Mittendorf 2 Pavilion Avenue South Burlington, VT 05403 Property description: Mailing address, 2 Pavilion Avenue Tax map location, 6 Pavilion Avenue Presentation requirements: 1)The lot is located on the corner of Pavilion Avenue and Lyons Avenue in Queen City Park. On the tax map the lot is labeled as #6 Pavilion Avenue. The lot is small for the area. 2)The structure on the lot is a single family home that is a pre-existing non -complying structure. It does not comply to the standard property setbacks of 10 feet in the front of the structure. The existing setback is 2'-6". In accordance with So. Burlington zoning regulations, this request for a variance is due to three factors: 1) the pre-existing status as a non -complying structure; 2) the intention to exceed the spending cap of thirty five percent of the appraised value ; 3) the plan to increase the square footage on the second floor. It is necessary to apply for a variance in order to proceed with needed renovations, to save and improve the structure. 3)The structure is a pre-existing non -conforming structure due to setback at the front. 4)Granting of the variance for the needed renovations will not change the character of the neighborhood. The structure will remain a single family home and will, in fact, improve the value and character of the neighborhood. 5)lf the variance is authorized, it will not make the structure less compliant then it all ready is, seeing as the front setback will remain as is.
