Findings of Fact, Conclusions of Law & Order This matter came before the South Burlington Zoning Board of Adjustment on February 9, 1998 by application of Larry Kupferman, Chairman of Prudential Committee, seeking conditional use approval to upgrade the water distribution system, installing a new 20,000 gallon storage tank, pump house and fire protection transmission line in the Queen City Park area located on the northerly end of Pavilion Avenue according to plans submitted. The Board of Adjustment finds as follows: 1) Mr. Roger Dickinson, consulting engineer, Lamoureux, Stone & O'Leary, Inc., represented the Prudential Committee. 2) Section 11.20 Conditional uses of the Zoning bylaws requires approval by the Zoning Board of Adjustment. 3) The proposed upgrade to the water system will improve the character of the area by removal of old and unsightly buildings and replacing with buildings more in keeping with the residential character. 4) The overall character of the neighborhood will be improved by supplying a good water supply. 5) The new water system will meet State standards by providing adequate water pressure. 6) An eight (8) inch water distribution line will be installed from the Champlain Water District on Queen City Park in order to increase fire protection. 7) The South Burlington City Council and Fire Service will be working with the Prudential Committee in order to provide fire protection. ORDER The conditional use to install a new water distribution system for the Queen City Park area is hereby GRANTED Dated at City Hall, South Burlington, Vermont this day of 1998.
