HomeMy WebLinkAboutSP-94-0000 - Decision - 0099 Proctor AvenueFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Rice Memorial High School to construct a 160 square foot concession stand, 99 Proctor Avenue On the 9th of August, 1994 the South Burlington Planning Commission approved the request of Rice Memorial High School for site plan review under Section 19.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of the construction of a 160 square foot concession stand. The last review of the site by the Planning Commission was on July 13, 1993 . 2. This property located at 99 Proctor Avenue lies within the R-4 District. It is bounded on the north by single family residences, on the east by Burlington Country Club and Meadowbrook condominiums, on the south by commercial buildings along Joy Drive, and on the west by single family residences. 3. Access/circulation: Access is provided via a 50 foot curb cut on Proctor Avenue. No changes are proposed for this existing access. Circulation is adequate. 4. Coverage/setbacks: Building coverage is 4.5% (maximum allowed is 20%) . Overall coverage is 13.1% (maximum allowed is 40%) . Setback requirements are met. 5. Landscaping: There is no minimum landscaping requirement for this project, based on building costs, and no additional plantings are proposed. 6. Parking: No additional parking required. 7. Sewer: No additional allocation required. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Rice Memorial High School to construct a 160 square foot concession stand, 99 Proctor Avenue, as depicted on a plan entitled "Proposed Site Modifications, Rice High School", prepared by Thermo Consulting Engineers with a stamped "received" date of 7 / 21 / 94, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The applicant shall obtain a zoning/building permit within six (6) months or this approval is null and void. 1 3. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to use of the concession stand. 4. Any new site lighting shall consist of downcasting shielded fixtures so as not to cast light beyond the property line. Any new lighting or change in existing lighting shall be approved by the City Planner prior to installation. 5.
