Dear Mr. Mrs. Wilkins:
Enclosed are the minutes of the meeting at which the pedestrian
trail was discussed. The Commission unanimously decided to re-
move the section of trail between your properties from the
trail network but to retain the easement legally. I realize
that you did not have the opportunity to discuss this personally
with the Commission except through your letter and will gladly
place it on the agenda again if you wish. You may call the
members of the Commission as well.

"Graphic/Construction Management Services, Inc.," with the
following stipulations:
1. All stipulations from the October 9, 1984 approval shall
remain in effect.
2. The 30 foot section of barrier shown at the drive near
Williston Road shall be a low type such as concrete curbs set
at edge or one foot or 2 feet beyond the designated drive
width. The end shall be tapered and marked with a delineator
to prevent snow plows from hitting it.
3. At this time, access road use is restricted to traffic
traveling between the Brockway office and hangar and to the
12 airplane condo hangars in the Airport Industrial zone.
The applicant shall be required to submit a revised parking
plan to the Commission if and when the 30 foot access road
becomes more heavily used.
4. The strip of white pines approved for western property
line shall be replaced with a more salt tolerant tree as ap-
roved E the City Planner. This change shall be shown on a
revised site plan.
Mr. Burgess seconded, and the motion passed unanimously.
Consider request 1�y Wilkins and Genever-Watling to eliminate
proposed pedestrian trail located between their properties at
23 and 25 Pheasant Way. —
Mrs. Maher noted that the 2 families want the land deeded
back to them. She said she didn't object to it not being
used in the trail system, but felt the City should retain the
easement.
Mr. Burgess moved that the Commission remove the stipulation
requiring a pedestrian trail between lot 10 and 11 on
Pheasant Way but that the City maintain its existing
easement. Mr. Jacob seconded, and the motion passed
unanimously.
Other Business
A work session will be held Tuesday, 11/19 to discuss
traffic. Craig Leiner traffic engineer with the MPO will
make a presentation and will talk about a computer model that
might be used to plug in development data to see its impact
on traffic.

Re: Pedestrian Trail

The Natural Resources Committee at its meeting November 5,
1985 supported a motion to recommend that the pedestrian trail
now located between lots #10 and 11 Pheasant Way, Meadowood,
be deeded back to the owners at their expense. The committee
feels the existence of the larger easement located along the
eastern border of the development is sufficient for pedestrian
trail purposes and provides the necessary link in the system.

Re: Ireland Development Sewer -Pedestrian Easement between
lots #10 and #11

When I was first approached regarding the need for this easement,
I only looked at the immediate area and saw the alternate which
I agreed that it was a better route for hiking in a north -south
direction because it was off the street. I did refer the
interested parties to the Natural Resouces Committee for their
comments. Easements and rights -of -way are very difficult to
obtain after the land is developed. If it is decided to abandon
this easement it should be with the stipulation that if some
times in the future the City has a need for this easement that it
has the right to reclaim it. There may be a need sometime in the
future to construct a walkway at this location for quick access from
one neighborhood to another or to a school or park.

Parking and Circulation: A $3000 landscaping plan is shown as
required. A cedar hedge is proposed to screen the Reilly property
to the north. A stockade fence will screen the playground area.
Lot coverage is only 31%.
Traffic: This is located in overlay zone five. Twenty one trips
are permitted during the peak hour. The applicant projects a
maximum of 23 trips during any one hour based on a study of a
similar facility at 1451 Williston Road. The ITE data for an
elementary school is .15 trips per student or 5.25 trips for
this use and 2.94 trips per employee or 11.8 trips during the
peak hour. These levels are acceptable especially given the
driveway location on Mills Avenue rather than Williston Road.

7) TATE, 3060 WILLISTON ROAD
Ira Tate has agreed to revise his site plan to move the first
148 feet of the access drive six feet to the west to better
align with Shunpike Road. The strip of trees will remain beyond
that point.
If and when the proposed Airport Access road becomes heavily used,
Mr. Tate agrees to move his spaces to a location at the rear
of the building. Until that time, he would prefer to have it
remain as it is. If we assume the District Commission's
restrictions on limited access will hold, this agreement should
be adequate. The District limited the access to the Brockway
office traffic and to the 12 condo -airplane hangars in this
Airport -Industrial alert area. Any increase in use requires
DEC approval.
The front building (former Auto Parts business) is the subject
of a Zoning Board of Adjustment appeal and will be a future
site plan application.
8) PEDESTRIAN TRAIL, PHEASANT WAY
The enclosed letter discusses the request of two property owners
to eliminate the pedestrian trail that was deeded to the City
when their development was built. It is located between lots
#10 and 11. They suggest a better route was provided when the
Overlook at Spear project dedicated a trail along lots six
through ten. This trail is also along a sewer easement. (see
enclosed letter and Bill Szymanski's comments.

Dear Bill,
It has come to our attention that a pedestrian easement exists
on the boundary of lots no. 10 and 11 in Meadowood at Spear.
This was put in at the time that the subdivision was originally
permitted. However, since that time the development of the Milot
Project included a larger and more directly routed pedestrian
easement along the eastern boundary of Meadowood. (see sketch)
Because this new pedestrian trail on the Milot property is
located with the sewer easement, what has been created is a
cleared and definitive trail along the eastern boundary. There-
fore, an additional pedestrian trail accessing Meadowood at
Spear through these two lots now seems unnecessary.
In addition the potential use of this easement would require
extensive removal of mature trees as well as creating a potential
infringement on, and maintenance liability for, the lawns on
lots 10 and 11. Conversations with Bill Szymanski and Tom Hubbard
have also indicated that the easement in question is no longer
necessary.
In summary, we request that this easement be deeded back to
the actual lot owners, at their own legal expense.

June 28, 1988 pendingthe outcome of discussions between

reconvened on Monday, August 8, 1988 at-4:30 p.m. at the
