SOUTH BURLINGTON DEVELOPMENT REVIEW BOARD
The South Burlington Development Review Board will hold a public hearing at the South
Burlington City Hall Conference Room, 575 Dorset Street, South Burlington, Vermont on
Tuesday, May 16, 2000, at 7:30 P.M. to consider the following:
1) Application of Kevin Renfrew seeking conditional use approval under Section 26.05,
Conditional Uses and Section 26.65, Multiple Structures and Uses on Lots, of the South
Burlington Zoning Regulations. Request is for permission to add automobile sales use in
conjunction with the current automobile repair and service use, 6 Gregory Drive.
2) Final plat application of Steven Lidofsky & Lis Barfod for boundary line adjustments of lots
#1 - 5, Pheasant Way.
3) Final plat application of Patchen Road Group, LLC to amend a previously approved planned
residential development consisting of 92 multi -family units in 23 buildings. The amendment
consists of amending condition #12 of the 4/16/96 approval to allow the indoor storage of
recreational vehicles, Patchen Road.
4) Application of Michael Burnham seeking conditional use approval under Section 26.05,
Conditional Uses and Section 26.65, Multiple Structures and Uses on Lots, of the South
Burlington Zoning Regulations. Request is for permission to convert 2250 square feet of an
11,250 square foot building from storage and distribution use to automobile repair and service
use, 91 Ethan Allen Drive.
5) Preliminary plat application of Jeffrey & Elizabeth Goldberg to subdivide a 12.92 acre parcel
into five (5) lots of 2.34 acres (lot #1), 2.34 acres (lots #2), 1.73 acres (lot #3), 1.92 acres
(lot #4), and 4.55 acres (lot #5), 1760 Dorset Street.

Lighting: The applicant has submitted cut sheets for the Director of Planning and Zoning to
review. The applicant should submit additional information indicating the wattage of each
fixture. All lights must be downcasting and shielded.
Building Height: The building will be a flat roofed structure that will rise to a height of 34.5
feet.
Traffic: The intersection of Swift Street Extension and Dorset Street was designed to
accommodate a full build -out of the park and therefore no additional improvements are
required.
Landscaping: The minimum landscaping requirement is $30,500. The applicant has
proposed $15,133 worth new of landscaping and is requesting a waiver for $15,367. The
applicant has proposed to relocate 26 white pine and 4 pin oak. The site is already well
landscaped.
Dumpster: A screened dumpster storage area is being provided.
Other: The applicant should revise the master plan approved on May 26, 1992 to reflect the
proposed changes to the park.
7) MEADOWWOOD AT SPEAR —FINAL PLAT— BOUNDARY LINE
ADJUSTMENTS - PHEASANT WAY
This project consists of boundary line adjustments for lots one through five. The South
Burlington Planning Commission approved the final plat for Meadowwood at Spear in
1976. Since that time, there have been several revisions, including one boundary line
adjustment. The proposal will both decrease and increase the lengths of lot lines. The
South Burlington Development Review Board considered the sketch plan application on
March 7, 2000 (minutes enclosed).
Boundary Line Adjustments: The boundaries for Lot One will decrease on the north side
from 359.74 feet to 349.9 feet and increase on the west side from 138.83 feet to 139.07
feet. Lot Two's boundary lines will increase on the east side from 138.83 feet to 139.07
feet and on the west side from 425.96 feet to 425.98 feet. Lot Three's will increase on
the east side from 425.96 feet to 425.98 feet and decrease on the west side from 443.04
feet to 442.97 feet. Three of the four boundary lines on Lot Four will change in length.
The north boundary will increase from 146.19 feet to 156.19 feet. The east side will
decrease from 443.04 feet to 442.97 feet while the west boundary from 459.90 to 459.59.
Lot five east boundary will decrease from 443.04 feet to 442.97 feet and the west
boundary from 482.12 to 481.75 feet.
Easements: The proposed boundary line adjustments will not effect the Pheasant Way
right -right-of-way or the 15 foot drainage easement between Lot One and Lot Two.
Setbacks: Buildings and building envelopes have been delineated on the plans. All

buildings appear to satisfy setback requirements.
8) PATCHEN ROAD GROUP — QUARRY RIDGE CONDOMINIUMS — FINAL
PLAT AMENDMENT
The applicant has requested amending one of the conditions of approval. Condition #12
states: " As expressly represented by the applicant, the Homeowners Association
documents shall prohibit the on -site storage and parking of recreational vehicles". The
applicant requests amending this condition to allow for the on -site storage of recreational
vehicles as long as they are solely contained within the garage appurtenant to each unit.
Final Plat Approval by the South Burlington Planning Commission on April 16, 1996 for
construction of a planned residential development consisting of 92 multi -family units,
201 Patchen Road
This project is located at 201 Patchen Road in the Residential Four District. It is bounded
on the east by Patchen Road, on the west and east by single family residences and on the
south by Summer Moods condominiums.
The applicant should address the parking requirements for this development. Staff is
concerned that if all or most of the residents chose to store a recreational vehicle (R.V.) in
their garage, there will be inadequate parking for the cars. One option to resolve this
problem would be to set a limit on how many garages can be used to store R.V.s, but this
would be very difficult to enforce. Another option would be to construct a R.V. parking
area. This is a requirement which was waived at the applicant's request when this project
was approved.
9 & 10) RENJF'REW — SITE PLAN AND CONDITIONAL USE APPLICATION —
AUTOMOTIVE SALES — 6 GREGORY DRIVE
This project consists of converting a portion of the parking area to a car sales display and
to expand a portion of the parking area. This property was previously approved for
automotive repair and service use by the Planning Commission on August 13, 1985.
Since that time, the Planning Commission has given approval for the expansion of the
parking area and a second curb cut.
This property located at 6 Gregory Drive lies within the Mixed Industrial Commercial
District. It is bounded on the west by Gregory Drive, on the south by an auto dealership,
on the east by an undeveloped lot, and on the north by an auto accessory business.
Access: There are currently two curb cuts on the property from Gregory Drive. The
southern most point of access is 23 feet in width and leads to a 19 foot access drive. The
northern most access drive is 36 feet in width. This second point of access was
previously approved by the Planning Commission. No changes are proposed.
Circulation on the site is adequate.
Coverage/setbacks: The lot is 92,325 square feet. The building coverage is 6.8%
(maximum 30%) and the total building coverage is 37.5% (70% maximum). The total

Mr. Taylor explained that the project was approved in June, 1977. The perimeter had
been surveyed a few years before that. After approval, they found an error of a few
inches in the perimeter near Pheasant Way. At the same time, Stu Ireland decided to
shorten Lot # 1 by 10 ft. In addition, some minor changes were made to lots 2-4. The
revised plan was never filed with the city. Now, because of the Bianchi decision, this
needs to be filed.
Mr. Belair said the application can go straight to Final Plat.
Members raised no issues.
8. CONTINUED PUBLIC HEARING: Application #CU-00-02 of Wesco, Inc.,
seeking conditional use approval from Section 26.05, Conditional Uses, and
Section 26.65, Multiple Structures and Uses on Lots, of the South Burlington

The Interagency Act 250 Review Committee supports the concerns of the
Environmental Advisor.
In addition to the advisor's concerns, the following comments were made:
Sewage Disposal
The Technical Plans Review Section is aware of limitations presented for
construction and installation of sewer, water, storm water and subsurface drainage
lines because of the high water table. The Plans Review Section has requested
considerable additional information from the applicant with regard to problems
presented by the saturated nature of the site.
Streams and Shorelines
[Criteria #l(E) and #1(F)J. The Environmental Advisor indicates that the
natural condition of the streams on site will be altered. To prevent undue adverse
impact, the Agency recommends a twenty-five foot setback for all construction from
centerline of each stream.
Discharges to Streams
A discharge .permit will be required for storm water discharges to streams.
Soil Erosion
The application indicates that the Soil Conservation Service has been consulted
with regard to the proposal. Soil Conservation Service comments included in the
application suggest several improvements and soil erosion control measures. Because
of the saturated nature of the site, the Agency requests that the applicant prepare
a specific soil erosion control plan for construction together with a response to the
suggestions of the Soil Conservation Service. Findings of fact should -be made as to
the requested submission.

Lots 13, 41 and east are on a west slope occupied, by a very open stand. of
sugar maple and. beech sawlogs, park -like in appearance. Soils are Geort;eia

Lots 19, 31 and east are flat, oxen and wet. Soils are P-P-17�--@.de and
Scarboro, with hir;h iwater table. These conditions continur� to the south,

the project.

The major concerns in this application are for soil erosion on stream banks
caused by increased stream .f'loJs, and need :for detailed construction

detailed review by Management and FYt7ineerinF; is in order.
Cumulative flows from the storm sewers are calculated to be 25.93 CT�,S.
This added volume would have a tremendous effect on the rr�ain stream, w1hich
was rouFhly calculated to be flowinr), at 15 CFS on '/P/76 at the proposed:

There does not appear to he any provision for the mairitenance of the drainage
system on private properties, ie: the 15 foot drainage easements.
In light of the severe frost -heave potential of these soils, the city of.
South Burlington should carefully evaluate the road construction details.
Sight distances at Spear Street are Food.

Comments attached to the application indicate no barden on municipal services.
However, the city eiXrineer should carefully consider construction techniques
in light of the wet soils, and the capacity of the sewage treatnent plant.
T'hi_s project will not be himhly visible from Spear Street. The .road
righ-of-way should be located so as to totally preclude damame to trees along
Lakewood Drive adjacent to the open meadow. If this is not possible, then a
detailed roadside landscaping; plan sliould be developed.. 7-1e preservation of
trees on lots 13, 41 and east would be highly desirable, however overfill and
other construction damarre will assuredly talce its toll.

ENGINEER's REPORT
MEADOWOOD at Spear is a proposed single family housing development located off
Spear Street in South Burlington, Vermont. The present owner of the property
is National Life Insurance Company of Montpelier, Vermont and the project will
be developed by Stuart D. Ireland of Ferry Road, Charlotte, Vermont.
There is presently a 12 inch water main along Spear Street which connects to the
Champlain Water District, 24 inch main along Swift Street. A hydrant test was
conducted with the Insurance Services Office and the South Burlington Water
Department on November 14, 1975. Static pressure was 60 psi and the residual
pressure was 52 psi at 1200 gpm. This 12 inch main will be extended along Spear
Street to the proposed development and provisions will be made for future extension
along Spear Street.. This location will be the high point of the line and a
hydrant will be located here. The City of South Burlington has a regular schedule
of hydrant maintenance to relieve trapped air in transmission lines and prefers
that no automatic air release valves be installed. An 8 inch main will be brought
into and used throughout the MEADOWOOD at Spear development. At two points,
provision will be made for the future extension of this main, should th(! property
to the soi;th be developed. Based on fire flows of 1200 gpm, the minimum pressure
calculated would be 51 psi. The maximum pressure under static conditions would
be 120 psi (see attached calculations). Class 150 asbestos cement pipe will be
used in the upper portion of the development (Lots 1 through 5), and Class 200
will be used below. Pressure reducing valves will be installed at the individual
homes.
l The mains will be laid in the street R.O.W. and the soil conditions existing are
/ conducive to adequate structural support (see plan -profile sheets for soils
information). An extensive subsurface drainage system is planned that will
lower the water table in the lower portions of the development, so that full
basements can be provided for the homes.
The estimated per capita consumption is 100 gpd since the homes will be of higher
value than normal. The ISO booklet "Guide for Determination of Required Fire Flow"
recommends flows of 750 to 1000 gpm for the type of home and spacing provided.
These flows can be adequately supplied (see attached calculations).
The area will be served by gravity sewers which will connect to the sewer on
Green Mountain Drive. Treatment is at the Bartlett's Bay Plant. Flow quantities
were based on 100 gped and the zoning used to determine the possible population
that will contribute to the wastewater flows. Peak flows were set at five times
the average flows, and the capacity of the sewers and the velocity at peak flow
were tabulated. (See attached tabulation.) The Bartlett Bay plant has a design
capacity of 0.75 mgd and is presently treating approximately 0.5 mgd. The plant
operates under Discharge Permit # 3-1023. The proposed sewers are 8 inch asbestos
cement with precast concrete manhole structures. Drop manholes were used where
depth or velocity became excessive. To maintain grade to the Green Mountain Drive
sewers, the water and sewer easement through the South Burlington - Recreation -
Conservation area has to be,iilled and a drainage structure provided. This fill
will also be used for the pedestrian easement which is coincident with the water
and sewer easement.
The capacity of the stormwater system was sized for a 10 year, 1 hour storm. The
drainage area was obtained from topographic maps above each inlet structure and
runoff from the open land, homes and paved areas were tabulated. Reinforced
concrete pipe will be used for the stormwater sewers and is sized for the estimated
flow at each inlet point. (See attached calculations.)
A subsurface drainage system of perforated pipe that will provide for the connection
of home footing drains and the elimination of wet areas is anticipated for the
project. Plans for this system were reviewed by the Soil Conservation Service
(see attached letter). Cleanout are provided so that the drain could be flushed,
1 if necessary. Where a natural Swale intersects the drainage line,a catch basin
J is provided that will intercept surface flow.
Electrical and telephone service will be underground and colonial style street
lights will be provided along the roads.

There is a portion of the site that is comprised of sandy soils, but this in not

RE: ADDENDUM TO APPROVAL OF MEADOWOOD AT SPEAR, FINAL PLAN
DATE: 2/24/76
I inadvertantly failed to bring up several points which
should have been clarified in the motion of approval for
Meadowood at Spear. The applicant has tentatively agreed to
these stipulations, which could be in the form of a motion for
an addendum to the approval as follows:
1) with regard to the boundaries of the R)+ and BPD districts
which affect the parcel under consideration, the Commission finds
that physical and cultural features on the ground are at variance
with those shown on the Official Zoning Map; the Commission
interprets the boundaries of the R1+ district as extending through-
out the property under consideration and westerly to a parcel
of City -owned land; the Commission further interprets the boundar-
ies of the BPD district as extending northerly to the south-
eastern corner of a parcel of City -owned land.
2) the conservation open space district is interpreted as
extending 501 from the centerline, on both sides, of drainageways
shown on the utilities layout (sheet 2 of 239 1/76) on lots 10,
119 131 159 l,9, ' and the park land.

a 3) the lot directly west of and abutting the cul-de-sac
is to be designated "Neighborhood Park" on the final plat.

February 24, 1976

trails is consistently low and does not have an
impact on adjoining residential neighborhoods.

100 Dorset Street Shopping Mall
Proposed is an addition containing approximately 4300 square
feet, one story - 1536 square feet is addition to Eastern
Mountain Sports, remaining square footage is additional
retail shops.
This proposed addition was granted a variance by the Zoning
Board of Adjustment on January 19, 1976 - provisions considered
were Section 11.15, Multiple uses and Section 13.40, Off-
street parking.
Multiple use provides for only one use per lot - the proposed
plan would allow for up to four more uses.
Off-street parking - Table I provides for a minimum of 449
parking spaces. Modifications within the existing parking
area would allow for 225 spaces, or 50h of the required
spaces. The Zoning Board of Adjustment granted a variance
stipulating that a minimum of 218 spaces be provided.
Landscaping within the parking lot will be rearranged to allow
for 21F spaces.
Town & Country Furniture Shoo
Proposed is the conversion of Valuga Sports, plus an addition
36' x 40, to the rear of existing building to be used as a
furniture shop. Parcel in quest -ion is located within two
zoning districts; BR District a depth of 300 feet and R4
District. (25,500 square feet in ER and 6,375 in R4).
Existing building contains 2,FF0 sauare feet. Use is allowed.
All dimensional requirements are conforming.
Parking required by Section 13.40: 33 spaces a minimum of
106 square feet and 2 spaces at 250 sq. feet (unloadin_; &
loading area).

Proposed parking for 33 spaces will require paving rear
portion of lot within BR District, R4 area to remain
undeveloped.
Planning Commission required to consider a reduction of two
spaces or greater (50% of required being 18 spaces).
Additional landscaping is proposed along the southerly
property line to screen rear yard from residential area
located on Imperial Drive. Twenty-six evergreens (arborvitae)
4 - 5 feet high spaced 5 feet on center, estimated cost
of landscaping ?by this office) $650.00.
Mr. Lash would be agreeable to erecting a stockade fence,
which might provide for better screening.
Gulf Oil Company
Service station located at 1041 Shelburne Road to be razed,
new building 24110" x 716" with canopy extension over pump
island will replace existing building.
Zoning Board of Adjustment will consider this proposal on
Monday, February 9, 1976.

Under the existing Vermont Public Service Law, Green Mountain Power
Corporation is required "to furnish reasonably adequate service, accommodations
and facilities to the public."
Historically, the company has been able to anticipate customer's
requirements, and has provided the necessary facilities for added loads. It is
our intention to continue this policy in accordance with applicable Public
Service Board regulations.
Assuming the project is approved by the necessary agencies, Green
Mountain Power Corporation will cooperate in every way to provide safe,

COMPREHENSIVE PLAN

An informal meeting of representatives from the Pedestrian
Trails subcommittee was held to help clarify the exact layout
and function of the pedestrian trails shown in the Comprehensive
Plan on or near the proposed Ireland Subdivision.
The conclusion of this group was that in general two types
of pedestrian trails are called for b the Plan: 1) paved (i.e
sidewalks and/or bikeways, or streets for walking, jogging, biking,
etc. and 2) non -paved, in a more or less natural state, for
walking, skiing, snowshoeing, etc along drainageways, property
boundaries, and/or connecting Cit open space land.
With respect to the proposed subdivision, it was felt that
the needs outlined in l)above were more than adequately met.
With respect to 2� it was felt that a pedestrian easement along
the north property line, which would 'link up the City's open
space land with the Nowland property, would be an important
link in the system proposed in the Comprehensive Plan.
The Natural Resource Committee should be asked for its
position on this matter, if the Planning Commission wishes to
persue it further.

Re: Open Space
In regards to your question pertaining to the Ireland Development and
the amount of land to be set aside for recreation and open space purposes,
I submit the following: A true judgment is extremely difficult to make
without, having some projections as to the character of the community or
development in question. I do not believe that a decision can be made based
strictly on numbers of homes or numbers of people; but rather should be
based on such data as ages, income, possible recreation interests and other
facilities that might be in the area. Example: Why allow for a little League
field where only teenagers and adults will live. Based on the information that
you have given me concerning the purposed price of these homes, I would not
expect to find many young children, but possibly would find many families with
teenagers. This would dictate certain types of facilities such as tennis,
basketball, bike and pedestrian trails, etc.
Please understand that this is any personal opinion and has not been discussed
with either the Natural Resources or Recreation Coomittees. The city currently
has 13 acres of land adjacent to the purposed development which I understand
would be suitable for possible activities, though I have not seen the land my-
self. It seems to me that land would be necessary for the development of some
facilities for more active recreation, probably 2-4 acres, but again I would
need more conclusive information on the people that would be living there.
I would strongly urge that some land be set aside for public access for
bicycling and hiking running parallel to Shelburne Road and Spear Street.
I realize that this response is rather vague and perhaps I can be more
definite in my suggestions when more information is available regarding tLe
development.

ARTICLE 1 - WATER MAINS
SECTION 1 - DESCRIPTION
This work consists of the excavation, installation of pipe, appurtenances and the
backfi.11ing required for the extension of the water system at Spear Street and
i,MADOW00D at Spear subdivision, South Burlington, Vermont.
SECTION 2 - MATERIALS
2.1 The water main shall be Class 150 and 200 asbestos -cement pressure
pipe manufactured in accordance with AWWA C-400-75 specification. The pipe
shall be vinyl -lined and be of equal quality to Johns -Manville Transite Ring
Tite Pressure Pipe or Certainteed Fluid Tite Pipe.
2.2 Valves shall be AWWA approved in accordance with 0-500-71 and shall
have cast iron bodies with parallel brass scats, double disc construction and
non rising stems. Valves shall be of equal quality to Kennedy Figure 573X for
6 inch, 8 inch, and 12 inch pipe or Mueller A 2380-5 for 6 inch and 8 inch pipe
and Mueller A 2380-15 for 12 inch pipe. Valve boxes shall be of equal quality
to Mueller H 10364 and cover H 10361 and be of the sliding type.
2.3 Fittings shall be cast iron conforming to AWWA specifications C 110-71
and be suited for connection to gasketed A.C. pipe.
2.4 Hydrants shall be of the dry barrel type conforming to AWWA C 502-73.
They shall be improved three way hydrants with inlets for A.C. pipe and shall be
Darling B 62B with National Standard Threads.
SECTION 3 - INSTALLATION
3.1 The pipe shall be installed in accordance with AWWA Standard C 603-65.
Implements, tools, and facilities satisfactory to the ENGINEER shall be provided
and used by the CONTRACTOR for the safe and efficient execution of the work.
3.2 The trench shall be two feet in width and provide a minimum of 5!--, feet
of cover over the top of the water main.
3.3 If the material in the trench bottom is satisfactory to the ENGINEER,
the pipe may be placed on the trench bottom. The bottom shall be shaped to the
pipe and holes provided for the couplings. If the ENGINEER directs that pipe
be placed on earth mounds, they shall be of an approved backfill material and
support the pipe at two points such that there is 2 inches of clearance between
the couplings and the trench bottom.
3.4 The pipe shall be carefully lowered into the trench and the ends,
grooves and rubbers cleaned before lubrication is applied and connection made.
3.5 Fittings and valves shall be cast-iron and supplied with a bell that
will accept the pipe and rubber ring. The inside of the bell shall be wire
brushed before connection to remove all lumps, blisters and excess coatings.

Where noted on the plans, thrust blocks and anchors shall be provided of Class B
C concrete. Cast-iron valve boxes shall be centered over the wrench nut of the
valve and be brought to the surface.

3.6 Hydrants shall be connected to the 8 inch main with 6 inch stubs and
provided with a separate 6 inch gate valve. Thrust blocks of Class B concrete
shall be provided for the tees and hydrants as shown on the plans. Hydrant
drains shall be plugged where the water table is encountered.
3.7 A standard end cap shall be installed at each dead end fitting and
provided with a thrust block as shown on the plans.
3.8 Backfilling shall be done as soon as possible after the pipe has been
laid. Sand bedding shall be placed in 6 inch lifts and compacted to 90%
density Standard Proctor Test to a point 4 inches above the pipe.
3.9 Water mains shall be laid at least ten feet horizontally from any
sanitary sewer, storm sewer or sewer manhole, whenever possible; the distance
shall be measured edge to edge.
3.10 When local conditions prevent a horizontal separation of 10 feet, a
water main may be laid closer to a storm or sanitary sewer provided that:
a) the bottom of the water main is at least 18 inches above
the top of the Sewer;
b) where this vertical separation cannot be obtained, the sewer
shall be constructed of materials and with joints that are
equivalent to water main standards of construction and shall be
pressure tested to assure water tightness prior to backfilling.
3.11 Water mains crossing house sewers, storm sewers or sanitary sewers shall
be laid to provide a separation of at least 18 inches between the bottom of the
watei main and the top of the sewer, whenever possible.
3.12 When local conditions prevent a vertical separation as described in
Section 3.11,
a) Sewers passing over or under water mains should be constructed
of the materials described in Section 3.10 b).
b) Water mains passing ender sewers shall, in addition, be protected

y providing:
1) a vertical separation of at least 18 inches between the
bottom of the sewer and the top of the water main;
2) adequate structural support for the sewers to prevent
excessive deflection of joints and settling; on and breaking
the water mains;
3) that the length of water pipe be centered at the point of
crossing so that the joints will be equidistant and as far as
possible from the sewer.

SECTION 4 - HOUSE SERVICES
4.1 Connections to the main for house services shall be made by use of
a tapped coupling with 3/4 inch threaded brass insert (AWWA threads). A
corporation stop with 3/4 inch AWWA Threads (Mueller H-15000 or equal) shall be
installed in the coupling.
4.2 The curb stop shall be the inverted key type for copper service of
equal quality to Mueller H-15200 and be supplied with an extension type curb
box with stationary rod and arch pattern base (Mueller H-10334 or equal).
4.3 Service line shall be 3/4 inch Type K Copper.
SECTION 5 - TESTING
5.1 After construction, the pipe shall be filled for 24 hours (Seven days
after placement of thrust blocks) before the pressure test. The pressure shall
be 150% of the static pressure for the test. The duration of the test shall be
for two hours unless directed otherwise by the ENGINEER. The allowable leakage
shall not exceed 30 gpd per inch diameter per mile of pipe. The pump, pipe
connection, and all necessary apparatus shall be furnished by the CONTRACTOR.
Defective work shall be replaced and retested.
SECTION 6 - DISINFECTION
6.1 The line shall be flushed prior to disinfection at a velocity not less
l than 2.5 fps.
6.2 A hypochlocite solution shall be fed into the line at the point of
connection to the existing main and supplied until the chlorinated water reaches
all points in the line. (Approximately 2.5 gallons of 1% solution per 100 feet of
8" pipe.) After 12 hours the chlorine residual shall be 50 ppm and after 24 hours
the residual shall be 25 ppm. If this residual is not maintained, the procedure
shall be repeated.
6.3 Upon completion of the disinfection, the main shall be flushed of the
heavily chlorinated water and a bacteriological sample submitted to the Health
Department.
6.4 Disinfection shall be in accordance with AWWA Standard C 601-68.

ARTICLE 2 - SANITARY SEWERS
SECTION 1 - DESCRIPTION
This work consists of the excavation, installation and baekfilling for the
sanitary sewer and appurtenances at MEADOWOOD at Spear, South Burlington,
Vermont.
SECTION 2 - MATERIALS
2.1 The pipe shall be Class 2400 asbestos -cement pipe meeting the
requirements of Federal Specifications SSP-331c and ASTM C428 with inside
nominal diameter of 8 inches. Couplings shall be of the rubber gasket variety
and be compatible with the pipe. The pipe shall be of a quality equal to
Certainteed "Fluid Tite" or Johns -Manville "Transite" asbestos -cement non -
pressure sewer pipe.
2.2 Fittings shall be asbestos -cement and be compatible with the pipe
used. Wyes, bends, stubs and caps for house services shall be 6 inch diameter
to the property line.
2.3 Manholes shall be pre -cast concrete sections. The base shall be
(" 6 inch x 72 inch x 72 inch reinforced concrete with #4 reinforcing bars 6 inches
on centers both directions. The manhole sections shall have an inside dimension
of 48 inches with 5 inch concrete wall reinforced with 3 x 6 4/4 welded steel wire
fabric. The pre -cast sections shall accept an 110" ring rubber gasket at the
joints. The gasket shall meet the requirements of ASTM C-443 and C-361. Ladder
rungs shall be aluminum and be spaced at 12 inch intervals. The top section
shall be an eccentric cone with bottom inside dimension of 48 inches and top
inside dimension of 24 inches. Wall thickness shall vary from 5 inches at the
bottom to eight inches at the top and shall be concrete reinforced with welded
steel wire fabric.
2..4 The manhole frame and cover shall be heavy duty cast-iron with a
minimum weight of 380#. The opening shall be a nominal 24 inches with a height
of 8 inches. The frame and cover shall be of equal quality to Neenah R 1649 or
LeBaron LA 21;8-1 .
SECTION 3 - INSTALLATION
3.1 The trench shall conform to the line and grade indicated on the plans
and provide a minimum width of 24 inches at the bottom. The depth of the trench
shall allow for 4 inches of bedding material under the pipe. Excavations for
the manhole shall provide for 8 inches of granular material lznder the base.
3.2 A crushed stone bedding material shall be placed in the trench bottom.
C The bedding material shall be 3/3 inch crushed stone. The bedding shall be
smooth and support the pipe throughout its length and be recessed under collars.
3.3 The asbestos -cement pipe shall be carefully lowered into the trench
and laid with the couplings on the upgrade end.

3.4 The coupling ring groove shall be thorougly cleaned and the rubber
C gasket installed. The machined surfaces of the pipe shall be lubricated with
the lubricant supplied by the pipe manufacturer. The lengths of pipe shall be
joined by bar and block, lever or friction pullers and the field joints shall
be checked with a feeler gage.
3.5 After installation of the pipe to the proper line and grade, additional
crushed stone shall be placed to the spring line of the pipe. The material
shall be thoroughly tamped around the haunches and placed equally in 4 inch lifts
to the spring line of the pipe. Select compactible soil shall be placed and
compacted in 6 inch lifts to 12 inches above the top of the pipe. The remainder
of the backfill shall be placed in 12 inch lifts and compacted. Tine ENGINEER
shall approve the backfill material.
3.6 The trough for the manhole shall be formed, where possible, by
removin„ the top section from a portion of half-length asbestos -cement pipe
and centering the pipe in the manhole. A table of concrete shall be placed to
the 3/4 height of the pipe and sloped 2 inches to the center.
3.7 The frame shall be adjusted to grade by a minimum of two courses of
concrete brick set in mortar and the frame shall be mortared to the top of the
eccentric cone. Backfill shall be placed and compacted in 12 inches lifts around
the manhole.
3.8 Drop manholes shall be constructed as shown on the plans. The drop
pipe shall be encased in Class B concrete for a minimum of 6 inches around the pipe.
SECTION 4 - TESTING
4.1 The sewer shall be tested between manholes by the exfiltration test
method in the presence of the ENGINEER. The inlet end of the down stream
manhole shall be plugged with a tapped plug to connect a source of water to and
braced in the manhole. The upper end shall be plugged and connected to a
10 foot stand pipe.
4.2 The line shall be filled from the down stream end and allowed to
stabilize for two hours. Additional water shall be added as necessary. The
head shall riot exceed-25 feet over the down stream plug.
4.3 The drop in the stand pipe shall be reaorded at 15 minute intervals
until stabilized leakage is determined.
4.4 The exfiltration shall not exceed 100 gallons per inch diameter
per mile per day. If the test indicates excessive exfiltration, the
CONTRACTOR shall take the necessary steps to locate and correct the deficiency.
The test shall be conducted again until satisfactory results are obtained.
SECTION 5 - SEPARATION FROM WATER MAINS
Refer to ARTICLE 1, SECTION 3, Paragraphs 3.9 through 3.12.

ARTICLE 3 - STORM SEWER
SECTION 1 - DESCRIPTION
This work consits of the excavation, installation and backfill for the storm -
water system at MEADOin'OOD at Spear, South Burlington, Vermont.
SECTION 2 - MATERIALS
2.1 The pipe shall be reinforced concrete pipe meeting the requirements
of Federal Specification SS-P-375b, with inside diameters of 12, 15, 18,21 and 24
inch. The pipe shall have belled ends suitable for mortar joints.
2.2 Catch basins and storm manholes shall be precast concrete. The base
shall be 6 inch x 48 inch x 48 inch reinforced concrete, with #4 reinforcing
bars 6 inch on centers both ways. The vertical section shall have inside dimensions
of 24 inch x 24 inch, with 8 inch concrete walls reinforced with 6 x 6 4/4
welded wire Fabric. Cutouts shall be provided as required. There shall be a
24 inch sump on all catch basins and storm manholes.
2.3 Trap catch basins shall be constructed similar to catch basins and
storm manholes. Lie inside dimensions of the vertical section shall be 24 inch x
56 inch. A bafle wall of reinforced concrete, 8 inches thick with horizontal
#'4 bars 18 inch on centers, shall be cast integrally with the vertical section.
There shall be a 48 inch sump, and 24 iaeh clearance between the base and the
baffle wall.
2.4 The catch basin inlet frame and grate shall be heavy duty cast iron,
of equal quality to Neenah R _3405. The storm manhole frame and lid shall be
heavy duty cast iron, of equal quality to Neenah R 1878-A5. The trap catch
basins shall be provided with an inlet frame and grate and a frame and lid of
equal quality to Neenah R 3405 and R 1878-A5.
SECTION 3 - INSTALLATION
3.1 The trench shall conform to the line and grade indicated on the plans
and provide a width at the bottom of 12 inches greater than the pipe diameter.
The depth of the trench shall allow for 4 inches of bedding material under the
pipe. Excavations for catch basins and storm manholes shall provide for 6 inches
of granular material under the base.
3.2 The bedding material shall be 3/8 inch crushed stone. The bedding
material shall be placed in the trench bottom such that it will be smooth and
supports the pipe throughout its length and be recessed at the bells.
3.3 The reinforced concrete pipe shall ba carefully lowered into the
trench and laid with the bell on the uphill end.
3.4 The lengths of pipe shall be joined by bar and block, Lever or friction
pullers.

3.5 The joints shall be thoroughly grouted with mortar.
3.6 After installation of the pipe to the proper line and grade, additional
crushed stone shall be placed to the spring line of the pipe. The material
shall be placed in 4 inch lifts and thoroughly tamped around the pipe haunches.
Select compactible soil shall be placed and compacted in 6 inch lifts to 12 inches
above the top of the pipe. The remainder of the backfill shall be placed in
12 inch lifts and compacted. The ENGINEER shall approve the backfill material.
3.7 The frame for the catch basins and storm manholes shall be adjusted to
grade by a minimum of two courses of concrete brick set in mortar. The frame
shall be mortared to the top of the vertical section.
3.8 Backfill shall be placed and compacted in 12 inch lifts around the
catch basins and storm manholes.
3.9 A concrete headwall shall be formed around tho outlet ends of the pipe
as shown on the plans. Reinforcing bars shall be placed as shown on the plans.
Rip rap, 8 inches to 12 inches in diameter, shall be placed in the outfall ditch.
The amount of rip rap shall be determined by the ENGINEER.
SECTION 4 - FOOTING DRAINS
4.1 Footing drain connections shall be made where noted on the plans.
The pipe shall be 4 inch polyvinyl chloride of equal quality to Certainteed
Schedule 40 within the road right -of -wary. The pipe shall conform to Commercial
Standard CS 272-65. A hole shall be cut in the storm sewer and the 4 inch
pipe shall be grouted in place.
SECTION 5 - SEPARATION FROM WATER MAINS
Refer to ARTICLE 1, SECTION 3, Paragraphs 3.9 through 3.12.

ARTICLE 4 - UNDERDRAINS
SECTION 1 - DESCRIPTION
This work consists of the excavation, installation, and backfill for the under -
drain system. at MEAD0WOOD at Spear, South Burlington, Vermont.
SECTION 2 - MATERIALS
2.1 The pipe and laterals shall be perforated pipe. The 4 inch, 6 inch,
avid 8 inch pipe shall be perforated bituminous fibre pipe conforming to
AASIO M 177-60. The 12 inch pipe shall be perforated corrugated galvanized metal
pipe conforming to AASIID M 36, and shall be 16 gage.
2.2 Underdrain catch basins shall be constructed of precast reinforced
concrete well tile sections, with 24 inch inner diameter and 3 inch concrete
walls. The walls shall be reinforced with 3 x 6 4/4 welded wire fabric. The
base shall be 6 inch x 36 inch x 36 inch reinforced concrete with #4 reinforcing
bars 6 inches on centers both ways. The grate shall be a 29 inch diameter
medium duty cast iron beehive style grate of equal quality to Neenah R 4353.
l 2.3 Cleanouts shall be constructed of 6 inch bituminous fibre pipe and
J fittings of equal quality to the underdrain pipe. There shall be 48 inch long
section of 12 inch diameter reinforced concrete pipe of equal quality to the
storm sewer surrounding the cleanout at the ground surface. (Refer to ARTICLE 3,
SECTION 21 Paragraph 2.1.) There shall be a concrete cap at the ground surface
which shall set in the bell end of the 12 inch concrete pipe.
SECTION 3 - INSTALLATION
3.1 The trench shall conform to the line and grade indicated on the plans,
and shall allow for 2 inches of crushed stone under the pipe. The width of the
trench shall le 24 inches. Excavations for catch basins shall provide for
6 inches of granular material under the base.
3.2 Crushed stone shall be 13!* inch crushed quarry stone. The initial
2 inches of crushed stone shall be placed in the trench bottom suct_ that it is
smooth and supports the pipe throughout its length.
3.3 The pipe shall be lowered into the trench and joined with collars
matching the pipe.
3.4 The lengths of pipe shall be firmly seated in the collars by bar and
block or lever.
\ 3.5 After installation of the pipe, additional crushed stone shall be
J placed to 12 inches over the top of the pipe. Bank -rim gravel shall then be
placed to a point determined by the ENGI14EER based upon field inspection of the
soil donditions.
3.6 The stone or gravel shall be covered with building paper.
3.7 The remainder of the backfill shall be placed and compacted in 12 inch
3.8 Backfill shall be placed and compacted in 12 inch lifts around cleanouts
and catch basins.
SECTION 4 - FOOTING DRAINS

the preparation of the subgrade, and the construction of
and sidewalks for the road at MEADOWOOD at Spear,
2.1 The materials shall conform to the requirements of the following
subsections of the "Standard Specifications for Highway and Bridge Construction",
approved and adopted by Vermont Department of Highways, January, 1972:
a) Gravel base - 704-05
b) Crushed gravel - 704.07
c) Bituminous concrete pavement - 406.02
(i) The base course shall be Types I or II
(ii) The surface course shall be Types III or
d) Concrete, for curbs, sidewalks and driveways -
concrete, Class B
e) Sand borrow (as required) - 703.03.
SECTION 3 - CUNSTRUCTION
IV.
501, Standard
3.1 Prior to the beginning of excavation, grading and embankment operations
in any area, all necessarf clearing and grubbing in that area shall have been
completed.
Excavation shall be made in reasonably close p�?oximity to the lines
and grades indicated on the plans and typical section.
During construction, the roadway shall be maintained so that it will
be drained at all times.
3.2 Cuts and fills shall -be accomplished so that the best material is
beneath the travelled way.
3.3 Fills shall be placed and compacted in 12 inch lifts to not less than
90% maximu:ii dry density. Stumps, roots, organic materials and other deleterious
materials shall not be included in .ills.
3.4 All loose rock or boulders encountered at subgrade shall be removed or
broken off to a depth of not less than 12 inches below subgrade.
3.5 After all sewer, water, stormwater, drainage and utilities systems and
appurtanances have been installed in accordance with the appropriate Sections
of these Specifications, the subgrade shall be brought to a firm surface, compacted
to not less than 95% maximum dry density.

3.6 The subbase of gravel shall be placed and compacted in two layers,
1 eacb layer being approximately 7 inches in depth. Compaction shall be accomplished
J with an approved 3 wheel power roller weighing between 8 and 10 tons, a rubber tired
roller, or other means approved by the ENGINEER, until a solid, unyielding base
4s obtained.
3.7 The crushed gravel base shall be placed and compacted in one layer of
approximately 4 inches in depth. All holes or depressions s1aall be filled with
crushed gravel and compacted. The final surface shall be in close proximity to
the lines, grades and cross -sections indicated in the plans.
3.8 Bituminous material shall not be placed between November 1 and May 1,
nor when the temperature in the shade at the paving site is below 32° F.
3.9 The bituminous material shall be placed and compacted in two layers,
such that upon compaction the base course has a uniform thickness of 11_5 inches, and
the surface course has a uniform thickness of 1 inch.
3.10 Bituminous pavers shall be used to distribute the mixture over the
half -section, or such partial width as is practical. On areas where irregularities
or unavoidable obstacles make the use of mechanical spreading and finishing
equipn.ent impracticable, the mixture shall be spread, raked and luted by hand tools.
3.11 Immediately after the bituminous mixture has been spread, struck off
and „urface irregularities adjusted, it shall be thoroughly and uniformly
compacted by rolling. The surface shall be rolled when the mixture is in the
proper condition and when rolling does not cause undue displacement, cracking,
or shoving.
The number, weight and type of rollers used shall be sufficient to
obtain the required compaction while the mixture is in a workable condition.
3.12 Joints between old and new pavements or between successive days' work
shall be made so as to insure a thorough and continuous bond between the old and
new mixtures.

Butt joints shall be formed by cutting the pavement in a vertical plane
at right angles to the centerline. The joint shall be thoroughly coated with
emulsified asphalt, Type RS-1, just prior to depositing the paving mixture.
Longitudinal joints shall be coated with Emulsified Asphalt, Type RS-1,
before the adjacent mat is placed.
3.13 Upon completion of compaction, the surface shall conform to the line,
grade, and cross -sections indicated in the plans.
3.14 Concrete curbs, sidewalks, and driveways shall be cast -in -place upon
a compacted gravel base.
All concrete shall be placed in daylight, unless otherwise authorized
by the ENGINEER.
3.15 When transit mix is used, a schedule of batching, delivery and placement
shall be submitted to the ENGINEER prior to the beginning of concreting operations.
3.16 The external surface of all concrete shall be worked to force all
coarse aggregate from the surface and to bring mortar against the forms to produce
a smooth finish.

3.17 In joining fresh concrete to concrete that has hardened, the surface
\ shall be roughened in such a manner that will not leave loosened particles or
�J damaged concrete at the surface. Immediately prior to placing the new concrete,
the surface shall be saturated with water.
3.18 Expansion joint material shall be cut to fit exactly and shall completely
fill the space.
3.19 All concrete surfaces shall be given a dressed finish. When the
concrete has hardened sufficiently, the surface shall be given a broom finish.

ARTICLE 6 - PIPE ARCH and FILL
SECTION 1 - GENERAL
This work shall consist of the excavation for and construction of the pipe arch,
backfill, and sewer main through the Conservation Open Space at MEADOWOOD at
Spear, South Burlin,-,ton, Vermont.
SECTION 2 - MATERIALS
2.1 The pipe arch shall be constructed of corrugated galvanized 10 gage
steel. The pipe arch, collars, bolts and nuts shall conform to the requirements
of AASHO M 167. Corrugations shall be 2 2/3 inches by !:� inches. Standard end
sections shall be compatible with the pipe arch. The pipe arch, collars and end
section openings shall have a span of 79 inches and a rise of 49 inches.
2.2 Granular backfill. shall conform to the requirements of subsection
704.11 of the Standard Specifications for Hgihway and Bridge Construction, Approved
and Adorted by Vermont Department of Highways, January, 1972.
2.3 The footpath shall be constructed of crushed gravel or plant mix, A
conforming w subsections 704-07 ar+d 704.03 respectively of the Standard Specifications
for Highway and Bridge Construction.
SECTION 3 - CONS^RUCTION
3.1 Prior to excavation for the pipe arch, a temporary channel for the
stream shall be excavated. Sections of the existing stream bed may be utilized for
this purpose. The temporary channel shall be used until the pipe arch has been
installed to grade and backfillin; has begun.
3.2 The area within the limits of construction of the"pipe arch and embankment
shall be cleared and grubbod, and all objectionable material shall be removed.
3.3 The pipe arch shall be bedded in an earth foundation of uniform density,
carefully shaped to fit the base of the pipe arch and to conform to the line and
grade indicated on the plsns.
3.4 The pipe shall be placed on the bed and the sections joined using
standard bolted collars.
3.5 Backfill material shall be placed evenly on both sides of the pipe arch.
Material shall be placed and compacted in 6 inch lifts until at least the 3/4
point has been reached. Special care shall be taken to thorougizly tamp each layer
by means of mechanical tampers under the Launches for the width of the trench.
The remaining fill shall be placed and compacted in 12 inch lifts, and shall
continue uniformly on both sides until at least 4 feet of compacted material is
obtained above the top of the pipe arch. The fill shall be compacted to 85%
maximum iry density.

3.6 The fill shall conform to the shape and grade indicated on the plans and
1 profiles. Side slopes stall not exceed 2.5 : 1.
3.7 Where a new channel is excavated, the cross-section shall be similar
to the existing channel. New banks shall be rip rapped.
3.8 Upon completion of the fill, the sewer main shall be installed and
backfilled according to the line and grade indicated on the plans, and in
conformance with ARTICLE 2 of these SPECIFICATIONS.
3.9 A footpath shall be constructed on the top of the fill as indicated on
the plans. The material shall be tamped to provide a firm surface.

ARTICLE 7 - EROSION CONTROL and TURF ESTABLISHMENT
SECTION 1 - DESCRIPTION
This work shall consist of construction of temporary diversions, debris, and
sediment collection basins for the control of erosion during construction, and
the preparation and application of topsoil, seed, fertilizer, limestone, mulch,
and matting for temporary and permanent turf establishment at MEADOWOOD at Spear.
SECTION 2 - MATERIALS
2.1 Topsoil shall be natural workable loam, free of refuse, roots, stones,
brush, weeds, or other material which would be detrimental to proper application
or proper development of plant growth. Topsoil stripped within the construction
site may be stockpiled for use. Other sources of topsoil shall be inspected
and approved by the ENGINEER before its use.
2.2 Seed shall be furnished new in clean, properly labeled packages. Seed
which has become wet or moldy shall not be acceptable. Seed types or mixtures
and application rates shall be as listed under SECTION 5.2.
2.3 Fertilizer shall be standard commercial grade fertilizer furnished in
new, clean, properly labeled packages not exceeding 100 pounds each. Wet, caked,
or otherwise damaged fertilizer shall not be acceptable. The minimum percentage
of nitrogen, phosphoric acid, and potash, and the application rate shall be
as listed under SECTION 5.2.
2.4 Agricultural limestone shall be calcic or dolomitic ground limestone
containing not less than 85% of total carbonates. Limestone shall meet the
following sieve analysis: at least 40% shall pass the No. 100 sieve and at
least 95% shall pass the No. 8 sieve. The limestone shall -be furnished in new,
clean, properly labeled packages of 100 pounds or less each, or may be delivered
and spread from bulk delivery trucks. The application rate of limestone shall be
as listed under SECTION 5.2.
2.5 Hay mulch shall consist of mowed and properly cured grass or legume
moorings, reasonably free of weeds, twigs, debris or other objectionable
material. It shall be free from rot or mold and shall be acceptable to the
ENGINEER.
2.6 Erosion control matting shall be paper yarn of approximately .05 inch
diameter woven into netting with approximate openings of 7/8 by ig inch. It shall
weigh about .20 pounds per yard. Staples shall be made from 12 inch lengths of
No. 11 gauge steel wire bent to form a "U" of 2 inches in width. Longer staples
may be required in loose soils.
SECTION 3 - SEDIMENT COLLECTION
3.1 One debris basin shall be constructed downstream from the proposed
pipe arch. This -basin shall consist of a temporary earth dam not to exceed
5 feet in height constructed perpendicular to the flow of the stream.

3.2 A corrugated metal pipe drop inlet spillway shall be installed
through the dam. This spillway shall have a 24 in diameter barrel with a
36 inch diameter perforated riser. The top of the riser shall be 2 feet below
the crest of the dam. The perforations shall be 1-s inch to 1 inch in diameter
spaced 8 inches vertically and 12 inches horizontally. Two corrugated metal
anti -seep collars shall be attached to the barrel and spaced 15 feet apart.
3.3 In no event shall debris or sediment be allowed to accumulate to
within 11g feet of the top of the spillway riser. Sediment shall be removed from
the debris basin at regular intervals at least monthly according to the
calendar year.
SECTION -4 - DIVERSIONS
4.1 Diversions to carry runoff safely from the construction site shall be
constructed at various locations within disturbed areas. They shall have a
smooth channel bottom and grade which will prevent erosion within the diversion.
All diversions shall be acceptable to the ENGINEER.
SECTION 5 - SOIL STABILIZATION
5.1 All areas to be seeded shall be shaped in reasonably close conformity
to the lines and grades shown on the plan. All areas to be permanently seeded
shall receive 3 inches of compacted topsoil. Limestone and fertilizer shall be
spread evenly over the topsoil by mechanical or other means and tilled into the
soil to a depth of 3 inches. Seed shall be applied evenly over the topsoil
and raked in to a depth of about 4 inch. The seeded area shall then be rolled
lightly. Hay mulch shall be spread over all seeded areas.
5.2 All areas to be seeded shall receive -seed, fertilizer, limestone,
and hay mulch according to the following schedule:

5.3 Erosion control matting shall be used in temporary diversions and areas
to be permanently seeded which are unusually, susceptible to erosion. Generally,
matting will not be required on slopes less than 3 on 1. Matting shall be
installed on both the upstream and downstream sides of the fill within the
utility easement crossing the stream. All matting shall be anchored with steel
wire staples. Matting placement shall be acceptable to the ENGINEER.
SECTION 6 - CLEAN UP
6.1 The sedimentation basin and diversions shall be considered temporary.
l Upon completion of the project they shall be graded over as shown on the plans.
J All sediment and debris collected shall be removed from the sedimentation basin.
The outlet pipe shall be removed and the stream channel shall be graded to
conform to contours shown on the plans. Disturbed areas shall be treated as in
SECTION 5. All clean up operations shall be acceptable to the ENGINEER.

1 6.2 The CONTRACTOR shall be responsible for protecting and caring for
J seeded and mulched areas until final acceptance of the work. He shall repair
and replace all areas where seed has failed to germinate and areas damaged by
pedestrian or vehicular traffic or other causes.

10. These covenants are to run with the land and shall
be binding on parties claiming under them for a period of
twenty (20) years from the date these covenants shall be
extended for a period of ten (10) years unless an instrument
signed by a majority of the then owners of the lots has been
recorded agreeing to change said covenants in whole, or in part.
11. Enforcement shall be by proceedings at law or in
equity against any person, or persons, violating or attempting
to violate, any covenant either to restrain violation or to
recover damages.
12. Invalidation of any one of these covenants by judgment
or Court Order shall in no way affect any of the other pro-
visions which shall remain in full force and effect.

of the Committee the remaining members shall have the full
authority to designate a successor. Neither the members of the
Committee nor its designated representative shall be entitled
to any compensation for the services performed pursuant to

Upon completion of construction of single family dwellings
on ninety (90%) percent of the lots in Meadow Wood At Spear,
a majority of the then recorded owners of the majority of the
lots -shall have the power through a duly recorded written
instrument -to change the membership of the Committee or to
withdraw from the Committee, or restore to it any of the powers
and duties.
The Committee's approval or disapproval, as required in these
covenants, shall be in writing. In the event the Committee,
or its designated representative,•fails to approve or disapprove
within thirty (30) days after plans and specifications have been
submitted to it, approval will not be required and the related
covenants shall be deemed to have been fully complied with.
Recreation area to be owned by a Home Owners Associates after
