Findings of Fact, Conclusions of Law & Order
This matter came before the South Burlington Zoning Board of Adjustment on November 23, 1998 for a
variance to renovate an existing structure and increase living area by 533 square feet to a non -complying
structure, located at 2 Pavilion Avenue according to plans submitted. The Board of Adjustment finds as
follows:
1) The area is zoned Q.C.P. District.
2) Section 11.50 prohibits increasing the footprint and overall size of a non -complying structure.
3) The structure in question is non -complying to setback requirements.
4) The proposed renovations will not alter the existing setbacks.
5) The overall increase in living space is 533 square feet.
6) Character of the area will not be altered.
7) Lot is small and irregular typical of Queen City Park.
8) The hardship predates applicant's ownership.
The variance to renovate and increase living area at 2 Pavilion Avenue is hereby GRANTED
