FINAL PLAT APPLICATION #SD-06-72
FINDINGS OF FACT AND DECISION
Peter Cherouney and Susan Jacques, hereinafter referred to as the applicants, are
seeking final plat approval for a boundary line adjustment between 43 Pheasant Way
and 15 Quail Run. The Development Review Board held a public hearing on September
5, 2006. Scott Jones represented the applicants.
Based on testimony provided at the above mentioned public hearing and the plans and
supporting materials contained in the document file for this application, the Development
Review Board finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicants are seeking final plat approval for a boundary line adjustment
between 43 Pheasant Way and 15 Quail Run.
2. The owners of record of the subject properties are Peter Cherouney & Susan
Jacques, and Gary & Tonia Karnady.
3. The subject property is located in the Residential 2 (R2) Zoning District.
4. The plan submitted is entitled, "Boundary Plat Peter Cherouney & Susan
Jacques 43 Pheasant Way So. Burlington, Vermont", prepared by Trudell
Consulting Engineers, dated 5/17/06.
5. The applicant is proposing to adjust the boundary between the two properties in
order to comply with a judicial order issued in 1986 . The total acreage conveyed
as a result of this boundary line adjustment is 0.02 acres. This is a minor property
line adjustment and results in no substantial change to setbacks, coverages, or
other dimensional requirements as regulated in the South Burlington Land
Development Regulations. Both properties are still in full compliance with the
Land Development Regulations.
6. The applicant appeared before the Development Review Board for sketch plan
review on June 20, 2006. The Board had no concerns at that time. There have
been no changes to the application since the sketch plan review.

DECISION
Motion by 1r seconded by
to approve Final Plat Application S -06-72 of Peter Cher6Lky & Susan Jacques,
subject to the following conditions:
1) All previous approvals and stipulations shall remain in full effect, except as
amended herein.
2) This project shall be completed as shown on the plat submitted by the applicant,
and on file in the South Burlington Department of Planning and Zoning.
3) The plans shall be revised to show the changes below and shall require approval
of the Administrative Officer. Three (3) copies of the approved revised plans shall
be submitted to the Administrative Officer prior to recording.
a) the plan shall be revised to note that the original lot line will be
disolved.
4) Any changes to the final plat plan shall require approval of the South Burlington
Development Review Board.
5) 4. The final plat plan shall be recorded in the land records within 180 days or this
approval is null and void. The plan shall be signed by the Board Chair or Clerk
prior to recording. Prior to recording the final plat plan, the applicant shall submit
a copy of the survey plat in digital format. The format of the digital information
shall require approval of the Director of Planning and Zoning.
