HomeMy WebLinkAboutCU-96-0000 - Decision - 0099 Proctor AvenueSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 13th day of May, 1996 the South Burlington Zoning Board of Adjustment heard testimony regarding a conditional use application of Rice Memorial High School, Ron Stankervich agent, 99 Proctor Avenue. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findings of Fact 1) The area in question is zoned Residential 4 District. 2) Educational facilities are a conditional use under Section 9.20 of the zoning by-laws. 3) Under Section 26.056 any alteration or change to a conditional use requires approval by the Zoning Board of Adjustment. 4) Included with the proposed alterations is the need to fill an area with approximately 112 cubic yards of earth materials. Alterations of existing grades requires Zoning Board of Adjustment approval. 5) The proposed alterations are the addition and re -configuration of a soccer field and installation of a soft ball field. Conclusion 1) Educational facilities are acceptable uses within any residential areas. 2) This is a outdoor facility, no impact on municipal facilities are projected. 3) The expansion of the recreational facilities will not have an adverse impact on the character of the neighborhood. 4) Neighbors are deeding land to allow for these expansions. 5) No additional traffic is expected by these changes. 1 Based upon the findings and conclusion set -forth above, the Zoning Board of Adjustment hereby grants a conditinal use permit to R.M.H.S. allowing for the e 3�z!vi Qf a soccer field and installation of a softball fie r l or Avenue.
