Re: Findings of Fact, application of Goldfield Construction
Management to amend a previously approved plan for a 23,600 square
foot building for equipment rental/light manufacturing use. The
amendment consists of: 1) increasing the size of the internal
office space from 2605 square feet to 4605 square feet, 2) reducing
the width of a curb cut, 3) adding green area at building entrance,
and 4) constructing a 20 space parking lot, 14 Berard Drive.
On the 16th day of December, 1997, the South Burlington Planning
Commission approved the request of Goldfield Construction
Management for site plan review under Section 26.10 of the South
Burlington Zoning Regulations based on the following findings:
1. This project consist of amending a plan previously approved on
1/10/95 for a 23,600 square foot building for equipment
rental/light manufacturing use. The amendment consists of: 1)
increasing the size of the internal office space from 2605 square
feet to 4605 square feet, 2) reducing the width of a curb cut, 3)
adding green area at building entrance, and 4) constructing a 20
space parking lot.
2. This property located at 14 Berard Drive lies within the IC
District. It is bounded on the east by a fuel storage and
distribution business, on the north and west by undeveloped land,
and on the north and west by undeveloped land, and on the south by
Berard Drive.
3. Access/circulation: The property is currently served by six
(6) curb cuts on Berard Drive ranging in width from 60 feet to 12
feet. The 1/10/95 approval required that the 60 foot curb cut be
reduced in width to 36 feet. This was never done. This proposal
would reduce the 60 foot curb cut to 24 feet. A seventh curb cut
is proposed at the northerly end of the property to access a new 20
space parking lot. Section 26.103(a) of the zoning regulations
states that "unless specifically approved by the Planning
Commission there shall be a maximum of one driveway per lot
accessing a public street."
Circulation on the site is adequate.
4. Coverage/ setbacks: Building coverage is 16.6% (maximum allowed
is 30%) . Overall coverage is 37.3% (maximum allowed is 70%).
Front yard coverage is 22.7% (maximum allowed is 30%).
Setback requirements are met.

5, Parking: A total of twenty four (24) spaces are required and
29 spaces will be provided including two (2) handicapped spaces
and a bike rack.
6, Landscaping- The minimum landscaping requirement, based on
building costs, is $4050 which is being met. Proposed plantings
include Boxwood, Arborvitae, Pine and Pear.
7. Sewer: No additional allocation needed.
8. Traffic: No additional traffic is expected.
9. Lighting: Exterior lighting consists of seven (7) building
mounted 100 watt high pressure sodium lights with downcasting
shielded fixtures.
10. Lot mercrer: The new parking area is to be constructed on an
adjoining lot acquired by the property owner. A lot merger
agreement should be recorded merging the new lot with the existing
lot prior to permit issuance.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington
Planning Commission approves the site plan application of
Goldfield Construction Management to amend a previously approved
plan for a 23,600 square foot building for equipment rental/light
manufacturing use. The amendment consists of: 1) increasing the
size of the internal office space from 2605 square feet to 4605
square feet, 2) reducing the width of a curb cut, 3) adding green
area at building entrance, and 4) constructing a 20 space parking
lot, 14 Berard Drive, as depicted on a three (3) page set of
plans, page one (1) entitled, "Vermont Tent Co. South
Burlington, Vermont," prepared by Michael Lawrence Associates,
dated December 8, 1997, with the following stipulations:
1) All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2) For the purpose of calculating road impact fees under the
South Burlington Impact Fee Ordinance, the Planning Commission
estimates that the additional office space will generate zero (0)
additional vehicle trip ends during the P.M. peak hour.
3) Any new exterior lighting shall consist of downcasting
shielded fixtures. Any change to approved lights shall require
approval of the City Planner prior to installation.
4) Prior to issuance of a zoning permit, the applicant shall
post a $4050 landscape bond. The bond shall remain in effect for
three (3) years to assure that the landscaping takes root and has

a good chance of surviving.
5) Pursuant to Section 26.103(a) of the zoning regulations, the
Planning Commission approves a seventh curb cut to serve the new
parking area.
6) Prior to permit issuance, the applicant shall record in the
land records a lot merger agreement that merges the newly
acquired lot with the existing lot. The agreement shall require
approval of the City Attorney prior to recording.
7) At the new curb opening, the existing barrier curb shall be
removed and a new depressed curb shall be installed..
8) The new parking lot shall be graded so as to drain towards the
gully to the east.
9) The applicant shall obtain a zoning permit within six (6)
months pursuant to Section 27.302 of the zoning regulations or
this approval is null and void.
10) The applicant shall obtain a Certificate of
occupancy/Compliance from the Administrative Officer prior to the
use of the additional office space and the new parking lot..
11) Any change to the site plan shall require approval by the
South Burlington Planning Commission.
