HomeMy WebLinkAboutSP-18-35 - Decision - 0014 Berard Drive#SP-18-35 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING MOVEABLE PEAKS, INC. — 14 BERARD DRIVE SITE PLAN REVIEW APPLICATION #SP-18-35 FINDINGS OF FACT AND DECISION Site plan review application #SP-18-35 of Moveable Peaks, Inc. for after -the -fact approval to amend a previously approved plan for a 23,676 sq. ft. equipment rental use building. The amendment consists of after -the -fact approval for 13 detached accessory structures (storage containers) of 342 sq. ft. each, 14 Berard Drive. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT The applicant, Moveable Peaks, Inc., seeks after -the -fact approval to amend a previously approved plan for a 23,676 sq. ft. equipment rental use building. The amendment consists of after -the -fact approval for 13 detached accessory structures (storage containers) of 342 sq. ft. each, 14 Berard Drive. 2. The owner of record of the subject property is Moveable Peaks, Inc. 3. The subject property is located in the Mixed Industrial - Commercial Zoning District. 4. The application was received on July 18, 2018. 5. The plan set submitted consists of a four (4) page set of plans, page one (1) is labeled "Vermont Tent Company Lot 10, 11 Berard Drive South Burlington Vermont", prepared by Krebs & Lansing Consulting Engineers, Inc., and dated 7/18/18. DIMENSIONAL REQUIREMENTS 6. The new detached accessory structures will: increase building coverage to 19.8% (maximum allowed is 40%), increase overall coverage to 43.0% (maximum allowed is 70%), and front yard coverage will remain at 31.7% (maximum allowed is 30%). 7. The new detached accessory structures will meet the setback requirements. SITE PLAN REVIEW STANDARDS Only the standards below are affected by this application. All other standards will continue to be met. #SP-18-35 Bicycle Parking 8. The plan complies with Section 13.14 of the LDRs to include the new type and location for bicycle racks, to accommodate two (2) short-term bicycle parking spaces (100% of requirement). The bicycle parking detail on sheet CD-1 shows two (2) racks but only one rack will be installed to satisfy the 100% requirement. Accessory Structures; 9. The 13 accessory structures will meet all the provisions of Section 3.10 of the LDRs. Dumpster., 10. A new dumpster enclosure is proposed behind the building. Lighting 11. All the non -complying exterior lighting fixtures will be replaced with downcasting and shielded fixtures. A point by point lighting plan was submitted showing compliance with the Performance Standards regarding lighting. This plan shows six (6) parking spaces at the northeast corner of the building which are not being proposed. This plan should be revised to not include these spaces. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP-18-35 of Moveable Peaks, Inc., subject to the following conditions: All previous approvals and stipulations which are not changed by this decision, will remain in full effect. 2. This project must be completed as shown on the plans submitted by the applicant, and on file in the South Burlington Department of Planning and Zoning. 3. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications must be underground. 4. The plan must be revised to show the changes below and will require approval of the Administrative Officer. Three (3) copies of the approved revised plan must be submitted to the Administrative Officer prior to permit issuance. a. The site lighting plan (sheet SL-1) must be revised to remove the six (6) parking spaces at the northeast corner of the building which are not being proposed. 5. The applicant must obtain a zoning permit within six (6) months to construct the site modifications pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 6. All exterior lighting must be installed or shielded in such a manner as to conceal light 2 #SP-18-35 sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. 7. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to use or occupancy of the accessory structures. 8.
