HomeMy WebLinkAboutSD-96-00000 - Decision - 0004 Berard DriveFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Noyes Berard Kitty Trust & Baldwin, Cherie A. Trust & Berard June A. Revocable Trust, and Patrick and Terese Ayer for subdivision of an undeveloped 21 acre parcel into two (2) parcels of 1.12 acres and 19.9 acres. The 1.12 acre parcel is to be merged with an adjoining parcel of 1.1 acres to create a new parcel of 2.22 acres, 4 Berard Drive. On the 26th day of November, 1996, the South Burlington Planning Commission approved the request of Noyes Berard Kitty Trust & Baldwin, Cherie A. Trust & Berard June A. Revocable Trust, and Patrick and Terese Ayer for revised final plat approval under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1. This project consists of the subdivision of an undeveloped 21 acre parcel into two (2) parcels of 1.12 acres and 20 acres. The 1.12 acre parcel is to be merged with an adjoining parcel of 1.1 acres to create a new parcel of 2.22 acres. The sketch plan was reviewed on October 22, 1996. 2. This property located on Berard Drive lies within the IC, CO and Floodplain Overlay Districts. It is bounded on the north by the Winooski River, on the east by undeveloped land, on the south by commercial and industrial buildings along Berard Drive, and on the west by Berard Drive. 3. Lot size/frontage: Lot size requirement of 40,000 square feet will be met. The 1.12 are parcel will be merged with the existing 1. 1 acre parcel at 4 Berard Drive to create a new lot of 2.22 acres. Frontage requirement will be met. 4. Coverage/ setbacks: Coverages on the 4 Berard Drive parcel will be reduced and the coverages on the remaining 20 acre parcel will remain unchanged. Setback requirements are met. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the revised final plat application of Noyes Berard Kitty Trust & Baldwin, Cherie A. Trust & Berard June A. Revocable Trust, and Patrick and Terese Ayer for subdivision of an undeveloped 21 acre parcel into two (2) parcels of 1.12 acres and 19.9 acres. The 1.12 acre parcel is to be merged with an adjoining parcel of 1.1 acres to create a new parcel of 2.22 acres, 4 Berard Drive, as depicted on a three (3) page set of plans, page one (1) entitled, "Subdivision of Lands of Berard for Patrick & Terese M. Ayer d.b.a. Autobahn Body Works off Berard Dr. & Airport Parkway South Burlington, Vermont, " prepared by Chase & Chase, dated 6/5/96, last revised 8/9/96, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. Any change to the plat shall require approval by the South Burlington Planning Commission. 3. The final plat plan shall be recorded in the land records within 90 days or this approval is null and void.
