Ryan Request for variance 59 Proctor Avenue Findings of Fact, Conclusions of Law & Order This matter came before the South Burlington Zoning Board of Adjustment on November 9, 1998 by application of Francis J. Ryan, for a variance to construct a 18' x 26detached garage to within ten (10) feet of the rear yard, at 59 Proctor Avenue according to plans submitted. The Board of Adjustment finds as follows: 1) The area in question is zoned residential, detached garage are accessory uses. 2) Section 25.00 area, density and dimensional requirements require a minimum rear yard of thirty (30) feet. 3) The proposed 18' x 26' detached garage will be constructed to within ten (10) feet of the rear property line. 4) Mr. William Anthony representing the applicant, testified that the narrowness of the property prevents locating the garage at thirty feet from the property line. 5) Existing storage sheds and a portable garage will be removed from the property. New garage will be used for storage of mowing equipment and a plow truck. 6) Neighbors (Mike Henry & Bob LaClair) were concerned about the number of vehicles parked on the property. Requesting that "no vehicles" be parked within the front yard. Board stipulated that in order to protect character of the neighborhood that no parking within the front yard be allowed. Id The variance to construct a 18' x 26' garage within ten (10) feet of the rear yard is hereby GRANTED Stipulations: 1) No parking along the northwest corner easterly along the front of the house except in the driveway and into the back yard. 2) All storage buildings will be eliminated including temporary garage. 3) Non-commercial work on cars will be done inside the garage. 4) Motor home parking will be incidental to use. 5) Stipulations are predicated based upon the drawings prepared by Mr. Anthony and are based on measurements at the site realizing that because no survey has been done they may or may not be accurate.
