The design review committee of the Pinnacle at Spear Homeowners association has reviewed the
request for a side lot waiver on lot 31. The reasoning for their decision is that the sidelot variance
is adjacent to an open space dedicated for a retention basin. This parcel is unbuildable and
therefore this variance has no impact on an adjoining property owner or and open space use.
