conditions, and not the circumstances or conditions generally created by the provisions of the
zoning regulation in the neighborhood or district in which the property is located.
Staff feels that the subject property does not meet this requirement. The construction of a shed at the
required location is not dependent on the shape, size, or exceptional topographical features of the
property.
(2) That because of such physical circumstances or conditions, there is no possibility that the
property can be developed in strict conformity with the provisions of the zoning regulation and
that the authorization of a variance is therefore necessary to enable the reasonable use of the
property.
This property does not contain any unique physical circumstances or features, so the subject property
does not meet this requirement. In addition, the subject property is currently developed with a single-
family dwelling, which staff feels is a reasonable use of the property.
(3) That the unnecessary hardship has not been created by the appellant.

Any hardship that exists is being created by the appellant, as the applicant constructed the shed in a
location which violates the South Burlington Land Development Regulations.
(4) That the variance, if authorized, will not alter the essential character of the neighborhood or
district in which the property is located, substantially or permanently impair the appropriate use
or development of adjacent property, reduce access to renewable energy resources, nor be
detrimental to the public welfare.
Staff does not feel that the variance, if authorized, would alter the essential character of the

(5) That the variance, if authorized, will represent the minimum variance that will afford relief

Staff does not feel that the variance, if authorized, would represent the minimum variance that will
afford relief or represent the least deviation possible from the South Burlington Land Development
Regulations. The subject property is 10,000 SF acres. There is a great deal of land available on the lot
with which to place the shed that would be in compliance with the South Burlington Land
Development Regulations.
RECOMMENDATION
South Burlington Land Use Regulations require that the applicant meet all five of the criteria for approval
of a variance. As all five of the above criteria are not met, staff recommends that the Development
Review Board deny Variance application #VR-06-01.
