PLANNING COMMISSION
CITY OF SOUTH BURLINGTON
RE: APPLICATION OF PATRICK & TERESE AYER - PARKING AREA EXPANSION
This matter came before the South Burlington Planning Commission pursuant to the
provisions of Section 26. 10 of the South Burlington Zoning Regulations on application
of Patrick & Terese Ayer, hereinafter "Applicant" for approval to construct 62 auto
storage spaces on a lot containing a 9761 square foot building consisting of 3200
square feet of printing use and 6561 square feet of auto repair and service use, 4
Berard Drive, as depicted on a plan entitled, "Autobahn Body Works, Inc. 4 Berard
Drive South Burlington, Vermont Proposed Storage Parking Spaces," prepared by
Llewellyn, Inc., dated May 1997. The Applicant's representative was present at the
public meeting held relative to this application. Based on evidence submitted at the
meeting and as part of the application, the Planning Commission hereby renders the
following decision on this application:
FINDINGS OF FACT
1. This project consists of constructing 62 auto storage spaces on a lot containing
a 9761 square foot building with 3200 square feet of printing use and 6561 square
feet of auto repair and service use. This property was last reviewed on 9/15/92.
2. This property located at 4 Berard Drive lies within the IC District. It is bounded
on the north by undeveloped land, on the east by a restaurant (Pizza Putt), on the
west by a multiple use commercial building, and on the south by Berard Drive.
3. Access/ circulation: Access is provided by a 20 foot curb cut on Berard Drive.
Applicant has been using the adjacent Pizza Putt property for access to the
northeast portion of the building. Approval for this access has never been granted
by the Planning Commission and an easement across the Pizza Putt property does not
exist.
Circulation on the site is adequate.
4. Coverage/ setbacks: Building coverage is 10.1% (maximum allowed is 30%).
Overall coverage is 35.9% (maximum allowed is 70%). Front yard coverage is 13.3%
(maximum allowed is 30%).
Setback requirements are met.
5. Parking: A total of 20 spaces are required and 18 spaces will be available
including one (1) handicapped space for customers and employees. The 62 space
parking area will not be used for customer parking. Staff felt that adequate parking
will still be available since these spaces may be available for employees. A bike
rack, which is required under Section 26.253(b) of the zoning regulations, is not
proposed to be provided.
6. Landscaping: No additional landscaping is required, based on building costs,
for this project. A significant landscape buffer is not being proposed around the
storage area. Therefore, the storage area will not be screened from view from the
adjoining Pizza Putt property or from the Winooski River.
7. Sewer: No additional allocation needed.
8. Traffic: No additional traffic expected.
9. Dumpster: A non -screened dumpster is shown on the plan. All dumpsters
should be screened as required under Section 25.102 (d) of the zoning regulations.
CONCLUSIONS
1. Applicant has been using the adjacent Pizza Putt property for access to the
northeast portion of the building. Section 26.104 of the zoning regulations requires
that approval for access to abutting properties be obtained from the Planning
Commission. The Planning Commission concludes that the requirements of Section
26.104 of the zoning regulations are not met.
2. Section 26.105(d) of the zoning regulations allows the Planning Commission to
require additional plantings above the normal landscaping requirement whenever it
determines a particular site warrants such additional landscaping or screening. No
additional landscaping was proposed to screen the 62 auto storage spaces from view
from the adjoining Pizza Putt property or from the Winooski River. No screening was
proposed around the dumpster storage area. The Planning Commission concludes
that the requirements of Section 26.105(d) of the zoning regulations are not being
met.
3. Section 26.253(b) of the zoning regulations require that a bike rack be provided
for all uses other than single family residences. No bike rack is being provided.
The Planning Commission concludes that the requirements of Section 26. 253 (b) of the
zoning regulations are not being met.
DECISION
Based on the above Findings of Fact and Conclusions, the South Burlington Planning
Commission hereby denies the Applicant's request for site plan approval to construct
62 auto storage spaces on a lot containing a 9761 square foot building with 3200
square feet of printing use and 6561 square feet of auto repair and service use for
the following reasons:
1. The application does not comply with or satisfy the requirements of Section
26.104 of the zoning regulations. Applicant is using the adjacent property for
access without approval from the Planning Commission.
2. The application does not comply with or satisfy the requirements of Section
26.105(d) of the zoning regulations. Applicant did not propose landscaping to
screen the 62 auto storage spaces from the adjoining Pizza Putt or from the Winooski
River. Applicant did not propose to screen the dumpster storage area.

3. The application does not comply with or satisfy the requirements of Section
26.253(b) of the zoning regulations. Applicant did not provide a bike rack.
