Dear Mr. Senecal:
This is in response to your letter of 11/09/16 requesting approval under your umbrella permit
for a new tenant, Gorillaz Garage, as a new tenant at 8 Berard Drive replacing Sterling
Motorwerks. It is my understanding that Gorillaz Garage is an auto service & repair use and
would be occupy one half of the building which was previously used for auto service & repair
use. This tenant change is approved. Since this tenant change does not result in a change in
use, a zoning permit is not required.
Please contact Administrative Officer Ray Belair to apply for the zoning permit if fit -up costs
exceed $5000.

I am writing to request permission to change the tenants at 8 Berard Drive in South
Burlington.
The first tenant will be Phil's Car Care; the business will occupy 2,280 square feet of the
7,200 square foot building. The second tenant will be Priority Auto; that business will
occupy the remaining 4,920 square feet on the first floor of the building and 1000 square
feet of second floor space of the building.
Both businesses perform truck and auto repair; Phil's Car Care carries 1 to 3 employees
at any give time, and Priority Auto employees between 3 and 5 persons at any given time.

without penalizing the owner taxwise. He showed the various
zones included in the properties. They will be separating the C-
2 zoned land from the remainder.
Mr. Weith said he would like the right-of-way to result in one
shared curb cut.
Mr. O'Brien asked if it would be possible to have preliminary and
final plat in one hearing. Members had no problem with this
request.
A Rec Path Committee member asked for consideration of the path
along Kimball Ave. Mr. Dinklage felt this was a good point. Mr.
Burgess suggested the applicant speak with the Committee.
8. Site Plan Application of Alfred Senecal, Jr., to convert an
8200 sq. ft. building from office/warehouse use (electrical
contracting business) for one tenant to a multiple of industrial/
commercial uses for several tenants, 8 Berard Drive:
Mr. Burgess noted that staff had recommended a couple of
changes. This would allow for a lot of uses not granted by the
Zoning Board, as long as they fall within certain parameters
(traffic, parking, etc.). Mr. Burgess asked if the applicant was
comfortable with the uses on the list. Mr. Senecal said he was.
No other issues were raised.
Mr. Crow moved the Planning_ Commission approve the site plan a2-

Jr., dated 10/5/96, with the following stipulations:

seded by this approval shall remain in effect.
2. This approval is for the following uses which are currently
allowed in the IC District: Permitted uses: general office; med-
ical office; light manufacturing; research and testing laborator-
ies; printing, bookbinding, publishing and engraving; wholesale
establishments; warehousing, storage and distribution facilities;
truck terminals; contractor's yards not including retail; lumber
yards not including retail; equipment service and repair shops
not including retail; catering and food delivery use; accessory
uses to uses listed above. Conditional uses: automobile repair
and service; equipment service and repair shops that include re-

tail. If the zoning regulations change so that any of the above
uses are no longer allowed, then those uses which are no longer

4. The applicant shall obtain approval from the City Planner
prior to the change of any tenant in the building. The City
Planner shall approve the pr02Osed new tenant only if the pro-
posed use fits within the limitations established in stipulation
#3 above. In making his determination, the City Planner shall
utilize the2arking standards contained in Appendix A in the
ZoninsRegulations, and trip generation rates contained in the
ITE Trip Generation Manual. If a use is proposed which does not
fit clearly within any of these standards, or if a shared 2arkinq
concept is proposed in order to meet the parking limit, the ap-
plicant shall obtain approval from the Planning Commission for
the proposed use.
5. Any new exterior lighting shall consist of downcastinq
shielded fixtures so as not to cast light beyond the propert
line. Any chance in lighting shal_1beapproved by the City
Planner prior to installation.
6. For the purpose of calculating road impact fees under the
South Burlington Impact Fee Ordinance, the Planning Commission
estimates that the proposed change in use will generate 10.9 ad-
ditional vehicle trip ends during the P.M. peak hour.
7. The applicant shall obtain a zoning permit within six months
pursuant to Section 27.302 of the zoning regulations or this
approval is null and void.
8. The applicant shall obtain a Certificate of Occupancy/Com-
pliance from the Administrative Officer prior to use of the
building.
9. Any change to the site plan shall require approval by the
South Burlington Planning Commission.

I move the South Burlington Planning Commission approve the site

business) for one (1) tenant to a multiple of industrial/commercial
uses for several tenants, 8 Berard Drive, as depicted on a plan

residence and undeveloped land, on the east by Technology Park, on
the north by Kimball Avenue, and on the west by residences and Old
Farm Road.
Access: Applicant should reserve a shared access easement between
lots 1 and 2.
Lot size/frontage: Lots #1 and 2, which lie entirely within the C2
District, will meet the minimum lot size requirement of 40,000
square feet (0.92 acres). Lot #3 meets the minimum lot size
requirement for all districts.
Lots #1, 2 and 3 meet the minimum frontage of 200 feet along
Kimball Avenue and 120 feet along Old Farm Road.
Other:

8) ALFRED_SENECAL, JR. - MULTIPLE USES - SITE PLAN
This project consists of converting a 8,200 square foot building
from office/warehouse use (electrical contracting business) for one
(1) tenant to a multiple of industrial/commercial uses for several
tenants. An addition to this building was approved on 8/8/95
(minutes enclosed) but was never constructed The ZBA on October
20, 1996 granted the applicant a conditional use permit for the
multiple use of the property.
This property located at 8 Berard Drive lies within the IC
District. It is bounded on the north and west by a fuel
distributor, on the east by a mixed use commercial building, and on
the south by Berard Drive.
The applicant is requesting to use the proposed building for three
(3) tenants for any of the permitted and conditional uses listed
below. This request is being made with the provision that all the
uses would not require more than 32 parking spaces, and would not

generate more than 18 vehicle trip ends during the P.M. peak hour.
The reason for this request is so the applicant can have the
flexibility of changing tenants whose uses fall within the approved
traffic and parking limits without having to return to the Planning
Commission each time. When a use is to be changed, the applicant
would contact the City Planner and he would review the existing
uses and the proposed use to make certain that it does not exceed
the upper limits approved by the Planning Commission.

Access/circulation: Access is provided by a 20 foot curb cut on
Berard Drive. No change proposed.
Circulation on the site is adequate.
Coverage/setbacks: Building coverage is 17.8% (maximum allowed is
30%). Overall coverage is 53% (maximum allowed is 70%). Front
yard coverage is 24.2% (maximum allowed is 30%).
Setback requirements are met.
Parking: A total of 32 parking spaces are available including two
(2) handicapped spaces. A bike rack is being provided as required
under Section 26.253(b) of the zoning regulations.
Landscaping: There is no minimum landscaping requirement, based on
building costs, for this project. No additional landscaping
recommended.
Traffic: ITE estimates that the current facility generates 7.1
vehicle trip ends (vte's) during the P.M. peak hour. The applicant
is seeking approval for 10.9 additional vte's for a total of 18
vte's. The applicant may request additional vte's at the meeting.
The applicant should be aware that the road impact fee for 10.9
Additional vte's will be approximately $2300.
Sewer: This property is not connected to the City sewer system.
pum ster: The dumpster is located at the rear of the existing
building so it will not be visible from the street.
Lighting: Exterior lighting will consist of the following:
--- five (5) 35 watt high pressure sodium lamps mounted on the
building with shielded fixtures.
An existing pole mounted flood light will be removed.

final plat application of David Olenick to amend a previously
approved two lot subdivision. 700 Hinesburg Road. The amendments

4. Site plan application of Alfred Senecal, Jr., to construct a
2-story 6,400 sq. ft. addition to an existing 7200 sq. ft.
building used for office/warehouse use (electrical contracting
business), 8 Berard Drive:
Mr. Baker showed that the property is bordered by the Gas Company
on one side and a multi -use building on the other side. They
currently have 7200 sq. ft., 1500 of which is office space. The
office space will move into the new part of the building. They
will eliminate all but two of the storage trailers.
Mr. Burgess asked if the trailers are an on -going use and do they
pre-empt parking spaces. Mr. Weith said they do not pre-empt
parking and are designed so there is access to parking.
Mr. Baker said they will also move the dumpster to be out of
view. The trailers are not visible from other buildings. Mr.
Sheahan asked if they stick out and get in the way of loading and
unloading. Mr. Baker said only if unloading an 18-wheeler, not
with the usual UPS trucks, etc. Mr. Crow asked why 2 trailers
and not one. Mr. Baker said they need two to function
reasonably.
Mr. Austin questioned counting green space under the trailers.
Mr Weith thought they are meeting regulations. He said the
Commission could include the trailer square footage toward
parking and traffic. Mr. Burgess said he wanted to be sure they

are not using the trailers to circumvent square footage
calculations. Mr. Austin felt they were doing the right thing by
counting the square footage toward landscaping, parking, etc.
Other members agreed.
Mr. Weith asked that the parking space closest to Berard Drive be
removed. He noted that they are way over on landscaping. Mr.
Burgess added that any extra parking or landscaping needed for
the additional square footage of the trailers has been met.
Mr. Austin moved the Planning Commission approve the site plan
application of Alfred Senecal Jr to construct a 2-story 6.400

5. Sketch plan application of Veve Associates to amend a
previously approved planned unit development for 105 multi -family
dwelling units. The amendment consists of 1) construction of 4
dwelling units in 2 buildings and 2) allowing a portion of the
property to be used for a parking area for an adjacent
nursing/convalescent home and senior center, 435 Dorset Street:
Mr. Veve said the piece of land is.594 acres and was acquired a
number of years ago. It abuts land with apartments. The plan is
for apartments on this lot D. It is zoned R-7. There would be a
quad of 4 buildings. The entrance would be through Dorset
Commons, and there is a right-of-way through the property.
The Pines developers have asked to use a portion of the lot for
parking. Mr. Veve said he then decided to move the units into the
rest of the property and have units in 2 buildings as duplexes.
The new piece of land would be for parking for the senior center.
This gives rise to issues of density, etc. They are short .42
acres in order to have what they want with this scenario.
Mr. Weith said they are actually short .235 acres. In addition,
the Planning Commission can't approve more than 107 units. Mr.
Veve said they are requesting a variance for the additional
units. He felt it would look better visually with more green
space.
Mr. Burgess asked if there are any issues with the leasing of
parking. Mr. Austin said he doesn't have enough parking for the
development. Mr. Burgess said the Commission won't allow a bad
situation to be made worse. Mr. Veve said there are no parking
problems. Mr. Weith said there are many more cars than spaces.
People park along drives and technically the drives are not wide
enough for that. Mr. Burgess said he wasn't ready to accept that
with illegal parking everything is OK.
Mr. Sheahan felt it was impossible because of the parking.
Mr. Austin suggested the possibility of making the road 3 ft.
wider or otherwise adding parking.
Mr. Burgess summarized by saying the applicant would get a lot

DAVID OLENICK - RESUBDIVISION - REVISED FINAL PLAT
This project consists of the resubdivision of a two (2) lot
subdivision approved on 3/12/85. The resubdivision consists of:
1) reducing size of parcel #3 by transferring 0.24 acres to an
adjoining parcel, and 2) reducing size of parcel #3 by
transferring 0.14 acres to another adjoining parcel. The
resubdivision being requested has already been completed in
violation of the subdivision regulations. This application is to
correct this violation. The sketch plan was reviewed on 3/14/95
(minutes enclosed).
This property located at 700 Hinesburg Road lies within the R1 and
IC Districts. It is bounded on the south by I-89, on the east by
undeveloped land, on the north by a single family dwelling, and on
the west by two (2) single family dwellings and Old Farm Road.
Lot frontage: The parcel being reduced in size will continue to
meet the one (1) acre lot size requirement and 120 foot frontage
requirement.
Setbacks: The new property lines meet the setback requirements
from the existing buildings.
4) ALFRED SENECAL, JR. - OFFICE/WAREHOUSE ADDITION - SITE PLAN
This project consists of the construction of a 2-story 6,400 square
foot addition to an existing 7200 square foot building used for
office/warehouse use (electrical contracting business).
This property located at 8 Berard Drive lies within the IC
District. It is bounded on the north and west by a fuel
distributor, on the east by a mixed use commercial building, and on
the south by Berard Drive.
Access/circulation: Access is provided by a 20 foot curb cut on
Berard Drive. No change proposed.

Coverage/setback: Building coverage is 25.7% (maximum allowed is
30%). Overall coverage is 61% (maximum allowed is 70%). Front
yard coverage is 29% (maximum allowed is 30%).
Setback requirements will be met.
Parking: A total of (22 park i g paces are required and 2 spaces
are being provided including one (1) handicapped space. A bike
rack is being provided as required under Section 26.253(b) of the
zoning regulations. The parking space closest to Berard Drive
should be eliminated to provide a minimum 15 foot green strip along
the street as required under Section 25.107 of the zoning
regulations.
Landscaping: The minimum landscaping requirement, based on
building costs, is $1200 which is being met. Plantings will 1
include White Pine, Spruce and Yew.
Traffic: ITE estimates that the current facility generates 7.1
vehicle trip ends and with the addition to generate 13.3 vte's for
a 6.2 vte increase. The applicant should be aware that the road
impact fee for this project is approximately $1000.
Sewer: No sewer allocation needed due to on -site septic.
Dumpster: The dumpster is located at the rear of the existing
building so it will not be visible from the street.
Lighting: Exterior lighting will consist of the following:
--- one (1) 175 watt high pressure sodium lamp with a downcasting
and shielded fixture mounted on a 12 foot pole.
--- five (5) 35 watt high pressure sodium lamps mounted on the
building with shielded fixtures.
An existing pole mounted flood light will be removed.
5) VEVE ASSOCIATES - ADD DWELLING UNITS - SKETCH PLAN
