Public Hearing: Application #C U-05-07 of Joel S. Clements for conditional use approval under Section 14.10, Conditional Use Review of the South Burlington Land Development Regulations. Request is for permission to allow a 5'x32' porch to encroach 15 feet into the front yard setback, 24 Maryland St: Mr. Belair explained where measurements are taken from. The applicant then provided photos of what exists now. Mr. Clements said he wants to extend the porch along the front of the house which doesn't go any further from where the bottom of the steps is now. The roof over the steps has existed since they have owned the house. Mr. Belair said this house is further into the setback than any other house on the street. He is concerned with a porch because if it were to be enclosed, it would become part of the house footage. Mr. Clements said they don't want to enclose it. Mr. Dinklage said a. future'owner might. Mr. Belair agreed there was probably no other way to build the porch. Members felt this was a substantial incursion into the front yard. Mr. Kupferman told the applicant that the Board has in the past referred applicants with similar problems to the Planning Commission to see if there is any way to change zoning so the Board can have the ability to approve such a request. Mr. Clements noted the neighbors across the street have put on porches. Mr. Belair said he would have to see if there were permits for these. Mr. Bolton said he could support the application if the applicant could show their movement into the front yard is less intrusive than other homes in the neighborhood. He added that it bothers him that people who play by the rules get turned down while others who don't may get what they want. The applicant asked to continue so staff can look at what exists in the neighborhood. Ms. Quimby moved to continue Application #CU-05-07 until 5 July. Mr. Boucher seconded. Motion passed 6-1 with Mr. Kupferman opposing. Request is for permission to increase the size of the footprint of an existing single family dwelling by 540 sq ft, 5 Pleasant Avenue: - 5 - DEVELOPMENT REVIEW BOARD 17 MAY 2005 Mr. Gittelsohn said they want to build a one-story addition on the south and west sides of the house. Mr. Belair said the plan meets setback requirements and the height is OK. He noted the house next door to the applicant does not meet setback requirements. Mr. Boucher moved to approve Application #CU-05-08 of Paul & Ellen Gittelsohn subject to the stipulations in the draft motion. Ms. Quimby seconded. Motion passed unanimously. 11. Sketch plan application #SD-05-35 of Stephen ]Moore for a planned unit development consisting of: 1) a 10,064 sq ft mixed use commercial building, 2) a 3100 sq ft short-order restaurant, and 3) a 5007 sq ft mixed use commercial building. The request involves: 1) razing the 5007 sq ft building and 2) construction a 24-unit multi -family dwelling, 388, 400 and 410 Shelburne Rd: Mr. Dinklage noted that because this is a corner lot there should be a 50 ft. setback from Shelburne Rd. and a 30 ft. setback from Proctor Ave. Mr. Belair noted the applicant is asking for a height waiver and setbacks could be an issue. Mr. Dinklage felt this was a huge building on a heavily developed lot. He was concerned with the mass of the building and its proximity to streets. He noted the proposed setback from Shelburne Rd. is only 14 feet and from Proctor Ave. only 9 or 10 feet. Mr. Dinklage felt this would be a departure from what else has been developed in this area and he thought it would not be very attractive. He added that the existing office building is not as tall and is set further back. Mr. Belair noted that Town & Country Motel will be coming in to tear down their building and put a retail building up front. The applicant showed a model of the proposed building. It would be flat -roofed with recesses, porches, etc. to break up the mass of building. The applicant also explained the stormwater system and detention ponds. Mr. Kupfennan asked about the relationship to Burlington regarding traffic. Mr. Belair said the building would be all in South Burlington's traffic concern. The applicant would just eliminate a curb cut on Shelburne Rd. and relocate one on Proctor Ave. Ms. Quimby said she didn't want to see a "cheap -looking" building on Shelburne Rd. Mr. Behr said he was concerned that people entering would have to go all around the lot to get into the parking garage. He felt there was too much on the lot with too little space. Mr. Dinklage noted that someone entering at Proctor Ave would have to go all around Kentucky Fried Chicken's building to get to the garage. He felt that was ludicrous. He also felt the section of one-way traffic would be a problem. Associate Planner Brian Robertson and Administrative Officer Ray Belair, referred to herein as Staff, have reviewed the plans submitted on April 12, 2005 and have the following comments. QUEEN CITY PARK REVIEW STANDARDS Pursuant to Section 4.08(D) of the Land Development Regulations, the proposed conditional use shall meet the following standards: 1. The maximum height for all structures shall be no more than twenty-five (25) feet above the average pre -construction grade adjoining such structure See Article 3, Section 3 07(B) for definition of pre - construction grade. The applicant did not submit information on the average pre -construction grade of the subject property, so staff cannot accurately determine the height of the proposed addition. 1. The applicant shall submit information in the average pre -construction grade of the subject property, and the height of the proposed addition in relation to the average pre -construction grade, prior to conditional use approval. This measurement shall be conducted in accordance with Section 3.07 of the Land Development Regulations. 2. The maximum height of a structure may be increased to thirty-five (35) feet if approved by the Development Review Board subject to the provisions of Article 14, Conditional Use Review. In addition, the Development Review Board shall determine that the proposed increase in height will not affect adversely: This criterion is not applicable to the proposed project. (a) news of adjoining and/or nearby properties; This criterion is not applicable to the proposed project. (b) Access to sunlight of adjoining and/or nearby properties; and This criterion is not applicable to the proposed project. (c) Adequate on -site parking. Rooftop apparatus, such as solar collectors, television antennas, and air conditioning equipment shall be included in the height measurement. Chimneys for residential structures shall be exempt from the height limitations. This has been acknowledged in the height calculations for the proposed project. 4. Television antennas and steeples for places of worship that are taller than normal height limitations may be approved by the Development Review Board subject to the provisions of Article 14, Conditional Use Review. This criterion is not applicable to the proposed project. S. The Development Review Board may approve any alteration which exceeds the thirty-five and twenty-five percent rule described above or which involves an increase to the structure's height, footprint or square footage subject to the provisions of Article 14, Conditional Use Review. The provisions of Article 14, Conditional Use Review have been addressed below. 6. In addition to the provisions set forth above, the Development Review Board shall determine that the proposed alteration or expansion will not adversely affect: (a) hews of adjoining and/or nearby properties; The proposed addition is lower than the existing structure and will not adversely affect the views of adjoining or nearby properties. (b) Access to sunlight of adjoining and/or nearby properties; and The proposed addition will not adversely affect the access to sunlight by adjoining or nearby properties. (c) Adequate on -site parking The proposed addition will not alter or affect on -site parking. Z Development, construction, and alterations within the QCP District within one hundred (100) linear feet of the center line of Potash Brook shall be subject to the requirements of the Potash Brook Overlay District The subject property is not within 100 linear feet of the Potash Brook. 8. Multi family dwellings shall be subject to site plan review, as per Article 14. This criterion is not applicable to the proposed project. 1 CITY OF SOUTH BURLINGTON 4 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING \drb\misc\gittelsohn\conditional use.doc CONDITIONAL USE REVIEW STANDARDS Pursuant to Section 14.10(E) of the Land Development Regulations, the proposed conditional use shall meet the following standards: 1. The proposed use, in its location and operation, shall be consistent with the planned character of the area as defined by the City of South Burlington Comprehensive Plan. The proposed addition to the existing single-family dwelling is in keeping with the planned character of the area as identified in the Comprehensive Plan. 2. The proposed use shall conform to the stated purpose of the district in which the proposed use is located According to Section 4.08(A) of the Land Development Regulations, the QCP Zoning District is formed to encourage residential uses at densities and setbacks that are compatible with the existing character of the QCP neighborhood. It is designed to promote smaller lots, and reduced setbacks. Staff feels that the proposed addition to the existing single-family dwelling is keeping in with the purpose of the QCP Zoning District. 3. The Development Review Board must find that the proposed uses will not adversely affect the following: (a) The capacity of existing or planned municipal or educational facilities. The proposed addition will not adversely affect municipal services. (b) The essential character of the neighborhood or district in which the property is located, nor ability to develop adjacent property for appropriate uses. The proposed addition is in keeping with the character of surrounding properties and will not adversely affect the character of the area or the ability to develop adjacent properties. (c) Traffic on roads and highways in the vicinity. The proposed addition will not affect traffic in the vicinity. (d) Bylaws in effect. The proposed addition will not affect bylaws in the vicinity, as the proposed addition will be in compliance with the applicable dimensional standards outlined in Table C-2 of the Land Development Regulations. (e) Utilization of renewable energy resources. The proposed addition will not affect renewable energy resources.
