Mr. Mona noted that a future right of way to the south was shown at the end of roads Mr. Ireland wanted to be private. He also said there was a city park planned at the end of a private road. Mr. Poger asked Mr. Ireland to comment on why he wanted private roads. Mr. Ireland said he had many reasons and the Commission could go back to the minutes when the private road was approved. He said he would submit his reasons to the Commission but did not feel, since he and the city were in litigation over the issue, that he should discuss his reasons at this time. Mr. ;Mona felt the policy of the Commission was to have public < streets whenever possible and he felt that if they were to deviate from that policy, there should be a reason for it. Mr. Doug Irish spoke in favor of private streets. Mr. Woolery noted the items to be resolved were having the City Engineer look at drainage, the question of where the pedestrain trails would be, and parkland dedication vs. a recreation fee. Mr. Page felt it would be premature to take action on the preliminary plat with so many major issues unresolved. Mr. Poger stated that it has been the policy of the Commission to require public streets because of public access, public utilities, health, safety and welfare of the citizens of the community, and especially where, as in this case, there will be extensions of the roads to other roads and developments. He said that, unless It:r. Ireland could give them some specific reasons for private streets, the Commission would probably ask that these streets be public. Mr. Draper felt there should be a road across the south part of the land connecting the 6 lots to the 34 on the other side of the open space. He felt that would lessen traffic on Pheasant Way, which moves swiftly now. He felt it was a matter of safety. Mr. Ireland did not like the idea, feeling it would become a speedway. Mr. Irish hoped the developer would keep the streams in the development open so water would not back up onto his land. He also noted that it would be helpful if he and Mr. Ireland could split the cost of a fence to be erected at the south end of the property to keep the Irish cattle out of the Ireland development. Mr. Woolery moved to continue the public hearing on Ireland's Meadowood at Spear South preliminary plat until two weeks from tonight at City Hall at 7:30 Pm on May 8. Mr. Levesque seconded the motion and all voted yes. �9 rizon Heights Man men Mr. Page said Horizon Heights was an 11 acre parcel of R7 land which had received approval two years ago for an apartment complex. The originL'_ approval was for 77 units but at final approval that number became 76. The proposal now is to add one unit to bring it up to the maximum density because the manager of the complex had a baby and the family now needs a larger apartment. They propose to add the new unit to building #4. The addition would be one story and contain 1,000 square feet. Mr. Page said there were some items that needed to be cleared up from the last hearing, and those will be done before a building permit is issued. The addition will be visible from the parking lot and one edge can be seen from the Interstate. Mr. Richard Bruce said the location shown for the addition was really the best one. It fits the area, is away from the Interstate, and is visible for anyone coming into the complex and looking for the manager. Mr. Levesque questioned the _unauthorized use of secondary access point to Quarry Hill Rd., which was intended for use only _by emergency vehicles. Mr. Bruce agreed that it was a _em, saying that people were _;ways taking; the gate down and using that -,;ad. The Commission asked that he chain it closed, saying that in an emergency it could be cut open, but also asked him to check that with the Fire Chief. He was also told that Horizon Heights was to plow that road to keep the access open at all times. Mr. Woolery moved that the South Burlington Planning Commission approve the revised final plat for 1 additional dwelling unit for Horizon Heights, subject to the following stipulations as a prerequisite to issuance of a building permit: 1. That the final balance due on the recreation fee (i891) be paid. 2. That there be a final inspection, that "as builts" be submitted, and that easement deeds for sewer and water lines be executed. 3. That an offer of dedication on the pedestrain easement be executed. 4. That the emergency access be chained as approved by the Fire Chief. 5. That a revised final plat be recorded. Ivir. Jacob seconded the motion and all were in favor. Colony Office Park sketch plan IYIr. Claude Gagne said he would like to build two office buildings on the land adjacent to Treetops. He has been to the City Council for approval under Interim Zoning and he read the approval motion from those hearings. The stipulations have been or will be met. There will be a retention pond for storm water runoff from the parking lot and there is a 24" drainage pipe from Kennedy Drive and a drainage swale on the property that is dry normally. There will be a small lift station for sewage to go out to Kennedy Drive. The developers of this lot are hoping Treetops will extend its water line to the property line so they can hook to the 12" line. If not, Mr. Gagne said, they could perhaps tap off the 8" line in Treetops interior. Mr. Jacob did not think that should be done. That should be a 12" line, he said. Mr. Jacob said Ed Blake, CWD General Manager, could take care of the problem. Mr. Woolery brought up the question of screening between this land and Treetops next door but Mr. Gagne said there would be about 55' of heavily treed land between the two. If these people have to locate some trees, Mr. Gagne said, they will do so. Mr. Gagne said the land sloped toward the rear and that the buildings would be one story in the front and two in the back. Parking will be provided in both front and back yards. The buildings will be 160' x 60' and 193 parking spaces are provided, 1 more than the requirement. The spaces are 10' x 20' and the drives are 25' wide. The buildings will contain professional offices. Mr. Gagne was advised to get in touch with the Trails Committee and see where trails were to be on the property. He was also asked to provide, at subdivision review, some justification for the number of parking spaces he was providing. Mr. Gagne said he could provide more spaces if the Commission wished, but he could not justify the number until he knew who his tenants were going to be. Rr. Poger asked that the slope of the land to the rear be gentle so that use of the parking lots under icy conditions was not difficult. He also felt it would be good to have some signs erected directing people to the parking in the rear. I•:r. Gagne said there would be rear entrances so people would go back there to park anyway.
