HomeMy WebLinkAboutCU-96-0000 - Decision - 0008 Berard Drive (2)STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 28th day of October, 1996 the South Burlington Zoning Board of Adjustment heard testimony regarding a conditional use application of Alfred Senecal, 8 Berard Drive. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findings of Fact 1) The area in question is zoned I-C District. 2) The applicant is requesting a multiple use approval for a maximum of three (3) tenants. 3) The proposed uses to include automobile sales and service, taxi companies, equipment sales and service, auto repair and other similar conditional uses under Section 15.20 of the zoning by-laws. 4) The structure contains 7200 square feet and lot contains 40,500 square feet. 5) The prior use being a electrical contractor and warehouse. 6) The property is connected to City water and a on -site sewer system. Conclusion 1) The Zoning Board finds that certain uses are not compatible with the general character of the area, resulting in deletion of the following uses from the original request. Section 15.204 Rental of equipment, Section 15.207 Taxi companies, Section 15.210 Retail businesses, Section 15.217 Day care centers and Section 15.222 Contractor yards. 2) The proposed use automobile repair and a car care center will occupy approximately half of the building, the third tenant has not been identified. 3) This location is classified as an industrial park adjoining properties are occupied by similar uses. 1 4) Maximum vte's proposed for this location should not adversely affect the character of the area. 5) The property is served by an on -site sewer system and a dry well connected to the floor drains, therefore, not affecting the capacity of the Airport Parkway Treatment Plant. 6) With a stipulation that reduces the proposed uses the Board f inds that the essential character of the area will not be impacted. Based upon the findings and conclusion set -forth above, the Zoning Board of Adjustment hereby grants the applicants request to occupy an existing structure h a maximum of three (3) tenants, located at 8 Berard Drive.
